I. OVERVIEW

The Committee on Labor, the Public Structure, Public Libraries, and Technology convened the public hearing on February 12, 2010 at 1:30 am in I Liheslatura's Public Hearing Room. Among the items on the agenda was the consideration of Bill 217-30 (LS) as substituted by the Committee- An act to a new §23112 to Chapter 23 of SGCA relative to the requiring the posting of travel itineraries on agency's website. - By: Ray Tenorio, E.B. Calvo, and A.B. Palacios Sr.

Public Hearing Requirements Notices of the hearing were disseminated via facsimile and email to all senators and all main media broadcasting outlets on February 4, 2010 (5-day Notice) and on February 9, 2010 (48-Hour notice)pursuant to meeting the requirements of the Open Government Law. Notice of the hearing was also posted on the Guam Legislature's website.

II. SUMMARY OF TESTIMONIES Interim Chairman Adolpho B. Palacios, Sr. called the Committee on Labor, the Public Structure, Libraries, and Technology to order at 1:30pm, welcomed and introduced Senators present.

Chairman Palacios then allowed the author of the bill, Senator Ray Tenorio, who gave a brief presentation of the bill.

Chairman Palacios reads written testimony submitted from Elizabeth Gayle P.E. member of the Guam PEALS board.

Chairman Palacios called those who are present to testify.

Captain Steve Ignacio, Guam Police Department introduces himself and thanks the senators in attendance for giving him an opportunity to testify on Bill No. 217-30. Captain Ignacio states that he is in support of the intent of the bill, but he has concerns about law enforcement officers posting their travels online. Captain Ignacio's concerns for law enforcement officers posting their travels is; 1 put the officer in danger when they are doing an ongoing-investigation, 2 officers who go undercover, example narcotics officers, subjecting them to these rules will pose a threat to the officer and his/her family and the investigation, and 3 confidentiality of training has to be protected.

Senator Tenorio states, that he is working with his staff right now to have exemption language to criminal investigations on this bill. Senator Tenorio states that he too has had training before in law enforcement, he can see in cases for training in the F.B.I., C.I.D. or Drug interdiction cannot be seen in the public view. Senator Tenorio states that we do not want to deal with cases where someone who is computer savvy and go on the internet and use this information to go after a victim, a witness, or a suspect before law enforcement officers can close the case.

Chairman Palacios allowed Senators to give comments and/or questions.

Senator Taitague states that the author's intent of the bill was having transparency, and that she believes in his intent.

Captain Steve Ignacio, Guam Police Department states that his concerns how this can be a problem is that they will have to disclose the information of where did they come from and purpose. Captain Ignacio uses and example if one of the judges whom gives a verdict on a case in which the defendants family do not agree, they can use that information given in the internet and maybe do retaliation, or in cases of burglary they can use that information when no one is at home and break in. Captain Ignacio states

that his primary concern and purpose was putting names of officers whom are doing ongoing criminal investigations. He explains that these officers are also attached to the federal offices F.B.I., D.E.A., U.S. Customs, I believe that they do not want the public to know that these task force officers are traveling doing work on their behave.

Senator Taitague stated that she also had some concerns and that she supports the intent of the bill which is always good.

Chairman Palacios states that this bill has a purpose and it was for any ordinary government of Guam officials that can travel, the purpose for the public to know where they are, where they are going, and what are they doing. Chairman Palacios express that maybe new language in the bill should exempt all investigatory, public safety, and transportation of prisoners.

Senator Tenorio says that he doesn't want to create an umbrella where certain agencies do not have any requirements.

Chairman Palacios ends the public hearing and that Bill 217 is dully heard.

Chairman Palacios concluded the hearing and requested that written testimony be submitted within the next ten (10) days. He adjourned the hearing at 4:05pm.

Elizabeth Gayle is a professional civil engineer and an appointed member of the Guam Board of Registration for Professional Engineers, Architects and Land Surveyors (Guam PEALS Board) since 2003. 5 itineraries of all travelers covered by this Chapter, unless exempted, shall be posted

6 on the internet.

7 (a) The itineraries shall include (1) the date of departure (2) the destination

8 city(ies), (3) the purpose of the such travel and the intended date of return.

9 (b) For elected officials, agency heads and deputy agency heads, board and

10 commission members, judges and justices, the itineraries shall be posted not

11 less than twenty-four (24) hours prior to departure. For all other travelers,

12 the itineraries shall be posted no later than ten ( 10) days, Saturdays,

13 Sunday's and Government of Guam holidays excepted, following the return

14 of the traveler."

15 (c) This Section shall not apply to ( 1) persons traveling at government

16 expense for medical purposes or those accompanying a person traveling for

1 medical purposes and (2) inmates/ detainees that are being transported at

2 government expense and (3) travel by investigatory personnel as part of a

3 criminal investigation.

Written Testimony

Bill No. 217-30: An Act to Add a §23112 to Chapter23 to SGCA Relative to Requiring the Posting of Travel Itineraries on Agency's Website.

Dear Mr. Chairman,

I am Elizabeth Gayle, a professional civil engineer and an appointed member of the Guam Board of Registration for Professional Engineers, Architects and Land Surveyors (Guam PEALS Board) since 2003. I served as PEALS Chairwoman from 2003 to 2005.

I am a full time civil engineer working for a private engineering firm on Guam, not a GovGuam employee. As a PEALS board member, I am paid a nominal stipend for attending PEALS meetings, but I am not paid for hours spent on PEALS related business outside of the board meetings (such as disciplinary hearings, public hearings, etc).

The bill, as drafted, raises some fundamental questions that need clarification.

Bill 217-30 does not specify what types of travel are subject to the Act. Does the bill apply only to government funded travel? Or does it also apply to personal and/or (non­PEALS) business-related travel?

I am opposed to the Bill if I must post all my travels, including my non-PEALS-business and/or personal travel. On a professional level, my business travel may take me to the US mainland or foreign countries, where clients may require confidentiality. If I were to post my business travel itinerary, even if it's just the destination and dates as required by Bill 217-30, my business competitors could surmise my travel purpose and undermine any business opportunities I was seeking.

As a result of the terrorist attacks on the U.S. on 9/11, I am required to follow specific security measures for travel associated with federal projects. All security training and briefings I have had in recent years have always discouraged the dissemination of travel information to non-family and non-business acquaintances. Posting of travel dates and destinations on the internet would undermine these security requirements.

On a personal level, I am opposed to posting ANY travel information on the PEALS' website for my own personal security reasons. Recent burglaries of Hollywood stars such as Paris Hilton, Lindsay Lohan and others were allegedly done by a burglary ring whose members were able to determine when the stars would be away from their homes based on information gathered on the internet. While I do not profess to be anything

close to a Hollywood star, posting my travel itinerary on the internet could be used by potential burglars on Guam. Anyone will be able to determine when I would be off­island and my house potentially left empty if I were required to post my travel itinerary online, whether the travel was Government-related or not. My street address is included in the telephone book, so it would not be difficult for a burglar to break into my house while I am away.

I encourage all legislators to seriously think about the possible consequences of posting such information on the web because unscrupulous individuals will definitely take advantage of such personal information.

I trust that you will consider these concerns carefully before passing this bill as introduced.

BILL NO: 217-30 (LS) AN ACT TO ADD A §23112 TO CHAPTER 23 of SGCA RELATIVE TO THE REQUIRING THE POSTING OF TRAVEL ITENIRARIES ON AGENCY'S WEBSITE.

RAMIFICATIONS/IMPLICATIONS/ISSUES/HIGHLIGHTS: 1. Bill intends to require the posting of travel itineraries on the Agency's website.

The following officials are required to post their travel itineraries on the respective agency's website: elected officials, agency heads and deputy agency heads, board and commission members, judges and justices. The itineraries shall be posted not less than twenty-four (24) hours prior to departure. A section of the bill does not apply to the following: persons traveling at government expense for medical purposes or those accompanying a person traveling for medical purposes and inmates/detainees that are being transported at government expense.

REMARKS: A public hearing will be held on Friday, February 12, 2010 beginning at 1:30p.m. at the Guam Legislature's Public Hearing Room. A copy of this bill is available at http://www.guamlegislature.com/30th bills intro.htm or my office can fax a copy to you. Written testimony may be submitted to [email protected] or fax: to 472-5022 on or before the public hearing date. After the public hearing, you may submit or fax your testimony to my office for up to 1 0 days after the hearing. I would appreciate any comments you can provide. BILL NO: 217-30 (LS) AN ACT TO ADD A §23112 TO CHAPTER 23 of SGCA RELATIVE TO THE REQUIRING THE POSTING OF TRAVEL ITENIRARIES ON AGENCY'S WEBSITE.

RAMIFICATIONS/IMPLICATIONS/ISSUES/HIGHLIGHTS: 1. Bill intends to require the posting of travel itineraries on the Agency's website.

The following officials are required to post their travel itineraries on the respective agency's website: elected officials, agency heads and deputy agency heads, board and commission members, judges and justices. The itineraries shall be posted not less than twenty-four (24) hours prior to departure. A section of the bill does not apply to the following: persons traveling at government expense for medical purposes or those accompanying a person traveling for medical purposes and inmates/detainees that are being transported at government expense.

REMARKS: A public hearing will be held on Friday, February 12, 2010 beginning at 1:30p.m. at the Guam Legislature's Public Hearing Room. A copy of this bill is available at http://www.guamlegislature.com/30th bills intro.htm or my office can fax a copy to you. Written testimony may be submitted to [email protected] or fax: to 472-5022 on or before the public hearing date. After the public hearing, you may submit or fax your testimony to my office for up to 10 days after the hearing. I would appreciate any comments you can provide. Your comments would be very helpful to me when this Bill comes up for Legislative debate on whether to pass the Bill or not.
