Power of Attorney

Do you have a Power of Attorney?

Do you need one?

What is it?

A Power of Attorney can be a very valuable and useful document. When you sign it, you authorise someone else to do certain things for, in relation to financial matters. You can choose how much you allow your attorney to do.

A Power of Attorney can remain effective after someone subsequently becomes mentally incapable (and that is an important reason for doing it in the first place). It will incorporate a certificate from a Solicitor confirming that the person understands the document and its effect. It can then be registered with a government official called the Public Guardian who can exercise some control over how an Attorney acts. The Attorney is legally required to act in the best interests of the person who has signed the document.

Some older Powers of Attorney may remain capable after you have become incapable, but others cannot. If you already have a Power of Attorney made before 2011, it is best to check with your solicitor if yours needs to be updated.

I am proud and honoured to be the President of DACC at such an exciting time for the Chamber and for Dundee and Angus.

Your Chamber continues to grow, with new members from many different sectors joining this year to maintain our very broad and representative mix of businesses from across the region. But, I want to go further and when I addressed the 2012 AGM, I set a goal of doubling the Chamber’s membership. This is a tough target, but if every existing member refers just one potential new member to us in the next 12 months, it wouldn’t take us long to achieve. Dundee City Council Looks to the FutureæCounCillor Ken Guild, Leader of Dundee City Council, writes:

Dundee City Council remains firm in its commitment to help the local economy during these challenging times.

We are investing in our local communities with a £420 million building programme covering schools, leisure facilities and housing.

Plans are well advanced for the redevelopment of our central waterfront, with a £1 billion transformation project now taking shape and continuing over the next decade.

People, organisations and businesses in the city are fully behind the V&A project and believe that the city is moving forward together in the right direction.

The biggest challenge for the council is growing the economy and bringing jobsintothecity.Wehaveaworld-classreputation in the computer games industry and in life sciences.

We need to build on this success, and work is well underway by the council and its partners to prepare for investment in the city to support offshore energy projects.

This continues to hold the prospect of several hundred jobs for the city and we are confident that our memorandum of understanding with our partners in Forth Ports, SSE and Scottish Enterprise will deliver for the local economy. The Scottish Government’s commitment to renewable energy and the companies that will create new jobs and wealth is undiminished.

We are dedicated to improving prospects

for young people in Dundee and are working with a range of local companies to maximise opportunities going forward.

For the first time in twenty years we have seen an increase in the population of Dundee and the city council will continue to work with the private sector to lay further foundations for growth.

I firmly believe that because of our strength of partnership working in Dundee, we will be well placed when the national economy picks up once more.

CounCillor iAn GAul, Leader of Angus Council, writes:

POLITICS at any level can be a ‘difficult’ business and the last five years spent in opposition, where a traditional Administration versus Opposition adversarial atmosphere prevailed, really lived up to the difficult tag.

It made me think about how the politicallandscape in Angus could be changed, and following the council elections in May, I was fortunate to be given the opportunity to put my thoughts into practice.As the new leader of Angus Council my first priority was to change the extant ‘them and us’ view to one that is open and

inclusive.Ipersonallycalledeachnon-SNP Angus councillor; extending a hand of friendship so we could work together for the betterment of Angus. Discussions with senior officers followed and so Team Angus was born.

This ‘one council’ approach is about breaking down barriers to help us do things differently, whether that’s through cross party budget planning or having a more relaxed dress code in the office. Encouraging and using all the available talent on the team is just common sense – how else will be able to deliver the outcomes Angus’ people, communities and businesses deserve?

So what is Team Angus’ relationship with business? We are focusing on our interface with business not as a customer or provider but as a facilitator, enabling local businesses to grow and prosper. We have started a series of meetings with groups of business people with a simple one question agenda – apart from money what can Angus Council do to help you and your business?

As a council, and the biggest employer in Angus, we need to not only listen to the people we serve but also recognise that we can have a positive impact on how people do business in Angus, we can make a positive contribution. Our strategy is therefore based on four fundamentals:

• wemustlistentobusinessesandacton what they tell us• wecanbeproactiveinbringingin investment• wecanbeacandocouncil, and we will be• wewillshapeAngusCouncilintowhat we want it to be and not be content with what we have.

This is a work in progress, and one that we look forward to developing in partnership with the business community. After all Team Angus is not an exclusive club, anyone working for the benefit of Angus is already a member!

Local Colleges to Pursue MergerNew ‘aspirational college’ to be created

æTHe BoArdS oF AnGuS And dundee ColleGeS have agreed to merge the two institutions to create a single college for the Dundee and Angus region. The Scottish Government’s post-16reformandregionalisationagendarequirescollegestowork together in their respective geographic regions, combining expertise and resources in order to best serve the needs of learners and employers. After considering both federation and merger, both colleges agreed to pursue the merger option. This agenda for change comes at a time of reduced public expenditure; cuts to college budgets have been significant and there have already been a number of mergers across the sector.

Christina Potter, Dundee College Principal, said: ‘While this decision is momentous, we are only at the very early planning stages, with much work to be done before the two colleges can become one. The Scottish Funding Council estimates that it takes a minimum of 12 months to complete a merger of this sort and our planned vesting date is therefore 1 November 2013. In the meantime, all our

staff will be working hard to give all college stakeholders, students, employers, parents and schools the best possible service. We believe we have excelled in our services to business as individual colleges and together we will be even stronger. There are many new investments planned for the region, not least the V&A and the Dundee Waterfront Development; and the new college will be able to provide the skills to underpin them while working with Dundee & Angus Chamber of Commerce and other partners to contribute to the economic development of the region as a whole.’

John Burt, Principal of Angus College, stated ‘Angus College is fully committed to the creation of a new aspirational college that will be a Centre of Education and Skills Excellence to enhance sustainable economic growth, prosperity and well-being.

We have achieved a great deal as individual organisations, and will now move on together to achieve even more under our guiding principles of:

Denki Snaffle Two Awards at Games IndustryCeremony ‘snaffle – 16 points’

æGAMeS STudio denKi TooK HoMe TWo AWArdS at the recent TIGA Games Industry Awards ceremony. Their popular XBox Live game ‘Quarrel’ won Best Social Game and Best Serious Game, beating off strong competition in both categories. The game, based on Scrabble but with added elements of the board game Risk, has been lauded for its educational abilities, as well as just being fun to play. The team initially struggled to find a publisher for the game, before putting it out on Apple’s iOS format first, the success of which led to Quarrel for XBox Live.

Overgate Ends 2012 on a HighNew stores aid growth

In recent months Overgate has been awarded the coveted Achieving Customer Excellence (ACE) honour from the British Council of Shopping Centres, while Centre Manager, David Carson was also recognised at the SCEPTRE Awards at the Dorchester Hotel in London in the Shopping Centre Manager of the Year category.

This along with a host of new store launches throughout the year, including Quiz and The Perfume Shop, has helped the popular city

centre shopping destination go from strength to strength.David said: “This year has been a fantastic opportunity for us to shout about Dundee. The city is leading the way in many industries, including retail. Blue Square Wins National Digital AwardSuccess recognised

ædundee-BASed CreATiVe And diGiTAl AGenCY Blue Square won the Public Sector Award for their work on the Dundee Waterfront website at the Herald Scottish Digital Awards 2012 ceremony in Glasgow.

Blue Square designed and built the website with full content management, using their own bespoke software, which allows users to browse information about the Dundee Waterfront Development. Interactive elements include: video playing via a dedicated YouTube channel; Twitter traffic and update feeds; automatic posting of website news to Facebook; interactive investors plot map; interlinking between zones and projects to help navigation throughout the site; managed forum; integrated events, parking and traffic feeds from external websites; completed project library; resource centre including publications presentations, image gallery, video feeds and an Ambassador Toolkit for download; and integrated eNewsletter system. A mobile version of the website was also implemented which allows users to view a condensed version of the website data.

The website receives around 7000 unique visits a month with approximately 10% accessed by mobile devices and it is testament to

£50 Million Icing on the Cake for GSK Montrose’s Diamond Celebrations60 years in Angus

While there were manyhighlights throughout the diamond year,the icing on the cake came in March whenthe company announced it was to investa further £50 million in its Angus plantwhere it manufactures active ingredientsfor pharmaceuticals.

Half of this is going towards a brand new plant to make aluminium adjuvants,high-techagentsusedinthemanufactureof vaccines to help stimulate the body’simmune system.

GSKistheworld’slargestvaccinecompany and Montrose will become thefirstUKGSKsitetoparticipateinthecompany’s vaccine manufacturing supplychain. The £50 million commitment will also help to develop products already established at Montrose, as well as introducing new technologies.

invested in Montrose in the past five years or so, the further £50 million represents a huge vote of confidence in the site and further underpins Montrose’s renaissance.

The ambition now is to significantly increase the site’s volumes in the next five years.’

A year of celebrations has been enjoyedby members of staff, events often involvingpartners and families. A factory open day in September was one such occasion when over 400 employees and guests turned up.

‘The overwhelming impression of visitorswho had never been on the site previouslywas that they hadn’t realised what it tookto make our products,’ said Andy. ‘Visitorsalso said how proud everyone was in whatthey were doing.’

Looking to secure its future for manydecades to come, the site has ambitiousplans to introduce renewable technologiesto become both sustainable and carbonneutral in terms of energy used to run thefacility.

The site is trail blazing the use of tidalturbines in the River South Esk on thesouthernboundaryofthe45-acreplot.With the site’s boilers approaching the endof their functional life biomass options arebeing looked at to replace them.Wind turbines are also an option togenerate green electricity and permission is currently being sought for two turbines.

Michelin -40 years in Dundeeæon 6TH noVeMBer THe dundeeFACTorY CeleBrATed iTS 40TH AnniVerSArY. JoHn reid, FACTorY MAnAGer, TAlKS BeloW ABouT MiCHelin’S ForMulA For SuCCeSS

The plant was originally built during 1971 and ’72 as part of a Scottish Michelin group. The plan had been to create a group of factories making car and truck tyres. Just as the work started the Oil Crisis of the early 70’s struck and the plans were quickly modified. The truck plant in Perth was cancelled but the steel product factory in Aberdeen and the car tyre plant in Dundee were both built. The wire plant in Aberdeen was unfortunately closed in the early 80’s.

When the factory was built it was configured for low complexity and what was then regarded as high volume. This model of producing only four types of tyre, all 13” diameter, evolved and by the early 90’s the plant was producing 13,000 tyres/day of a dozen different types and employing 1,300 people. Contrast that with today’s performance when the plant can produce 24,000 tyres/day with over 100 different types of tyre in its portfolio, using only 850 people to do so. This clearly demonstrates the performance evolution required to keep the plant productive and cost effective.

With an export level rising to 95% and no semi-finishedcapability,theDundeeplanthas been as we say “Defying Gravity”. When you think about it, we don’t actually make sense. We get all our materials from

Ballymena in Northern Ireland or Central Europe, make the tyres and send 95% of them all the way back to Central Europe and beyond. This has, as you’d imagine, led to some sticky moments over the years!

The secret ingredients that have allowed us to beat the odds and get through these sticky moments are our people and our ability to work together. This approach is something that comes in the first instancefromMichelin’slong-standingcore value of Respect for People. In Dundee we have taken it further through the vision of managers and union reps over the years, both learning from the painful lessons of others in Dundee andmanufacturinggenerallyintheUK.Over the years I’ve seen the power of a workforce that respects each other and eachother’sroles-unions,managers,engineers and operators. It means when we face problems, we face them together and when we see an opportunity we can exploit it faster than most.

This formula has kept us successful all these years and was also what allowed us to transform our factory and its performance over the last two or three years. By doing

thiswehavebeenabletoincreaseto7-dayworking and recruit another 140 people, construct a new production building and install the first of our new generation tyre building machines. These significant investments will give us the platform to be successful for years to come.

Today, like many of you, we face the challenges of a decimated European market and it looks like next year will be much the same. For us this has resulted in a 25% drop in volumes versus the production plan. As ever we have worked together and have done enough to be successful. In fact, it has driven us to create a labour flexibility model which has been recognised by Michelin as a Group Benchmark!

As the current Factory Manager, and someone who has worked in the plant for 20 years, I’d like to close by thanking the people of Dundee and the Chamber for their support over the years, and to congratulate my team for the fantastic achievement that 40 years in manufacturing is, particularly in this part of the world.

The changing role of the Reserve Forces

æAlreAdY A ViTAl CoMPonenT oF our ArMed ForCeS, the Reserve Forces will have a greater role and will be more integrated with the Regular component of the military in the future. This requires an increase in size and change in the nature of the Reserve Force’s role. To achieve the range and scale of military forces and skills required, and in an austere economic climate, there will also be a need to use the Reserve Forces to access wider skill sets that cannot be held economically within Regular Forces or are much better drawn from the civil sector. These changes are most significant for the Army – examples being Medical and IT.

In the future, the Reserve Forces will need to be available for a number of additional roles, for instance contributing alongside other Government Departments (Foreign & Commonwealth Office and the Department for International Development) to build the capacity of indigenous forces in parts of the world whichmattertotheUK,ortomeetstanding commitments, such as the defenceoftheFalklandIslands.Undercurrent legislation reservists could not be mobilized for these tasks. The Government’s vision is to enhance the relationship between the military and employers in order to develop

and maintain a robust, balanced and openthree-waydialoguebetweentheemployer, the reservist and the military.

To deliver these changes MOD will require access to appropriately trained and skilled reservists from the civilian workforce. The military recognize that they must better understand the needs of employers, whether large, medium or small, while taking into account the specific needs oftheself-employedandunemployed.Their intent is to develop sustainable and mutually beneficial relationships with them, most notably by managing better the issue of mobilization, and by setting out the benefits that employment of reservists can give employers.

The Government is considering introducing some element of financial reward for those employers employing a reservist.

Under Pressure in the WorkplaceCoping with stress

æeVerYone eXPerienCeS iT - THAT FeelinG oFdread as the ‘to do’ list gets longer, with time ticking by at an alarming rate. It can feel as though there just aren’t enough hours in the day to get everything done. And, in today’s difficult climate when budgets are tighter than ever before, it’s easy for this feeling to become a daily occurrence.

But constant worrying is a symptom of stress – a condition which, while many of us choose to accept it as a ‘normal’ part of working life, can take a major toll on your health and wellbeing.

Stress can affect your appetite, cause you to smoke or drink more and lead to physical problems such as headaches and dizziness, breathlessness and muscle pain. Sufferers may lose their temper more easily and find it difficult to concentrate, andlong-termstresscancausearangeofserioushealthcomplications including depression and insomnia, high blood pressure and heart disease.

Research found that working adults who have a poor diet are more likely to suffer from stress, low productivity and low job satisfaction. Those with good nutrition achieved a 6% higher job satisfaction score, as well as a 15% higher mood score. Exercise can also play a part in alleviating stress. According to Dr Cary Cooper, an occupational health expert attheUniversityofLancaster,‘todealwithstresseffectively,you need to feel robust and you need to feel strong mentally. Exercise does that,’ he said.

In addition to lifestyle changes, talking therapies such as counselling and cognitive behavioural therapy (CBT) are widely renowned for helping people suffering from stress, anxiety or depression to deal with negative thoughts and feelings and to make positive changes.

Big PAYE ChangesIntroduction of Real Time Information

æReal Time Information, or RTI, is one of the biggest changes to the PAYE system since its introduction in 1944, and will affect every employer, regardless of size.

It is essential that employers start to prepare for RTI now. Payroll software is a must, either in the form of a computerised package forprocessingpayrollin-houseorbyoutsourcing to a payroll provider.

By outsourcing to a payroll provider, employers do not need the knowledge required to handle this complex area.

Benefits of outsourcing are:• staffpaidontimewithappropriate deductions made• HMRCcomplianceensured• nopayrollsoftwarecosts• significantlylowerriskofHMRC penalties.

RTI is aimed at improving the operation of PAYE. Currently, if you’re an employer

operating PAYE, you submit an end of year returntoHMRC.UnderRTI,informationabout PAYE, NIC and student loans will be submitted throughout the year as part of the payroll process rather than at the end of the year. Every time you process your payroll, your software will collate the necessary information and send it to HMRC.

Apart from a few specified exceptions, it is a legal requirement to report payroll information electronically on or before any day when you pay someone. Regular reporting under RTI will reduce end of year pressures and be more efficient, saving you time and money. However, the risks of getting it wrong may increase.

Penalties will apply to the late filing of RTI submissions during the year. The guidance for this is under consideration so employers should note that existing penalties are £100 per month. Penalties accrue for each month (or part month) for which a return remains outstanding after the filing date.

Most employers will be legally required to use RTI from April 2013, and all employers will be required to do so by October 2013. HMRC will inform you when your business needs to make the move, therefore, it is crucial to be prepared. When RTI commences, you will encounter major problems if any of your employee data is missing or incorrect. However, you can start preparing now by ensuring that all your employee data is complete, accurate, and up-to-date.Theessentialelementsarefullname, address, date of birth and NI number.

In our regular “ask the coach” series, we answer your questions to help you grow your business.

TalkBuddyTM has many years’ experience helping business people to speak with confidence. French dressing has inspired and helped hundreds of men and women with their personal and professional image.

How do I decide who to speak to?eugene: It can be pretty intimidating to enter a room full of strangers. Use our knowledge of body language. Look at how the people in a group are standing in relation to each other. If a couple are standing directly facing each other the chances are they are having a conversation that they don’t want to have interrupted. If they are standing at an angle it’s a sign they would welcome someone to join them.

Does the way I dress really matter for networking?edith: Yes, especially if you don’t know anybody there. First impressions count a lot and your clothes and body language are important. You represent your company or the company you work for. What values do you want to project?

I’m a bit uncomfortable starting a conversation with a stranger; what do I say?eugene: Think about some openers you can use to strike up a conversation. Effective openers are often open-ended questions that give the person you’re addressing the opportunity to reply with more than just ‘yes’ or ‘no’.

Try openers like these:• This is my first time at one of these events, what are they like?• I see XXX is giving a talk later on, do you know what topics he’ll be covering?

What to wear if the dress code is ‘informal’edith: It is not a matter of what to wear at an informal meeting, but a matter of establishing your standards and maintaining them. What you need to remember is that you are in a professional setting. Clean clothes and shoes are a minimum.

I know I’m going to be asked: ‘So what do you do?’ How do I answer?eugene: Try to avoid starting with ‘I’m a . . .’ This can often lead the listener to jump to the stereotype of that particular business. Try to identify a benefit your business can bring and mention that. Almost certainly the listener will respond by asking you how you do that. And bingo! You’ve got a conversation going.

Should I try to use the same colours as those on my website or logo?edith: Yes . . . and no! If there is a really striking colour that you are using in your brand, then I would expect to see it somewhere on you. But you need to be careful: choosing the wrong shade of that colour for your own complexion or the wrong colour for you could make you look older, drained or tired.

Finally, any last bits of advice?eugene and edith: Establishing good standards and wearing clothes that fit you well make you look more confident. Remember that everyone else is there for the same reason – to help develop business relationships. So just relax and enjoy and treat networking as a long-term activity, not an instant fix!
