INexerciseofthepowersvestedinmeasthePresidentoftheRepublicofFijiandtheCommanderinChiefof

theRepublicofFijiMilitaryForcesbyvirtueoftheExecutiveAuthorityofFijiDecree2009,Iherebymakethe

followingDecree

TOAMENDTHEFIJICONSTITUTIONALPROCESS(CONSTITUTIONCOMMISSION)DECREE2012

Short title and commencement

1.(1) ThisDecreemaybecitedastheFijiConstitutionalProcess(ConstitutionCommission)(Amendment)

Decree2012,andshallcomeintoforceonthedateofitspublicationintheGazette.

(2) TheFijiConstitutionalProcess(ConstitutionCommission)Decree2012shallbereferredtoasthePrincipal

Decree.

Section 7 amended

2. Section7(1)of thePrincipal Decreeisamendedby deletingparagraphs(j)and(k)andsubstitutingthe

following

(j) prepareadraftConstitutiononthebasisoutlinedinsection3,withanExplanatoryReport;and

(k) presenttothePresidentthedraftConstitutionandtheExplanatoryReport.

Section 10 amended

3. Section10(3)ofthePrincipalDecreeisamendedbydeletingthewordsorthehearingofviewsonthe

draftConstitution.

Section 12 amended

4. Section12ofthePrincipalDecreeisamendedbyinsertingthefollowingnewsubsectionsaftersubsection

(3)

(4) TheCommissionshall,attheendofeachCalendarmonth,publishinthedailynewspapersinFiji

(a) a list of all its staff, including the Commission members and any consultants, and their

remuneration, including any allowances and benets; and

(b) a nancial report of all its expenses and any monies received by the Commission pursuant to

section16.

(5) The Commission shall, immediately upon the commencement of the Fiji Constitutional Process

(ConstitutionCommission)(Amendment)Decree2012,publishtheinformationrequiredinsubsection

(4),forthemonthsofJune2012toOctober2012.

Consequential amendment

5. TheFijiConstitutionalProcess(ConstituentAssemblyandAdoptionofConstitution)Decree2012isamended

insection8(1)(c) bydeletingthewords,andtheviewsofthepeopleofFijiexpressedonthedraftConstitution.
