A pedestrian crossing will be constructed in place of the road connection. The applicant is responsible for the cost of construction of this connection over the valley. OVERVIEW

This application involves the removal of the requirement for the Mistymorning Drive collector road valley crossing It was approved by the Planning Design and Development Committee meeting of June 24 2013

Subsequent to the approval of the application area residents requested a reconsideration of the proposal specifically to determine if the deletion of the road connection would reduce the

need for traffic signals at Mistymorning Drive and Airport Road It was subsequently determined by the Region of Peel that traffic signals are not warranted even if the connection existed

2 THAT a by-law be passed to adopt the Official Plan Amendment removing the Collector Road designation from Mistymorning Drive and

3 THAT it is hereby determined that in adopting the attached Official Plan Amendment Council has had regard to all matters of Provincial Interest and the Provincial Policy Statement as set out in Section 2 and 3(5) respectively of the Planning Act RSO cP 13 as amended

BACKGROUND

This application involves the removal of the requirement for the Mistymorning Drive collector road valley crossing The public meeting for this application was held September 5 2012 The Recommendation Report was approved by the Planning Design amp Development Committee on June 24 2013 and ratified by Council on August 7 2013

Following the Recommendation Report some area residents raised concerns about the need for traffic signals at the intersection of Mistymorning Drive and Airport Road Staff was requested to investigate whether retaining the valley crossing as a collector road would increase the traffic volumes enough to warrant the need for traffic signals In order to address this concern an informal public meeting was held by the area Councillor for the residents on June 26 2014 Both City staff and Regional staff were in attendance The Region confirmed that not only are traffic signals not warranted at this time but that the installation of unwarranted traffic signals would have a negative effect on road safety and efficiency The Region subsequently confirmed that traffic signals would not be warranted even if there was a collector road crossing of the valley in place

CURRENT SITUATIONANALYSIS

After hearing from the area residents and the Region of Peels response staff are in a position to bring forward the implementing Official Plan Amendment for Councils consideration This amendment will provide the Official Plan policy basis to facilitate the construction of the pedestrian connection

Through an executed subdivision agreement for the lands located generally to the east of the proposed valley crossing (File C07E11014 and 43M-1918)

Fernbrook Homes (Castlemore) Limited is responsible for the cost of construction of a connection over the valley

The Official Plan amendment will remove the vehicular valley crossing by deleting the collector road designation from a portion of Mistymorning Drive and re-designating the remainder of the road to the appropriate local road designation

The purpose of this amendment is to remove the Collector Road designation

from the lands shown outlined on Schedule A to this amendment to permit the

construction of a pedestrian bridge in place of a vehicular crossing

The lands subject to this amendment are located between Airport Road and

Fairlawn Boulevard approximately 290 metres (951 feet) north of Castlemore

Road and within part of Lot 11 Concession 7 ND in the City of Brampton

30 Amendments and Policies Relative Thereto

31 The document known as the Official Plan of the City of Brampton Planning

Area is hereby amended

(1) by amending on Schedule BCitv Road Hierarchy thereto the

Collector Road designation by deleting a portion of the road and

amending parts of the road to local road as shown outlined on

Schedule A to this amendment

(2) by amending on Schedule UB1 Citv Road Riaht-of-Wav Widths

thereto the 23-26 metres designation by deleting a portion of the

road and amending parts of the road to local road as shown

outlined on Schedule B to this amendment
