Central Valley Water Board staff that participated in the inspection included Ayda Soltani and Kim Sellards from the NPDES Compliance and Enforcement Unit, and Jeff Huggins from the Title 27/Mining Unit. effluent limit. This exceedance may be subject to mandatory minimum penalties

(MMPs). A final determination will be made at a later date.

Areas of Concerns

1. The Receiving Water Limitations, Section V.A., of the WDRs states that the discharge

shall not cause settleable substances to be present in concentrations that result in the

deposition of material that causes nuisance or adversely affects beneficial uses. In

addition, the discharge shall not cause suspended material to be present in

concentrations that cause nuisance or adversely affect beneficial uses. During the

inspection, deposited mine waste was observed at effluent sampling location EFF-001

and in the receiving water approximately 200 feet downstream of the discharge location.

These gray, fine-grained deposits are visible in Photo 8 of the attached Inspection

Report. The amount of the deposited mine waste seemed to decrease rapidly with

distance from the mine. The location where the deposited mine waste was no longer

visible could not be determined due to the heavy vegetation and steepness of the terrain

adjoining Kanaka Creek.

2. During the inspection, Board staff observed a failed berm (as shown in Attachment A,

Photo 3) adjacent to the 800-level portal of the Original Sixteen to One Mine. This failed

berm and the unpaved roads on the site are areas of concern because storm water

runoff from these roads is likely being discharged directly to Kanaka Creek. The

Discharger should implement effective perimeter sediment control Best Management

Practices (BMPs) and limit the amount of sediment migration into Kanaka Creek.

BACKGROUND The Original Sixteen to One Mine (Facility) is owned by Original Sixteen to One Mine, Inc. (Discharger), an underground hard rock gold mine in Alleghany, California. The Facility is regulated by Waste Discharge Requirements (WDRs) Order R5-2015-0002 and Time Schedule Order (TSO) R5-2015-0035 and TSO R5-2015-0035-01. On 6 April 2018, the Central Valley Regional Water Quality Control Board (Central Valley Water Board or Board) amended TSO R5-2015-0035, based on new information provided by the Discharger, and adopted TSO R5-2015-0035-01. The Facility is located on the south side of the Pliocene Ridge and on the north side of Kanaka Creek. The mine consists of about 35 miles of underground tunnels. The Facility discharges mine drainage via the 21 Tunnel Portal to Kanaka Creek, tributary to Middle Yuba River, Yuba River, Feather River, and Sacramento River, a water of the United States in the Sacramento Hydrologic Basin. Currently there is no treatment or control on the mining waste, including the mine drainage discharge from the 21 Tunnel Portal to Kanaka Creek at Discharge Point 001.

OBJECTIVE

Central Valley Water Board staff conducted an inspection of the Facility on 29 August 2018 to determine compliance with WDRs Order R5-2015-0002. Central Valley Water Board staff that participated in the inspection included Ayda Soltani and Kim Sellards from the NPDES Compliance and Enforcement Unit and Jeff Huggins from the Title 27/Mining Unit. AREAS INSPECTED

Main Office

Central Valley Water Board staff arrived at the Original Sixteen to One Mine office, where they met Michael Miller and geologist Robert Campbell. While at the main office, Michael Miller consented to Central Valley Water Board staff collecting samples from the Facility. Then Mr. Miller accompanied staff to the mine.

800 Level Portal

The group drove to 800 Level Portal and discussed the Facility’s history and current conditions: 1. The 800 Level Portal is the main access to the underground mine workings of the

Sixteen to One Mine. Mine workers, mine supplies, and equipment enter the mine at this location.

2. Mr. Miller informed staff that the mine currently operates with four employees due to the heavy cost of operating the mine. At one point in time, the mine had up to 60 employees.

3. Mr. Miller explained that the Mine’s milling operations ceased in 1999, that the mill is

inoperable at this time, and that there are no plans to resume milling in the near future.

4. Metal detectors are used for exploratory work and once ore is identified, the area is

drilled and blasted, and probable gold is collected by hand and taken to the office. Specimen gold is sold as-is, and the rest is milled by hand.

5. Currently, mine water from the lower mine workings (below the 1,500 Level) is

pumped to the 21 Tunnel, which is then discharged to Kanaka Creek at Discharge Point 001.

6. Mr. Campbell stated he has conducted a bench scale study using a passive treatment media called Metal Solve filtration system within 21 Tunnel. Mr. Campbell believes the Metal Solve filtration system can reduce the discharge of arsenic from 21 Tunnel Portal to Kanaka Creek, but the Discharger cannot afford the technology.

7. The unpaved roads down to the 800 Level Portal pose a potential risk to water quality. During the inspection, Board staff noted a failed berm (as shown in

Attachment A, Photo 3) adjacent to the 800 level portal of the Original Sixteen to

One Mine and is concerned that storm water runoff from the access road is being discharged directly to Kanaka Creek.

21 Tunnel Portal

The 21 Tunnel portal is accessed via a rugged walking trail along Kanaka Creek that leads north from the 800-Level location. Water discharging from the 21 Tunnel portal to Kanaka Creek is shown in Attachment A, Photo 8.

Inactive Settling Ponds

The group drove past the former settling pond locations and observed that the ponds were dry.

Upper Shop Area

After completing the inspection of the 800 Level Portal area, the group drove to the upper shop area. Once arriving at the upper shop area, Water Board staff observed mining waste from the mine that is reportedly being screened, then used for on-site projects or being sold for off-site use. Water Board staff is concerned that the screened and processed mining waste may pose a potential threat to water quality.

SAMPLING AND FIELD ANALYSIS

Jeff Huggins, Ayda Soltani, and Kim Sellards collected water samples from three locations: (1) from the 21 Tunnel Portal (Attachment A, Photo 8), (2) receiving water samples RSW-001, upstream of the mine’s discharge (Attachment A, Photo 9), and (3) receiving water samples

RSW-002 downstream of the mine’s discharge (Attachment A, Photo 10). The sampling locations were difficult to get to due to heavy vegetation and steep terrain. Water Board staff observed fine grain solids that had settled out of the mine waste and deposited (fine-grained materials) at the 21 Tunnel Portal as well as algae growth, as shown in Attachment A, Photo 8. At the time of inspection, it is estimated that flow from 21 Tunnel Portal was 15 gallons per minute to Kanaka Creek.

Analytical Results

The results of the effluent water samples are summarized in Tables A and B. The results of the receiving water samples RSW-001 (upstream) and RSW-002 (downstream) are provided in Table C. The effluent total suspended solids result was above the monthly average effluent limitation of 20 mg/L.

2. During the inspection, Board staff observed a failed berm (as shown in Attachment A,

Photo 3) adjacent to the 800-level portal of the Original Sixteen to One Mine. This failed

berm and the unpaved roads on the site are areas of concern because storm water

runoff from these roads is likely being discharged directly to Kanaka Creek. The

Discharger should implement effective perimeter sediment control Best Management

Practices (BMPs) and limit the amount of sediment migration into Kanaka Creek.
