The c o u r t ' s r u l i n g was based upon t h e f a c t t h a t C o n g r e s s g a v e TVA t h e power t o set t h e r e t a i l ra te fo r a l l c u s t o m e r s who p u r c h a s e e l ec t r i c i ty from TVA u n d e r a w h o l e s a l e c o n t r a c t . The power of t h e f e d e r a l gove rnmen t t o s e t t h e r e t a i l r a t e f o r t h e s e u t i l i t i e s t a k e s p r e c e d e n c e o v e r t h e power o f t h e s t a t e t o l i k e w i s e se t t h e rate. I n January o f t h i s y e a r , t h e PSC r e c e i v e d c o r r e s p o n d e n c e from TVA s t a t i n g t h a t i t was T V A ' s b e l i e f t h a t t h e p r i n c i p l e e n u n c i a t e d i n t h e 1979 f e d e r a l c o u r t d e c i s i o n would a p p l y t o s e r v i c e as w e l l a s rates. TVA t h u s c o n t e n d s t h a t none of i t s w h o l e s a l e customers o p e r a t i n g i n Kentucky are subject t o any of t h e PSC's r e g u l a t i o n s g o v e r n i n g t h e p r o v i s i o n of e l ec t r i ca l s e r v i c e t o c u s t o m e r s . The PSC h a s c o n s i d e r e d t h i s matter and it is our c o n c l u s i o n t h a t TVA i s r i g h t o n t h i s p o i n t and t h a t federa l r a t h e r t h a n s t a t e law g o v e r n s t h e s e r v i c e a s w e l l as t h e ra tes of a l l TVA-supplied u t i l i t i e s . A. Thermostats on heating and cooling equipment in office and shops will be set to published desired settings of TVA. All unoccupied areas will be closed off if possible and unheated or uncooled.

B. Cut off outside lighting except for security purposes. Reduce lighting to minimum in office and work areas.

When notified by TVA, normal operating conditions and power use will be resumed.

West Kentucky Rural Electric Cooperative Corpora- tion will encourage voluntary load reduction by all consumers through announcements over the local news media.

Interruption of Firm Load Upon notification by TVA we will interrupt firm load on a rotational. basis by opening feed circuits from district substations or by opening reclosers and switches from lines feeding emergency facilities. Load reduction shall be implemented by de-energizing circuits for two (2) hours then re-energizing for four (4) hours. West Kentucky Rural Electric Cooperative Corpora- tion shall take measures so that service to essen- tial loads, such as pumping stations, police and fire stations, radio stations, airports and others, can be maintained for public health and safety to an extent that is practicable. The load Curtailment Program will be divided into six districts of implementation as listed below:
