The undersigned is directed to refer the Accountant General (A&E) J&K, Srinagar's letter No. PNR-Rcv. Cell/G. 0. 57/201 3- 14/ 2755-61 dated 15-10-2013 on the above captioned subject and to state

that the doubts raised therein have been examined in the Final'ce Department and clarified as under. :-

Kindly refer your No. PNR-1/SR0-59/12-13/3522-29 dated 26-3-2013 on the subject captioned above. In this context the doubts expressed is clarified as under :-

2. The Jammu and Kashmir Civil Services (Revised) Pay Rules, 1987, are applicable to work charge employees also and as such provision of Appendix 2-A inserted in the said rules vide SR0-59 dated 6-2-1990 are also applicable to work charge employees. Following points arises:-

I. Whether while working out prescribed number of years for elevation from lower grade to higher grade as required under G. 0 . No. 84-PW of 1994 entire Work Charge service shall be taken into account or only 50% of Work Charge service shall be accounted for.

II. Whether daily wages service shall be accounted for while calculating the number of years for elevation from lower grade as required under G. 0. No. 84-PW of 1994 dated 21-2-1994. If daily wage service is to be taken in calculation then how much portion, thereof shall be taken.

Since the Pay Ruic , 1987 are appl icaule to Work Charge employees and as such it is obvious that the Appendix inserted v ide SR0-59 shall apply to Work Charge employees. However, their elevation from lower grade to higher grade in terms of G. 0. No. 84-PW of 1994 dated 2 1-2-1994 shal I be taken into account only after their regularisation on substantive basis. Appendix 2-A of J&K Civil Procedural delay duly Services (Revised) Pay Rules, authenticated by concerned 1987 inserted vide SR0-59 dated Head of the Department in 6-2-1990 has since been allowing the benefit of deleted w. e. f. 15-01-1996 vide SR0-59 retrospectively shall SR0-231 dated 15.7.2003. In continuation to Government Order No. 126-F of 20 I 3 dated 15-05-2013, it is hereby ordered that the State Government employees including Work Charged and Whole Time Contingent paid employees, working in regular pay bands/scale, shall be paid Dearness Allowance as under :-

(i) The differential amount on account of enhancement in DA by 10% w. e. f. July, 2013 to February, 2014 shall be paid through the GPF route with lock-in-period of one year and form part of the monthly salary there onwards.

(ii) The differential amount on account of DA to the State Government employees governed under New Pension Scheme (NPS) shall be paid in cash w. e. f. July, 2013 to January, 2014 in the month of February, 2014. The employees ' share @ I 0% shall be deducted at source and credited to the respective PRAN numbers along with the matching share by the employer.

Thereafter, the enhancement in the DA by I 0% shall form part of their monthly salary.

(iii) The basic pay for the purpose of this order shall mean the basic pay as defined in Note below Article 27(aa) of J&K Civil Service Regulations.

(iv) The payment of Dearness Allowance involving a fraction of 50 paisa and above shall be rounded to the next higher rupee and the fraction of less than 50 paisa shall be ignored.

(v) The provisions of this order shall also apply, mutatis-mutandis to the All India Service Officers serving in connection with affairs of the State.

23-07-2013 , it is hereby ordered that those State Government employees

including Work Charged and Whole Time Contingent paid employees

working in regular time scale of pay who have elected, in terms

of the provisions of the J&K Civil Services (Revised) Pay Rules,

2009, to continue to draw their pay in the pre-revised scales or where

new scales of pay are not applicable, shall be paid Dearness

SRO- 51.-ln exercise of the powers conferred by the proviso to section 124 of the Constitution of Jamm u and Kashmir, the Governor is pleased to direct that the following amendments shall be made in the Jammu and Kashmir Government Degree Co lleges (Adoption of U. G. C. Revised Pay Scales) Rul s, 2009, namely :-

I. Rule 2 shall be recast as under -

"These rules shall come into force on the first day of January, 2006 with effective date of implementation from First August, 2009 for the purpose of revised pay and revised rates of Dearness Allowance only. The revised rates of all other applicable allowances including non-compounded advance increments shall be deemed to have come into force on 1-9-2008 with effective date of implementation from 1-8-2009."

II. In Sub-Rule (x) of Rule 11, the word ·'Five" appearing in the third line shall be deleted.

Subject :-Clarification to Rule 67 of the Jammu and Kashmir Civil Services (Leave) Rules, 1979 recast vide SR0-274 dated 30th May, 2013.

Doubts have been expressed by various Administrative Departments regarding application of SR0-274 dated 30th May, 2013 as to whether the in-service candidates/officers who are on study leave on the date of issue of the notification can be paid salary for the

remaining period of leave.

The issue has been examined in the Finance Department and it is clarified that the notification has prospective effect and as such, the Government servants who had been on study leave (without pay and allowances) on the date of issue of SR0-274 are not entitled to the leave salary for the remaining period of leave.

Accordingly, all the Administrative Departments are requested to communicate the above clarificatory instructions to all Heads of Departments to settle such cases. .

Subject :-Facility to Migrant State Government employees to draw advances out of their G. P. Fund Account and settlement of their final G. P. Fund and State Insurance claims.

In order to facilitate the State Government employees who have migrated from Valley to other parts of the country, to draw advances and make non-refundable withdrawals out of the balances standing at their credit from the offices wherefrom they have been drawing their leave salary at Jammu and other places and final payment of G. P. Fund balances on retirement and settlement of their insurance claims against the State Insurance Fund Policies, Finance Department has laid down provisional procedures for settlement of these cases way back in 1991, vide OM No. A/97(90)-946 dated 02-01-1991.

The Migrant State Government employees drawing their leave salary from the office of the Principal Resident Commissioner, New Delhi have now represented for enhancement in the ceiling of withdrawals (non-refundable advances) from existing 50% of the net credit verified, to 75% of the balance at credit as is applicable to other State Government employees in terms of Rule 8-C of the General Provident Fund Rules amended from time to time. After examination of the issue in the Finance Department, it has been decided to propose enhancement in the existing ceiling of 50% of net credit verified as laid down in sub-clause (b) of clause vi of para B of OM No. A/97(90)-946 dated 02-01-1 991 to 7 5 % of the net credit.

Consequent upon the above, the sub-clause (b) of clause vi of para B of OM cited above is recast as under:-

75% of the net credit verified.

The undersigned is directed to invite attention of the Accountant General (A&E), Sirnagar to his letter No. PN-Rev-Cell/G0-57-F/255 dated 11-3-2013. The concordance table attached to Government Order No. 57-F of 2013 dated 11-3-2013 is to facilitate the payment of revised pension/family pension, and has no bearing on pensioner's/ family pensioner's eligibility which is to be determined in terms of the provisions of Government Order in question. The provisions of Government Order No. 57-F of 2013 dated 11-3-2013 are equally applicable to pre-1-1-2006 pensioners/family pensioners of erstwhile Government Lumbering Undertaking (GLU) and Government Transport Undertaking (GTU) pensioners from the date it is applicable to other State Government pensioners. The pension/family pension of erstwhile GLU/GTU pre-1-1-2006 pensioners as revised w. e. f. 1-1-2006 in terms of SR0-94-F of 2009 and amended from time to time shall further be stepped up in terms of the provisions of the Government Order No. 5 7-F of 2013 dated 11-3-2013 read with provisions of Government Order No. 92-F of 2009 dated 24-4-2009.

The case of Shri Raj Nath Dhar which has been pending for want of concordance table may kindly be disposed of at an earliest so that compliance report is filed with NHRC.
