Attached is a resolution recommending approval of a request from Arthur Rozzi Pyrotechnics for a Fireworks Discharge Permit for the Amway Family Fireworks event. The fireworks will launching from the Gillett Bridge on Saturday, July 2, 2016, at dusk or approximately 10:30 pm. The applicant has provided evidence of insurance which has been reviewed and approved by Risk Management. If the attached resolution is approved, the Fire Department will issue the permit after conducting an inspection.

SUBJECT: Resolution approving an agreement with MDOT for

rotomilling/resurfacing of Leonard Street

This project consists of rotomilling and resurfacing, curb and gutter removal and replacement, sewer improvements, porous brick pavers, rain gardens, bike loops, traffic signal improvements, planting of 32 street trees, landscaping, installation of Americans with Disabilities Act (ADA) compliant ramps, pavement markings, and final restoration. It should be noted that a portion of the Federal funds for this project are not available in the current Fiscal year. In order to proceed with the work, it is recommended that the City of Grand Rapids (City) approve the Agreement which calls for the City to advance a portion of the Federal funds ($153,579.10) and be reimbursed at the time the funds are available. The Michigan Department of Transportation (MDOT) received bids for this project on June 3, 2016, however, bid information is not available at this time. The engineer’s estimate is $1,450,400. Estimated total expenditures required for this project, which total $1,983,307, include the construction contract, traffic safety/traffic sign force account work/public information program, previously authorized design phase services by Moore & Bruggink, Inc., construction phase services by Moore & Bruggink, Inc., administration and an approximate twelve percent allowance for local contingencies and ten percent allowance for MDOT contingencies. The attached resolution provides for the approval of an Agreement with MDOT and the authorization of total expenditures in an amount not to exceed $1,771,528.80 for the local share of costs for this project and the necessary advancement of federal funds. The Agreement with MDOT sets forth the financial responsibilities of the parties and the conditions under which the work will be performed. This project is being financed by a combination of MDOT grant funds and local share from Vital Streets Capital Fund, Capital Improvement Traffic Safety Fund and Sewer Fund. Accompanying budget requests in the Vital Streets Capital and Sewer Funds are

YOUR COMMUNITY DEVELOPMENT COMMITTEE recommends adoption of the following resolution approving an Agreement with the Michigan Department of Transportation and authorizing expenditures in connection with Resurfacing of Leonard Street from Alpine Avenue to Turner Avenue.

WHEREAS, It is necessary to enter into an Agreement with the Michigan Department of Transportation in connection with:

Resurfacing of Leonard Street from Alpine Avenue to Turner Avenue

(MDOT Contract Number 16-5283) (hereinafter referred to as the “Project”)

and to authorize expenditures in connection therewith; therefore

RESOLVED:

1. That the City enter into an Agreement with the Michigan Department of Transportation in connection with the Project and that, upon approval as to form by the City Attorney, the Mayor and City Clerk are hereby authorized to execute the same on behalf of the City.

2. That upon City approval of the Agreement, said action will call for the City to advance a portion of the Federal funds and be reimbursed at the time the funds are released.

3. That expenditures for the anticipated Federal grant and local share of costs for the Project be authorized in an amount not to exceed $1,771,528.80, which includes the construction contract, traffic safety/traffic sign force account work/public information program, testing, previously authorized design phase services by Moore & Bruggink, Inc., construction phase services by Moore & Bruggink, Inc., administration and contingencies. Said amount of $1,771,528.80 to be charged as follows: $1,516,319.70 to Code No. 4091-449-9110-9890-409116045, $153,579.10 to be charged to Code No. 4090-449-9010-9890-409016045 and $50,137 to Code No. 5901-527-9000-9880-590116045.

4. That the City Comptroller is hereby authorized and directed to make payment, in amounts and to said payees, as the City Engineer requests in connection with the Project.

5. That the City of Grand Rapids, pursuant to Section 1.150-2 of the Treasury Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended, declares its intent to reimburse itself the costs of the Project and other related costs in an amount not to exceed $1,516,319.70 (Vital Streets Capital Fund) through the issuance of tax-exempt bonds.

SUBJECT: Resolution approving an agreement with MDOT for Rehabilitation

of Alger Street Bridge

In November, 2013, the City was notified that a Local Bridge Program grant for rehabilitation of the Alger Street Bridge over CSX Railroad was awarded. For this program, the Federal and State shares of the eligible project costs are 95%. This project consists of rehabilitation work including fascia beam replacement, substructure repairs, deck replacement, concrete surface coating and limited approach work on the Alger Street Bridge. The Michigan Department of Transportation (MDOT) received bids for this project on June 3, 2016, however, bid results are unavailable at this time. The engineer’s estimate is $942,600. Estimated total expenditures required for this project, which total $1,287,000, include the construction contract, traffic safety/street lighting force account work/public information program, previously authorized design phase services by Fishbeck, Thompson, Carr and Huber, Inc. (FTCH), construction phase services by FTCH, previously authorized payment to CSX Railroad, Inc. for preliminary engineering, administration and an approximate twelve percent allowance for local contingencies and ten percent allowance for MDOT contingencies. SUBJECT: Resolution approving an agreement and release of a portion of

easement, and accepting an easement for Aspen Lakes

Apartments - Phase II

The attached resolution provides for the approval of a Construction Agreement with TEG AQ2 LLC (Developer), the acceptance of a Public Utilities Easement, and the approval of a Release of a Portion of a Public Utilities Easement to facilitate public sanitary sewer and water main construction in connection with the above-captioned project. The project is privately funded and involves development of multi-family apartments in the City of Grand Rapids.

The public sanitary sewer and water main will be maintained by the City of Grand Rapids (City) in accordance with the current customer community service agreement. The Public Utilities Easement gives the City rights to maintain said public utilities. Recommended herein is a Construction Agreement that provides for the construction to be performed in accordance with Grand Rapids’ Standard Construction Specifications 1993 and any revisions thereto, including bond and insurance requirements. Field inspection will be done by the City. The public sanitary sewer and water main will be constructed by a contractor prequalified to do such work under contract by the Developer. The City will be reimbursed the cost of services (inspection, plan review, administration, etc.) associated with the project in accordance with the Construction Agreement. An accompanying budget request in the Capital Improvement Fund is necessary to recognize a deposit from the developer and will be presented to the Fiscal Committee for consideration and approval. This project is located north of Knapp Street and east of Ball Avenue in the Utility Service District of the City and has been previously approved in concept by staff.

SUBJECT: Resolution Consenting to the Vacation of Prospect Avenue Alley

(Grand Valley State University)

The above-captioned vacation request was made by Grand Valley State University (GVSU), the owner of all properties adjacent to the affected portion of Prospect Avenue Alley, in connection with the development of Block 2 of GVSU's proposed campus expansion that is generally north of Hastings Street, east of Clancy Avenue, south of Trowbridge Street, and west of College Avenue ("GVSU's Belknap Property"). GVSU, the Neighbors of Belknap Lookout (NOBL), and the City of Grand Rapids (City) have entered into a series of memoranda of understanding that provide for a collaborative approach to engagement, planning, and development of facilities on GVSU's Belknap Property in the NOBL neighborhood. On February 9, 2016 (Proceeding No. 85392), the City authorized three memoranda of understanding between the City, GVSU, and NOBL that describe the relationship the City, GVSU, and NOBL established, the joint interests that have been identified, what the parties believe is essential for proper growth in NOBL, and a framework that will enable the parties to move forward together. On May 27, 2016, Suzanne Schulz, City Managing Director of Design, Development and Engagement, provided a letter of City Concurrence to GVSU for the Phase 1 plans and renderings as submitted by GVSU for Block 2 (500 Block of Lafayette Ave. NE) of GVSU's Belknap Property. The Letter of City Concurrence complies with items 1A. and 1B. of the Initial Memorandum of Understanding (IMOU) between GVSU and the City, and fulfills the prerequisites leading to the City's consideration of GVSU's request to vacate Prospect Avenue Alley that is addressed in item 1C. of the IMOU. The alley vacation request has been circulated to affected City departments and public utility companies and there are no objections. An accompanying budget request in the Capital Improvement Fund is necessary to

YOUR COMMUNITY DEVELOPMENT COMMITTEE recommends adoption of the following resolution consenting to the Vacation of Prospect Avenue Alley from Hastings Street to Trowbridge Street. WHEREAS, a request has been received from Grand Valley State University (the Petitioner), the owner of all adjacent properties, for the vacation of Prospect Avenue Alley from Hastings Street to Trowbridge Street described as:

Public Right-of-Way to be Vacated Approximate property address: 315 Hastings St. NE

All that portion of Prospect Avenue Alley (14 feet wide) from the North line of Hastings Street (66 feet wide) to the south line of Trowbridge Street (66 feet wide) in the Subdivision of Block Seven Coit & Co.'s Addition to the City of Grand Rapids, Kent County, Michigan, as recorded in Liber 2 of Plats, Page 21, Kent County records. Contains 7,000 square feet, more or less; therefore

RESOLVED, that all reports for all interested parties being favorable, the City Commission consents to the aforesaid vacation of Prospect Avenue Alley from Hastings Street to Trowbridge Street subject to the following conditions:

1. That the Petitioner provides to Consumers Energy Company, AT&T, and

Comcast easements, as necessary, for existing and future facilities or pays for the relocation of said utilities in the area to be vacated in Prospect Avenue Alley from Hastings Street to Trowbridge Street; and

2. That if required by others, the Petitioner causes to be completed an amended plat conforming to State of Michigan requirements of the area affected by this vacation request, the cost of which is estimated to be $2,500; and

3. That the Petitioner causes street lighting facilities in the area affected by this vacation request to be removed from the City's street lighting system, the cost of which is estimated to be $2,000. Said removal work shall be performed under the direction of the City of Grand Rapids’ Street Lighting Department. The Petitioner further accepts all street lighting and electrical facilities remaining in the vacated area after the aforesaid removal as private facilities; and

4. That the Petitioner causes the alley approaches at Prospect Avenue Alley and Hastings Street and at Prospect Avenue Alley and Trowbridge Street to be removed and properly restored, the cost of which is estimated to be $8,000 including inspection fees. Said removal and restoration work shall include sidewalks, parkways, drive approaches, curbs and gutters, and any adjustments of the street crowns and surfaces to provide a normal street cross section and grade line. All work required shall comply with the City's Standard Construction Specifications, shall be completed in

accordance with plans approved by the City Engineer or designee, and shall be constructed by a contractor who is licensed for said work by the City. After completion, the City shall inspect said work prior to its acceptance as public improvements; and

5. That the Petitioner deposits the amount of $27,500, which includes inspection fees, to be held in escrow by the City. Said amount includes the estimated costs outlined in Items 2, 3 and 4, and an estimated cost of $15,000 for engineering administrative fees. The City shall hold said escrow amount until such time as the amended plat requirement outlined in Item 2 and all removal and restoration work outlined in Items 3 and 4 have been completed. When said amended plat has been completed and the removal and restoration work has been completed, inspected, and accepted by the City, any such monies remaining in the escrow account will be returned to the Petitioner. The inspection fees and the engineering administrative fees shall be charged to the escrow account. If, after a reasonable length of time, the said amended plat requirement outlined in Item 2 and/or removal and restoration work outlined in Items 3 and 4 have not been completed, the City may use the money held in escrow to accomplish the same. If any additional costs are incurred by the City in connection with the aforesaid amended plat requirement outlined in Item 2 and/or removal and restoration work outlined in Items 3 and 4, including inspection fees and the engineering administrative fees, which exceed the escrow amount of $27,500, the Petitioner will be responsible to reimburse the City for said costs; and

6. That consent be predicated on receipt of the escrow funds outlined in Item 5 and the proper proceedings being commenced in the proper court within ninety (90) days of the date herein; and

7. That the Petitioner shall deliver a recorded copy of the court judgment regarding the aforesaid vacation of Prospect Avenue Alley from Hastings Street to Trowbridge Street to the City Attorney's office; and

SUBJECT: Resolution awarding a contract for Water Main Replacement in

Crescent Street

The existing 14” water main is 128 years old. The overall ratings of the water mains highlight their poor condition and the need for their replacement. In keeping with the Vital Streets strategy, the water main work will be leveraged to rehabilitate the street condition from a Poor/Fair condition to Very Good condition as we work towards the goal of 70% good and fair condition for Local streets. This project consists of the placement of approximately 520 feet of 12-inch water main and 64 feet of 6-inch water main to improve the reliability and performance of the existing water system. In addition to water main improvements, the project will also replace 8 feet of 15-inch sanitary sewer, portions of the concrete curb and gutter, concrete driveway and approaches, sidewalks and install ramps to meet Americans with Disability Act standards. The street will be rotomilled and resurfaced as recommended in the Vital Street and Sidewalk Investment Guidelines. Bids were received on May 26, 2016 for this project. The engineer’s estimate is $259,834, and Lodestar Construction, Inc. (Lodestar) submitted a bid of $263,143 (low discounted bid is $252,617.28). Lodestar will be utilizing 10.66% Micro Local Business Enterprise participation and will be subcontracting a total amount of $28,050. Reference the attached Equal Business Opportunity – Construction Worksheet regarding the applicable bid discounts for this project. The attached resolution provides for the award of the construction contract for this project to Lodestar in the amount of $263,143, with total expenditures not to exceed $373,400. This amount includes the costs of the construction contract, public information program, Forestry Force Account Work, Right-of-Way/Legal Fees, testing/printing/permits, engineering/inspection/administration, previously authorized design phase services by Materials Testing Consultants, Inc. and Hubbell Roth, & Clark, Inc., and an approximate twelve percent allowance for contingencies. The City will provide the construction phase services including inspection.

WHEREAS, bids were received on May 26, 2016 for the following project: Water Main Replacement in Crescent Street from Barclay Avenue to Lafayette Avenue

(hereinafter referred to as the “Project”) and Lodestar Construction, Inc. (Lodestar) submitted a bid of $263,143 for which the engineer’s estimate is $259,834; therefore

RESOLVED:

1. That the bid of Lodestar be accepted and that, upon approval as to form by the City Attorney, the Mayor and City Clerk be authorized to execute the contract documents for the Project on behalf of the City.

2. That total expenditures for the Project be authorized in an amount not to exceed $373,400 which includes the costs of the construction contract, public information program, Forestry force account work, Right-of-Way/Legal Fees, testing/printing/permits, engineering/inspection/administration, previously authorized design phase services by Materials Testing Consultants, Inc. and Hubbell, Roth & Clark, Inc., and contingencies. The City will provide the construction phase services including inspection. Said amount of $373,400 to be charged as follows: $306,800 to Code No. 5911-536-9000-9880-591115157, $5,000 to Code No. 5901-527-9000-9880-590115157 and $61,600 to Code No. 4091-449-9130-9885-409115157.

3. That the City Comptroller is hereby authorized and directed to make payment, in amounts and to said payees, as the City Engineer requests in connection with the Project.

4. That the City of Grand Rapids, pursuant to Section 1.150-2 of the Treasury Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended, declares its intent to reimburse itself the costs of the Project and other related costs in an amount not to exceed $61,600 (Vital Street Fund) through the issuance of tax-exempt bonds.

SUBJECT: Resolution awarding a contract for Reconstruction of Oakdale

Street

This project consists of the reconstruction of Oakdale Street from Eastern Avenue to Kalamazoo Avenue, including the full replacement of the existing 10-inch water main, ADA sidewalk ramp installation, sidewalk replacement, and minor storm sewer replacements. The existing water main in Oakdale Street is over 96 years old. The overall ratings of the water main highlights the poor condition and great need for replacement. In keeping with the Vital Streets strategy, the water main work will be leveraged to reconstruct the street condition from a Failed/Very Poor condition to Very Good condition as we work towards the goal of 70% good and fair condition for Major Non-Federal Aid streets. The reconstruction will also include the proposed installation of seventeen infiltration basins as recommended in the Vital Streets Guidelines. Bids were received on June 6, 2016 for this project. The engineer’s estimate is $1,694,477 and Nagel Construction, Inc. (Nagel) submitted a bid of $1,613,680.50 (low discounted bid is $1,532,996.48). Nagel will be utilizing 18.1% Micro Local Business Enterprise participation and will be subcontracting a total amount of $691,657. Reference the attached Equal Business Opportunity – Construction Worksheet regarding the applicable bid discounts for this project. The attached resolution provides for the award of the construction contract for this project to Nagel in the amount of $1,613,680.50 with total expenditures not to exceed $2,138,500. This amount includes the costs of the construction contract, public information program, traffic safety/street lighting force account work, testing/printing/permits, engineering/inspection/administration, previously authorized services by NTH Consultants, Ltd. (NTH), and an approximate twelve percent allowance for contingencies. The overall design and construction engineering/inspection will be performed by the City of Grand Rapids. NTH provided design phase services for soil borings.

YOUR COMMUNITY DEVELOPMENT COMMITTEE recommends adoption of the following resolution awarding a contract to Nagel Construction, Inc. and authorizing expenditures in connection with Reconstruction of Oakdale Street from Eastern Avenue to Kalamazoo Avenue.

WHEREAS, bids were received on June 6, 2016 for the following project:

Reconstruction of Oakdale Street from Eastern Avenue to Kalamazoo Avenue (hereinafter referred to as the “Project”)

and Nagel Construction, Inc. (Nagel) submitted a bid of $1,613,680.50 for which the engineer’s estimate is $1,694,477; therefore

RESOLVED:

1. That the bid of Nagel be accepted and that, upon approval as to form by the City Attorney, the Mayor be authorized to execute the contract documents for the Project on behalf of the City.

2. That total expenditures for the Project be authorized in an amount not to exceed $2,138,500 which includes the costs of the construction contract, public information program, traffic safety/street lighting force account work, testing/printing/permits, engineering/inspection/administration, previously authorized services by NTH Consultants, Ltd., and contingencies. The overall design and construction engineering/inspection will be performed by the City. Said amount of $2,138,500 to be charged as follows: $1,269,000 to Code No. 5914-536-9000-9880-591416085 and $869,500 to Code No. 4091-449-9120-9895-409116085.

4. That the City of Grand Rapids, pursuant to Section 1.150-2 of the Treasury

Regulations promulgated pursuant to the Internal Revenue Code of 1986, as amended, declares its intent to reimburse itself the costs of the Project and other related costs in an amount not to exceed $1,269,000 (Water Systems Fund) and $869,500 (Vital Streets Capital Fund) through the issuance of tax-exempt bonds.

The attached resolution provides for the approval of a Construction Agreement with Knapp’s Corner Flats, LLC (Developer), and the acceptance of two Public Utilities Easements to facilitate public sanitary sewer and water main construction in connection with the above-captioned project. The project is privately funded and involves development of multi-family rental apartments in the City of Grand Rapids. The public sanitary sewer and water main will be maintained by the City of Grand Rapids (City) in accordance with the current customer community service agreement. The Public Utilities Easements give the City rights to maintain said public utilities. Recommended herein is a Construction Agreement that provides for the construction to be performed in accordance with Grand Rapids’ Standard Construction Specifications 1993 and any revisions thereto, including bond and insurance requirements. Field inspection will be done by the City. The public sanitary sewer and water main will be constructed by a contractor prequalified to do such work under contract by the Developer. The City will be reimbursed the cost of services (inspection, plan review, administration, etc.) associated with the project in accordance with the Construction Agreement. An accompanying budget request in the Capital Improvement Fund is necessary to recognize a deposit from the developer and will be presented to the Fiscal Committee for consideration and approval. This project is located south of Knapp Street and west of East Beltline Avenue in the Utility Service District of the City and has been previously approved in concept by staff. #16009

WHEREAS:

1. The City Commission previously approved the Brownfield Plan (the "Plan") of the City of Grand Rapids Brownfield Redevelopment Authority (the "Authority") December 22, 1998, pursuant to the Brownfield Redevelopment Financing Act, Act 381 of the Public Acts of Michigan of 1996, as amended, MCL 125.2651 et seq.; and

2. The Authority has pursuant to Act 381 approved and recommended an

amendment of the Plan for the 1001 Monroe, LLC redevelopment project (the "Project") identified therein (the "Amendment"); and

3. Before considering approval of the Amendment the City Commission must

hold a public hearing in accordance with Act 381; therefore

RESOLVED:

1. That a public hearing be held to consider the Amendment to the Plan of the Authority; and

2. That the public hearing be held on Tuesday, July 12, 2016, at 7:00 p.m., in

the City Commission Chambers on the 9th Floor of City Hall, 300 Monroe Avenue NW, in the City; and

3. That the City Clerk give or cause to be given public notice of the hearing in

accordance with Act 381; and 4. That, in accordance with the provisions of Act 381, the City Clerk give or

A PUBLIC HEARING ON AN AMENDMENT TO THE BROWNFIELD PLAN OF THE CITY OF GRAND RAPIDS BROWNFIELD REDEVELOPMENT AUTHORITY FOR THE 1001 MONROE, LLC REDEVELOPMENT PROJECT

A public hearing will be held before the Grand Rapids City Commission in the City Commission Chambers, 9th Floor, City Hall at 300 Monroe Avenue, N.W., in the City of Grand Rapids on Tuesday, July 12, 2016, at 7:00 p.m., in accordance with the Brownfield Redevelopment Financing Act, Act 381 of the Public Acts of Michigan of 1996, as amended, MCL 125.2651 et seq. ("Act 381"). establishment of a Neighborhood Enterprise Zone - 1001 Monroe,

LLC at 1001 Monroe Avenue NW

Attached is a resolution setting July 12, 2016 at 7:00 p.m. as the date and time when the City Commission will hold a public hearing to consider the establishment of the 1001 Monroe Avenue NW Neighborhood Enterprise Zone for the property located at 1001 Monroe Avenue NW (the “Property”). The public hearing is to be held in connection with an application for a 13-year Neighborhood Enterprise Zone Exemption Certificate filed by 1001 Monroe, LLC (the “Developer”), an entity affiliated with Orion Construction. The Developer has also submitted a Brownfield Plan Amendment for the project, and a public hearing is anticipated to be held on that application, also on July 12, 2016. The Property is located in both the Monroe North Tax Increment Finance Authority (Monroe North TIFA) and the SmartZonesm Local Development Finance Authority’s (SmartZonesm LDFA) development districts. Pursuant to Commission policy, the project has been presented to the overlapping tax increment finance authorities for consideration. The SmartZonesm LDFA approved the application on May 20, 2016, and the Monroe North TIFA approved the application on May 11, 2016. 1001 Monroe, LLC owns the Property and has plans to demolish the existing single-story structure and to construct a new five-story mixed-use project that would contain 32 market-rate rental units, approximately 3,600 square feet of ground floor restaurant space, and a 32 car parking facility integrated into the first floor of the project. The residential component of the project is comprised of one and two bedroom apartments with rents projected to range from $1,625 to $3,500 ($1.84/square foot to $2.12/square foot) depending on the size and layout of the unit. Although no tenant has been secured, the Developer anticipates a restaurant user in the commercial space with outdoor seating along the river.

The estimated investment in the redevelopment is approximately $9,605,000, with hard construction costs of approximately $7,061,000. An estimated 30 new full-time jobs are expected to be created, with wages of approximately $18/hr. In addition to employment based income taxes, staff estimates that residents of the apartments could generate an additional $14,454 in new City income taxes. The proposed project is substantially similar to much of housing found in the census tract. According to 2010-2014 American Community Survey estimates, 75% of housing units are studio, one or two bedroom units, 67.2% are rental units as opposed to owner-occupied, and 57% of dwelling units are found in multi-family buildings. The project qualifies for the establishment of a Neighborhood Enterprise Zone as it meets the criteria established in Public Act 147 of 1992, as amended (the “Act”), including (i) being located in an area that is zoned and primarily used for business (i.e. Transitional City Center zone district), (ii) is a mixed-use building with commercial space on the ground floor, and (iii) is available for rent or lease. The NEZ designation would provide for an approximately 50% reduction in property taxes over a period of 10-years with three additional years of exemption during the phase out period described in the Act for a total of a 13-year NEZ exemption. The project qualifies for one additional year above the 12-year standard exemption pursuant to City Commission policy 900-45 because it meets City Investment Criteria 4.A. by providing public access to and along the Grand River by permanent easement in conformance with the purpose and intent of the Urban Open Spaces section of the City’s Zoning Ordinance and in furtherance of Goal 1 of GR Forward to restore the Grand River as the draw for downtown and enhance connections to the river corridor. The aspect of the project has been approved by the City’s Planning Commission. The Property qualifies as a brownfield due to the presence of various contaminants in both the soil and groundwater. Through the Brownfield Plan Amendment, the Developer is seeking reimbursement of brownfield eligible activities including environmental site assessment, demolition, site preparation, public infrastructure improvements and the privately owned parking structure, all estimated at just over $1 million. Reimbursement is estimated to occur over a period of 25 years. The project has been presented to the Planning Commission for consideration of several aspects including the treatment of both the river facing and Monroe Avenue facing sides of the building and the access provided to the Grand River. The Planning Commission approved a reduced width of access in favor of enhanced aspects of the project achieved by widening the building. The property is surrounded by public parks and therefore access to the Grand River is not necessarily reduced by the narrower access, but will be enhanced by the Developer’s improvements. The project is in accordance with the City’s Master Plan. There are no significant environmental concerns at the Property and the applicant is current on all of its tax liabilities to the City. Pursuant to Commission Policy 900-45, the Neighbors of Belknap Lookout (NOBL) Development Committee has reviewed and supported the project, and the NOBL board will review the project at their meeting on June 14, 2016. A letter of support from NOBL

will be required to proceed with the application. The Monroe North Business Association has also submitted a letter of support, and the Developer has met with the Boardwalk Condominium Association representatives to discuss the project as it is directly adjacent to that project. The Economic Development Project Team will review the project at its meeting on June 7, 2016.
