The officers elected hereunder shall be ORDINANCE NO. 2525 SUMMARY On October 17, 2016, the City of Gardner, Kansas passed Ordinance No. 2525 changing the zoning classifications or districts of certain lands (northwest corner of South Moonlight Road and 183rd Street) located in the City of Gardner, Kansas from R-2 – Two Fam- ily District to CO-A – Neighborhood Busi- ness District under the authority granted by Title 17 of the Municipal Code of the City of Gardner, Kansas. The removal from the City of any officer elected hereunder who is required by State law to be a qualified elector thereof, shall occasion a vacancy in such office. In case of a vacancy in the council oc- curring by reason of resignation, death, or removal from office or from the city, the governing body shall appoint a quali- fied elector to fill the vacancy until the next election for that office. In case any person elected as a council member ne- glects or refuses to qualify within 30 days after election, the council member shall be deemed to have refused to accept the office and a vacancy shall exist. The governing body shall appoint a qualified elector to fil1 the vacancy. In case of a vacancy in the office of mayor, the president of the council shall become mayor until the next regular elec- tion for that office and a vacancy shall occur in the office of the councilmember becoming mayor.” SECTION 2. Section 4 of Charter Ordi- nance No. 26 of the City of Gardner, Kan- sas, which previously amended Section 3 of Charter Ordinance No. 19, is hereby repealed. SECTION 3. Those provisions stated within Charter Ordinance No. 19 and Charter Ordinance No. 26 of the City of Gardner, Kansas which are inconsis- tent with the foregoing are hereby re- pealed. SECTION 4. This Charter Ordinance shall be published once each week for two consecutive weeks in the official City newspaper. SECTION 5. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication unless a sufficient petition for a referendum is filed requiring a referendum to be held on this ordinance as provided in Article 12, Section 5, Sub- section (c)(3) of the Constitution of the State of Kansas, in which case the ordi- nance shall become effective if approved by a majority of the electors voting thereon.
