City of Cheyenne Municipal Pool Renovation & Expansion Owner and CMAR Guaranteed Maximum Price (GMP) Agreement Amendment No. 2 Pursuant to Article 2, paragraph 2.4.6 of City Contract #6041 (Agreement) between the City of Cheyenne, Wyoming (Owner) and AP Wyoming, LLC (CMAR), for the Parks & Recreation Department, Municipal Pool Renovation & Expansion, the Owner and CMAR establish a Guaranteed Maximum Price for the Work as set forth below. Assumptions and Clarifications June 13, 2014

The following assumptions and clarifications are meant to provide additional information to clarify the Bid Package #3 GMP Cost Estimate. The items listed below are an overview and are meant to compliment the Detailed Cost Estimate. The Bid Package #3 GMP Cost Estimate is based on the information provided in the following documents:

1. Bid Package #3 Plans Issued by Barker Rinker Seacat Architecture and Noel Griffith, Jr & Associates Architects dated April 18, 2014.

2. Bid Package #3 Project Manual dated April 23, 2014. 3. Addendum #1 dated April 24, 2014. 4. Addendum #2 dated May 1, 2014. 5. Addendum #3 dated May 8, 2014. 6. Addendum #4 dated May 12, 2014. 7. Questions & Responses document dated April 23, 2014. 8. Clarification #1 document dated May 13, 2014.

General Clarifications:

1. Taxes – The project cost includes Sales Tax of 6.00% on materials. 2. Permits – The building permit fee and plan check fee are assumed to be waived or covered by the Owner.

No costs have been included for these fees. 3. Wyoming 70/30 requirements – The project may not meet the Wyoming 70/30 requirements depending on

waivers for the pool scope and some specific specialty scopes and products. 4. Construction Type – The building construction type is type V-B and will include a full fire protection system

(except over the water for both pools). 5. Labor Wage Rates – Davis-Bacon or other special wage rates have not been included. 6. Temporary Heat – We’re assuming it’s acceptable to tie-into the natural gas line on-site for temporary heat

fuel in lieu of propane. 7. Project Furnishings, Fixtures & Equipment (aka FFE) are not included in the construction cost estimate.

These costs are assumed to be carried by Owner outside of the construction budget. 8. Abatement of asbestos and hazardous materials or removal of lead has not been included. Abatement and

removal of hazardous materials are assumed to be contracted separately by the Owner. 9. Remediation of mold has not been included. 10. Cheyenne Light, Fuel & Power costs are not included in the construction cost estimate and are assumed to

be paid by Owner. 11. Special inspections and testing of materials are assumed to be by Owner per IBC (International Building

Code) recommendation. 12. Utility tap and development fees are by Owner. 13. Geotechnical engineering services are by Owner. 14. Commissioning of the building Mechanical and Electrical systems is not anticipated and the construction cost

estimate does not include any costs for commissioning. 15. Professional Architecture and Engineering fees are by Owner. 16. Seismic bracing or special seismic requirements are assumed not required. 17. Translucent-Insulated-Panel Assemblies specification calls for a 10 year warranty. The manufacturer listed

for this product does not offer a 10 year warranty therefore the cost estimate does not include a 10 year warranty. A standard one year warranty is included.

18. Painting and high performance coatings includes a standard one year warranty. The final BP#3 specifications noted a five year warranty for high performance coatings. A five year warranty is not included

in the cost estimate. This is not industry standard and is cost prohibitive to the project. The Price Options list includes an additional cost for five year warranty and an option for two year warranty.

Pool Clarifications:

1. Pool Underdrain – pool underdrain system is included per the geotechnical recommendations. 2. Pool Structure – 8” thick pool slab is included per details on PL112 and 13/PL102. 3. Play Structure and Water Features – estimate includes Vortex L-1 play structure and Vortex donut spray.

Other water features to be field fabricated per plan. 4. ADA Pool Lift – estimate includes one ADA pool lift per revised equipment schedule from WTI.

Fire Protection:

1. Fire Protection System is included for the entire building with the exception of over the pool water at both pools. The SD Report noted that the fire protection system is not required over the water.

2. Corrosion resistant uprights in pool and pool mechanical areas. Mechanical:

1. Plumbing includes the backwash holding tank, 2,450 gallons, located in the Pool Storage Room. 2. Plumbing includes the pool deck trench drains located around the leisure pool. 3. HVAC includes RTU-1, PDU-1 and PDU-2 to serve the existing building and expansion. 4. Aluminum ductwork is included for the Natatorium expansion and as noted for the existing Natatorium.

Electrical:

1. New electrical service of 800 amps, 208 volt, three-phase is included. 2. The construction documents do not include any design for the low voltage systems such as tele/data cabling,

paging, security and audio/visual. Rough-in for these systems is not included in the estimate. At the time of GMP the City was not sure what the low voltage system requirements will be for this project.

3. An allowance for Intrusion Detection ($5,000) and Surveillance ($10,000) systems is included. Exterior Improvements:

1. The cost estimate includes a landscaping and irrigation allowance of $59,105. The construction documents do not include any plan or narrative to identify landscaping requirements.

2. Modular block retaining walls are included per plan and specification. The walls are assumed to be a max height of 30”, as noted in the plans, which does not require engineering or stamped/sealed shop drawings. Costs for engineering of the retaining walls have not been included.
