Inaddition, the successfulbidder must ensure thatemployees and applic-ants for employment arenot discriminated againstbecause of race, color, religion, sex, age or na-tional origin.
Upon consideration of theproposals the City Com-mission plans to award aContract; however theCity reserves the right toreject any and all bids, towaive any and all formal-ities and technicalities, and to accept any bidwhich deems advantage-ous to the City. Each bid-der agrees to waive anyclaim it has or may haveagainst the Owner, theEngineer, and their re-spec t i ve emp loyees ,arising out of or in con-nection with the adminis-tration, evaluation or re-commendation of anybid. The successful bid-der will be required to fur-nish a performance andpayment bond in theamount of 100 % of thetotal contract price.
