2010 ADA STANDARDS The U.S. Department of Justice recently issued revised ADA regulations, including changes to its 2010 Standards for Accessible Design that effect ATMs. Details on how the regulations affect ATMs can be found in section 707, Automatic Teller Machines and Fare Machines. The 2010 ADA standards address both physical access and communication-related elements to make ATMs usable by individuals who are visually impaired as well as those who have mobility challenges.

Safe Harbor Fixed ATMs: Fixed ATMs that were installed prior to March 15, 2012, and are in compliance with the 1991 ADA standards qualify for safe harbor and need not be physically adjusted to meet the 2010 standards. There however is no “safe harbor” for 2010 ADA standards in regard to communications elements. Non-Fixed ATMs: There is no safe harbor for non-fixed terminals. Non-fixed ATMs must meet 2010 standards for both physical access and communications elements. See fixed ATM definition below. Keypads: In March 2011 the Department of Justice indicated that keypads on fixed ATMs installed prior to March 15, 2012, that meet the 1999 ADA standards, do NOT need to be modified. More Than One Terminal Per Location: Where two or more ATMs are located at the same location (both must be inside or both must be outside of the location, location must have same address), only one machine — the one with the highest functions available — must be compliant.

Fixed ATMs vs. Non-Fixed ATMs The Department of Justice has historically considered terminals that are bolted to the ground and/or use hard-wired communications methods to be fixed. Accessibility standards for non-fixed ATMs have not been released by the Department of Justice and there is no estimated release date set at this time. It is possible that the guidelines may come out well after the final compliance deadline of March 15, 2012. It should be assumed that non-fixed ATMs will need to meet 2010 ADA standards for physical access and communications elements.

ADA Enforcement Although there is no official agency set up to enforce ADA, there are a number of ways that ATM owners could be at risk for litigation if they do not comply with ADA. The two most likely scenarios are:

— The Attorney General of the United States filing suit in federal court to enforce ADA, and — A class action lawsuit brought by a disability rights group or disabled individuals that feels they have been

discriminated against.

Responsibility for Compliance According to the Department of Justice, any entities that own, lease or operate ATMs in a public place are ultimately responsible for ADA compliance. This could be a financial institution, merchant, an independent ATM deployer, ATM manufacturer, ATM lessor or a sponsoring financial institution. Because our legal system in the United States allows anyone to sue anyone else for anything and attorneys tend to sue all parties involved looking for the highest payoff, it is important that everyone involved in the ATM value chain be aware of ADA compliance and take steps to ensure that their ATMs are compliant.

Non-Compliance Penalties Although it isn’t clear at this point how much penalties for non-compliance will be, some attorney’s are suggesting that civil penalties could be up to $55,000 for the first violation and $110,000 for any additional violation. Add in lawyer fees for representation and non-compliance with ADA could be extremely costly for small businesses.

New ATM ADA Standards

PHYSICAL ACCESS

1. Height & Reach Requirements** To meet the 2010 ADA regulations, the high forward reach without any obstructions shall be 48 inches (1220 mm) maximum and the low forward reach shall be 15 inches (380 mm) minimum above the finish floor or ground. Operable parts must be placed within the reach ranges.

** Fixed ATMs that were installed prior to March 15, 2012, and are in compliance with the 1991 ADA standards qualify for “safe harbor” and need not be physically adjusted to meet the 2010 standards. There will be no “safe harbor” for 2010 ADA standards in regard to communications elements on these ATMs however. **There will also be no safe harbor for “non-fixed” terminals either. Non-fixed ATMs must meet 2010 standards.

ATMs with touchscreen functionality must follow the same height and reach specifications as with other operable parts.

2. Accessible Route One full unobstructed side of the clear floor or ground space shall adjoin an accessible route or adjoin another clear floor or ground space.

3. Floor Space The clear floor or ground space must be 30 inches by 48 inches minimum. Positioned for either forward or parallel approach, one full unobstructed side of the clear floor space must adjoin an accessible route. Please be careful to not stack boxes or other items near the ATM. This action may cause the ATM to be non-compliant.

If your clear floor space is located in an alcove or otherwise confined on all or part of three sides, additional maneuvering clearance must be provided.

— Parallel Approach Alcoves: Must be at least 60 inches wide by 15 inches minimum.

— Forward Approach Alcoves:

Must be at least 36 inches wide by 24 inches.

These regulations do not apply to drive-up ATMs.

COMMUNICATIONS ELEMENTS 1. Speech Capabilities

The new ADA regulations mandate that ATMs must be speech enabled in order to accommodate the visually impaired and those with mobility challenges as these individuals cannot effectively block the ATM screen with their bodies for privacy. Speech shall be capable of being repeated or interrupted. Volume control shall be provided for the speech function.

2. Input Controls

Under the new ADA regulations, at least one tactilely discernible input control shall be provided for each function. Where provided, key surfaces not on active areas of display screens, shall be raised above surrounding surfaces. Where membrane keys are the only method of input, each shall be tactilely discernable from surrounding surfaces and adjacent keys.

There is NO “safe harbor” for speech capabilities. Advertisements and other similar information are not required to be audible unless they convey information that must be used in the transaction process.

In March 2011, the Department of Justice indicated that keypads on “fixed” ATMs installed prior to March 15, 2012, that meet the 1999 ADA standards, do NOT need to be modified.

3. Numeric Keys Numeric keys must be arranged in a 12-key ascending or descending telephone keypad layout in order to meet new ADA regulations. The number five key shall be tactilely distinct from the other keys.

4. Function Keys

To meet new ADA regulations, function keys must contrast visually from background surfaces. Characters and symbols on key surfaces shall contrast visually from key surfaces, and visual contrast shall be either light-on-dark or dark-on-light. Function key surfaces shall have tactile symbols as follows:

If audio guidance provides clear instructions on how to increase/decrease volume using other keys, the +/- keys do not

need to be raised, according to the Department of Justice.

5. Display Screen

The display screen must be visible from a point located 40 inches above the center of the clear floor space in front of the machine. Drive-up ATMs are excluded from these regulations. Screen Characters Characters displayed on the screen must be in a sans serif font. Characters should be 3/16 inch high minimum based on the uppercase letter “I”. Characters must contrast with their background with either light characters on a dark background or dark

characters on a light background.

6. Braille Instructions Braille instructions that explain how to initiate the speech mode must be affixed to ATMs in order to be in compliance with new ADA regulations. There is NO “safe harbor” for Braille instructions.

Additional information on Braille can be found in Section 703.3 of the 2010 ADA Standards for Accessible Design.

Non-Compliant Symbol The raised headphone symbol which is present on most ATM models is NOT adequate.

If the Braille instructions are not present on the ATM, a Braille instruction decal should be installed near the audio jack. If the instruction decal will not fit near the jack, a directional Braille decal should be installed there and Braille instruction decal should also be applied to the ATM as close to the jack as possible. ADA-compliant Braille decals are available from GetBranded.com.
