the amount of the refundable deposit,) the homeowner receives a detailed account of the damages incurred and a summary of charges (i.e., invoice) for the subsequent cleaning and/or repairs. The homeowner is responsible for paying the charges within ten (10) days of receipt of the invoice. Deposit (refundable) $500.00 Check #

cancelled 7 days or more prior to the scheduled event.

RENTAL PERIODS

The exercise room is available from 6:00 am – 10:00 pm. The great room is available daily. Informal use (i.e., card games, TV football games) is on a first-come, first-serve basis. Music must cease at 10:00 pm during the week (Sunday – Thursday). During the weekend (Friday and Saturday), the Clubhouse is available from 8:00 am until 12:00 am-midnight. Overnight functions are not permitted. The above rental periods include plenty of time for set up and clean up. Therefore:

Homeowners cannot begin preparation activities or allow access to the Clubhouse by guests or other participants prior to the stated periods. This should be sufficient for any catering companies.

Homeowners must finish all cleaning tasks by the end of the rental period.

Homeowners must remove all personal and rental property by the end of the rental period.

RENTAL CHECK-OUT

After the event, ensure that all doors are securely close and locked. The following is a checklist of clean up tasks:

Wipe counters, sink, refrigerator and microwave.

Wipe tables, chairs and floors of great room area.

Reset all furniture moved for the event.

Remove all personal and rental property.

Remove all food from the Clubhouse.

Remove trash from all rooms (bathroom, kitchen, great room)

and take it to homeowner’s receptacle.

Reset HVAC units according to instructions. (See instructions at thermostat)

All residents and their guests are responsible for removing any and all of their personal belongings from the Clubhouse. If such items remain in the Clubhouse and are not claimed by the responsible individual, then such belongings become the property of the Association. The Association has the right to remove and dispose of said property within 14 days. Any damage to the Clubhouse must be reported to the Homeowner’s Association Manager by the homeowner no later than the morning after the scheduled event.

CLUBHOUSE AMENITIES

No paint, tape or tacks are permitted on walls, windows, fixtures, moldings, fireplace, mantel or ceilings. Children under 16 years of age are not allowed in the Clubhouse unless accompanied and supervised by an adult. Any person who brings a child under the age of 16 into the Clubhouse is responsible for the child’s conduct and safety. Glass bottles, drinking glasses and other glass containers are not permitted in the Clubhouse or on the porch area (only canned or plastic beverage containers are allowed). Indoor furniture and outdoor furniture should remain in appropriate areas. Furniture is to remain inside. Folding chairs and tables are permitted on the Clubhouse porch until the event is over. Please return them to their original location after the event. Limited parking is provided. Homeowners and their guests should park their vehicle on one side of the street only and cannot block any resident’s driveway. This allows

access for residents, as well as emergency vehicles.

RESPONSIBILITIES, RISKS, LIABILITIES AND HAZARDS

The homeowner assumes all responsibility, risks, liabilities and hazards incidental to the activities applied for (including, but not limited to, the serving of alcoholic beverages), and hereby release and forever discharge the Association, its officers, directors, employees, agents and members, past, present and future, from any and all claim, costs, causes of action and liability for personal injury or death and damager to or destruction of property arising from the homeowner’s use of the Clubhouse and its appurtenances. Violation thereof by any person, setting up, serving at, present at, attending, or in any other way related to the function, may at the sole discretion of the Association’s Board of Directors, result in, but is not limited to, forfeiture of the refundable deposit. The homeowner agrees that, if alcoholic beverages are served during the function, then alcoholic beverages shall (1) not be sold at the function, (2) not be served or allowed to be provided to minors at the function, and (3) shall only be provided to or served to adults in a responsible manner. At any functions held on community property, if alcoholic beverages are permitted, they are permitted on a “bring your own” basis only

and are only to be consumed by persons 21 years of age and older, and the homeowner reserving the Clubhouse is responsible for ensure that attendees at the function drink responsibly and legally. At no time will the Association provide/serve alcoholic beverages. As a condition of use of the Clubhouse, the homeowner agrees to the terms of these rules and of the correlating Reservation Agreement, to use the Clubhouse subject to the right herein reserved by the Association to enter the Clubhouse and terminate the homeowner’s use thereof should any person engage in conduct that endangers the health, safety or welfare of other persons attending a function at the Clubhouse, or if such conduct constitutes a threat to the Clubhouse property, then the Association will have the right to immediately enter the Clubhouse and terminate the member’s use of such property.

INDEMNITY

The homeowner agrees to indemnify and hold harmless the Association its officers, directors, employees, agents and members, past, present and future from any and all charges, claims, costs, causes of action and liability (including by not limited to, attorneys’ fees) for any injury, to either person or property, suffered by the homeowner, family members, employees, agents, servants, guests, invitees or any member of the Association or any other person which arise from or are in any way related to the agreed upon function, activity, rental or use of the Clubhouse whether or not caused by the Association’s negligence.
