Integrating Firearms Compliance and Business ObjectivesOrchid Advisors and the National Shooting Sports Foundation® welcome you to the 2017 Firearms Industry Compliance Conference (FICC). For the 4th year in a row small and large Federal Firearms Licensees hail from across the country to set the industry’s compliance agenda for the coming year. Lawrence G. Keane, SVP, Asst. Secretary and General Counsel, NSSF

Lawrence G. Keane, Esq. is Senior Vice President, Assistant Secretary, and General Counsel to the National Shooting Sports Foundation, Inc. (NSSF), the firearm industry’s trade association. He is responsible for all of NSSF’s legal, government relations and risk management functions. He assisted in drafting the Protection of Lawful Commerce in Arms Act (Public Law No. 109-92) and the so-called “Tiahrt Amendment”. He serves as the firearms industry’s chief spokesperson for all legal, legislative and regulatory matters.

He was named a 2014 Top Lobbyist by CEO Update for his handling of the flood of legislative proposals in the aftermath of the tragedy

that struck Newtown, Connecticut, noting that “in his many media appearances he has been a calm, reasonable voice for an industry often caught in a passionate debate.”

He has co-authored several amicus curiae briefs on behalf of NSSF filed in the U.S. Supreme Court, most notably in the landmark Second Amendment cases of District of Columbia v. Heller, 128 S. Ct. 2783 (2008), portions of NSSF’s brief were quoted in Court’s opinion, and in NRA v. Chicago and McDonald v. Chicago.

Mr. Keane also serves as general counsel and corporate secretary to the Sporting Arms and Ammunition Manufacturers’ Institute, Inc. (SAAMI), the technical trade association of leading United States firearms, ammunition, and propellant manufacturers that sets voluntary firearms and ammunition safety standards. In addition to serving as an officer of SAAMI, Mr. Keane currently is the chairman of SAAMI’s committee on legal and legislative affairs.

Mr. Keane serves on the board of directors for the Congressional Sportsmen’s Foundation, an organization that works closely with Congress, governors, and state legislatures to protect and advance hunting, angling, recreational shooting and trapping. He is corporate secretary for Project ChildSafe Inc., a 501(c)(3) not-for-profit established to support NSSF’s premiere safety education program Project ChildSafe.

Mr. Keane additionally is an alternate member of the Wildlife and Hunting Heritage Conservation Council, an official advisory group established under the Federal Advisory Committee Act.

The Assistant Secretary of State for Political Military Affairs appointed Mr. Keane to the Defense Trade Advisory Group (DTAG), which advises the State Department on the regulation of defense trade to help ensure that impediments to legitimate exports are reduced while the foreign policy and national security interests of the U.S. continue to be protected and advanced in accordance with the Arms Export Control Act. He served as a member of DTAG between 2008 and 2014.

Prior to joining NSSF, he was a partner in the White Plains, NY law firm of Pino & Associates, LLP where he represented a number of domestic and foreign firearm manufacturers in product liability cases. Mr. Keane successfully represented Beretta U.S.A. Corp. in the landmark cases of Hamilton v. Accu-Tek, et al. and Dix v. Beretta U.S.A. Corp.

Before joining Pino & Associates, LLP Mr. Keane was an Assistant District Attorney in the Westchester County, NY District Attorney’s Office. During his career as ADA, he investigated and prosecuted violent criminals. He was also assigned to the Economic Crime Bureau where he investigated and prosecuted complex white collar and organized criminal cases.

Mr. Keane obtained a B.A. in Economics and his Juris Doctorate from Fordham University. Mr. Keane is rated A.V. by Martindale-Hubbell.

Mr. Keane is a member in good standing of the bars of the State of Connecticut and New York, and is admitted to practice in the United States District Court for Connecticut, the Southern and Eastern Districts of New York, the United States Court of Appeals for the Second Circuit and the Ninth Circuit and the Supreme Court of the United States.

Karri Allen is in-house counsel for The Safariland

Group, a diversified global manufacturer and seller of products for the military, law enforcement, and safety markets. She advises on firearms compliance and international trade compliance including oversight of compliance programs in both areas.

Starting in 2015, The Safariland Group acquired several retail locations that sell firearms. As a result, Karri’s role has expanded to creating an integrated retail firearms compliance program addressing federal and state requirements in multiple jurisdictions. Karri graduated from the University of Miami with a B.B.A. in International Finance and Marketing. She obtained

Ron’s past time activities include biking, water skiing and boating (with whomever will go with him), woodworking and singing with the Minnesota Oratorio Society. Sam Kirkland, Strategy Channel Director, Epicor Software Corporation

Sam Kirkland brings over 30 years of experience to his role

of National Accounts Manager at Epicor Software Corporation. He joined Epicor in May 2011 following a merger with Activant Solutions Inc., where he served as a National Accounts Manager in the Retail Distribution Group. Phil Milks, Executive Director, Manufacturing Practice, Orchid Advisors

Philip Milks is an attorney and was formerly employed by the National Shooting Sports Foundation (NSSF) and Remington Outdoor Company (ROC). While at Remington, Phil served his executive peers as the leader of ROC’s corporate compliance function which included ATF, Import, and Export (ITAR and EAR). Phil played a key role in advising ROC and its subcontract manufacturers in the development of ammunition, suppressors,

Phil had numerous professional interactions with national and local ATF leadership and responded to a multitude of high volume serial number ATF inspections.

Kevin Miller, Senior Trade & Security Consultant, Miller & Chevalier

Kevin Miller is a Senior Trade & Security Consultant. He has experience in export/import regulations, economic sanctions, and regulatory compliance and investigations. Mr. Miller regularly prepares and submits license applications under the International Traffic in Arms Regulations (ITAR), the Export Administration Regulations (EAR), economic sanctions regulations administered by the Office of Foreign Assets Control (OFAC), Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations, and nuclear related licenses issued by the United States Nuclear Regulatory Commission and the Department of Energy. In addition, he assists with export and import classification matters, e-FCL filings

with the Defense Security Service (DSS), regulatory due diligence and notifications in merger and acquisition transactions, preparation of joint voluntary notices to the Committee on Foreign Investment in the United States (CFIUS) and related FOCI mitigation measures, training and compliance programs, and internal investigations and voluntary disclosures. Mr. Miller also monitors legislative and regulatory developments in the area of economic sanctions and export controls, and performs research and analysis for clients regarding these issues.

Previously, Mr. Miller served as an Export Compliance Administrator with the Survivability and Protection Systems business at BAE Systems. While there, he served as the key point of contact for export compliance matters related to the business unit, prepared license applications and technical assistance agreements, and monitored the export and import of technical data, hardware, and services. In addition, he had oversight of compliance with NISPOM and Special Security Agreement requirements. Mr. Miller has co-authored a number of articles on export controls and economic sanctions.

1995. She joined the National Instant Criminal Background Check System (NICS) Section in 1999. She has served on the NICS Quality Assurance team, as an Analyst to the NICS Section Chief, State Liaison and as Supervisor of the State Support Team. She currently serves as the Supervisor of the NICS Business Relations Team. This team is responsible for developing and maintaining relationships with all customer segments of the NICS. Jill lives in Fairmont, West Virginia with her husband Jeff and her two children, Ryan and Leah.

Bill Napier, NSSF Store Security Consultant

Bill has over thirty years’ experience in

retail loss prevention passionately serving others in leadership roles such as site manager, corporate manager and director. Businesses have included small and growing retail chains as well as a Fortune 1000 company. For over 18 of those years Bill has been in the retail outdoor arena with responsibility for ATF compliance and firearms related investigations. Bill is a guest speaker at groups such as National Shooting Sports Foundation (NSSF) SHOT Show, National Retail Federation (NRF), Retail Industry Leaders Association (RILA), Retail Technology (RETECH), ASIS International and The Loss Prevention Foundation. Bill has appeared in various retail

related magazine interviews and articles on such topics as emerging security technology, return fraud, physical security and leadership. Bill served over twenty years in municipal law enforcement as a uniform patrol officer, detective and supervisor where he specialized in impaired driving enforcement with the drug recognition expert program. In addition Bill was a state certified law enforcement instructor. Bill volunteers as a Hunter Education instructor in Nebraska, serves on the ASIS Retail Loss Prevention Council and is a member of the Subject Matter Expert Committee. Bill is also on the board of directors for The Loss Prevention Foundation.

John Neiman, Shareholder and Appellate Group Chair, Maynard Cooper

John currently is litigating a water-rights case against the federal government in the District of Columbia, a voting-rights dispute in the Northern District of Alabama, and a defamation case in Alabama state court. In 2016, he has successfully argued one case for a client in the Eighth Circuit and is representing other clients in cases to be argued in the Eleventh Circuit and California appellate courts. He recently successfully defended, in the trial court and the Alabama Supreme Court, the Alabama Governor’s decision to remove the Confederate Flag from the state capitol grounds.

Phillip Nelsen, Attorney at Law Nelsen Law Office, P.C.

Phillip Nelsen is an attorney, assistant professor of law and business, firearm industry consultant and founder of the nationwide firearm training firm Legal Heat. Legal Heat is the nation’s largest concealed firearm training firm, operating in over 20 states and 100 retail locations, and is the exclusive training partner of Cabela’s. He earned his Juris Doctor Degree from the University of Idaho College of Law and his Bachelor’s Degree in Political Science from Weber State

University. He is routinely retained as special counsel for firearm law cases throughout the United States and has been called upon to serve as an expert witness for both civil and criminal cases. Phillip’s clients include several nationwide firearm retailers and manufacturers, and he also serves in an advisory capacity for multiple members of the United States Congress.

A contributor to numerous scholarly publications, he is also the author of Legal Heat: 50 State Guide to Firearm Laws, which is in its 5th edition as a printed work and is used by over 150,000 gun owners as a popular mobile phone application available on iOS, Android and Kindle devices.

In his personal life, Phillip is a happily married father of 3. He enjoys shooting sports and big game hunting. Each year in the fall he has the pleasure of “working” as a professional hunting guide, where he has guided over 100 successful big game hunts from Northern Idaho to Mexico.

Ryan Nokes, Director, Marketplace Insight

Ryan leads the MarketPlace Insight division for the leading data and analytics provider to the firearms industry. He works with manufacturers, distributors, and retailers to provide accurate forecasting, real-time market trends, and operational and

David Power, Vice President Sales, Outdoor Products, Oneida Molded Plastics

David Power has a Bachelors of Science in Industrial Distribution/Industrial Engineering from Southern Tech, a MBA from Belmont University, and Trade Compliance certifications from Dunlap University. He has been in the firearms industry for over ten years and is an active competitive shooter and philanthropist serving roles such as the Board Member for the 2A Heritage Junior shooters camp, auctioneer for multiple charity events, head of evaluation team for the Industry Choice Awards, and Chief Range Officer for a multitude of competitions around the country.

David has been serving clients through Oneida Molded Plastics as the VP of sales for Outdoor products since 2010. His focus is OEM programs contract supply to a multitude of clients in the firearms and outdoor products division. As one of the largest

OEM suppliers of plastics components to the firearms industry, he has gained a wide array of knowledge as a contract supplier and handling compliance in various circumstances. Oneida Molded Plastics produces and handles numerous firearms components that include multiple stages of controlled units including hydrographic decorating processes, assembly, producing under variance, and classification determinations of new components.

Dan Rice, Director of US Ethics and Compliance, ATF, & Lottery, Walmart

Dan Rice is the Director for Alcohol, Tobacco, Firearms, Ammunition, and Lottery Compliance for Walmart, Inc. He has responsibility for compliance program strategy, design, and execution for these product lines across all Walmart stores in the U.S. This footprint includes more than 2,000 FFLs, in addition to stores selling ammunition that do not carry firearms. Mr. Rice is focused on how to operationalize a national compliance program across multiple jurisdictions, and focuses efforts on systematic and systemic controls to make compliance policies, procedures, and controls, easy to follow and execute for Walmart associates. Mr. Rice is a licensed attorney and graduated from the University of Missouri School of Law.

Cole Roberts, Director of Compliance, Hudson Manufacturing

Cole Roberts currently serves as the Director of Compliance for Hudson MFG located in Temple, Texas. The up-and-coming firearms manufacturer has seen rapid growth since being featured on the cover of RECOIL magazine and unveiling their innovative H9 pistol at SHOT show 2017.

Cole’s background in the firearms industry includes the maintenance of multiple Federal Firearms Licenses, manufacturing oversight, adherence to provisions of the Gun Control Act and National Firearms Act, acquiring and maintaining multiple marking variances, inventory control, export management, and the general interpretation of regulatory guidelines to both mitigate risk and increase efficiencies. As a member of Hudson’s founding team, he has played an active role in ERP implementation and A&D integration while working diligently to instill a healthy culture of compliance.

Prior to joining the firearms industry, Cole served President George W. Bush as an intern in the White House Office of Intergovernmental Affairs. He later assisted Congresswoman Virginia Foxx as a liaison to the Military, Department of Defense, Department of Veterans Affairs, and other key federal agencies.

Cole holds a Bachelor of Science in Political Science from East Carolina University and earned his Juris Doctor degree from Elon University School of Law.

Raymond Ruthen, Sr. Manager, International Trade Compliance, Pratt & Whitney

Ray has been involved in international trade compliance for sixteen years as a Business Area Export Representative and as a business unit export manager for the aerospace manufacturer operations and supply chain. Ray joined United Technologies Corporation in 1987 and has held positions in Engineering and Operations throughout his career. He is responsible for providing leadership and guidance for international trade compliance across the Pratt and Whitney Global Supply Chain. In this role, Ray is responsible for designing a world class ITC strategy supporting Pratt & Whitney’s global growth strategy.

Remington, Matthew focused his legal practice on the protection of 2nd Amendment liberties and served as counsel to firearms owners, manufacturers and dealers in matters pertaining to BATFE compliance, criminal defense, state and federal firearms law compliance and is an instructor on the law of self- defense and state and federal firearms laws. Working closely with private clients and firearms rights groups, Mr. Trask litigated firearms licensing, asset forfeiture and criminal defense matters in state and federal court.

Matthew served in the United States Marine Corps as an encrypted communications materials manager. With the Marines, he was responsible for the accountability of communications assets and compliance with national security regulations pertaining to the handling of classified hardware, and coordinated the deployment of encrypted communications networks in support of infantry operations.

Alexis Tunell, Operations Executive, Orchid Advisors

Alexis Tunell led the federal ATF and state firearms compliance function for EZCORP, Inc., the nation’s second largest and publicly traded pawn lender with over 700 retail locations across North America, including more than 350 FFLs. She has an

extensive background in retail firearm operations, retail store security, retail Point of Sales and electronic 4473 / A&D book development. She is recognized nationally by regulatory agencies and was an NSSF-chosen speaker at the 2017 SHOT Show University.
