Fortification: a structure or device that alone, or as part of a system, is designed to stop or hinderuninvitedentry.
Seriouscriminalactivity:conductconstitutinganindictableoffencewherethemaximumpenaltyisatleast7yearsimprisonment
Recognisedoffender:anadultwitharecordedconviction(otherthanaspentconviction)foranindictableoffencepunishablebyatleast5yearsimprisonmentoranotheroffenceprescribedundersection77oftheCriminalCode(FactSheetseries2liststheprescribedoffences).
Associateofarecognisedoffender:apersontowhomanofficialconsortingwarninghasbeengivenunderthePolicePowersandResponsibilitiesAct2000.
Participantinacriminalorganisation:asdefinedundersections161N(intermsof‘criminalorganisation’)and161P(intermsof‘participant’)ofthePenaltiesandSentencesAct1992.
Disorderlyactivity:
a) drunkenness,disorderlyorindecentconductorentertainmentofademoralisingcharacter;orb) unlawfulsupplyofliquorordrugsfromthepremises;orc) unlawfulpossessionatorsupplyfromthepremisesoffirearmsofexplosives;ord) thepresenceofrecognisedoffenders,associatesofrecognisedoffenders,orpersonssubjectto
controlordersonthepremises;ore) participationofrecognisedoffenders,associatesofrecognisedoffenders,orpersonssubjectto
controlordersinthemanagementorcontrolofthepremises.

fortificationsatapremises.

WHATISTHETESTFORTHEORDER:TheCourtmaymaketheorderifsatisfiedthat:
a) thepremiseshaveafortification;andb) thefortifiedpremisesareeither:
i. being,havebeen,orlikelytobeusedforor inconnectionwithseriouscriminalactivity,ortoconcealevidenceofortokeepproceedsofseriouscriminalactivity;or
ii. ownedorhabituallyoccupiedorusedbyacriminalorganisation(orparticipants), recognisedoffendersorassociatesofrecognisedoffenders;and
c) thenatureofthefortificationisexcessiveforlawfuluseofthattypeatthepremises;andd) makingtheorderisappropriateinthecircumstances.
WHATARETHECONDITIONSOFTHEORDER:Theordermayrequiretherespondenttoremoveormodifythefortificationwithinastatedperiod.
CONSEQUENCESOFTHEORDER
Itisanindictableoffenceforapersontointentionallyhindertheremovalormodificationof
thefortification/s.
Maximumpenalty:5yearsimprisonment.
Whatpowersdothepolicehave?
POLICECANENFORCETHEORDER:
Policehavebroadpowerstoenterapremisesandremoveormodifythefortificationswithforceand
assistance.
TheStatemaybeabletorecovercompensationforanyreasonablecostsincurredintakingthis
enforcementaction.
FORFEITURE:TheCommissionerofPolicemayforfeitanyremovedfortificationstotheState.

AstopanddesistnoticecanbeissuedbyPolicetostoptheinstallationofexcessivefortificationatapremisesuntilanapplicationforaFortificationRemovalOrderismade(seeFactSheet5A).

ACommissionedPoliceOfficercanissueastopanddesistnoticeiftheyreasonablebelievethat:
a) Stepsarebeingtakentoinstallexcessivefortificationatthepremises;andb) Thepremisesareeither:
i. being,havebeen,orlikelytobeusedfororinconnectionwithseriouscriminalactivity,ortoconcealevidenceofortokeepproceedsofseriouscriminalactivity;or
ii. ownedorhabituallyoccupiedorusedbyacriminalorganisation (orparticipants), recognisedoffendersorassociatesofrecognisedoffenders.
HOWLONGDOESTHENOTICELAST?14daysunlessanapplicationforaFortificationRemovalOrderismadetotheMagistratesCourt(seeFactSheet5A).
WHATARETHECONSEQUENCESOFTHENOTICE?
Policecanmakeafortificationremovalorderapplication.
Thecommissionedpoliceofficerhas14daystolodgeanapplicationforafortificationremovalorder.Onceanapplicationismade,thestopanddesistnoticeremainsonfootuntilthehearingofthefortificationremovalorderapplication.
Ifnoapplicationislodgedthenoticewilllapse.
Iftherespondentdoesnotstopanddesistfrominstallingthefortificationthiswillbeevidencethatthegroundsforafortificationremovalorderaremadeout(unlessprovenotherwise)andanorderwillfollow.
NON-COMPLIANCEWITHTHENOTICE
Thebreachofthestopanddesistnoticewillbeevidenceof‘disorderlyactivities’inanapplicationforarestrictedpremisesorder(seeFactSheets3A-C.
