Community Development Committee Mark Baker, Chair ORDINANCE NO. 17-76 INTRODUCED BY COUNCIL AN ORDINANCE AUTHORIZING THE PROPER CITY OFFICIAL TO SUBMIT AN APPLICATION TO THE OHIO DEVELOPMENT SERVICES AGENCY FOR AN AWARD OF COMMUNITY DEVELOPMENT NEIGHBORHOOD REVITALIZATION PROGRAM FUNDS AND DECLARING AN EMERGENCY. WHEREAS, the City of Zanesville wishes to participate in, and receive financial assistance under, the 2017 CDBG Community Development Program provided through the State of Ohio, Ohio Development Services Agency (ODSA), Office of Community Development (OCD); and WHEREAS, the City is eligible for $500,000 under th e 2017 Ne ighborhood Revitalization Program (NRP) grant; and WHEREAS, the City has identified the investment area for said funds to be the Chaps Run Target Area, bound ed by Luck Ave. to the east, Dryden Rd . and Hickory St. to the south, Bailey St. to the west, and Ridge Av e. to the north (Exhibit A); and WHEREAS, the City will be committing $91,000 of its CDBG Allocation money (Ordinance 17- 75) into the Chaps Run NRP Target Area in order to augment the NRP investment in the neighborhood and help to make the NRP application stronger; and WHEREAS, the City has conducted extensive outreach to the neighbors of the Greater Brighton neighborhood to get input for the NRP grant application, includi ng two public meetings, two meetings with the Community Planning Advisory Committee (CPAC), and a survey posted on the City's website and in local media; and WHEREAS, due to del ays at the Federal level for HUD's 2017 budget, ODSA was forced to change the application window to Monday, June 19 th , 2017 through Friday, July 14 th , 2017, con sequently not allowing enough time for the full legislative process at the local level to take place and thus needing to be expedited. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Zanesville, State of Ohio, that: SECTION ONE: City Council designates the Mayor is the designated official representative of the City of Zanesville with respect to all matters relating to the application for the Community Development Block Grant assistance authori ze d by this Ordinance. SECTION TWO: The Mayor is authorized to: a) Prepare and file all documents necessary to make application to the Ohio Development Services Agency for an award of Community Development Block Grant assistance through the Fiscal Year 2016 Community Development Allocation Program; b) Certify that the City will replace all occupied and vacant occupiable low/moderate income dwelling units demolished or converted to a use other than as low/mod erate income housing as a direct result of activities assisted with funds awarded pursuant to the application as required by 24 CFR 570.496(a);

AN ORDINANCE TO AUTHORIZE AND PROMOTE ART DISPLAYS IN AND ON PUBLIC SPACES

WHEREAS, in an effort to reinforce and expand art and culture in the Zanesville Downtown area, the Community Development Department proposes to establish a program to display art in and on public spaces; and

WHEREAS, the City has created a set of guidelines that creates an application process, standards and procedures that will receive renderings from local artists at no cost to the City; and

WHEREAS, the guidelines are intended to create a true public/private partnership which will showcase local artists' works of art including, but not limited to, a painting, sculpture, monument, mural, fresco, relief, fountain, banner, mosaic, ceramic, weaving, carving and stained glass; and

WHEREAS, it is the express intent of this program to increase recognition of the Zanesville Downtown as the regional center for showcasing art; further the economics in the Downtown around art and culture, and enhance the esthetics of the Zanesville Downtown,

NOW, THEREFORE, BE IT ORDAINED by the Council ofthe City of Zanesville, State of Ohio; that

SECTION ONE: The Zanesville City Council hereby authorizes the use of public property and rights of way in the Zanesville Downtown area for the placement of art, subject to the Public Art Policy guidelines, attached as Exhibit A.

SECTION TWO: This Ordinance shall take effect upon the approval of the Mayor and from and after the earliest period allowed by law.

GUIDELINES AND POLICIES FOR ART DISPLAYS IN AND ON PUBLIC SPACES IN THE CITY OF ZANESVillE

The City of Zanesville recognizes the value of public art to its citizenry and to its visitors. In keeping with

the evolution of public art in as a crucial component in Zanesville's civic and cultural life, the City of

Zanesville intends to integrate a wide range of artworks reflecting diverse artistic disciplines and points

of view into public locations throughout the community.

In support of these ambitions, this document outlines the policy which facilitates the development of

public art throughout the City and should be utilized as a guide by the City departments while

considering the placement of public art in the City of Zanesville.

The following outline the intended purpose of the City's Public Art Policy, the acceptable criteria for

potential project types and the process by which future public art projects are to be implemented and

realized.

PURPOSE

The purpose of this policy is to ensure the following are taken into account:

• Establishing a diverse display of public artworks for the City of Zanesville and our residents;

• Creating works of public art with the cooperation of the community for which it is intended;

• Involving local artists of diverse backgrounds;

• Providing ongoing opportunities for artists to advance their art forms with temporary, and with

City Council approval, permanent public artworks;

• Considering economic development and cultural tourism as factors when advocating for the

advantages of public art;

• Fostering an understanding of public art and encouraging public dialogue;

• Incorporating art and design projects of the highest quality throughout the community, in

essence creating a museum without walls and making art accessible to all; and

• Providing a legacy of art and culture for future generations.

PUBLIC ART PROJECT TYPES

a) For the purposes of this document, works of public art may include, but need not be limited to

the following examples: b) Sculpture: in the round, bas relief, mobiles, fountains, kinetic and electronic work in any

approved material or combination of materials;

c) Painting: all media, including oils and acrylics, that are portable or permanently affixed works

such as murals;

d) Graphic arts: printmaking, drawing and banners;

e) Mosaics; including works executed in tile, glass, stone or other materials

f) Does the artwork have a connection with the surrounding community? Fabrication, Handling

and Installation

g) Are the projected costs accurate and realistic?

h) Have written estimates been obtained from qualified technical support and fabrication

contractors?

i) Does a certain site present any special obstacles to installation?

j) Can the work easily be removed if necessary?

Maintenance Requirements

a) Is the work suitable for outdoor display or special indoor environments?

b) Are the materials durable and will they last? Does the work have a limited lifespan due to built­

in obsolescence or any inherent weakness?

c) What are the existing or projected maintenance requirements of the work? Are they excessive

or cost prohibitive? Are any unusual or ongoing costs likely?

d) What are the artist's suggestions for protection of the work should it be subject to vandalism?

Liability and Safety

a) Are any aspects of the work a potential safety hazard?

b) Does the work meet building code requirements?

C) Will fencing or other types of security measures be required?

PROCESS

Public Art Project Selection Methods

One of the following selection methods may be used to select artist or artist teams for eligible public art

projects:

a) Open Invitation: Open to all qualified artists without restriction. The Artist Colony of Zanesville

(ArtCoZ) is advertised and project guidelines are published.

b) Limited Invitation/Focused Invitation: A selected group of artists is invited or are pre-selected

as candidates for a particular project or site.

c) Interest by Artist: Any artist or organization that wishes to have their artwork installed in or

on public property or right-of-way, shall submit an application to the mayor's office. The

application shall be provided by the City of Zanesville.

i. The request will be routed to the following city departments and other appropriate

boards/commissions for their review and comments: Planning, Public Service

(Engineering), Community Development (Zoning), Human Resources/ADA, and the AC.

f) Crafts: in clay, fiber and textiles, wood, metal, plastics, stained glass and other materials, both

functional and nonfunctional;

g) Photography; both digital and traditional photographic print media

h) Mixed media which may include any combination of two- and three-dimensional forms of

media, including collage;

i) Earth works, environmental installations and environmental art;

j) Decorative, ornamental or functional elements designed by practicing artists or other persons

submitting as artists, including but not limited to design professionals who are not participating

members of the City's design team for the project;

k) Light-based or luminal art: including experiential site specific or installation based work that

explores optical phenomena, work comprised of transmitted light, artificial or natural light

sources, projections or sculpture which incorporate light sources as major compositional and

expressive elements. Sound art: media with primarily aural based expressive elements which

can include electronic, audio media, found or experimental sound sources

I) Video and animation: including projected or displayed on a video monitor

m) Portable art that may be displayed at locations other than its substantially permanent location

or adjacent to the project site;

N) Temporary performance or time-based art.

CRITERIA FOR SELECTION

The following questions may be used as criteria when conducting reviews of proposed artworks as a part

ofthe selection panel process:

Aesthetic Quality and Artistic Merit

a) What has the artist accomplished with the work and does it align with the proposed project

goals?

b) Does the work under consideration have artistic merit?

c) Is the work relevant to the City of Zanesville, our values, culture and people, and does it

contribute to the fabric of the City?

d) Is the work an integral component ofthe overall project?

e) Is the work of art appropriate for the community that it serves?

Placement I Siting

a) What is the relationship of the work to the site? Is it appropriately scaled?

b) Will the work help to anchor and activate the site and enhance the surrounding area?

c) Will there be convenient public access to the site?

d) Will additional parking or access accommodations be required?

e) What are the utility requirements of the artwork?
