AFFIDAVIT IN THE NATURE OF NOTICE TO THE COURT
COMES NOW, the petitioner/affiant/defendant/Secured Party Creditor, Amunhotep El Bey, in
Propria Persona (my own proper self), formerly known as the artificial person, EUGENE
JAMES WILLIAMS, is a Noble of the Washitaw Nation of Muurs (Moors), better known as,
Uaxashaktun de Dugdahmoundyah, also known as, Amurru Washitaw de Dugdahmoundyah, which is an off branch of the Kushite Empire, the Ottoman Empire, and the Songhai Empire,
which later became the Al-Moroccan Empire; to wit: North, South, Central America, and
including the adjoining Islands; upon his inherited Nobility, and upon his private
Aboriginal/Indigenous, In Full Life, status and commercial liability, I, Amunhotep El Bey, being duly affirmed under Consanguine Unity; pledge my national, political, and spiritual
allegiance to my Moabite/Moorish Nation; being the archaic Aboriginals/Indigenes of
Amexem/Ameru/Amurru/Al-Moroco/Amaru-Ka/Amen-Ra-Ka (the Americas), standing squarely
affirmed upon my Oath to the Five Grounds of Light - Love, Truth, Peace, Freedom, and Justice; deposes as follows under oath:
The affiant is not a lawyer and his pleadings cannot be treated as such. In fact, according to
Haines v. Kerner, 404 U.S. 519 (1972), a complaint, "however inartfully pleaded," must be held
to "less stringent standards than formal pleadings drafted by lawyers" and can only be dismissed
for failure to state a claim if it appears "beyond doubt that the plaintiff can prove no set of facts
in support of his claim which would entitle him to relief." Id., at 520-521, quoting Conley v.
Gibson, 355 U.S. 41, 45-46 (1957).
-
Indeed, no more than affidavits is necessary to make a prima facie case. (See United States v.
Kis, 658 F. 2nd
, 526, 536 (7th
Cir. 1981): Cert Denied, 50 U.S.L.W. 2169; S. Ct. March 22,
1982.)
Notice is hereby given that the above-styled cause is the only correct style for this case. For
example, notice how the petitioners title is spelled in upper and lower case letters. It is properly
spelled Amunhotep El Bey, as is indicated in the above-styled cause, because petitioner is a
natural person, he is a flesh and blood living being; and not a artificial person, which is spelled in
all-caps because a corporation is a fiction, its not real and it is considered to be dead in the eyes
of the law. Petitioner has always wondered why dead peoples names are always in all-caps on
the tombstone of their graves, because they are legally dead at law.
The current style of this case is EUGENE JAMES WILLIAMS a/k/a AMUNHOTEP EL BEY v.
STATE OF FLORIDA, which is incorrect because EUGENE JAMES WILLIAMS and
AMUNHOTEP EL BEY are Improper Nouns because they are spelled in all-caps. An Improper
Noun denotes something that is not real, something that is dead, i.e., a corporation or artificial
person. Corporations are considered persons according to the US Supreme Court. The petitioner
is not a person, he is a natural person.
However, Amunhotep El Bey is a Proper Noun, because it is spelled in upper and lower case
letters, and it denotes something that is living, something that is real; therefore, the current style
of this case is in error and must only reflect Amunhotep El Bey v. STATE OF FLORIDA. Please
correct this error, because it is fraud and a Corporation (the STATE OF FLORIDA) cannot sue
or otherwise contend with a natural person (see Rundle v. Delaware & Raritan Canal Company,
55 U.S. 80 (1852)).
Petitioner will now submit evidence that demonstrates that he is the Secured Party Creditor over
the estate of EUGENE JAMES WILLIAMS, a corporation, and that he is the living and
breathing, flesh and blood, natural person, Amunhotep El Bey: See attached copies of Affidavit
to Invoke Power of Attorney, Indemnity Bond, UCC -1 Financing Statement, Security
Agreement, Affidavit in support of UCC-1 Financing Statement, Notice of Common Law Name
Correction, and Affidavit of Live Birth.
WHEREFORE, notice is hereby given that Petitioner/Secure Party creditor, Amunhotep El Bey
has separated himself from the corporate entity, EUGENE JAMES WILLIAMS, and is no longer
recognized by that corporate legal fiction, that fraud, anymore.
Based upon all the foregoing authorities, facts, and evidence stated herein, let it be known that
petitioners name is forever, Amunhotep El Bey; and the correct style of this case must reflect, Amunhotep El Bey v. STATE OF FLORIDA. There can be no variations.
