Ark Groups 11th Annual WOMEN LEGAL 2018 Illustrating the business imperative for the advancement, retention and succession of female leadership in the legal profession - while identifying opportunities to open up business dialogues and make useful connections While it is true that law firms (in general) are not making sizable advances when it comes to the advancement, retention and succession of female leadership in the legal profession—firms that have figured out how to retain, champion, develop and advance women among their ranks are solving three significant problems. For starters, they are closing the gender gap with respect to law firm compensation— which is critical, seeing as law firms cannot thrive without a commitment to institutional sustainability and a culture that supports equitable compensation, designed to incentivize the right behaviors. Second, they are winning top-talent available to the profession (and driving innovation) —and finally, they are meeting their clientsdemand for diversity (a very real business imperative, as it has been proven that diversity and inclusion represent a significant competitive advantage). Ark Groups 11th annual WOMEN LEGAL conference will examine actions that have had a direct impact on the advancement or preservation of organizations committed to diversity and inclusion. This years conference will once again provide an ideal platform for the exchange of ideas and experiential wisdom as we collectively address the primary obstacles, challenges and opportunities that exist around the promotion, retention, and succession of female leadership—as well as identify opportunities to open up business dialogues and make useful connections—turning strategic relationships into mentors, sponsors and clients! Why Are Women leaving the profession in material numbers? This years conference will also focus on the career trajectories of female lawyers. Research reveals that the most experienced women in the profession are leaving in their 40s and 50s—as these women ought to be reaching the highest levels of leadership within their organizations. We need to better understand the career dynamics of women lawyers, as this incredible loss of talent and expertise is something that the legal profession (and our justice system) simply cannot afford. We hope you will join your peers this February in San Francisco, as we re-imagine our approach, stimulate thinking about whats important, and build momentum towards collective action and impact! WOMEN LEGAL 2018 Illustrating the business imperative for the advancement, retention and succession of female leadership in the legal profession - while identifying opportunities to open up business dialogues and make useful connections

While it is true that law firms (in general) are not making sizable advances when it comes to the advancement, retention and succession of female leadership in the legal profession—firms that have figured out how to retain, champion, develop and advance women among their ranks are solving three significant problems. For starters, they are closing the gender gap with respect to law firm compensation—which is critical, seeing as law firms cannot thrive without a commitment to institutional sustainability and a culture that supports equitable compensation, designed to incentivize the right behaviors. 9:00AM Introductions Conference Chairperson Patricia K. Gillette, Public Keynote Speaker and Member of JAMS

9:15AM KEYNOTE ADDRESS Why Are Women Leaving the Profession in Material Numbers? Potential solutions for the long-term retention and advancement of women in law...

Hilarie Bass, President of the American Bar Association, and Co-President, Greenberg Traurig, LLP

10:00AM ACTIONS THAT HAVE DIRECT IMPACT Diversity Innovations Impact Report: The Mansfield Rule In summer 2017, 44 major law firms agreed to pilot the Mansfield Rule, one of the winning ideas that was generated as a result of the 2016 Women in Law Hackathon, hosted by Diversity Lab in collaboration with Stanford Law School and Bloomberg Law. Named after Arabella Mansfield, the first woman admitted to the practice of law in the United States, the Mansfield Rule measures whether law firms have affirmatively considered women and attorneys of color — in at least 30 percent of the candidate pool — for leadership and governance roles, equity partner promotions, and lateral positions. Join Diversity Lab’s CEO, Caren Ulrich Stacy, and several of the pilot firms’ representatives to learn more about the details of the Mansfield Rule, including how it works and it’s impact thus far.

Caren Ulrich Stacy, Creator of Diversity Lab & OnRamp Fellowship

10:30AM Morning Coffee Break

11:00AM ACTIONS THAT HAVE DIRECT IMPACT First Chairs at Trial—The Gender Imbalance A first-of-its-kind empirical study entitled, First Chairs at Trial: More Women Need a Seat at the Table, found that, despite the increasing numbers of women in the profession, they remain grossly under-represented in first chair roles at trial in both civil and criminal cases, and the gender disparity is particularly pronounced in certain types of cases. One of the co-authors of this groundbreaking study, Roberta Liebenberg, will discuss the findings of the study; the business case for creating a more level playing field for women litigators; and how the First Chairs study has served as a springboard for further studies examining the number of women in lead counsel positions.

Bobbi Liebenberg, Partner, Fine, Kaplan and Black

11:30AM ACTIONS THAT HAVE DIRECT IMPACT Judge-Driven Diversity Do you know who you can't say no to? A judge. And we see judges in various parts of our country using their power to force firms to give women and diverse attorneys speaking roles on significant motions and stand up time at trials. In this segment, attendees will hear from (former) Judge Grewal, who happens to be one of those men who has helped women and diverse attorneys break into new courtroom roles. And it made a difference…

Paul Grewal, Vice President & Deputy General Counsel, Facebook (former U.S. Magistrate Judge for the U.S. District Court for the Northern District of California)

12:00PM Networking Luncheon

1:00PM ACTIONS THAT HAVE DIRECT IMPACT

Implicit Bias Training For years law firms have intentionally or unconsciously maintained leadership structures dominated by men. That mentality and expectation is not going to change overnight. If new ideas like the Mansfield rule are going to have meaningful impact, firms must be willing to address many of the systemic issues that have held women back. Training is one of the methods that can be used to begin this process. But it has to be the right training delivered to the right people. In this segment, We will talk about what that looks like.

Patricia K. Gillette, Public Keynote Speaker and Member of JAMS

1:30PM PANEL DISCUSSION Firms That Advance Women Win (but how?)… While it is true that law firms are not making big advances when it comes to increasing numbers of women partners in absolute terms, law firms that have figured out how to retain, champion, develop and advance women partners are solving three significant problems – they are closing the gender gap in law firm partner compensation, they are winning top talent and they are meeting their clients’ demands for diversity. This engaging panel discussion will illustrate how three (3) law firms—each taking a different approach to solving these problems—

have met with great success. Attendees will learn from the experts how to create and preserve an organization committed to diversity, while also generating more business, hiring the best talent and institutionalizing equity in pay.

2:15PM Afternoon Coffee Break

2:30PM PANEL DISCUSSION Should I Stay - Or Should I Go? There is more than one way to practice law. And few who practice in big firms do not at some point fantasize about starting or joining a small firm, or going in-house. In fact, many women have found extremely satisfying legal careers in different settings, in contrast to the “traditional law firm track.” And yet some are very content to remain in law firms for their entire careers. What’s right for you? Is the decision to leave a firm forever-after? What kinds of challenges and opportunities come with changing the place you practice law? There is no one-size-fits-all when it comes to a legal career. Attorneys must decide for themselves what work environment best suits their personal and professional goals. This panel of highly-successful women will share their stories and what motivated them to make career choices, with a focus on values and culture that tend to drive career choices—and changes.

Brooke D. Arena, Sr. Counsel, Global Product & Operations, Visa, Naomi B. Waltman, Esq., Senior Vice President & Associate General Counsel, CBS, Linda M. Moroney, Partner, Gordon Rees Scully Mansukhani, LLP, Jennifer H. Zimmerman, Executive Director, Morgan Stanley

3:15PM The Evolving Legal Talent Pool A lawyer's career path was traditionally very linear and unforgiving. However, over the last decade, that rigid path has begun to erode, making way for a more creative means to build a legal career. In this session, we will explore the changing demographic of lawyers who are receptive to alternative career paths. We will uncover how the economy and other drivers have triggered these shifts in a lawyer’s career trajectory and how Baby Boomers and Millennials have joined the ranks of some women who first carved this path. We will also explore how law firms can become smarter in staffing their matters as well as how in-house legal departments and law firms can more effectively develop their talent and ensure that diverse lawyers are integral to that plan. Attendees will leave this session with a greater understanding of the opportunities that present and the challenges that remain in catering to clients and cultivating talent in an ever-changing legal market.

Debbie Epstein Henry, Co-Founder, Bliss Lawyers; Founder, DEH Consulting, Speaking, Writing

3:45PM CLOSING PANEL DISCUSSION

Diversity: It’s Complicated... How are firms addressing some of the “complicated tensions” between different kinds of diversity within law firms with limited resources and attention spans? Do white men have much to complain about (not getting the same opportunities as women)? How about Affirmative Action and tensions among white women and women of color? This closing panel discussion will delve into the complications of diversity and inclusion (concerning both race and gender) — addressing a perception that perhaps white male fear or resentment exists in the wake of high-profile inclusion efforts that have taken place in the past few decades. What is the source of this consternation? And will it impact diversity efforts in firms and legal departments? Most women would probably agree that it’s critically important that (white) men be involved in moving the diversity agenda forward. But how can we do so, without creating some of these unintended consequences?
