CRIMINAL COMPLAINT AFFIDAVIT

I, Mario Cruz, the undersigned, of legal age, married and a resident of #123 Canciller Avenue, Cauayan City, accuses Maria Palad and Juancho Gancho of the crime of Adultery, committed as follows:

1. At around 8:30PM of Monday, February 23, 2015, I, Mario Cruz was going home from work to my house at #123 Canciller Avenue, Cauayan City;2. Upon arriving at my house, I immediately called for my wife to tell I am already home but she did not answer;3. Thinking that she went out, I then proceeded to go upstairs in our room to change;4. However, as I approach the room, I heard a strange noise coming from our room;5. I slowly tried to open the door, but it was locked. However, I used my key to open the same;6. After opening, I was shocked to see my wife Maria Palad laying in our bed with Juancho Gancho naked and in the act of committing sexual intercourse;7. I immediately rushed towards them, and punched Juancho and tried to restrain him and was able to do so;8. I immediately called the authorities, and report said incident;9. Several minutes thereafter, the police arrived, and there apprehended my wife and his paramour;10. That all these stated herein are true and were stated freely without any force or intimidation done against me. 11. To attest to the truthfulness of the foregoing, I, Mario Cruz, complainant, attaches my signature below.
