The Gallatin City Council met in regular session on Tuesday, July 20, 2021in the Dr. jDeotha Malone Council Chambers Gallatin City Hall. Mayor Paige Brown called themeeting to order at 6:01 P.M. Councilman John D. Alexander led the opening prayerand also led the pledge of allegiance.

WHBREAS, the number of mobile food vendors in the Middle Tennessee area has grown

significantly, presenting both opportunities and challenges for local governments; and

WHEREAS, the Gallatin Municipal Code does not currently address mobile food vending;

and

WHERBAS, it is appropriate to establish reasonable regulations to govern mobile food

vending in the City of Gallatin, in an effort to provide reasonable oppoftr,rnities for mobile food

vendors to operate within the City; and

WHEREAS, the City fLrrther finds that such regulations are needed in order to protect the

public health, safety and welfare.

SECTION l:That Chapter ll of tlie Code of Ordinances of the City of Gallatin is liereby amendedby adding a new afiicle, to be designated as Afticle Vlll and to read as follows:

ARTICLE IX. MOBILE FOOD VENDORS

Sec. 1l-271 - Purpose.

The City flnds that allowing mobile fbod vendors to operate, subject to practical regulatiorrsand limitations, is beneflcial to persons living and working within the City. This article recognizesthe unique physical arrd operational characteristics of mobile fbod vending, establishes standards formobile food vendirrg operatiorrs and promotes practices that serve the lrealth, saf-ety and welf'are ofthe pLrblic.

Sec. 1l-272 - f)efinitions.

The following words. tenrs, and phrases. r,r,herr used in this article, shall have meaningsascribed to thenr in tlris sectiorr, except wlrere the context clearly indicates a dil'ferent nreaning:

Edible food products: those products that are ready for immediate consumption, including pre-packaged food and food cooked, prepared or assembled on-site. The term "edible food products" does

not include fresh produce unless the produce has been packaged, cooked, chopped, sliced, mixed,brewed, frozen, squeezed or otherwise prepared for consumption.

Food truck: a vehicle frorn which edible food products are cooked, prepared or assembled withtlie intent to sell such items to the general public, which specifically excludes private events not opento the general public. Provided further that food trucks may also sell other edible food products and

beverages that have been prepared or assembled elsewhere.

Food truckrally: a coordinated and advertised gathering of more than four mobile food servicevehicles in one location on a date certain with the intent to serve the public.

Food truck rally permil: a permit issued by the City for a food truck rally

Ice cream truck: a vehicle frorn which the operator sells only pre-packaged frozen dairy orwater based food products and pre-packaged non-alcoholic beverages. For purposes of this article, anon-motorized cart from which such products are sold shall be considered an ice cream truck.

Localion: any single propefty parcel or any combination of contiguous parcels that are ownedor controlled by a single entity or affiliated entities.

Mobile.food vendor or mobile food service vehicle: a food truck or ice cream truck and/or a

Sec. l1-273 - Generally.

(a) It is a violation to operate a mobile food service vehicle at any location except incompliance with the requirements of this arlicle.

(b) Mobile food service vehicle operators must comply with all federal, state and locallicensing and permitting regulations and all business tax, sales tax and other tax requirements.

(c) Mobile food vendors are not transient vendors as defined in Chapter 11, Article V,Section 11-134 ofthe Municipal Code, and as such mobile food vendors shall be regulated by Chapter11, Article VIII of the Municipal Code.

Sec.ll-274 - Locations and hours of operation.

(a) Food trucks

(l) Right-of-way/public property. Food trucks may not operate within the publicright-of-way or on any City property except as may be specifically allowed by the City. When allowedin the public right-of-way, a food truck must be positioned so as to comply with the requirements of16-231(b) herein. Operation of food trucks within City parks shall be subject to rules and regulationsof City parks. Food trucks may not operate on property owned by a public entity other than the Cityunless specifically allowed by such public entity. No food truck shall be left at any tirne in the right-of-way or parked on any public property outside the operating hours set forth in this Afticle.

(2) Private property. A food truck with a current mobile food vendor permit mayoperate on private property if allowed as a permitted use under the Gallatin Zoning Ordinance, subjectto the following conditions:

b. Unimproved properties. Regardless of any agreement witlr the owner ofthe property, a food truck may not operate on an unir.nproved parcel. Forpurposes of this section, a parcel is considered "irnproved" if it contains a

e. Restriction. No food trr"rck shall be left on private property where foodservice is offered outside the operating lrours set forth irr this Article. Thefood truck site must be vacated after each operational day.

(3) Hour.s of operation Food trucks may operate beginning at 5:00am and endingat I 1 :00prn unless otherwise restricted by operator's mobile food vendor perrnit or by the propertyowner. The City may permit extended hours of operation for a food trLrck rally.

(b) Ice cream trucks.

(l) Right-of-way/public property. An ice crearn truck with a curuent mobile foodvendor permit may operate from the right-of-way at any one location for no more than l5 minutesbefore relocating to another location not less than one-quarter mile fronr the previous location. Whenoperating in the public right-of-way, an ice cream truck must be positioned so as to comply with therequirements of section 1l-275(b) herein. Ice crearn trucks may not operate on any property ownedby the City or any another public entity, except as may be specifically allowed by the City or otherpublic entity. No unattended ice cream truck shall be left at any time in the riglit-of-way or parkedon any other public propefty overnight.

(2) Private property. An ice creanr truck with a current mobile food vendor pennitmay operate on private property if allowed as a pennitted use under the Gallatin Zoning Ordinance,subject to the following conditions:

a. Permission. Ice cream trucks operating on private property shall liave tliewritten permission of the property owner, which shall be made available to theCity immediately upon request.

b. Unimproved properlie^s. Regardless of any agreement with the owner of theproperty, an ice creatr truck may not operate on arr unimproved parcel. Forpurposes of this section, a parcel is considered "improved" if it contains a

Sec. I l-275 - Operating requirements

(a) Vehicle recluirentents

(2) Licensing. Mobile food service vehicles must be licensed and equipped inaccordance with the rules and regulations of all Iocal, state, and federal agencies having jurisdictionover such vehicles. The preparation and sale of food from mobile food service vehicles must complywith all applicable local, state and federal laws.

(b) Right-of-way

( I ) Mobile food service vehicles other than ice cream trucks may not operate, stop,stand or park in any area of the right-of-way that is intended for use by vehicular travel, except in theevent of a street closure for a special event. Mobile food service vehicles, including ice cream trucks,may not operate, stop, stand or park in any way that violates the provisions of Chapter 16, Articles IIand VI (Traffic and Vehicles) of this Code, impedes the flow of traffic, interferes with the ingress oregress to or from any property or presents an unsafe condition for patrons, pedestrians or othervehicles.

(2) Mobile food service vehicles shall park facing the same direction as traffic, ata distance of no more than l8 inches between the curb face or edge of pavement and with the servicewindow of the vehicle facing the curb or edge of pavement.

(3) When mobile food vendors are allowed to operate in the public right-of-way,no seating area shall be provided, except as pennitted in conjunction with a street closure for a specialevent.

(c) Business access. No rnobile food service vehicle may operate in a location that

(l) Impedes the ingress to or egress from another business or otherwise causesundue interference with access to another business; or

(2) Blocks the IawfLrlly placed signage of another business; or

(3) Prevents access to another business by emergency vehicles

(d) Pedeslrians. If on or adjacent to a sidewalk, the components of a mobile food servicevehicle's operations, irrcludirrg signage, seating areas and patron qLrelre may not reduce the clearpedestrian path of travel on the sidewall< to less than six feet wide. All awnings or canopies of thevehicle shall be at least seven feet above the sidewall<.

(e) Distance between unil.s. A nrobile food service vehicle may not operate within ten feetof any other nrobile l'ood service vehicle.

(f) Sqfety ancl .fire prevention. All cooking, heating and electrical equipment and allcooking practices mLrst comply with applicable safety regulations, inclLrding applicable fire andelectric codes and any other safety requirements inrposed by the City's Fire arrd Codes Depafiment.No cool<irrg or heatirrg equipment nray be used in an ice cream truck. All nrobile fbod service vehiclesnrLtst be eqLrippecl with fire extinguishers that are inspected annLrally and certifred as meeting NationalFire Protection Association standards. No power cord, cable or equipnrent shall be extended acrossany pLrblic street, sidewall< or other public property.

(g) Noise. No sounds/noises prohibited by Chapter 10, Afiicle IV of this Code may be

produced by a mobile food vendor or its vehicle's operations.

(h) Support methods. No mobile food service vehicle may use stakes, rods, or any othermethod of support that must be drilled, driven or otherwise fixed into or onto asphalt, pavement, curbs,sidewalks or buildings.

(i) Spills. To prevent discharges into waterways, drainage systems or public sewersystems, each mobile food service vehicle shall cornply with all stonn waterregulations of the Cityand all regulations regarding prohibited discharges to public sewers. In addition, each vehicle shallhave a spill response plan to contain and remediate any discharge fiom the vehicle.

(t) Waste collection. The area of the mobile food service vehicle operation must be keptneat and orderly at alltimes. Operators of a mobile food service vehicle shall be responsible forthecleanliness of the area surrounding the operations (not less than 50 feet from all pafts of the vehicle)regardless of the occurrence or source of any waste in the area. During each period of operation at

the location, the operator must provide proper trash receptacles for public use that are sufficient and

suitable to contain all trash generated by the rnobile food service vehicle operation. All trashreceptacles must be emptied when full, and all waste must be removed prior to deparlure of a mobilefood service vehicle from a location.

(k) Pedestrian service. Mobile food service vehicles shall serve pedestrians only. Drive-througlr or drive-in-service is prohibited.

(l) Signage. Signage for each mobile food vendor shall be limited to signs on the exterioror interior of the vehicle and one sandwich board sign. AII signs on the exterior of the vehicle shallbe secured and shall not project more than six inches from the vehicle. One sandwich board sign maybe placed or-rtside the rnobile food service vehicle, provided that the base of the sandwich board signmust be placed five feet frorn the mobile food service vehicle. Sandwicli board signs shall not exceedeiglrt sqr-rare feet per side or 4 feet in heiglit, as set fofih in the Gallalin Zoning Ordinance, and shallnot obstruct or impede pedestrian or vehicular trafflc.

(m) Alcohol sales. Mobile fbod service vehicles may not sell alcoholic beverages, exceptas may be specifically allowed by applicable state law and City ordinance. Ice cream trucl<s are

prohibited fi"om selling alcoholic beverages.

(n) In.surance

(l) Mobile food service vehicles must maintairr all nrotor vehicle insurancecoverage required by applicable state and f-ederal laws and regulations.

(2) Mobile food service velricles operating on City property other than the right-of-way shall, at all times, maintain such fufther insurance coverage as reqLrired by this Code or otherCity regulation. (o) Inclemnificatiott. The owner and operator of any nrobile fbod service vehicle/nrobilefood vendor operatirrg on any City properly or in a City parl< shall def'end, indemnify and hold

harmless the City of Gallatin and all its departrnents and employees frorn and against any and allclaims, liabilities, loss, damages, costs and expenses, includingreasonable attorneys'fees, courtcostsand other expenses of litigation or adrninistrative proceedings, for personal injury, damage to real ortangible property arising out of the operator's use of the City's property for operation of a rnobile foodservice vehicle. The owner/operator of a rnobile food service vehicle operating on City property orin a City park shall provide proof of liability insurance coverage naming the City of Gallatin as an

additional named insured with a minimum of $1,000,000 in liability coverage. The City must be

notified within fifteen (15) business days if the liability coverage naming the City of Gallatin as an

additional name insured is cancelled or tenninated.

(p) Restroomfacility. Mobile food service vehicles operating at a location for a durationof more than three (3) hours must have a written agreernent, available upon request by the City, thatpermits employees to have access to a full-service restroom no more than 450 feet from the vendinglocation during all the hor,rrs of operation.

(q) Exterior cooking equipment. Any food preparation equipment outside of the mobilefood service vehicle shall not obstruct vehicular or pedestrian traffic, and the use and operation ofsuch equipment shall not create safety hazards for the public. Food shall not be served to customersdirectly from any outside food preparation equiprnent. Any smoker or other exterior equipment thatgenerates heat shall be surrounded with at least three traffic safety cones or similar barricades.

Sec. 11-276- Mobile food vendor permits.

(a) Required. The designated permit adrninistrator shall oversee the issuance, suspensionand revocation of mobile food vendor permits. No mobile food service vehicle selling to the generalpublic may operate within the City without a mobile food vendor permit issued by the City. A mobilefood vendor perrnit authorizes the lrolder only to engage in the vending of products from a mobilefood service vehicle in compliance with this Code and as specified on the pennit. The mobile foodvendor perrnit rnust be prorninently displayed when the rnobile food service vehicle is in operation.This section shall not apply to contractlral arrangetnents between a mobile food vendor and anyindividual, grolrp or entity for private events at a specific location for a period of not more than fourIrours, provided that the mobile fbod service vehicle is not open to or serving the general pLrblic.

(b) Application

(l) ln order to obtain a rrrobile fbod vendor pennit, a rnobile food service vehicleoperator must conrplete an application tbrm provided by the City. The applicatiorr shall include thefol lowirr g infomation :

a. Nanre and address of the owner of tlre vehicle.

b. Name and address of the operator of the velricle

c. Color photographs of the exterior (front, sides, and back) of the velricle inits I'irral uurrditiurr arrd witlr all nrarkings undel wlriclr it will opelate.

d. A copy of tlre vehicle license and registration fornr reflecting the velricleidentification nurnber (VIN) of the vehicle.

e. A copy of the state or county health department license or pennitapplicable to rnobile food providers.

f. A copy of any alcoholic beverage licenses, if applicable.

g. A copy ofthe operator's business license.

h. A certificate of insurance coverage, including required motor vehicleinsurance coverage.

i. A signed acknowledgement that the operator has read this article and willcomply with all applicable requirements herein.

j. Any additional information required by the permit administrator

(2) Submittal of an application for a mobile food vendor permit n,ust beaccompanied by payment of an application fee in the amount of $100, provided for any mobile foodvendor previously found to be operating within the City without a current pennit, the application feeshall be $500.

(3) Each rnobile food vendor permit holder shall have an ongoing duty to providethe City with notice of any change to any of the information submitted with its pennit application,including current photographs of the mobile food service vehicle in the event of any change in theappearance ofor signage on the vehicle.

(c) Issuance. A mobile food vendor permit shall be issued upon verification that an

application has been completed in accordance with the requirements of this section, except that nosuch permit will be issued to an operator whose permit is currently suspended or has been revokedwithin the preceding l2 months, or to any person who intends to operate the same mobile food servicevehicle for which the operator's permit is currently suspended or has been revoked within thepreceding l2 nronths. If tlre perrnit adniinistrator denies the application, such denial shall be irr writingand provided to tlre applicant within 15 days of receipt of the application.

(d) Expiration. All mobile food vendor permits shall expire one year lrom date ofissuance. Arnobilefoodvendorpernritmayberenewedforthenextl2-nronthperiod,providedthatall applicable requirements are nret and the perrnit is not curreutly suspended or has not been revokedwithin the preceding 12 rnorrtlrs. The fee for renewal shall be tlre same as the application f-ee fbr a

new nrobile food vendor pernrit.

(e) Trcrns.fbrobility. Amobilefbodvendorpennitmaynotbetransferredexceptapartolthe sale of a controlling interest in a bLrsiness liolding the perrrrit or a sale of substantially all of theassets of a business holding the pennit. The operator of the mobile food service velricle shall notilythe City within ten days of any such sale and shall r,rpdate any information that has been changed sincetlre submittal of the application fbr tlre rrrobile food vendor pennit.

(f) Tentporary permit. If an operator of a mobile food service vehicle lras not previouslyobtairred a mobile lood verrdor pernrit and is fbund to be operating within the City, City staff nrayauthorize the operator to cor-rtinue operatirrg for not more than two hours, provided that the operations

must comply with the location and hours of operation requirements set forlh in section ll-274 herein.Thereafter, the operator shall not operate a mobile food service vehicle witliin the City without firstpaying the required application fee and obtaining a mobile food vendor permit as required by thissection.

Sec. 11- 277-Food truck rally permits.

(a) Applicability/approval. All food truck rallies on public or private property require a

food truck rally permit. The permit administrator shalloversee the issuance of food trLrck rallypermits and the enforcement of food truck rally regulations and permit conditions.

(b) Application.

(1) In order to obtain a food truck rally permit, the entity or organization hostingthe food truck rally must complete an application from provided by the City. The application shallinclude the fol lowing information :

a. Name and address of the owner of the entity or organization hosting the foodtruck rally.

b. Name of person in charge of the fbod truck rally and a telephone numberthat may be used to contact such person during the food trr"rck rally.

c. Name and address of the owner of the propefty on which the food truck rallywill be held, along with the property owner's written authorization.

d. A site plan ofthe property on which the food truck rally will be lield, showingproposed location of each food truck; location of any portable restroomfacilities for customer Lrse, if applicable; and location of any stages, tents,seating areas and any other facilities, structures or equipment to be used inconiunction with the food truck rally.

e. Written description of tlre plans for the food truck rally, irrclr-rding parl<inglocations, traffic control plans and the anticipated hoLrrs of operation.

f. A list of all mobile food service vehicles parlicipating in tlre food trucl< rally,along with confinrration that each velricle operator has obtained or will obtaina mobile food vendor pernrit fi'om the City.

(2) Subrnittal of an application fbr a food trucl< rally rrust be acconrpanied bypayment of an application fee in tlre amount of $50.

(3) Ari application for a food trucl< rally permit shall be frled with tlie perrritadministrator at least 30 days priorto the date on which the food truck rally is to be held. However,at the discretion of tlie permit administrator, taking into account the fbasibility of processing and

approvirrg the application, an application nray be accepted by the pernrit adnrinistrator less tlran 30days prior to a fbod trr"rcl< rally.

(c) Financial guarantees

(1) The City may establish requirements for the posting of a financial guaranteeprior to issuance of a food truck rally permit to ensure that:

a. The premises will be cleared of all debris during and afterthe food truckrally.

b. Any damage to the public right-of-way resulting from the food truck rallyis repaired.

(2) Financial guarantee requirenrents may be established by the permitadrninistrator for food truck rallies.

(3) Any financial guarantee required shall be returned to the applicant only afterall costsforremoval ofdebrisorrepairstopublicright-of-waydamagehavebeendeducted. Intheevent the financial guarantee is not sufficient to cover such costs, the entity or organization hostingthe food trLrck rally shall be responsible for paying all rernaining costs.

(d) Issuance/denial. An application fora food truck rally permit shall be approved if the

application is complete, the food truck rally will comply with tlre standards set forth in this article,and appropriate measures will be in place to adequately protect tlie public health, safety and welfare.The decision to approve or deny a food trr-rck rally permit shall be made by the pennit administrator.If the permit administrator denies an application an application for a food truck rally permit, suchdenial shallbe in writing and provided to the applicant within l5 days of receipt of application. Thedecision of the permit administrator to deny a food trr-rck rally permit may be appealed to the CityCouncil as set forth in this article.

(e) ConditionsoJ'approval.

(1) All food truck rally pernrits shall be sLrbject to the following conditiorrs:

a. All participating rnobile fbod service vehicles rnust hold avalid rnobile foodvendor perrnit.

b. All lighting and electrical equipment bror,rght to the site shall be sLrbject toapplicable permitting and inspection requirements, including paynrent ofapplicable fees.

c. AII tents, stages and otlrer tenrporary f-acilities shall be sLrbject to saf-ety

inspections by the City befbre Lrse.

d. The location shall be cleared of all trash and debris at the errd of the eventand cleared of all ternporary strllctlrres and restored to its previous conditionwithin 48 hours al'ter the event.

e. Traffic control and pedestrian saf'ety in the vicirrity of the event shall be theresponsibility of the pennittee of the event. The City nray requir"e City

personnel be employed to assist with traffic control and pedestrian saf-ety.

Costs anticipated by tlie City for these services shall be estirnated by the Cityarid paid at least ten days in advance by the pennittee as a condition of theperrnit. Following the event, any overpayment shall be refunded to permittee,and underpayment shall be billed to the perrnittee.

(2) In order to protect the health, safety, and welfare of the general public, tornitigate the potential irnpacts of the food truck rally, and to ensure compliance with applicable lawsand regulations, the City rnay impose additional conditions and restrictions on the issuance of a foodtruck rally permit. Such conditions and restrictions may relate to, but are not limited to, hours ofoperation, layout, parking, security, and insurance requirements.

Sec. 11-278 - Bnforcement.

(a) Citation. Each of the following circumstances constitute a violation of this article, forwhich a citation may be issued by a codes enforcement officer or police officer of the City:

(l) Operation of a mobile food service vehicle without a current, valid permit,provided further that each day and each separate location at which a mobile food service vehicle is

operated withor-rt a current, valid perrnit shall be considered a separate violation.

(2) Continuation of temporary mobile food service vehicle operations beyond thetime period authorized by staff.

(3) Holding a food truck rally without a pennit or failing to comply with theconditions of approval for a food trr,rck rally permit.

(4) Failr,rre to conrply with any other provision of this article.

(b) Respon.sihility /br violotion.s. The City codes enforcenrent officers and police officersmay, at their discretiorr irr consideratiorr of the situation, cite arry of the individLrals or entities listedbelow for any violation of the provisions of this article:

(3) The owner of the property on which a mobile food service vehicle is

operated

(c) Su.spensiort o.f permit. A rnobile food vendor pernrit shall be suspended by the permitadministrator if:

(l) The applicarrt for the permit knowingly provided f-alse infbrmation orr the

(2) Two violations of this article have occurred within a six month period inconjunction with the mobile food service vehicle forwhich the perrnit has been issued.

(3) The operator of a mobile food service vehicle fails to maintain a current, validvehicle registration, health department pennit, business license or proof of required motor vehicleinsurance coverage.

(d) Revocation of permit. A mobile food vendor permit shall be revoked by the permitadministrator:

(l) Four violations of this arlicle have occurred within a 12 month period

(2) A rnobile food service vehicle is operated in an unlawful manner so as toconstitute a breach of the peace or otherwise threaten the health, safety or general welfare of thepublic.

(e) Reinstatement.

(l) An operator may reinstate a suspended mobile food vendor permit by takingsuch actions as may be necessary to correct a mobile food service vehicle's noncompliance and payinga reinstaternent fee of $500 to offset the City's cost of enforcement measures, inspections and

compl iance verifi cations.

(2) An operator whose mobile food vendor permit has been revoked may apply fora new permit after 12 months from the date of revocation, provided the operator has taken such actionsas may be necessary to correct a mobile food service vehicle's noncornpliance. The operator shallpay a pernrit reinstatement fee of $500 to offsetthe City's cost of enforcement Ineaslrres, inspectionsand compliance verifi cations.

(3) No permit will be issued to any person who interrds to operate the sanre rnobilefbod service vehicle for which the operator''s permit is cLrrrently suspended or has beerr revoked withinthe precedirrg l2 rnonths.

(f) Notice. Notice of the suspension or revocation ola rnobile fbod vendor permit slrall

be issLred to the operator in writing by the permit adntinistrator.

Sec. I l-279- Appeals.

(a) Filing. The denial, suspension or revocation of a rnobile fbod verrdor pertrit or the

derrial o1'a fbod trLrck rally permit by the perrnit adnrinistrator n-ray be appealed by filing a writtennotice of appeal, establisliing the grounds fbr the appeal, with tlie Mayor fbr City CoLrrrcil review. TheNotice of Appeal shall be filed no later tharr ten business days fbllowing receipt of the rrotice of denial,suspension or revocation.

(b) C'ity Co11t1grl revrev,. When an appeal is filed with the Mayor for City CoLrrrcil reviewas set forth herein, the City Cor,rrrcil lxay reqLrest such additional infbrnration fi'onr the operator and

the perntit adrrirristrator as may be deemed necessary. At the City Council's discretion, the appealrnay be decided based on the written infbrnration and docurnentation sLrbnritted. or a hearing may be

scheduled with the operator and the perrnit administrator. The appeal shall be placed on the agenda ofthe next regularly sclieduled Cor"rncil Cornrnittee rneeting or Council meeting. The City Council'sdecision on the appeal shall be issued in writing, based on a written summation of the pertinent facts,and shall be final. The City Council may reverse the denial, suspension or revocation of a pennit, ormay reduce the waiting period required for reinstatement of a revoked permit if it is detennined thatthe operator has taken reasonable steps to mitigate the violations leading to the revocation and toprevent future violations.

(c) Refunds. There shall be no refund of an application fee for a mobile food vendor permitor food truck rally perrnit that has been denied. There shall be no refund of a reinstatement fee for a

suspended or revoked permit unless the City Council determines on appeal that the permitadministrator acted in error in suspending or revoking the permit.

SBCTION 2. In case of conflict between this ordinance or any part hereof, and the whole part of anyexisting ordinance of the City, the provision that establishes the higher standard shall prevail.

SECTION 3. If any section, subsection, clause, provision orpoftion of this Ordinance is held to beinvalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect anyother section, subsection, clause, provision or portion of this ordinance.

SECTION 4. This Ordinance shall take effect upon final passage, the public welfare requiring such

"safety Partners" Matching Grant Programfor all members who have workers'compensation coverage.

OBIECTIW: To help eligible members purchnse safety items designed to reduce

ut orkers' comp ensation claims.

Safety reimbursable items include:

Expenditures for employee safety devices, equipment and safety training, or employee

education / trainrngthat is necessary to control an employee safety hazatd.

Please read this information in its entirefy before completing the application:

1) Public Entity Partners will reimburse up to 50 percent of the cost of the safetv-related

approved item(s) with a maximum reimbursement based on the Priority Classification

matrix rating.

2) Matching grant funds must be used for employee safety related items.

GRANT CONSIDERATIONS: Consideration of grants will be based on a variety of issues, such as

your entity's risk management practices, loss experience, and availability of funding and submission

date.

1. The primary consideration will be the amount of available funding for the fiscal year.

2. Priority will be given to risk exposures noted in the loss control site surveys/

recommendations andf ot loss trends, and a history of sound risk management practices'

Grant funding will depend on the matrix rating (Priority Classification) assigned to a member which

assesses the workers' compensation earned premium contribution and loss experience for the

previous year. This process allows all members that might have high losses, but who are in

compliancl with sound risk management practices, to have equal consideration. Your earned

premium from the previous year is available after Julv 5.2021, at which time you may call to inquire

about your classifi cation.
