ARTICLE3- TEXTANDDATAMININGEXCEPTIONTheEPPGrouprecognisesthepotentialofcontentminingtechniquestocontributetobreakthroughsinresearchandpronouncesitselfinfavourofaText-and-Data-Mining(TDM)exceptionforresearchorganisations whohavelawfulaccess,asproposedbytheCommission.WeconsiderthatitwouldalsobeappropriatetoincludePublicPrivatePartnerships(PPPs)wheretheresearchisinthepublicinterestandprovidedthattheresultsaremadepubliclyavailableintothescopeoftheexception.OurGroupisnotinfavourofwideningthescopebeyondthisastheriskofinterferencewithawell-functioninglicensingmarketistoohighandmightnotbejustifiedbytheBerneThreeStepTest,astheywouldconflictwithanormalexploitationoftheworkorothersubjectmatterandwouldunreasonablyprejudicethelegitimateinterestsoftheright-holder.
