Casinos statewide reported $61.1 million in AGP in November, up 7.8 percent from $56.7 million in November 2008, but down 1.0 percent from $61.7 million in October. For the first five months since the implementation of Amendment 50, casino revenues are up 8.5 percent over the same period in 2008. Black Hawk’s 18 casinos again fueled the increase in November, producing $45.8 million in AGP during the month, up 13.0 percent from $40.5 million in November 2008 and up slightly from $45.4 million in October. Cripple Creek’s 16 casinos generated $10.3 million in AGP in November, down 5.3 from $10.9 million in November 2008 and down 7.2 percent from $11.1 million in October. Central City’s six casinos totaled $4.9 million in AGP in November, down 4.7 percent from $5.2 million in November 2008 and down 3.2 percent from $5.1 million in October. Casinos statewide paid $9.2 million in gaming tax proceeds in November, up from $8.6 million in October. The Division of Gaming is on the move—at least looking at this time to be on the move. We are looking at possible sites in the Golden area to move our Lakewood headquarters office. We are focusing on Golden because it provides staff with better access to Central City and Black Hawk, as well as to Cripple Creek through the “back way” up Highway 285 to Highway 67. It should also be a more convenient location for most of our gaming license applicants. We are aware that people may ask why we would move from a “paid for” facility to a leased facility, especially given the State budget crisis. While the State owns the Pierce Street building, we still have to pay for maintenance. Additionally, we are in the process of closing on the purchase of the building that houses our Cripple Creek office. Once that is finalized, we will no longer be paying lease on that facility. We are striving to keep relocation costs to a minimum, and the combined cost savings from the Pierce maintenance and the Cripple Creek lease will be a tremendous help. The move would be a win-win proposition not only for us, but for the Department of Revenue as well. With additional staff for Amendment 50 and the moving of audit staff from our Central City office to Lakewood, we have outgrown our office space. Other DOR divisions in the Pierce building are experiencing similar space issues. Our move would give them space in which to expand. Ironically, the main reason we moved into the Pierce building 13 years ago was because Motor Vehicle could not occupy enough space.     Philip Baca Appointedas New Commissioner

    Gov. Bill Ritter has appointedPhilip Baca to serve as the law en-forcement member of the GamingCommission. He replaces JimAlderden, whose second term endedon June 30, but continued to serveuntil Baca’s appointment.

    Baca, a graduate of the FBI Na-tional Acedemy, is the chief of po-lice for Commerce City. He beganhis law enforcement career in 1974with the Denver County Sheriff’sDepartment and a year later joinedthe Denver Police Department,where he reached the rank of lieu-tenant. In 1990, he left law enforce-ment to join the legal professionafter earning his juris doctorate fromthe University of Denver. He prac-ticed law until becoming the lawenforcement academy director of theColorado Sheriff’s Training Insti-tute in 1998. He then joined theJefferson County Sheriff’s Office in2000, where he became the divisionchief of the criminal investigationssection before being named Com-merce City police chief in 2008.

    Commission ActionAt its meeting on Jan. 21 in Lake-

    wood, the Gaming Commission:• Renewed the retail license of

    Johnny Nolon’s Casino• Approved stipulations and

    agreements between the Division ofGaming and Aristocrat Technolo-gies Inc., resulting in a $7,500 fine,and between the Division andGolden Gates Casino, resulting in a$25,000 fine

    December Caps Up-Down YearColorado casinos finished an up-and-down year on a high note in December.

    Casinos statewide reported nearly $734.6 million in AGP in 2009, up 2.6 percentfrom $715.8 million in calendar 2008. The year ended with increasing revenues inDecember. For the month, casinos posted $55.4 million in AGP, up 14.0 percent from$48.6 million in December 2008, but down 9.4 percent from $61.1 million inNovember.

    During the first six months of the year, casino revenues were down 3.9 percent overthe first half of 2008. Over the final six months after the implementation ofAmendment 50 on July 2, revenues were up 9.2 percent.

    Black Hawk’s 20 casinos generated $529.9 million in AGP in 2009, up 4.2 percentfrom $508.6 million in 2008. Cripple Creek’s 16 casinos produced $140.3 millionin AGP in 2009, up 0.2 percent from $140.0 million the previous year. Central City’ssix casinos totaled $64.2 million in AGP in 2009, down 4.3 percent from $67.1million in 2008.

    In December, Black Hawk casinos reported $41.4 million in AGP ($35.4 millionin December 2008); Cripple Creek casinos, $9.5 million ($8.8 million); and CentralCity casinos, $4.5 million ($4.3 million). Casinos statewide paid $8.6 million ingaming tax proceeds in December.

    Commission OKsRegulation Changes

    The Colorado Limited GamingControl Commission on Feb. 18 ap-proved a series of rule changes.

    The most notable is the reductionof the allowable minimum odds forthe payment of blackjack wins from“three to two” to “six to five.” Underthe rules, casinos can still offerhigher odds than six to five.

    The rule changes also include,among others:

    • The option to offer match playcoupons on all table games, includ-ing specifications for coupons thatare redeemable for chips

    • The option for hardways to beactive on the come out roll in crapsif allowed by house rules

    • The option to charge vigors onbuy and lay bets rather than requir-ing them

    The changes will go into effectApril 30.

    Commission ActionAt its meeting on Feb. 18 in Lake-

    wood, the Gaming Commission:• Renewed the manufacturer/

    distributor and operator licenses ofWMS Gaming, Inc.

    • Approved a change of owner-ship in Atronic Americas, LLC

    • Issued new manufacturer/dis-tributor and operator licenses toSpeilo Manufacturing, ULC

    New Year Starts PositivelyColorado casinos started the new year positively in January. Casinos statewide

    reported $64.2 million in AGP in January, up 11.7 percent from $57.5 million inJanuary 2009 and up 16.0 percent from $55.4 million in December.

    Black Hawk’s 20 casinos produced $48.2 million in AGP in January, up 16.0percent from $41.5 million in January 2009 and up 16.5 percent from $41.4 millionin December. Cripple Creek’s 16 casinos totaled $10.8 million in AGP in January,up 1.3 percent from $10.7 million the previous January and up 13.9 percent from $9.5million in December. Central City’s six casinos generated $5.2 million in AGP inJanuary, even with January 2009 but up 15.6 percent from $4.5 million the previousmonth.

    Casinos statewide paid $10.4 million in gaming tax proceeds in January, up from$8.6 million in December.

    For the first seven months of the fiscal year starting in July after the implementationof Amendment 50, AGP is up 9.6 percent and tax revenues have increased by 17.1percent compared to the first seven months of fiscal year 2009.

    No Gaming Commission action in recent memory has stirredmore public discussion than the Commission’s considerationand approval on February 18 of rule changes that lower the oddson blackjacks from 3-to-2 to 6-to-5.

    Unfortunately, that is how many people interpret theCommission’s action. In fact, the rule changes lowered the allowable minimumodds on blackjacks from 3-to-2 to 6-to-5. There is a big difference. StartingApril 30, when the new rules go into effect, casinos can lower the odds, but manywill choose not to. Starting then, casinos can offer 6-to-5 single-deck pitchblackjack, a variation that casinos have chosen not to offer in the past becauseof the current 3-to-2 minimum odds.

    Lost in the discourse regarding the rule changes was the fact that the changeswere more about choice than they were about odds. As a Division, we had tochoose whether to take the industry’s request for a rule change to the Commission.Although we remained neutral, we took the proposed changes before theCommission because there was no legal reason why they should not beapproved. The Commission then chose to approve them because the rulechanges were permissive and not mandatory.

    Now the choice rests with the casinos. They can choose to offer 3-to-2 or 6-to-5 on all games or no games or only single-deck games. The combinations areendless. Finally, the choice will fall upon the casino patrons, who will decidewhich games at which odds they will play. Again, this decision was ultimatelyabout choice, and the market will ultimately decide.

    ICMP Changes toBe Effective April 30

    The Division of Gaming hasposted proposed changes to theInternal Control Minimum Proce-dures (ICMPs) to go into effectApril 30. The proposed changesare available on the Division’s website, with a link from the currentICMP page. Industry comment onthe proposed changes ends onMarch 26. The ICMP changes cor-relate with rule changes approvedby the Commission in February.

    Offices to be ClosedFor Furlough Day

    All three Division of Gamingoffices will be closed Friday, April2 for a State mandatory furloughday. The closings will be the sev-enth of eight mandatory furloughdays for the fiscal year. The lastfurlough day will be Friday, May28.

    Tax Hearings SetThe Gaming Commission’s an-

    nual tax setting hearings to deter-mine the gaming tax rate for Fis-cal Year 2011 starting July 1 willcommence on Thursday, April 15and continue on Thursday, May20. Both hearings will be held atthe Division’s Lakewood office.

    Commission ActionAt its meeting on Feb. 18 in

    Lakewood, the Gaming Commis-sion:

    • Renewed the manufacturer/distributor license of Paltronics,Inc.

    AGP Grows Slowly in FebruaryA short month resulted in shorter revenues at Colorado casinos in February.

    Casinos statewide reported nearly $58.7 million in AGP in February, up 2.5 percentfrom $57.2 million in February 2009, but down 8.7 percent from $64.2 million inJanuary. The 2.5 annual percent growth rate was the second lowest since theinception of Amendment 50 in July. Revenues in August grew by 2.1 percent.Overall, revenues have increased 8.7 percent since the implementation of Amendment50.

    Black Hawk’s 20 casinos totaled nearly $43.6 million in AGP in February, up 5.9percent from $41.1 million in February 2009, but down 9.6 percent from $48.2million in January. Cripple Creek’s 16 casinos generated $9.9 million in AGP inFebruary, down 9.5 percent from $11.0 million the previous February and down 7.9percent from $10.8 million in January. Central City’s six casinos produced $5.1million in AGP in February, up 1.1 percent from $5.0 million in February 2009, butdown 1.9 percent from $5.2 million the previous month.

    Casinos statewide paid $9.9 million in gaming tax proceeds in February, downfrom $10.4 million in January.

    Normally at this time of year I would provide updates onpending or approved legislation affecting the Division of Gamingand the casino industry. This year, if you search for the word“gaming” in the text of legislative bills, you will find a list ofsupplemental appropriation and distribution bills affecting theState agencies and funds that receive the General Fund share of the LimitedGaming Fund. You will also find an amendment to the Colorado RegionalTourism Act passed last year that exempts facilities that offer “gambling-related activities” from receiving funding under the act.

    That’s the extent of legislation related to “gaming.” That doesn’t mean thatthe legislature is ignoring the Division or the industry entirely. We continue toreceive inquiries from legislative staff and others, asking for the latest distributionprojections as the legislature and State agencies continue to look for ways tomake up for budget shortfalls. One measure to help balance the State budget isto carve out more than $15 million from the General Fund share of the LimitedGaming Fund.

    Although we would like to be able to look into the crystal ball and give anexact figure after seven months of revenues, it is still too early to say what thefinal numbers will be. If we were to use the year-to-date increase in tax revenuesat the end of January, the figure would have been 17.1 percent. At the end ofFebruary, it was 15.1 percent. Anyone willing to give a best guess estimate whatit will be at the end of June? I am not.

    The Gaming Commission on April15 approved budget requests for FY2011 for the Division of Gaming,$10,071,796; the Colorado Bureauof Investigations, $833,492;Colorado State Patrol, $2,240,597;the Division of Fire Safety,$173,255; and Dept. of LocalAffairs, $151,516. The Commissiontabled until the May meeting adecision on whether to fund anadditional $454,729 for fouradditional FTE for the ColoradoState Patrol.

    Final Furlough DayAll three Division of Gaming of-

    fices will be closed Friday, May 28for the final of eight State manda-tory furlough days for the currentfiscal year.

    AGP Springs Forward in MarchRevenues at Colorado casinos sprang forward in March. Casinos statewide

    reported $63.2 million in AGP in March, up 4.3 percent from $60.6 million inMarch 2009 and up 7.7 percent from $58.7 million in February. Overall,revenues have increased 8.2 percent since the implementation of Amendment50 in July 2009.

    Black Hawk’s 20 casinos produced $46.5 million in AGP in March, up 6.7percent from $43.6 million in March 2009 and up 6.8 percent from $43.5 millionin February. Cripple Creek’s 15 casinos totaled $11.1 million in AGP in March,down 4.3 percent from $11.6 million the previous March, but up 11.5 percentfrom $9.9 million in February. Central City’s six casinos generated $5.5 millionin AGP in March, up 4.2 percent from $5.3 million in March 2009 and up 8.1percent from $5.1 million the previous month.

    Casinos statewide paid $10.7 million in gaming tax proceeds in March, upfrom $9.9 million in February.

    At the Division of Gaming, we like to try to go about ourbusiness quietly without much notice. That hasn’t happenedrecently because of two events on back-to-back weekends.

    On March 26, a patron was playing a penny slot machineon a wide area progressive at Fortune Valley Casino inCentral City when the machine displayed a $42,949,673.84 jackpot award.Obviously that’s not a programmed outcome on a penny slot machine, so wehave asked our independent testing lab, GLI, to conduct a forensicinvestigation to determine the actual award. What is so noteworthy aboutthis incident is not so much how much was displayed on the machine, buthow much coverage that this story received. It quickly became a nationaland international story the following week, with the patron appearing onseveral television interviews and with Division Communications DirectorDon Burmania handling several newspaper, television and radio interviews,including the BBC. Compare that with the coverage of a $164 millionjackpot on a penny slot machine in Black Hawk two years ago. Never heardabout that one before this story? I didn’t think so.

    Eight days later, a lone gunman allegedly robbed a Central City casino.Three Division investigators assisted the Central City police in identifyingthe escape vehicle and counting down the cage to determine how muchmoney had been allegedly stolen. A Division investigator was able topositively identify the escape vehicle in a parking garage at a Black Hawkcasino, where a shootout between the suspect and a Black Hawk officerensued. So much for going about our business quietly.
