HON. KAREN BOBACK, member of the House of
Representatives, offered the following prayer:
Heavenly Father, Almighty God, as we gather here today
among colleagues and friends, hear our prayer. Bless our new
member-to-be, David Rowe. Enlighten him, inspire him, and
grant him courage in making decisions that will have a positive
impact on those he serves. For David and for all of us, bless those
who nourish and support our journeys. May their love and
guidance give us strength to live our convictions.
Dear God, enrich our lives and show us Your presence in one
another so we can build camaraderie and make strong the ties that
unite us. May the spirit who breaks down barriers teach us to
respect and celebrate the diversity that makes our
Commonwealth great.
And today, the first day we formally gather after Freedom
Day, may we never forget the conflicts Your children, O God,
endure in the name of peace. In remembrance of our role as a
Commonwealth and our nation and what it played on September
11th, may we memorialize those who were loved and lost, and in
their memory pray that America will forever remain one nation
under You, O God.

for the purpose of taking the oath of office.
And, Representative-elect Rowe, is there anybody – and if you
would not mind introducing them to us – any family members or
friends that you would like to be with you at the time of
swearing-in? And please, just adjust the mike and introduce them
for us.
Mr. ROWE. Thank you, Mr. Speaker.
It is a privilege and an honor to have my parents here today,
John and Sherry Rowe. It is a privilege as well to have my family,
my entire immediate family – John and Wendy Rowe, his wife;
my sisters, Rebekah Prestwich now; and my sister, Bethany
Rowe. It is also an honor to have the chairman of the Snyder
County GOP, Nick Gingrich, as well as the State
committeewoman for Snyder County, Pat Saylor.
The SPEAKER. Okay. Who will be standing with you for the
administration of the oath?
Mr. ROWE. My parents.
The SPEAKER. Parents, please come forward. Thank you.
I have the honor of introducing to you Judge Cheryl Lynn
Allen, who will be administering the oath of office today. Judge
Allen is a Pittsburgh native and former Pittsburgh public school
teacher, a graduate of Penn State University and the University
of Pittsburgh School of Law. Oh, you must have had an amazing
weekend. As you know, the judge spent 15 years practicing law
before earning a merit selection appointment to the Allegheny
County Court of Common Pleas in 1990 and then was elected to
a 10-year term in 1991 and retained in 2001, and then she was
elected to the Superior Court of Pennsylvania. And really, quite
a distinguished background – serving on the Juvenile Court
Judges' Commission and on boards, including Pittsburgh
Leadership Foundation, Hosanna House, Cornerstone Television.
She is a Waynesburg University trustee.
And we are so honored that she is here today to administer the
oath of office to our newest member-to-be. Judge, thank you.
JUDGE ALLEN. Thank you, Mr. Speaker.
And to the members of the House and family members and
friends of Representative-elect David Rowe, I am truly honored
to be here today to share this moment with you. And as I was
reflecting upon this day, I could not help but remember the
Scriptures where it states that if a man or if a person is to be great,
let him serve. In other words, greatness is not only defined by
great leadership skills but by having a servant's heart. And so it
is my prayer that you will serve not only the people of the
85th Legislative District with distinction but also the people of
the Commonwealth of Pennsylvania.
So if you will place your left hand on the Bible and raise your
hand and repeat after me: I – state your name – do solemnly swear
that I will support, obey, and defend the Constitution of the
United States and the Constitution of this Commonwealth and
that I will discharge the duties of my office with fidelity.

And thank you to Judge Allen for providing the administration
of the oath of office required by Article VI, section 3, of the
Constitution of Pennsylvania.
At this time, Representative, we are going to be calling upon
both the majority leader and the minority leader for remarks, and
then I will close with some remarks myself.
REMARKS BY MAJORITY LEADER
The SPEAKER. The Chair is going to call upon the majority
leader, our good friend and colleague, Representative Bryan
Cutler of Lancaster County, for remarks with respect to your
swearing-in. Leader.
Mr. CUTLER. Thank you, Mr. Speaker.
Congratulations, Representative Rowe. It is wonderful to have
you amongst our ranks. As many of your friends and guests will
see here today, we have the privilege of not only serving in one
of the prettiest Capitols across the country, but I would offer one
of the best because you will find amongst your colleagues here a
strong passion, sometimes disagreement, but a strong passion on
serving all of those whom we represent.
Along that line, I want to thank your friends and family. You
all played an integral role in ensuring that he got here. You also
will continue to play a very integral role as he carries out the
duties of the job. And you will be sacrificing schedules and time
as well. However, I want to encourage all of you to remember
your reason why you ran. Remember your passion, remember
what drove you, what interested you in getting here.
On swearing-in day, which the majority of us enjoyed together
and you will hopefully have that opportunity the next cycle,
I shared my own personal story of why I ran for office. And
I think it is very important to understand why we, each and every
one of us, ran for office and what drives us because it really colors
how we make decisions. If you can understand someone's reason
or their why, I think you can understand what drives them and

what their goals are. I would offer that all of us can identify the
problems, we sometimes disagree on the solutions, but it is in that
robust debate that we can hopefully find some form of
compromise.
So as we get to the business here, you will be taking your seat
shortly and casting your first official vote. I wanted to
congratulate you, and I look forward to working with you as we
go forward, learning your reasons why in terms of what drove
you to run here.
And to the family, I would ask you to continue to support him
as he carries out the duties of the office, I would offer one of the
best jobs in the Commonwealth. So good luck.
REMARKS BY DEMOCRATIC LEADER
The SPEAKER. The minority leader, Representative Frank
Dermody of Allegheny County.
Mr. DERMODY. Thank you, Mr. Speaker.
Mr. Speaker, it is fitting that our newest State legislator takes
office on September 17, the same date on which 38 delegates
meeting in the hall of Pennsylvania's State House in Philadelphia
in the year 1787, "…in Order to form a more perfect Union,…"
put their names on the United States Constitution.
So on this special day, I also would like to say, Judge Allen,
thank you for participating here today and it is good to see you
again.
Welcome to all of you, and especially the family and friends
who joined us from Snyder and Union Counties to see David
Rowe sworn in as our newest State Representative. You all
helped him get here, and you deserve to share this celebration
with him.
You know, it is always a special occasion here when the oath
is recited. The swearing-in of David Rowe, now with the
swearing-in, we now have 203 elected Representatives in the
State House of Representatives. That is a good thing for this
House, and it is especially good for the people of the 85th District
in the Susquehanna Valley to have an elected advocate in State
government, a person they chose with their vote.
Representative Rowe, congratulations on winning your
election. This is going to be a special moment in your life. You
have already served in township government, and you are
beginning a new level of service to the people in your district.
With this service comes lots of challenges and new
responsibilities; some of that you have not faced before. It will
also come with a level of personal fulfillment and satisfaction you
will be able to take pride in. You are in a position to help the
people and the communities that you serve.
And as you get to know your new colleagues and as we get to
know you, I will expect you will discover that we have many
things in common. We care about our constituents; we care about
our districts. We bring a lot of different ideas and perspectives
and experiences and insight to this job. And I believe that each
and every one of us has the same goals. We want to do the best
that we can for the people who sent us here, and we want to do
what is best for the Commonwealth of Pennsylvania.
Most people would agree that our system of government has
become very partisan in recent years. It sometimes seems like
there are more political games and posturing than there is actual
governing. To our newest member, and indeed to all of us in this
House, I suggest that it is a good time to tone down the
partisanship and focus ourselves on getting things done in the
time we have to work here together. If we can find ways to do
that, we stand a much better chance of keeping our State, our
schools, our communities, and our institutions on the right track.
We are all here to serve the common interests of the people of
Pennsylvania.
So in that spirit, I look forward to working together with you.
Once again congratulations on beginning your service here.

REMARKS BY SPEAKER
The SPEAKER. Representative Rowe, on behalf of each and
every member in the Pennsylvania House of Representatives, we
welcome you to this august body.
As my good friend and colleague noted – and we served as
prosecutors together in Allegheny County – today is Constitution
Day. I think it is interesting to note not only in 1787 did these
great 39 individuals meet to sign the United States Constitution,
but that that happened in our Commonwealth in Philadelphia and
in the building that our predecessors actually served in. Many
people forget or do not know that Independence Hall was the
home of the Pennsylvania Provincial and then General Assembly,
of which we are the direct descendants. From 1732 when it was
first begun to be built up to and through 1799, it served as the
Capitol for the Colony and then the State of Pennsylvania.
William Penn in fact started the Provincial Assembly, and you
can see his portrait right here in the middle of the Apotheosis and
then also to my right, your left, in the painting that depicts his
treaty with the Delaware Indians. He comes here in 1682 to found
a colony of religious tolerance, he being a Quaker, and it predated
the formation of the United States of America through its
Constitution by more than 100 years. You are serving today in
that body.
You yourself have been a public servant in your community
for more than a decade. You have been an active leader, serving
as vice chair of the East Buffalo Board of Supervisors; a member
of the Capital Campaign Council for an important health-care
entity, the Evangelical Community Hospital. You were director
of the Central Susquehanna Fire and Emergency Services board
and a commissioner of the Buffalo Valley Regional Police
Department. You are an active member of New Hope Lutheran
Brethren Church in East Buffalo Township and a leader of its
music ministry. And I know that you are an entrepreneur and a
business owner who takes care of customers and has many
employees operating CrossFit Lewisburg. All of these are so
crucial. You are a member of the community and an active citizen
in the Commonwealth of Pennsylvania.
Following 2 years of Christian ministry work as an educator
in Southeast Asia, you actually attended National Sun Yat-sen
University in Taiwan and participated in its Mandarin Chinese
immersion study program. You are a person that actually reaches
beyond your community to get to know people of all backgrounds
and faiths and cultures. How exciting for the local community in
Snyder and Union Counties to have you now be their State
Representative.

(f) Court filing.–Upon filing with the appropriate court of
common pleas of a complaint for ejectment supported by an owner or
authorized agent affidavit alleging unlawful occupancy and a motion
for emergency preliminary injunction, the court shall schedule an
emergency hearing within the time period necessitated by the
circumstances presented or applicable court procedures.
(g) Residential lease fraud victims.–Upon receiving information
that an alleged unlawful occupant is a residential lease fraud victim, the
law enforcement agent shall notify the victim in writing that the victim
cannot legally remain in the residence and must make arrangements to
move out within 30 days or other time period as is necessitated by the
circumstances presented or applicable directive.
(h) Mandated report.–A police officer conducting an
investigation under this section shall make an incident report, and other
reports as prescribed by law enforcement directive, which shall
include, but not be limited to:
(1) the parties involved and any verifiable identification
provided or lack thereof;
(2) the facts as alleged by the respective parties;
(3) any visual or other observations made by the officer
that support statements made by any party; and
(4) any documentation concerning the alleged existence
of a lease or other agreement concerning the current living
arrangements or ownership of the property.
(i) Definitions.–As used in this section, the following words and
phrases shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Residential property." A dwelling intended for human
habitation, including a house, apartment, mobile home or manufactured
home.
"Unlawful occupant." A person who is not an owner of the
subject residential property, is not a victim of domestic violence, sexual
harassment or stalking perpetrated by an owner of the property or by
another person who is or had recently lived with the victim in the
residential property and who occupies the residential property without
one of the following:
(1) title, including by adverse possession, of the
residential property under Pennsylvania law;
(2) permission of an owner of the residential property, a
prior owner of the residential property with legal authority to
grant permission at the time it was granted, a tenant of the
residential property with legal authority to grant permission at
the time it was granted or an authorized agent of any individual
listed under this paragraph;
(3) other interaction with an owner of the residential
property, a prior owner of the residential property, or an agent of
either, that would indicate a relationship recognized as a
landlord-tenant relationship pursuant to the act of April 6, 1951
(P.L.69, No.20), known as The Landlord and Tenant Act of
1951;
(4) the payment of a deposit, rent or rent substitute to an
individual whom the person believes in reasonable good faith is
either an owner of the residential property or has the authority to
rent the property; or
(5) other legal claim to reside in the residential property,
including a claim to legal or equitable title of the residential
property, including, but not limited to, a claim asserted by:
(i) a former owner of a residential property sold
at tax sale claiming a right to redeem before the end of
the redemption period under Pennsylvania law;
(ii) an individual who is a buyer of the
residential property under an installment sales contract;
(iii) an individual to whom the property has been
conveyed pursuant to an unrecorded deed; or
(iv) an individual with a right to reside in the
residential property under the Protecting Tenants at
Foreclosure Act of 2009 (Public Law 111-22, 123 Stat.
1660).

We had concerns raised with this bill from constituent
organizations, Community Legal Services, and the Philadelphia
Bar Association. Those concerns related to the due process that
occurs in this bill with—

So the concerns with this bill revolve around due process and
the fact that police are making a life-changing decision right at
someone's door. Currently that is a process that is handled
through the courts, and that is something that our constituent
organizations had a concern with.
We are also going to be subjecting some very vulnerable
populations – domestic violence survivors and people with
tangled titles, and frankly, some legitimate tenants in this bill –

and I appreciate that the maker of the bill has offered an
amendment that does improve the bill and does provide for
tenants' rights, but there is more work to be done on it and in
particular protecting victims of domestic violence, protecting
people whose tangled titles tangle up their lives, and we have got
to be able to get this bill right.

The SPEAKER. Representative Dan Moul is recognized on
unanimous consent.
Mr. MOUL. Thank you, Mr. Speaker.
The SPEAKER. Members, if you could, please turn your
attention to our colleague, Representative Dan Moul, who is
recognized on unanimous consent.
Mr. MOUL. Thank you, Mr. Speaker.
Ladies and gentlemen, about 3 weeks ago my father passed
away, and it was quite a solemn time for our family, very sad
time. He lived to be 91 1/2 years old. He did have a good life.
I was with him when he took his last breath, and he watched me
take my first.
But the reason I am standing in front of you today is the
outpouring of sympathy and condolences – phone calls, letters –
that came from this body was so overwhelming I did not know
what to say. Actually, the first day they started coming in, I made
a list and I was going to go around and shake those people's hands
and say thank you very much, I appreciate it. But from both sides
– this aisle disappeared in that time, it totally disappeared –
I received literally over 100 from this body, and I could not get
around to seeing each and every one of you, so I personally

wanted to get up here and say to my family, thank you so much
for your condolences and your sympathies in our time.

Mr. Speaker, it is my privilege to bring to the attention of the Speaker
and the members of the Pennsylvania House of Representatives the name
of Luke Eric Andre, who has been awarded Scouting's highest honor –
Eagle Scout.
Mr. Speaker, I would like to read to the members of the House of
Representatives the following citation of merit honoring Luke Eric
Andre.
Whereas, Luke Eric Andre earned the Eagle Award in Scouting. This
is the highest award that Boy Scouts can bestow and as such represents
great sacrifice and tremendous effort on the part of this young man. Luke
is a member of Troop 5.
Now therefore, Mr. Speaker and the members of the House of
Representatives, it is my privilege to congratulate and place in the
Legislative Journal the name of Luke Eric Andre.

The last time I stood at this podium to make an announcement
of this sort, I was wearing a light-pink tie. Today I am wearing a
light-blue tie. I am pleased to bring good news from the Gabler
household. On August 27 we welcomed a little boy to our
household, Sebastian Michael arrived. He was 7 pounds
5 ounces, 20 inches long. Thank you. The entire family is happy
and healthy. Big sister, Caroline, is very proud. And I want to
especially thank my wife for being the strongest person I know.
