Nondiscrimination, Equal Employment Practices andAffirmative Action Program (Construction),

Bidders/Proposers are advised that any contract awarded pursuant to this procurementprocess shall be subject to the applicable provisions of Los Angeles Administrative CodeSection 10.8.2, Non-discrimination Clause.

Construction projects with the City of Los Angeles for which the consideration is $1,000 ormore shall comply with the provisions of Los Angeles Administrative Code Section 10.8.3,Equal Employment Practices Provisions. All Bidders/Proposers shall complete and upload,the Non-Discrimination/Equal Employment Practices Certification (two (2) pages) available .....on the City of Los Angeles' Business Assistance Virtual Network (BAVN) residing atwww.labavn.org at the time it registers on BAVN, but no later than the time when anindividual Bid/Proposal is submitted. However, Bidders/Proposers with Certificationspreviously uploaded to BAVN and verified by the Office of Contract Compliance (OCC) do notneed to re-submit.

Construction projects with the City of Los Angeles for which the consideration is $5,000 ormore shall comply with the provisions of Los Angeles Administrative Code Section 10.8.4and 10.13, herewith referred to as the Affirmative Action Program. Bidders/Proposers arerequired to complete item number 6 on page 4 of the City of Los Angeles Affirmative Action "Plan (four (4) pages) and upload it on the BAVN residing at www.labavn.org at the time itregisters on BAVN but no later than the time when an individual Bid/Proposal is submitted.Bidders/Proposers opting to submit their own Affirmative Action Plan may do so byuploading it onto the City's BAVN. Bidders/Proposers with current OCC approval for theirAffirmative Action Plan do not need to re-submit unless the approval is 30 days or less fromexpiration.

Additionally, Bidders/Proposers must complete and submit with their bid, the "Anticipated IEmployment Utilization Report" on page 2-2 of this Bid Proposal, to effectuate therequirements of Los Angeles Administrative Code Section 10.13. The form can also bedownloaded from the Bureau of Contract Administration web page at http://bca.lacity.org.

Furthermore, subject subcontractors shall be required to submit the Non-Discrimination/Equal Employment Practices Certification, Affirmative Action Plan, and theAnticipated Employment Utilization Report to the successful Bidder/Proposer prior tocommencing work on the contract. The subcontractor's Non-Discrimination/EqualEmployment Practices Certification(s), Affirmative Action Plan(s), and AnticipatedEmployment Utilization Report(s) shall be retained by the successful Bidder/Proposer andshall be made available to the Office of Contract Compliance upon request.

Both the Non-Discrimination/Equal Employment Practices Certification and the City of LosAngeles Affirmative Action Plan shall be effective for a period of twelve months from thedate it is first uploaded onto the City's BAVN.
