2017 in Review: FCC & TCPA Telephone Consumer Protection Act (TCPA), 47 C.F.R. § 64.1200 (enacted in 1991):
Limits the use of phone calls for both telemarketing and informational purposes, particularly where communications are sent using an automated dialing system or a prerecorded artificial voice. Requires different types of consent based on type of call and phone numbers.
Change in 2013Included cell phones (calls and text messages) requiring a separate express written consent. Also added express written consent (versus express consent) for residential phones (landlines).Removal of an exemption for when there is a prior business relationships with a consumers.
Before 2013, if a FI had a preexisting relationship they were allowed to use automated dialing calls to their customers. This change has made TCPA a concern for banks and credit unions.
Change July 10, 2015Added “clarifications”, expanded definitions and new requirements. Including, expanded definition of “auto-dialer”, added text messages, addressed cell-phone number reassignments, and introduced new rules for types calls that are exempt from the general rule
