Investigate and make recommendations to the legislative body regarding reasonable and practical means for implementing the general plan or element of the general plan, so that it will serve as an effective guide for orderly growth and development, preservation and conservation of open-space land and natural resources, and the efficient expenditure of public funds relating to the subjects addressed in the general plan. 2. Provide an annual report to the legislative body, OPR, and HCD that includes all of the following: a. The status of the plan and progress in its implementation. b. The progress in meeting its share of regional housing needs determined pursuant to Section 65584 and local efforts to remove governmental constraints to the maintenance, improvement, and development of housing pursuant to paragraph (3) of subdivision (c) of Section 65583. The housing element portion of the annual report, as required by this paragraph, shall be prepared through the use of forms and definitions adopted by the HCD pursuant to the rulemaking provisions of the Administrative Procedure Act [Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2]. Prior to and after adoption of the forms, the housing element portion of the annual report shall include a section that describes the actions taken by the local government towards completion of the programs and status of the local government’s

That report shall be considered at an annual public meeting before the legislative body where members of the public shall be allowed to provide oral testimony and written comments. The report may include the number of units that have been substantially rehabilitated, converted from non-affordable to affordable by acquisition, and preserved consistent with the standards set forth in paragraph (2) of subdivision (c) of Section 65583.1. The report shall document how the units meet the standards set forth in that subdivision.

c. The degree to which its approved general plan complies with the guidelines developed and adopted pursuant to Section 65040.2 and the date of the last revision to the general plan.

FINDINGS AND ALTERNATIVES To address these requirements, the following items are included in the progress report provided to the State HCD and OPR:

● General Plan Amendments approved during 2015; ● Status of General Plan Implementation Measures;

● Compliance with the General Plan Guidelines adopted by the Governor’s Office

of Planning and Research per Section 65040.2; ● Progress in meeting the City’s share of regional housing needs pursuant to

Government Code Section 65584 and local efforts to remove governmental constraints to the maintenance, improvement, and development of housing pursuant to Section 65583(c)(3); and

● Status update for housing programs and compliance with the deadlines identified in the housing element.

1. 2015 General Plan Amendments

The following General Plan Amendment was considered by the City Council during 2015:

● GPA-93 – 4.55 acres located on the southwest corner of Erringer Road and

Heywood Street were changed from Commercial Office to Residential High to accommodate development 62 townhouse-style condominiums. This was approved by the City Council on May 11, 2015.

2. Status of General Plan Implementation Measures Each General Plan Section contains implementation measures to achieve the

goals and policies of the General Plan. A list of all implementation measures adopted with the General Plan is included in Attachment A, page 6, which summarizes each implementation measure, indicates which department has been assigned responsibility for completing the task, and describes the current status of the work program.

3. Compliance with General Plan Guidelines The General Plan is organized into nine sections and the required General Plan

elements are found within these chapters. Table 1 identifies how the required General Plan elements correlate with the sections of the General Plan:

Attachment B, page 25 includes a comparison of the Simi Valley General Plan and OPR Guidelines, which demonstrates that the City’s General Plan complies with the guidelines for the preparation of a general plan adopted by OPR.

4. Housing Element Implementation

Title 25 of the California Code of Regulations (CCR) Sections 6200, 6201, and

6203, require the City to identify its annual progress toward the implementation of

its Housing Element, including an analysis of the City’s progress in meeting the projected Regional Housing Needs Assessment (RHNA). Attachment C includes the required forms per CCR Title 25, Section 6202 to report on Annual Building Activity for New Construction and Units Rehabilitated, Preserved, and Acquired, and RHNA Progress. The current Housing Element was adopted on February 3, 2014, which incorporates the most recent RHNA figures. The Progress Report addresses the City’s efforts in producing housing for families of all income levels, and in assisting extremely low-, very low-, low-, and moderate-income households through the provision of new affordable apartments and townhomes, home rehabilitation loans, homebuyer assistance, and rental assistance for very low- and low-income residents for both senior and non-senior citizens.

Pursuant to Government Code Section 65583(a)(3), the City is required to demonstrate that there are adequate sites to accommodate the state-mandated RHNA allocation for the City. The RHNA establishes benchmarks for the creation of a certain number of new housing units affordable to each designated income level from January 1, 2014 through October 31, 2021. The RHNA allocation and number of units permitted during the reporting year, as required per Title 25 of the CCR Section 6203(b), are included in Table 2.

* In 2015, homes priced below $119,200 were considered affordable to very low-income

households (maximum income limited to $44,650 for a family of four); homes priced between $119,200 and $193,700 were considered affordable to low-income households (maximum income limited to $62,510 for a family of four); homes priced between $193,700 and $433,000 were considered affordable to moderate-income households (maximum income limited to $98,230 for a family of four); and, homes priced above $433,000 were considered affordable to above-moderate income households. These price estimates are based on the requirements of California Health and Safety Code Section 50052.5.

Residential construction activities for calendar year 2015 included the completion of 26 homes, including 3 single-family detached units, 20 condominium units, and 3 apartment units. Table 2 indicates that the development of homes for all income categories was below the annualized rate of development anticipated by Southern California Association of Governments’ (SCAG’s) RHNA projection for the City, although there is sufficient appropriately zoned land to accommodate

such development. During 2015, 28 permits were issued for above moderate­income single-family detached homes and 79 permits were issued for above moderate income attached homes located at the following developments: Savannah townhomes, Stratus condominiums, Haven townhomes at the Market Place, Kuehner apartments, Apricot apartment, single-family detached homes at Runkle Canyon, custom homes at Big Sky other various locations throughout the City.

5. Status of Housing Element Programs

Government Code Section 65400(a)(2)(B) requires that the City provide a status of the City's compliance with the deadlines in its housing element. Each program, or action, is listed in Attachment C, page 29, followed by a statement regarding the status of the program, as of December 2015. As indicated in Attachment C, during 2015, the City continued to implement housing programs and projects to ensure the housing needs of residents were addressed while complying with all state and federal requirements.

The following alternatives are available to the Planning Commission :

1. Forward the Simi Valley General Plan progress report to the City Council with a recommendation that it be received , filed , and forwarded to the California Department of Housing and Community Development (HCD) and the Governor's Office of Planning and Research (OPR); or

2. Provide further direction to staff.

Staff recommends Alternative No. 1.

SUMMARY

Government Code Section 65400 requires each city's planning agency to submit an annual report to the legislative body, OPR, and HCD that addresses the progress of each city's efforts toward implementing its general plan and the elements of its general plan within the past reporting year.
