PETITION SUBMITTED BY RESIDENTS OF SOSHANGUVE: REQUESTING THE CITY OF TSHWANE TO RELOCATE THEM FROM WETLANDS IN WARD 26, REGION 1 UNDER COUNCILLOR NGJ NDLOVU

Before commencement of the discussion of this matter at the Section 79 Standing Committee: Petitions meeting held on 17 November 2016, the petitioners as well as the Ward Councillor, Councillor NGJ Ndlovu, were present and were given the opportunity to address the were given the opportunity to address the Committee. During thorough discussion Councillor MA Makola referred the members to paragraph 5.1 Comments from the Regional Executive Director: Urban Management in this report which reads as follows:

(Unaltered) “…. that the first occupants to reside there were removed during the year 2009 and 2010 to Soshanguve Block SS and just after relocating the said families another informal settlements emerged because there was already seven existing families who refused to be relocated at that time. To date there is one thousand two hundred occupants who are residing there.

This means that there is a problem with regard to the monitoring of land invasion. If the Municipality relocate occupants, they must ensure that no further land invasion will take place in that area. Councillor Makola further referred to recommendation 2 that reads as follows:

(Unaltered) “2. That the Department Human Settlements apply control measures to avoid

more people coming into the area while assisting the community.” Councillor Makola was of the opinion that recommendation 2 does not address the request of the petitioners. In view of the above Councillor Makola, seconded by Councillor T Kgobane, proposed the following amendment, which proposal was accepted by the Committee: That this matter be referred back and that the Strategic Executive Director: Housing and Human Settlements investigate the possibility of relocating the community from the wetlands in Block KK informal settlement, Soshanguve and report back to the Section 79 Standing Committee: Petitions at its next meeting to be held on 19 January 2017. In view of the above the Section 79 Standing Committee: Petitions resolved as set out below. RESOLVED: 1. That this matter be referred back and that the Strategic Executive Director:

Housing and Human Settlements investigate the possibility of relocating the community from the wetlands in Block KK informal settlement, Soshanguve.

4. OFFICE OF THE SPEAKER PETITION SUBMITTED BY JJ TOMBISA COMPLAINING ABOUT A TAVERN AT 101 IRONBARK ROAD, CHANTEL EXTENSION 2 IN WARD 4, REGION 1 UNDER COUNCILLOR IJ PIETERSEN

Before commencement of the discussion of this matter at the Section 79 Standing Committee: Petitions meeting held on 17 November 2016, the petitioners were present and were given the opportunity to address the Committee. During thorough discussion Superintendent ED Roussouw of Tshwane Metropolitan Police Department (By-law Enforcement and Investigation) commented as follows: An investigation was done on 11 November 2016 in terms of the By-laws. The Liquor Officer will monitor the transgression in terms of the Liquor Act. Since the matter is handled by Urban Management in terms of the land use rights, Tshwane Metropolitan Police Department will follow up the matter after the findings of Urban Management. Hereafter the Development Compliance Officer of Region 1 commented, among others, as follows: Urban Management issued a notice to the owner on 31 May 2016. The notice has since expired. At the moment he is busy compiling an affidavit and the owner, Mr Ditodi, will be summoned within the next two weeks. On a point of clarity, the Development Compliant Officer indicated to the Committee that the notice was issued in terms of the illegal use on the premises, i.e. a place of entertainment and refreshment, as the owner is operating a tuck shop and a shebeen on the premises, while the property is zoned for road reserve. During further discussion Mr M van Niekerk of City Planning and Development Department commented as follows: The property is zoned for road reserve. It would assist if Property Management can indicate to the Regional Executive Director: Region 1 if the owner applied (to Property Management) to purchase the property. In view of the above discussion the Regional Executive Director: Region 1 submitted the following proposals: 1. That the Regional Executive Director: Region 1 (Urban Management)

proceed with the legal processes, i.e. to summon the owner, as a matter of urgency.

2. That the Chief of Police (Special Drug Enforcement Section) conduct frequent investigations in respect of drugs that are being sold on the premises.

3. That the Strategic Executive Director: Health and Social Development (Municipal Health Services Section) monitor the noise at the tavern.

Hereafter Councillor MA Makola proposed that the Committee consider the proposals of the Regional Executive Director: Region 1 as a resolution, which proposal was accepted by the Committee. Further, the Chairperson proposed that the Strategic Executive Director: Group Property Management investigate the current zoning of the property and determine if the road reserve was legally purchased, which proposal was also accepted by the Committee. The Section 79 Standing Committee: Petitions therefore resolved as set out below. RESOLVED: 1. That the Regional Executive Director: Region 1 (Urban Management) proceed

PETITION SUBMITTED BY THE RESIDENTS: OBJECTION TO THE SELLING AND CONSUPTION OF ALCOHOL AT HOUSE NUMBER 873 IN THE RESIDENTIAL NEIGHBOURHOOD IN BLOCK X MABOPANE, WARD 21, REGION 1, UNDER COUNCILLOR JM SINDANE

Before commencement of the discussion of this matter at the Section 79 Standing Committee: Petitions meeting of 17 November 2016, the petitioners were present and were given the opportunity to address the Committee. During thorough discussion the Development and Compliance Officer commented as follows: Officials of Urban Management conducted an investigation on 18 October 2016. The current zoning of the property is Residential 1.

Officials of Urban Management issued a contravention notice to the owner as a contravention is indeed taking place on the premises-the owner is preparing for on the premises and he is selling food as well as liquor on the premises. Urban Management gave the owner 28 days to comply by either to close the business that is operating on the premises or submit an application for rezoning. The 28 days will expire on Friday, 25 November 2016 whereafter Urban Management will do a follow up inspection. If the contravention is still taking place on the premises Urban Management will prepare the docket and the owner will be summoned to appear in Court. The Department Compliance Officer further indicated to the Committee that a joint inspection was arranged with all the relevant role players, but due to the fact that some of the role players were not available, the joint inspection was cancelled. Hereafter Superintendent ED Rossouw of Tshwane Metropolitan Police Department (By-law Enforcement and Investigations) commented as follows: During an investigation conducted by the officials of Tshwane Metropolitan Police Department it was found that officials of Municipal Health Services as well as the Fire Safety Office were on the premises. Notices were served on the owner by both Municipal Health Services as well as the Fire Safety Officer. However, no feedback has been received by Municipal Health Services or the Fire Safety Officer. Superintend Rossouw further clarified the following: If a business is illegal in terms of the zoning of the premises, it cannot be recommended to the owner of the premises as to how to comply with any By-laws until the matter has been resolved in Court. Hereafter members of the Committee were of the opinion that this matter be referred back and that the Regional Executive Director: Region 1 coordinate a joint meeting with the following stakeholders:

Officials of Tshwane Metropolitan Police Department with regard to the By-laws.

Officials of City Planning and Development Department (Building Control) with regard to building regulations.

Officials of Health and Social Development Department (Municipal Health Services Section) with regard to the noise and other health regulations.

Officials of Urban Management with regard to the town - planning scheme. Further, that the Regional Executive Director: Region 1 submit a progress report to the Section 79 Standing Committee: Petitions at its next meeting to be held on 19 January 2017. The Section 79 Standing Committee: Petitions therefore resolved as set out below.

Section) with regard to the noise and other health regulations. 1.4 Officials of Urban Management with regard to the town-planning scheme. 2. That the Reginal Executive Director: Region 1 submit a progress report to the

Section 79 Standing Committee: Petitions at its next meeting held on 19 January 2017.

PETITION SUBMITTED RESIDENTS OF MABOPANE: REQUESTING THE CITY OF TSHWANE TO REMOVE ILLEGAL SHACKS IN LEBANON, WARD 12, REGION 1 UNDER COUNCILLOR SF DLAMINI

Before commencement of discussion of this matter at the Section 79 Standing Committee: Petitions meeting of 17 November 2016, the petitioners were present and were given the opportunity to address the Committee. During thorough discussion Mr O Apies of the Office of the Regional Executive Director: Region 1 commented as follows: The Office of the Regional Executive Director: Region 1 (Housing Section) conducted an inspection on 6 October 2016. During the inspection it was found that traders are operating business at the shacks. The matter was then referred to Tshwane Metropolitan Police Department (Land Invasion) as it does not fall within the ambit of the Regional Executive Director: Region 1 to deal with this matter. Mr R Viljoen of Tshwane Metropolitan Police Department hereafter commented as follows: Mr Viljoen referred the Committee to paragraph 5.4 Comments of the Chief of Police which reads as follows:

(Unaltered) “Findings:

No illegal shacks were observed in Ward 12, Lebanon.

Furthermore, contact was made with Councillor Dlamini to verify the claims made on the petition.

She confirmed that there are no illegal shacks on the land referred to.” In view of the above, it seems that the petitioners are referring to the structures that the traders have erected on the road reserve. Mr Viljoen further indicated to the Committee that the former Mayor, Kgosientso Ramokgopa, placed a moratorium on acting against informal traders by Tshwane Metropolitan Police Department. Hereafter Councillor MB Ringane, seconded by Councillor MA Makola, proposed that this matter be referred back and that the Regional Executive Director: Region 1 coordinate a meeting with the following stakeholders to find an amicable solution to this matter, which proposal was accepted by the Committee:

The petitioners.

The Ward Councillor.

The vendors that are operating business in Lebanon, Ward 12.

Officials of Tshwane Metropolitan Police Department.

Officials of Health and Social Development Department.

Officials of Economic Development Department. Further, that the Regional Executive Director: Region 1 submit a progress report to the Section 79 Standing Committee: Petitions at its next meeting to be held on 19 January 2017. Before commencement of the discussion of this matter at the Section 79 Standing Committee: Petitions meeting of 17 November 2016, the petitioners as well as the Ward Councillor, Councillor TM Rangako, were present and were given the opportunity to address the Committee. During thorough discussion of this matter the Regional Executive Director: Region 2 commented as follows: With regard to stormwater: The problem in respect of a high water table and the lack of a stormwater system is not a problem that is unique to Ward 14, it is a problem in the entire Hammanskraal. In view of the fact that there is no stormwater network in Hammanskraal, the problem is exacerbated by a high water table during the rainy season, with the result that the whole area gets flooded. It is therefore an existing problem that the City of Tshwane is aware of. Currently the prioritization of stromwater is not indicated on the IDP. The Office of the Regional Executive Director: Region 2 has made a submission that there is a need for stormwater in Region 2. The Regional Executive Director: Region 2 further suggested that the Ward Councillor for Ward 14 should prioritize stormwater on the IDP.

With regard to the title deeds: The Housing and Human Settlements Department is in the process of appointing a service provider to register the title deed for Ward 14. With regard to water and sanitation: The entire area of Hammanskraal is experiencing a problem with water. Sanitation (toilets) cannot be prioritized if there is no water. The City of Tshwane is currently busy with a huge water project in Hammanskraal. Once the water project has been completed and the residents have water, then sanitation can be prioritized through the IDP process. Hereafter Councillor Makola proposed that the Strategic Executive Director: Transport submit a master plan in respect of resolving the stormwater challenges in the greater Hammanskraal area (Region 2), to the Section 79 Standing Committee: Petitions within three months, which proposal was accepted by the Committee. Further, members of the Committee proposed that the Regional Executive Director: Region 2 convene a meeting with the Ward Councillor, members of the community, the Strategic Executive Director: Regional Operations Centre as well as officials of Housing and Human Settlements Department to address the matter of providing temporary toilets to the community until the water project in Hammanskraal has been completed and sanitation has been prioritized through the IDP process. The Regional Executive Director: Region 2 then undertook that he will conduct an inspection-in-loco, together with the Ward Councillor, the Strategic Executive Director: Regional Operations Centre and officials of Housing and Human Settlements Department to assist the community with temporary toilets. In view of the above the Section 79 Standing Committee: Petitions resolved as set out below. RESOLVED: 1. That the Strategic Executive Director: Transport submit a master plan in respect of

PETITION SUBMITTED BY: MARTIN TJATJI ON BEHALF OF HILLSIDE RESIDENTS OBJECTING TO ILLEGAL LAND INVASION IN HILLSIDE COMPLEX, MAHUBE VALLEY EXTENTION 1, REGION 6, COUNCILLOR BOROTO AND TP MATSHELA

Before commencement of the discussion of this matter at the Section 79 Standing Committee: Petitions of 17 November 2016, the petitioners as well as the Ward Councillor, Councillor LJ Welmans, were present and were given the opportunity to address the Committee. After hearing the above and during thorough discussion Mr R Viljoen of Tshwane Metropolitan Police Department referred the Committee to paragraph 5.1, Comments of the Chief of Police, which reads as follows:

(Unaltered) “The Tshwane Metro Police, Land Invasion Unit, responded to the above objection to illegal invasion in Wards 17 and 99, Mahube Extension 1 in Region 6. FINDINGS: During the investigation the following was found:

An operation was carried out on 12 July 2016

On 12 July 2016 one hundred and thirty-one (131) illegal structures were demolished at Mahube Extension 1

A further twenty (20) illegal structures were demolished at Mahube Extension 17 on 14 July 2016.

RECOMMENDATIONS:

In terms of the findings above, it was recommended that:

The Tshwane Metro Police Department together with the service providers in that area must continuously monitor activities of invasion to ensure protection of Municipal land.” The petitioner responded that Tshwane Metropolitan Police Department attempted to remove the informal squatters, but after those illegal structures were demolished, more informal squatters returned and again erected illegal structures. Currently there are more than 1000 shacks in Wards 17 and 99, Mahube Valley Extension 1. Hereafter members of the Committee proposed that this matter be referred back to the following Departments:

Tshwane Metropolitan Police Department to investigate the matter further and take action against the illegal land invasion by informal squatters in Wards 17 and 99, Mahube Valley Extension 1.

Housing and Human Settlements Department and the Strategic Executive Director: Regional Operations Centre to relocate the informal squatters.

Energy and Electricity Department with regard to illegal connections of electricity.

Further, that the Chief of Police, the Strategic Executive Director: Housing and Human Settlements, the Strategic Executive Director: Regional Operations Centre and the Strategic Executive Director: Energy and Electricity report back to the Section 79 Standing Committee: Petitions with regard to the above pertaining to the informal squatters in Wards 17 and 99, Mahube Valley, Extension 1. After thorough discussion the Section 79 Standing Committee: Petitions resolved as set out below.

During thorough discussion the Chairperson proposed that this matter be referred back and that the Regional Executive Director: Region 7 coordinate a joint meeting with officials of the following departments to find an amicable solution to this matter, which proposal was accepted by the Committee:

Officials of Emergency Management Services (Fire Safety).

Officials of Municipal Health Services with regard to health regulations.

Officials of Environmental Health with regard to air pollution.

Officials of Urban Management with regard to zoning of properties.
