Ask for ReferralsYour family and friends may know a good agent. Besure to ask what they liked and disliked about howthe agent conducts business, not what they are likeon a personal level. Also, consult with neighbors whohave recently bought or sold their homes, how theiragents performed for them.

Seek an Agent With the Right ExperienceNeighborhood specialists have house-by-housemarket knowledge that is invaluable when you arecomparing your home to others. While residentialagents are licensed to sell any property in the state,you want your agent to have experience with thetype of home you own whether it’s a single-family,condo, high-rise, rural property, vacation orinvestment property.

Interview at Least Three ProfessionalsThe National Association of Realtors® recommendsthat you interview several agents before making yourdecision. Compare their experience, marketingplans, networking abilities, and commission rates,with the understanding that service levels should and will correspond with costs.

Ask Your Potential Agent the Following Questions:Will you represent me exclusively or both the buyer and seller in the transaction?This helps you understand service levels and responsibilities owed to you as the seller.

How do you plan to market my home?The marketing plan almost always includes a listing in the local multiple listing service, but there may beother means for your home to be presented. Ask the agents to show you examples of their marketingmaterials and ads that they’ve done for other homes. Ask how the agent plans to market via the Internet,mobile devices, and in the local newspaper.

What is your level of experience?There's no substitute for experience, except enthusiasm. A new agent will have close supervision by themanaging broker, so you’re likely to get the same level of service as a more experienced agent. But an


agent who has been through buyer's and seller's markets knows what can go right or wrong in anymarket and is more likely to be prepared for challenges. A more experienced agent will also have anetwork of former clients to inform about your home.

Do you hold any designations, and what are your specialties?Agents who hold designations have undertaken additional learning opportunities than those required bythe state. This shows motivation and a strong sense of professional pride.

Why should I choose you over other agents?The answer to this question should be specific including the number of years on the job, the agent'sranking (if available), the list-to-closing price ratio, the average number of days the agent takes to sell ahome compared to the general market.

Look for excellent communication skills. Hire an agent with skills that will complement your preferredmethods of contact; for example, if you like to text message, hire an agent uses text messaging. Askyour agent how frequently he will be in touch and when to expect reports about your listing.

WHAT YOU DON'T KNOW ABOUT DISCLOSURES

Most states have laws that require home sellers to disclose what they know about the operating andenvironmental condition of their homes as well as any situation or encumbrance that may affect thehome's value.

The best way to feel confident about the condition ofyour home is not to rely on the seller's disclosure.Have your home inspected by a licensed professionalhome inspector.

Disclosure StatementIf a shower pan leaked on the floors, and wasrepaired, that must be disclosed to the buyer, even ifthere are no outward signs that there was ever aproblem. A disclosure form is called a Real EstateDisclosure Statement, Property Condition Disclosure,or Condition Report. They are required by the federalgovernment to disclose the presence of lead paint,and many states require seller disclosures withregard to radon, gas believed to cause cancer.

"As Is"Some states allow sellers to disclaim disclosures tomake an "as is" sale, which means the seller has nointention of guaranteeing the property, but they mustdo so in writing. Even then they must disclose anymaterial defects they know of. Such forms saysomething to the effect of "the owner of the realproperty makes no representations or warranties asto the condition of the property and the purchaser willbe receiving the property as is with all defects whichmay exist". Even then, the seller must fill out afederal and/or state-mandated disclosure form.

While the forms may ask sellers to disclose whether or not they know there is lead paint or radonpresent, sellers aren't usually required to do tests to determine the presence of toxic chemicals. But if theseller notes the existence of a problem, he or she may need to provide proof of tests and/or remediationfor any problem that has been disclosed, including fire and water damage.

SellersIf you are a seller, your real estate professional will provide you with the disclosure documents you'llneed to sell your home. It's important to answer every question as truthfully as you can. Your real estateprofessional can not fill out the disclosure for you. If you're in doubt about what to disclose, such as arepair, it's best to err on the side of too much information than not enough. You don't want to give thebuyer any room for complaint after the closing. Sellers aren't expected to know everything about theirhomes. Disclosure forms allow you to check the “I don't know” box, but you should only do so if you trulydon't know the condition of a certain appliance or system. When you disclose a problem to the buyer thathas been fixed, be sure to provide a copy of receipts and invoices. The repairs should correspond with


the problem. Many agents provide a copy of the disclosure to interested buyers, so they can get an ideaof the home's condition before making an offer or having an inspection.

BuyersIf you are a buyer, read the seller's disclosure carefully and use common sense when you see thatsomething has been flagged. Leaks often produce mold, so ask the seller if the area with the leak hasbeen tested for mold. If a seller-disclosed problem hasn't been fixed, you can either ask the seller to fix it,or offer a little less for the home. Keep in mind that sellers aren't expected to disclose what should beobvious or discernible to you as the buyer. Use the disclosure as a guide for what to look at throughoutthe home. If one shower pan has been replaced, chances are the shower pan in the second bath willneed to be replaced soon.

The best way to feel confident about the condition of your home is not to rely on the seller's disclosure.Have the home inspected by a licensed professional home inspector. For a few hundred dollars and afew hours of your time, you can follow along and learn as much as possible about the condition of yourpurchase.
