A – INTRODUCTION With effect from 20th July 1995, it is mandatory for all contractors, either local or foreign,to be registered with the Construction Industry Development Board Malaysia (CIDB) under Section 25, Act 520 (Amendment 2011) prior to undertaking and completing any construction work in Malaysia. This rule does not apply to contractors who are exempted under Section 40 (1) of the Construction Industry Development Board Malaysia Act 1994 (Act 520). Any contractor found in breach of section 25 is liable, upon conviction, to a fine of not less than Ten Thousand Ringgit, but not exceeding One Hundred Thousand Ringgit under Section 29. Under Section 30, the Board may order a contractor, through written notice, to cease from starting or continuing construction work, or from undertaking to carry out or from completing construction work. Contractors applying for registration are required to refer to the Contractor Registration Requirements and Procedures Handbook and comply with the terms and conditions stated within before submitting an application. All information / documents submitted become the property of CIDB. The Board reserves the right to use and disclose such information in any form of publication for the purposes and interests of the construction industry.

B – DEFINITIONS

I Board The Construction Industry Development Board of Malaysia, established under Section 3, Act 520.
ii Construction Industry
Work related to construction, including design, manufacturing, technology, materials, workmanship and construction related services
iii Construction Work Construction, extension, installation, repair, maintenance, renewal, transfer, modification, alteration, renovation or demolition of: (a) any building structure, edifice, structure, wall, fence
or chimney, either constructed wholly or partially, above or below ground level;
(b) any road, harbour work, railway track, cable pathway, canal or aerodrome;
(c) any drainage, irrigation or river management; (d) any electrical, mechanical, waterworks, natural gas,
petrochemical or telecommunications; or (e) any bridge, viaduct, dam, reservoir, earthwork,
pipeline, sewer, aqueduct, sewerage, drive, shaft, tunnel or reclamation,
and includes:
(A) Any work that forms an important and integral part or is in preparatory of, or temporary for work described in paragraphs (a) to (e), including site clearing, soil investigation and improvement, earth transfer, excavation, foundation work, site restoration and landscaping; or
(B) Procurement of construction materials, equipment or labour necessary for any work mentioned in paragraphs (a) to (e).
iv Contractor
A person who carries out or undertakes any construction
work;
v Registered Contractor
A contractor registered under this Act.

vii Foreign Contractor A company incorporated in Malaysia or abroad and consists of equity held by non-Malaysians or a foreign company of thirty percent (30%) and above, with the exception of the equity distribution stated inAnnex 8
viii International Contractor
A local contractor registered with CIDB, who undertakes to complete or has completed construction work abroad.
ix Joint Venture Contractor.
A merger of two companies or more, incorporated in Malaysia or abroad.
x Applicant The applicant must be one of the business owners / directors. Applicants are allowed to register for only one company.
xi Company Staff A full time employeeof a company, proven by an EPF contribution statement, or the latest EPF contribution schedule (A form) with the official receipt for the current month’s payment. For staff aged 55 and above, attach proof of SOCSO contribution schedule with the official receipt for the current month’s payment, or the latest salary slip.
xii
Technical Person
Company staff with experience in a related field or in construction. The staff can be any Malaysian, either a business owner, member of the board of directors, director, member of a co-operative society board, president, president of an association, or full-time company employee.
xiii Recognized Degree / Diploma / Certificate
Degree / diploma / certificate related to the field of construction, either from local or foreign institutions and recognized by the Malaysian Government or CIDB.

xv Contractor RegistrationCertificate (PPK)
The certificate issued by CIDB to a contractor under Act 520 and the regulations contained within.
xvi Government Work Procurement Certificate(SPKK)
Enables the SPKK holder to participate in government work procurement in construction according to the eligibility stated
xvii Malaysian Citizen A Malaysian with a blue identity card.
xix SPKK Nominee An individual who is allowed to conduct any dealings related to government tenders. The nominee may comprise of any Malaysian, either a business owner, member of the board of directors, director, member of a cooperative board, president, president of an association, or full-time company employee.

C – APPLICATION GUIDELINE
1.0 Who Can Apply
Only the owner or director of the company can make an application. The applicant
must be one of the business owners or directors. Applicants are only allowed to
register for one company.

Online application procedure: 1. Complete the online application form at smb.cidb.gov.my. For ROC
incorporated companies, company information can be purchased online from the Companies Commission of Malaysia (CCM). The procedure for company information purchase from CCM is available on the CIDB website.Upon completion of the purchase, transfer the company information directly into the CIDB online application form.
Ensure that the application form is complete. The supporting documents do not need to be submitted online. However, retain these documents for a period of 3 years in the event of an audit.
2. After completing the online application form, pay the processing fee online or over the CIDB counter within 21 days from the date the application is generated online. Failure to do so will void the application without any notice. In such event, re-apply if registration with CIDB is required.
3. The system directs the application to the appropriate state or branch CIDB office,based on the registered address of the company. (e.g., if the company's registered address is in Selangor, the application is processed by the Selangor CIDB office. Addresses of the state / branch CIDB offices are as in Annex 1.
4. Receive the results of the application, whether successful or otherwise. If it is unsuccessful: 4a. receive a letter explaining the reason the application is unsuccessful. 4b. submit an appeal within 30 days from the date on the unsuccessful
application notice. Only one appeal is allowed within the period. 5. If it is successful, receive a letter notifying successful application with the
approved grade, category, specialization, and the registration fee amount to be paid. Check the details of the result before making payment.
6. Pay the registration fee for the issuance of the Contractor Registration
Certificate at the state or branch CIDB counter or online.
7. Only the company owner, director or nominee (in the SPKK) can collect the certificate over the CIDB state or branch counter. If the company owner, director or nomineecould not be present to collect the certificate, receive it by mail at the registered correspondence address.

Application procedure for submission at the CIDB counter:
1. Complete and submit the SSPK (1Roc) form with supporting documents at the CIDB counter. The CIDB state or branch office processing the application is based on the applicant’s registered address (e.g., applications for companies registered in Selangor must be sent to the Selangor CIDB office). Supporting documents required are as in Annex 2
2. Submit the application at the counter and receive an acknowledgement receipt.
3. Pay the processing fee at the CIDB counter and receive the payment receipt.
4. The application is processed and wait for the results of the application.
5. Receive the results of the application, whether successful or otherwise. If it is unsuccessful: 5a. receive a letter explaining the reason the application is unsuccessful. 5b. submit an appeal within 30 days from the date the unsuccessful notice is
issued. Only one appeal is allowed within the period.
6. If it is successful, receive a letter notifying successful application with the approved grade, category, specialization, and the registration fee amount to be paid. Check the details of the result before making payment.

3.0 Processing Fee
Attach each application with the processing fee. Pay the processing fee online or at the CIDB counter.The fee payable for the types applications are as in Table A.

4.0 Application Form and Supporting Documents
Online applications do not need to be attached with supporting documents. However, retain the original documents for a period of 3 years in the event of an audit.
For applications submitted over the counter or are mailed-in, complete the application form and attach the supporting documents as in the checklist in Annex 2.Only the company owner or director is allowed to sign the application form.Table B lists the application forms required according to the type of application made.

5.0 Application Processing Time
The processing time varies for the application made. Table C lists the processing time for the different types of application.

6.0 Application Results and Notification
The applicant is registered for the grade, category and specialization applied for if he fulfils all the conditions and criteria for the above. If the applicant does not fulfil the conditions for the grade, category and specialization applied for, CIDB has the right to register the contractor in the above areas as per the documents submitted, or to deem the application unsuccessful. Applicants are notified of the results in writing oralternately, they may check results on the CIDB website smb.cidb.gov.myoron the CIDB mobile apps. The results are announced as following:
(a) Successful
Applicants are reminded to check the results of the application before making payment for the issuance of the Contractor Registration Certificate. The result of the application is final once the Contractor Registration Certificate is issued.

(b) Unsuccessful
Incomplete applications or applicants who do not fulfil the requirements will not be registered. The reasons for unsuccessful application is stated in the results notice. File any appeal within thirty (30) days from the date on the notice. Appeals will only be considered once. Submit the letter of appeal with supporting documents to the CIDB state of branch office which issued the results.
7.0 Registration Fee
The registration fee payable is stated in the notice of successful application. This fee is due within thirty (30) days from the date of the notice of approval. The approval is automatically void without notice if the registration fee is not paid within the period stated. Applicants must submit a new application once the approval is void.
The Contractor Registration Certificate is issued once the registration fee is paid. Table D lists the registration fee payable.

8.0 Payment Method
All payments must be made in the name of “Construction Industry Development Board Malaysia”. Payment can be made by cash, bank draft, banker’s cheque, money order, postal order or online. Payment using company or personal cheques are not accepted. All fees and charges paid are not refundable. Cash payments can only be made at the CIDB state or branch counter.
9.0Collection / Delivery of the Registration Certificate
Only the company owner, director or nominee (in the SPKK) can collect the certificate at the CIDB counter. Certificates are sent by registered mail to the applicant’s correspondence address if the company owner, director or nomineedoes not collect it.
D – LOCAL CONTRACTOR REGISTRATION CERTIFICATE (PPK)
A company incorporated in Malaysia and consists of seventy percent (70%) and above of local equity, with the exception of the equity distribution stated in Annex 8.
1.0 Scope of Registration
Each contractor is registered according to:
a) Grade b) Category c) Specialization d) Classification Status
1.1 Registration of Contractor Grade
Each contractor is registered within a grade according to the contractor’s capability to fulfil the criteria for such. The grade limits the contractor to participate in tenders or to carry out work for certain values. Refer toAnnex 3.
1.2 Registration of Contractor Category
There are three (3) contractor registration categories:
a) Civil Engineering construction b) Construction of Buildings, and c) Mechanical and Electrical
Contractors can apply for the categories above, based on the work to be performed. The category registered, however, is based on the academic qualification and experience of the technical person. Refer to Annex 4.

1.3 Registration of Contractor Specialization
Each specialization is registered under a category and grade in the Contractor Registration Certificate. Most new applicants are generally registered as B04, CE21 or M15, based on the technical person. For specializations other than in Annex 5, registration is based on the work offer letter / proof of work completion /confirmation letter from the client awarding the project / Certificate of Competency in Management (SKP) conducted by CIDB for related specializations. Specializations Involving Other Acts, Regulations, Competent Person
Applications for specializations other than in Annex 6 must fulfill the requirements for registration. In general, applicants must comply with any law or written rule involving the activities conducted if successfully registered. Any specialization involving other Acts, of which the registration with a relevant authority has expired, will void the registration of such specialization with CIDB.
1.4 Classifications of Contractor Registration Status
For contractor status, applicants must attach information on the projects they have in carried out with a valid certificate in the latest three (3) year period. The status is as follows:
a) Active: A local contractor with a valid certificate who is
awarded a project within the last three (3) years; or a contractor who has a project during the valid period of his certificate; or a contractor with a valid certificate who has not won any projects within the last three (3) years, but actively participates in tenders.
b) Dormant: A contractor who has never been awarded any projectsand does not participate in any tenders within the last three (3) years.
c) New : Newly registered contractors.
To change the status of the Contractor Registration Certificate, complete the change of company information form (R6) and attach proof of work or tender to the state or branch CIDB office. Once notified of the results, bring the original registration certificate. Each amendment or replacement of the registration certificate is charged with a processing fee and certificate issuing fee.

2.0 Registration Terms and Conditions
Applicants must fulfill the registration requirements for an application to be considered.
2.1 Registration with the Registrar of Companies or Registrar of
Businesses
Applicants must register his business operations with the relevant authorities in Malaysia.The authorities include:
a) Companies Commission of Malaysia (Company Registration /
Business Registration / Limited Liability Partnership). b) Co-operative Societies Commission of Malaysia c) Business Registration (Cap 64), Business & Commercial License
Extract –I form (Sarawak) d) Business License - B form (Sabah) e) Registrar of Societies (ROS) (Societies) The activities or operation of a firm, company, co-operative society, society and the like must involve construction work and state as such in;
a) Company Registration (Memorandum & Articles of Association), b) Business Registration (A form), c) By-laws of Co-operatives / Societies, d) I form (Sarawak), or e) B form (Sabah)
2.2 Financial Feasibility
Applicants must have and maintain sufficient fundsforthe entire period of their registration. The minimum capital (paid-up or accumulated) owned by the applicant is as in Table E.

ii) Financial Feasibility Assessment The applicant’s financial feasibility is assessedbased on the paid-up capital or net capital worth owned. If the capital contains foreign equity holdings, refer to Annex 8 for the value of foreign equity allowed.

The applicant’s financial feasibility is valued by the company’s paid-up capital. Preference Shares and Authorized Capital are not considered.
The business’s financial feasibility is valued on its net capital worth, which is determined on one or all of the following;
a) Current account
The business’s current account statement. The value is based on the highest balance for the current month and / or
b) Savings account
A savings bond that is not charged to any bank or financial institution, and has not come to maturity and / or,
c) Owner’s savings account / current
account
The current balance in the owner’s savings account or the highest balance in the owner’s current account for the current month. If the business operates in Partnership, attach the financial information for each partner and / or,
d) ASB and Tabung Haji savings
The current balance in the business owner’s ASB or Tabung Haji passbook.
The financial feasibility is valued on the highest balance in the society’s bank account statement for the current month.

2.3 Technical Person Qualification
A technical person is the company owner, director, or full-time employee. They must be a Malaysian citizen with a certificate / diploma / degree / Certificate of Competency in a construction-related field.
Table G lists the minimum qualification of the technical person for different grades.

2.4 Registration of Company / Firm with the Energy Commission
A company or firm that is registered with the Energy Commission is registered as in Table H.

2.5 Additional Requirements
Applicants must fulfil or comply with other terms and conditions of the CIDB Contractor Registration Certificate, namely; a) Integrity and Code of Ethics Course for New Contractors
A new contractor registered with CIDB are required to attend and pass the ContractorIntegrity and Code of Ethics Course within one (1) year from the date of issue of the Contractor Registration Certificate.
The Contractor Integrity and Code of Ethics Course can be attended by the company owner, director or key management personnel.
Application for the first renewal of the registration certificate must be attached with the Contractor Integrity and Code of Ethics Course certificate. Failure to do so will disqualify the registration certificate renewal application. Applicants may contact any state or branch CIDB office for more information on the Contractor Integrity and Code of Ethics Course.
b) Business Management Course
For grades G1 to G3 new application made by applicants with no technical certificate or technical person in construction, either the owner or director must attend and pass the Business Management Course and obtain a Certificate of Competency in Management (SKP). This certificate must be attached when applying for renewal.
c) Contractor Continuous Development (CCD) Points A renewal application to extend the registration certificate is approved based on the CCD points accumulated during the current registration period. Only CCD points obtained by the company owner, director or full-time employee, or a certificate held by the company are considered. CCD points required for different renewal periods are as in Table J. Table J – CCD Points

3.0 Types of Application
The types of registration applications are as follows:
a) New registration b) Renewal c) Re-registration d) Change of grade / category / specialization e) Special permission to participate in tender beyond the scope of specialization f) Change of company information g) Application for lost, damaged, copy, or cancellation of registration certificate
3.1 New Registration A new registration is an application from a company that has not previously registered with CIDB. The company must fulfil the registration criteria and requirements. The registration period is one year and the contractor must fulfil the following requirements:
a) Attend and pass the Contractor Integrity and Code of Ethics Course b) Accumulate the minimum CCD points c) Attend and pass the Business Management Course (for grades G1 to G3
without a technical certificate).
A contractor is registered by the grade, category and specialization they qualify for. Generally, only B04 and / or CE21 and / or M15 category and specialization is approved, accordingly with the applicant’s qualification.
3.2 Renewal
Registration renewal is an application to extend the registration certificate. A company must apply at least one hundred and twenty (120) days before the expiry of the certificate. Applications submitted less than 30 days from the certificate expiry date are fined Two Hundred Ringgit (RM200.00). Companies must fulfil the registration criteria and requirements, and be free from any disciplinary action. The registration period is between one (1) to three (3) years, depending on the CCD points accumulated.
CIDB reserves the right to re-evaluate the registration of the existing grade, category or specialization based on the documents or information submitted during the renewal application.

3.3 Re-registration
Re-registration is an application made after the registration certificate has expired. Companies must fulfil the registration criteria and requirements and be free from any disciplinary action. The registration period is between one (1) to three (3) years, depending on the CCD points accumulated. CIDB reserves the right to re-evaluate the registration of the existing grade, category or specialization based on the documents or information submitted during the re-registration application.
3.4 Change of Grade
An application for grade change is made by a contractor, either to upgrade or downgrade the existing grade. Companies must fulfil the registration criteria and requirements and be free from any disciplinary action. If the registration is due to expire in less than one hundred and twenty (120) days, the application of grade change can be made together with the renewal application.
For grade change applications, the validity period is as per the existing registration certificate. If the current certificate has not expired, the original registration certificate must be returned during the payment of the registration fee.
For grade change application with renewal, the registration certificate is valid as per the approved period.
3.5 Addition of Category An application for category addition is made by a contractor to add a new category, aside from those stated in the existing registration certificate. Companies must fulfil the registration criteria and requirements and be free from disciplinary action. If the registration is due to expire in less than one hundred and twenty (120) days, the application of category addition can be made together with the renewal application. For category addition applications, the validity period is as per the existing registration certificate. If the current certificate has not expired, the original registration certificate must be returned during the payment of the registration fee.
For category addition application with renewal, the registration certificate is valid as per the approved period.
An additional category can be applied for if the applicant can prove one of the following:
a) Qualified technical person as per Annex 4. b) Proof of work c) Registration with other agencies d) Competent person e) Certificate of Competency in Management (CCM)

3.6 Addition of Specialization
An application for specialization addition is made by a contractor to add a new category, aside from those stated in the existing registration certificate. Companies must fulfil the registration criteria and requirements and be free from disciplinary action. If the registration is due to expire in less than one hundred and twenty (120) days, the application of specialization addition can be made together with the renewal application. For application of specialization addition, the validity period is as per the existing registration certificate. If the current certificate has not expired, the original registration certificate must be returned during the payment of the registration fee.
For application of specialization addition with renewal, the registration certificate is valid as per the approved period.
Additional specializations can be applied for if the applicant can prove one of the following:
a) The company has performed work in the specialization applied for by
submitting work offer letter, proof of work completion, or confirmation letter from the client awarding the project.
b) Employment of a competent person in a related field (refer Annex 6) c) Registration with any registrar under an Act of Parliament (refer Annex 6). d) CIDB Certificate of Competency in Management (SKP) in the field applied.
3.7 Special Permission to Participate in Tender Beyond the Scope of
Specialization
Company must a valid registration certificate and be free from any disciplinary action. The conditions of the application are as follows: a) Is not involved in specializations in Annex 6. b) Specialization applied for must be within the registered category and grade. c) A copy of the tender advertisement or offer letter to participate in tender must
be submitted with the application. The application results are announced in three (3) working days upon payment processing fee and submission of the complete set of supporting documents.

3.8 Change of Company Information
All contractors are required to notify CIDB of any change of company information within thirty (30) days of the change. Under Section 39, Act 520 (Amendment 2011) a contractor can be fined not exceeding Five Thousand Ringgit (RM5,000.00) if he fails to do so. Applicants must submit the R6 form with the processing fee and certificate re-issuing fee. The type of information change and the documents required is as in Table K.

1) Change of business particulars (ROB / PLT) a) The types of changes relating to
business status: i) Status change from Sole
Proprietorship to Partnership or vice versa (CCM registration number change)
ii) Change of company name (CCM registration number change)
iii) Change from Sole Proprietorship or Partnership or Limited Liability Partnership to Private Limited Company.
Application letter to dissolve the company. For new application, refer to the requirements for new application.
b) Change of company’s registered address The latest D form printout from the Companies Commission of Malaysia (CCM).
c) Death / withdrawal of partner i) Information change printout from CCM for withdrawal of partner and addition of new partner (if any).
ii) Proof of new agreement of share ownership where new partner, if any, holds less than 49% of shares from the original owner.
iii) If the new partner becomes the largest
shareholders in the share ownership agreement, the SPKK (if any) will automatically be void. Exceptions are for death, where the husband, wife or children may become the new partner with the largest share and the SPKK can be retained. The marriage certificate (husband/wife) / birth certificate (children) and the death certificate must be attached.
d) Change of partner
Latest CCM printout with information of current owner. Submit a copy of the partnership agreement bearing witness. The agreement must state the percentage of shares held by the partners.

3.9.1 Re-issue of Lost or Damaged Certificate
An application to re-issue a lost or damaged certificate must be attached with a copy of statutory declaration or Police report to notify of the loss or damage of the certificate and payment of RM100.00 for each replacement certificate.
3.9.2 Copy of Registration Certificate
Contractors who require copies of the registration certificate or Government Work Procurement Certificate must attach an application letter to CIDB with payment of RM20.00 per copy.

Attach proof of work / tender. For d) in the event of a shareholder’s death, the new shareholder consisting of only the husband, wife or children may become the largest shareholder. The SPKK can be retained (if any). The marriage certificate (husband / wife) / birth certificate (children) and death certificate must be attached.
3) Change of technical person / company nominee
Submit names of the new technical person / company nominee with their EPF statements and payment receipts.
4) Change of mailing address / telephone or fax numbers
Submit notice of address change. No fee is charged.
5) Dissolution of company Submit notice of company dissolution and return the original Local Contractor Registration Certificate to be cancelled. Statutory declaration notice of company winding-up from the Companies Commission of Malaysia / Insolvency Commission.
6) Change of Nominee in SPKK Submit the names of the nominee in the SPKK. If the nominee is a company employee, attach proof of EPF contributions and payment receipts. If the nominee is the director or owner, attach a company information printout from CCM.

3.9.3 Application for Cancellation of Contractor Registration Certificate An application to cancel the Contractor Registration Certificate can only be requested by the owner or board members of the company. Applicants must submit an application letter from the company to CIDB. For a company with more than one registered owner, written consent from all the owners is required.
Registration certificates which are still valid must be returned to CIDB.
3.10 Automatic Cancellation of Registration Certificate
The registration of any contractor will automatically be void:
i) Upon expiry or change of business registration with the Registrar of Business (ROB)
ii) When a contractor of a sole proprietorship (the company and its owner are of the same name) dies, unless his beneficiaries apply for permission from CIDB within 1 month of his death, and receives approval from CIDB, the registration continues to be valid until the completion of the current work.
E – GOVERNMENT WORK PROCUREMENT CERTIFICATE (SPKK)
SPKK holders may participate any government work procurement in construction
according to their eligibility as stated in the Treasury Circular No.6, 2012 and
the Treasury Bill Directive, amendment No. 3, 2012 by the Ministry of
Finance.Applicants must ensure that they have a valid PPK in order to apply for
SPKK. However, approval is subject to the SPKK registration requirements.
1.0 Terms and Conditions of the Government Work Procurement Certificate
(SPKK) Registration
Applicants will only be considered if they meet the following requirements:
a) Has a valid Contractor Registration Certificate, and b) Has the eligible paid-up capital or net capital worth or, financial and
technical person, except for grade G1 the paid-up capital or net capital worth is at least RM10,000.00, and
c) Has the eligible equity ownership in other companies, and
i) Company or individual shareholders who already own SPKK cannot
have equity exceeding 5% or RM50,000.00, whichever is lower, in any other company that already owns SPKK.
ii) A member of the board of directors, member of the management and a
technical officer of the company who already owns SPKK cannot be registered in any other company which owns SPKK.

Note: Consortium, co-operative and GLC (board members) are exempted
d) Meets the certification requirements for new application as follows:
i) Achieves a SCORE assessment certificate with at least 3 stars for
contractor grade G5, G6 and G7.
ii) Achieves a SCORE assessment certificate with at least 2 stars for contractor grade G2, G3 and G4.
iii) Has a valid ISO 9001:2008 certification for contractor grade G7.
iv) Is free from any disciplinary action or court conviction at time of
application submission.
e) Change in Equity
i) Change equity not allowed (either through transfers or addition of shares) OR where the percentage of shares held by new shareholders exceeds 49%of paid-up capital or net capital worth,OR
ii) A new shareholder (either an individual or company) has become
the largest shareholder in the company, owning more shares than the existing major shareholder.
f) Entry of New Shareholders
i) New shareholders (individual or company) are not permitted to own
the largest shares (major shareholders) for a period of 2 years for
grade G2 to G7, whereas for grade G1, for 5 years from the date of
approval for change of shareholders.
ii) New shareholders must not own more than 49% of shares of the
company’s paid-up capital or net capital worth, OR
iii) New shareholders (either an individual or company) may not become
the largest individual shareholder in the company to own more shares
than the existing major shareholders.
2.0 SPKK Period of Validity
The SPKK expiry remains the same as the expiry of PPK.
3.0 New SPKK Registration
Fulfil the requirements as in paragraph 1.0 page 29. Note: Registration of G1 SPKK is suspended until further notice.

4.0 SPKK Renewal
Renewal application can be submitted with the PPK application. SPKK that is not renewed for more than 12 months (1 year) after the expiry date will lead to termination of the registration. However, SPKK can be re-applied, provided that the new SPKK requirements are met.
5.0 Application to Downgrade SPKK
A company that has been approved to downgrade its grade, at the request of the company, or downgraded by CIDB for not meeting the requirements and criteria of the current grade will result in the Bumiputra Status Certificate (STB) to be withdrawn by the Contractor and Entrepreneur Development Division of the Ministry of Works.
6.0 Disciplinary Action on SPKK Holders
Disciplinary action is taken against SPKK holders for offences listed in Table L.

7.0 Terms and Conditions for the Usage of Government Work Procurement
Certificate (SPKK)
7.1 General Terms and Conditions of Government Work Procurement
Certificate (SPKK)
a) This certificate is issued based on the information provided by the company during application.
b) This certificate may not be used as a certification to start or
undertake construction work. This certificate may only be used to participate in work procurement for the government or government agencies.
c) This certificate will automatically be void if the Contractor
Registration Certificate has expired or has been cancelled, withdrawn, suspended pursuant to Rule 15, Rules of Contractor Registration (Construction Industry), 1995.
d) This certificate must be submitted with the Contractor Registration
Certificate to participate in work tender for the government or for other government agencies.
e) This certificate must be renewed together with the registration
certificate issued by CIDB. f) A Government Work Procurement Certificate that is not renewed
within one (1) year from the expiry of the SPKK come void. Any application made after this period considered as a new application and must comply with the terms and conditions for a new application.
g) Changes by the company or certificate holder that may affect the
requirements of the Government Work Procurement Certificate will void the certificate.

7.4 Value of Government Work Procurement for Contractor with only
Local Equity, or with Local and Foreign Equity
a) Construction company with 100% local equity may participate in according to the value of the work for the registered grade and category

7.5 Nominee in Government Work Procurement Certificate (SPKK)
a) Only officials of the company named in the SPKK are authorized
to sign the contract documents of the company and collect the
documents of the award.

F –CONSORTIUM OR JOINT VENTURE COMPANY REGISTRATION
A consortium or joint venture contractor is a merger of two or more companies, eitherincorporated or not with the CCM, and is appointed to carry out a construction project, which must register with the CIDB based on the project awarded. The registration certificate issued is only valid for the construction of projects as stated within it.
There are two (2) types of consortium or joint venture contractor registration with CIDB:
a) Consortium / joint venture between local contractor companies b) Consortium / joint venture between local and foreign contractors
1.0 Registration Terms and Conditions
Contractors must fulfil the following requirements:
a) Project Has an appointment letter or acceptance letter to carry out a project.
b) Contractor Registration
Between locals: One of the local contractors must be registered with CIDB by the grade appropriate for the value of the project.
Local-Foreign: The local contractor must be registered
with CIDB by the grade appropriate for the value of the project. Equity The foreign contractor equity in the joint venture agreement must not exceed 30%. If it is more than 30%, the joint venture must complete the R3 form, but with the conditions as in paragraph 2.0. If the local company is not registered with CIDB, the consortium or joint venture is registered as a foreign Contractor.
2.0 Supporting Documents

3.0 The Registration Period
The certificate is valid for the length of the project.

G –INTERNATIONAL CONTRACTOR REGISTRATION
An international contractor is a local contractor registered with CIDB and will carry out or has carried out construction work abroad.
1.0 Registration Terms and Conditions
a) applicants must be registered with CIDB for at least 3 years b) Active status
2.0 Supporting Documents
a) Copy of CIDB registration certificate b) Copy of ISO 9001:2008 certificate c) Proof of completed construction work, either locally or abroad (if any)
3.0 Registration Fee
Once approved and notified by CIDB, successful applicants must pay the registration fee of One Hundred Ringgit (RM100.00).
4.0 Registration Period
The certificate is valid for the same length as the existing local registration certificate.
H – FOREIGNCONTRACTOR REGISTRATION
A company incorporated in Malaysia or abroad, with equity owned by foreign individual or company of thirty percent (30%) and above, except for foreign equity as stated in Annex 8.
A foreign contractor must apply for the Provisional Registration Certificate before

participating in any tenders in Malaysia. 1.0 Provisional Registration Certificate
A foreign contractor must apply for the Provisional Registration Certificate before participating in any tenders in Malaysia.Companies are not allowedto participate in any tenders before obtaining a provisional registration certificate from CIDB.
1.1 RegistrationTerms and Conditions
a) Attach the tender advertisement or letter of invitation from the client. b) Attach relevant information on construction work experience. c) Has financial reserves of minimum RM750,000.00 or an equivalent
value in the currency of the country of origin. d) Attach the company’s technical person information.
1.2 Terms and Conditions for Provisional Registration Certificate
a) The certificate is non-transferable. b) The Provisional Registration Certificate is valid until the expiry of the
tender or the date of extension. c) The contractor may not participate in any tender other than as stated in
the certificate. d) If a contractor is successful in a tender bid, he must apply for a
Foreign Contractor Certificate before commencing any work. Refer to paragraph 2.0 for application of Foreign Contractor Certificate.
2.0 Foreign Contractor Registration Certificate
A Foreign Contractor Certificate is only issued to foreign contractors to carry out construction projects stated within it.
A foreign contractor is not permitted to carry out or undertake to carry out any construction project before obtaining a Foreign Contractor Certificate.
2.1 Registration Terms and Conditions
a) Attach a copy of the Registration Certificate from the Companies Commission of Malaysia (CCM)
b) Attach a work offer letter c) Has financial reserves of minimum RM750,000.00 d) Employ at least two Malaysians holding a local degree in construction.
At least one of the employees must have more than five years of experience in construction
e) Attach the SCORE form f) Attach L1/96 form (Project Notification form)
2.2 Terms and Conditions for Foreign Contractor Registration
a) The certificate is non-transferable. b) The certificate is valid until the expiry of the project stated within it.

I - REGISTERED CONTRACTOR RESPONSIBILITIES 1.0 Local Contractor
1.1 General Terms and Conditions
a) The certificate is non-transferable.
b) CIDB reserves the right to review the contractor registration grade
from time to time
1.2 Contractor Responsibilities and Obligations
a) Contractors must comply with the provisions in the Construction Industry Development Board Act 1994 (Act 520, Amendment 2011) rules and regulations made thereunder and any terms, conditions or restrictions imposed by CIDB from time to time.
b) The contractor shall not participate any tenders or carry out any
construction work after the certificate expires, unless it is renewed.
c) The contractor shall not undertake to carry out any construction project exceeding the value of construction work stated for the grade he is registered under, and shall not carry out any construction projects beyond his registered category.
d) The contractor shall inform CIDB of any information on construction
work or project within fourteen (14) days after being awarded.
e) The contractor shall inform CIDB of any information required by the Board from time to time.
f) The contractor must display the registration certificate issued by the
Board or a CIDB-certified true copy of it at his place of business.

g) The contractor must display the registration number on a signboard at each of his construction site.
h) The contractor must comply with the principles stated within the
CIDB Contractor Code of Ethics Handbook.
i) The contractor must employ skilled construction workers and a site supervisor who is accredited and certified by the Board.
j) All employees at the construction site must have a valid Construction
Personnel Card.
The contractor must ensure that the products or construction materials used are compliant to the MS (Malaysian Standard) or other standards yang approved by the Malaysian authorities and are certified by the Board.
1.3 Disciplinary Action
In accordance with Rule 15 of the Rules of Contractor Registration (Construction Industry) 1995, the Board may terminate or suspend the registration of any registered contractor under these regulations if: a) The certificate holder has been declared a bankrupt; or b) Awinding-up petition connected with the contractors have been
made; or c) The certificate holder fails to comply with any provision of the Act or
these regulations; or d) The certificate holder was certified by making a false declaration or
statement in writing or other; or e) The certificate holder abandons an ongoing construction work; or f) The certificate holder is found guilty by the court or any other
investigative body established under any written law for negligence in any construction work performed; or
g) The certificate holder has violated or failed to comply; or has assisted
in the breach of any terms, conditions or restrictions imposed by CIDB.
Note:
i) Any contractor whose registration certificate has been revoked
or suspended is not allowed to participate in any new tenders or continue any construction work.
ii) CIDB may under certain circumstances allow a contractor whose
Certificate has been revoked to complete any ongoing work. iii) Disciplinary actions and decisions made on the PPK certificate will
affect the SPKK status.

2.0 Foreign Contractor
2.1 General Terms and Conditions
a) The Foreign Contractor Registration Certificate is non-transferable. b) The certificate holder is only allowed to carry out projects as stated in
the certificate. c) This certificate does not allow the holder to participate in a tender for
any construction work or to carry out any other construction work.
2.2 Certificate Validity Period
This certificate is valid until the project expiry date as stated in the certificate.
2.3 Contractor Responsibilities and Obligations
a) Foreign contractors must comply with the provisions of the Construction Industry Development Board of Malaysia Act 1994 (Amendment 2011) (Act), and regulations made under it and any terms, conditions or restrictions imposed by the Board from time to time.
b) Foreign contractors shall submit any information requested by the
Board from time to time. c) If the completion date of the project is extended, the contractor shall
apply to the Board within fourteen days before the expiry date to extend the Registration Certificate. Supporting documents must be attached.
d) Foreign contractors shall display the registration certificate issued by
the Board or a Board-certified true copy of it at the place of business. e) Foreign contractors shall display the registration number on a sign at
each of its construction site.
2.4 Disciplinary Action
The Foreign Contractor Registration Certificate will be revoked or suspended if:
a) The foreign contractor does not comply with the requirements of any
other written law; b) The foreign contractor has been declared a bankrupt; c) A winding up petition has been madeagainst the foreign contractor;

d) The foreign contractor has violatedor failed to comply with any provision of the Act;
e) The foreign contractor was certified by making or causing to make
any false declaration orcertification, misrepresentationor fraud,either in writing or other;

without any reasonable cause; g) The foreign contractor is found negligent by the court or any board of
inquiry established under any written law in relation to any construction work that has been undertaken; or
h) The foreign contractor has violated any terms and conditions of the
Contractor Responsibilities and Obligations as specified under paragraph 2.3.
