Proposal to Dissolve

Joint Subcommittee on Environmental Law

On October 10, 1969, the Board of Directors approved formation of the Joint Subcommittee on Environmental Law (JSEL) to provide legal support to the Air Quality and Water Resources Committees, and later the Solid Wastes Management Committee, by reviewing legislative and regulatory proposals as an essential part of developing MCA views and statements.

This arrangement has not provided the necessary continuity and explicit legal expertise in the environmental laws to assure timely advice necessary for MCA to be ade- quately responsive to the timetables imposed by congressional or Environmental Protection Agency actions. the concerned technical committees recommended that MCA con- sider other measures to support their activities. Recently JSEL recommended that it be absolved of providing routine legal advice and assistance to the environmental committees and, further, that MCA should retain counsel to provide review needed in the regulatory process.

Consequently,

The Legal Advisory Committee concurs in the technical committees' views and recommends dissolution of JSEL.

As necessary legal support to technical committees will be arranged for as needed through MCA Staff Counsel, dissolution of J S E L is recommended.

Secretariat of ASTM Committee E - 1 5 on Analysis and Testing of Industrial Chemicals

Authorization for the Association's furnishing the Secretariat of ASTM Committee E - 1 5 on Analysis and Testing of Industrial Chemicals expireg July 1, 1978. The Committee has requested continuation and adaptation of the term to be consistent with the change in calendar year and officer terms recently adopted by ASTM. Staff recommends extension through December 1979.

The Committee is providing a valuable service to the chemical industry, since the standard tests and recommended practices under the jurisdiction of this Committee provide clearly described means by which the compliance or non- compliance of industrial chemicals with their purchase spec- ifications can be determined by procedures that are acceptable to both buyer and seller, and that have found acceptance in the courts.

The Committee develops the procedures, demonstrates their precision and accuracy by collaborative test programs, and maintains their currency by an ongoing program of sur- veillance and timely revision. The number of E - 1 5 standards will continue to increase as needs for test methods for additional chemicals become apparent, or as improved analyt- ical technology and new analytical instrumentation become available. Several other methods are under development.

Representatives of 3 2 MCA member companies, 46 other industrial firms, state and federal agencies, universities, and trade associations participate in the Committee.

The Secretariat requires about 12 days of a profes- sional staff member's time and about 2 5 days of a secretary's time per year.

Ways and Means Committee Chairman A 1 Ullman i n d i c a t e d some time ago t h a t he expected t o begin t a x reform hear ings w i t h i n a week a f t e r t he P r e s i d e n t ' s p roposa ls reached t h e H i l l and cont inue t h e hear ings i n t o the recess . With t h i s i n mind, ou r Tax Po l i cy Committee s t ands ready t o proceed wi th t h e d r a f t i n g of an Assoc ia t ion s t a t emen t as soon as t h e s p e c i f i c s of t he A d m i n i s t r a t i o n ' s program a r e made pub l i c .

Nine tax reform o p t i o n papers have been submit ted t o t h e P r e s i - dent by t h e Department o f t h e Treasury , con ta in ing a number of in - c e n t i v e s f o r c a p i t a l format ion as wel l as "loophole c los ing" provi- s ions t h a t could be c o s t l y t o i n d u s t r y . The package t h e P r e s i d e n t submits t o Congress i s l i k e l y t o c o n t a i n a mixture of both. There i s s p e c u l a t i o n t h a t i t w i l l c a l l f o r between $18 b i l l i o n and $20 b i l l i o n i n t a x cu ts , wi th about $13 b i l l i o n s l a t e d f o r i n d i v i d u a l reduct ions and $5 b i l l i o n t o $7 b i l l i o n aimed a t s t i m u l a t i n g bus iness investment .

Among the op t ions submi t ted t o t h e P r e s i d e n t i s one which would provide f o r c u r r e n t t a x a t i o n o f t h e income of f o r e i g n s u b s i d i a r i e s of U . S . companies. The Treasury Department has recommended t h a t de- f e r r a l o f t a x a t i o n of f o r e i g n source income be r e t a i n e d . However, t h e r e i s inc reased f e e l i n g i n Washington t h a t t h e P res iden t may be i n c l i n e d t o recommend repeal of d e f e r r a l as a means of moving toward h i s campaign promise of a balanced Fede ra l budget.

The bills i n q u e s t i o n , S . 1860 and H . R . 8333, introduced by Senator W i l l i a m V . Roth, J r . (R.-Del.) and Representa t ive Jack F . Kemp (R.-N.Y.; would reduce i n d i v i d u a l t a x r a t e s by an average of 33 percent over a th ree -yea r per iod and reduce co rpora t e t a x r a t e s from 48 t o 45 per- I

HOUSE PASSES NLEU AMENDMENTS b

A f t e r t h r e e days of f l o o r deba te t h e House passed H . R . 8410 on October 6 by a vo te of 257 t o 163. The b i l l amends t h e Nat iona l Labor I

Rela t ions Act t o make i t e a s i e r f o r unions t o organize and sha rp ly widens the powers of t he Na t iona l Labor Re la t ions Board. The v o t e , a s expected, was l a r g e l y a long p a r t y l i n e s with 2 2 1 of the 280 Demo- c r a t s vo t ing "yea" and 104 of the 140 Republicans vo t ing "nay". Democratic opponents o f t h e l e g i s l a t i o n were p r i n c i p a l l y from the South, where union s t a t u s has g e n e r a l l y been weaker and t h e impact of H.R . 8410, t h e r e f o r e , more l i k e l y t o be keenly f e l t .

The Na t iona l Act ion Committee on Labor Law Reform i s leading a j o i n t i n d u s t r y e f f o r t t o d e f e a t t h i s harmful l e g i s l a t i o n . The co- a l i t i o n has t h e .support of t h e NAM, the U. S . Chamber o f Commerce and o t h e r bus iness e n t i t i e s .

Business and i n d u s t r y favored another b i l l i n t h e House, H . R . 8310, Representa t ive Er l enborn ' s proposed Employee B i l l of Rights . It had been hoped t h a t some of i t s concepts f o r l abor reform could be incorpora ted i n H.R . 8410. However, from the very beginning of c o n s i d e r a t i o n i n t h e Labor-Management Re la t ions Subcommittee, M r . E r l enborn ' s b i l l faced ve ry long odds. P r i o r t o cons ide ra t ion of H.R. 8410 on the House f l o o r , p ro- labor f o r c e s i n t h e House voted t o block t h e Erlenborn s u b s t i t u t e .

There were a few minor concessions du r ing t h e debate i t s e l f , but none which s i g n i f i c a n t l y change t h e o v e r a l l e f f e c t of t h i s de- c ided ly pro-union l e g i s l a t i o n .

CONFERENCE BEGINS ON WATER QUALITY AMENDMENTS

House and Senate confe rees w i l l meet today f o r the second t i m e t o work toward r e s o l v i n g d i f f e r e n c e s i n t h e two ve r s ions of H . R . 3199, amendments t o t h e F e d e r a l Water P o l l u t i o n Con t ro l Act. The f i r s t meeting was he ld on October 4 , and l a s t e d only 15 minutes . Both s i d e s expressed a d e s i r e t o complete a b i l l t h i s Sess ion and the s t a f f s were i n s t r u c t e d t o work t o g e t h e r through t h e ho l iday weekend t o f i n d a r e a s of agreement.

BACKGROUND: On February 24 t h e House passed H . R . 11, a $4 b i l l i o n pub l i c works j o b s b i l l . However, t h e Senate v e r s i o n , a p - proved March 1 0 , i nc luded an a d d i t i o n a l $9 b i l l i o n f o r sewage t r e a t - ment p l an c o n s t r u c t i o n n o t inc luded i n the House b i l l . This s e c t i o n was added by Senator Muskie as a s t r a t e g i c maneuver i n an e f f o r t t o postpone major r e v i s i o n of PL 92-500. t h e e s s e n t i a l pub l i c works funding u n l e s s combined wi th s u b s t a n t i v e changes t o PL 92-500, and i t t h e r e f o r e dec l ined t o go t o conference on H . R . 11.

The House d id n o t want t o pass

The House P u b l i c Works and Transpor t a t ion Committee then com- p l e t e d work on H.R . 3199, which inc luded t h e w a t e r - r e l a t e d changes the Committee sought , and i t passed t h e House on A p r i l 5 , 1 9 7 7 .

The House also adopted a r u l e a l lowing H.R. 31 9 t o be a t t a c h e d t o H.R. 11. Subsequent conference committee a c t i o n immediately dead- locked over t h e amendments t o the Water P o l l u t i o n Cont ro l Act. The c o n t r o v e r s i a l amendments were then dropped from H . R . 11, al lowing the jobs b i l l t o be enac ted .

I n June and e a r l y J u l y , t h e Senate Environment and Publ ic Works Committee he ld hear ings and marked up a comprehensive review of PL 92-500, which then passed the Senate on August 5 , by a vote of 96 t o 0. The o r i g i n a l House v e r s i o n of H.R. 3199 has 22 s e c t i o n s ; t h e Senate v e r s i o n has 57 s e c t i o n s .

RECENT A C T I V I T Y : The comprehensive n a t u r e of the Senate b i l l prompted major i n d u s t r y groups t o encourage the House Publ ic Works and Transpor t a t ion Committee t o reopen hear ings on water q u a l i t y i s s u e s , wi th emphasis on those s e c t i o n s of t he Senate v e r s i o n no t addressed i n the House b i l l . Act ing Chairman Ray Roberts (D.-Tx.) responded t o i n d u s t r y r eques t s by conducting f o u r days of hear ings September 1 5 , 1 6 , 19 and 2 2 , i n the absence of Chairman Bizz Johnson (D, - C a l i f . ) , who has been ill.
