Constitution

PREAMBLE: We the Chicano/Latino students of the University of California, Berkeley realize that:

● Cultural, social, and economic barriers have been raised against the Chicano/Latino community;

● These barriers preclude the proper receipt of medical care in the aforementioned community.

● Standard medical education and practice have not made the necessary changes to ensure proper medical care for that community.

● These medical disparities have created serious health problems for that community to the extent that it suffers from one of the worst health records in America.

● The only visible means of alleviating this situation is for the Chicano/Latino community to address these problems.

Therefore, as Chicano/Latino students and all other empathizing persons, we hereby unite to form the organization henceforth known as Chicanos/Latinos in Health Education (CHE).

We assume upon ourselves the following goals:

1. INSTILL in each student the desire and dedication to serve mankind in general and in particular the Chicano/Latino community.

2. EDUCATE each student in the healthcare needs of the community and to help them discover ways to effectively deliver health care education.

3. EDUCATE the community in the use of available healthcare facilities and resources.

4. ASSIST & ADVOCATE in the recruitment of Chicano/Latino students into the health sciences and other professional fields.

5. PREVENTION THROUGH EDUCATION of health disparities by addressing the lack of diversity and cultural competency in the healthcare field.

TO ACCOMPLISH THE GOALS, CHE, AS AN ORGANIZED AND UNITED BODY HAS ADOPTED THE FOLLOWING ORGANIZATION:

ARTICLE IOrganization

● Chicanos/Latinos in Health Education shall be comprised of the Board of Officers, and the General Membership.

● Chicanos/Latinos in Health Education shall be affiliated with the ASUC as a Student-Initiated Service Group.

● Dues are $15 per semester; this fee may be paid anytime during the semester. The amount of dues to be paid may be amended by a majority vote. 

● Any member has the right to initiate a project or event, therefore necessitating the right to add to the agenda to any meeting.

● Any member shall receive a copy of the current Constitution upon request. All members shall receive a copy of the abridged Constitution at the first general meeting of the academic year. The abridged constitution shall be comprised of the Preamble, Article I, II, XIII, and XIV.

● UCB CHE Signature Events include the Community Health Education Fair, ¡Adelante Jornaleros Unidos en Acción! (¡AJUA!), Day in College, Interns’ Health Presentations, End-of-Semester Banquets, Taco Sales and the Día de los Muertos Conference (DDLM) every three years. CHE Events put on in

collaboration with other campus organizations, namely PAHC and BSHA, include the Minority in Health Conference. Other Community Service Events include Semana Binacional de Salud.

ARTICLE IIBoard of Officers

● The Board of Officers shall be the legislative body of CHE.● The Board of Officers has the power to establish the goals, priority of issues,

and the commitment of the organization so long as the desires and wishes of the general membership are taken into account seriously.

● It is recommended that the Board of Officers hold weekly meetings to ensure continuity in order for the activities of the organization to run smoothly.

● Any Board Officer shall have the right to call for meetings not already scheduled.

● Board Officers shall be cognizant of the importance collaborating freely with fellow Officers when necessary.

● Board Officers shall be responsible for retrieving correspondence from the ASUC office whenever is necessary.

● The Senior Advisor and Co-chairs must have held a Board Officer position for a minimum of one year.

● No Officer can hold concurrent office for another position. CHE Officers can hold the same position for two consecutive years only if no new applicant has applied for the position in question.

Description and Duties

● The Board of Officers shall consist of 2 Co-chairs and 12 elected Officers totaling 14 Board Members. In order to incorporate or terminate a position, approval of the Board of Officers is required.

● Their term of office shall be one academic year.● Upon hearing project reports from the members, or project leaders, the Board

of Officers may make recommendations to that person as to which direction and action he/she should take.

● Committee Leader: any member in charge of the planning of an event● Project: any event planned for the organization or for the benefit of the

Chicano/Latino community.● The Board of Officers shall vote as a body (when voting with general

membership, they shall vote as a general member; when voting at a Board of Officers’ meeting, they shall vote as a Board of Officers).

● Officers shall submit receipts for reimbursements to Finances Chair no later than two weeks after date of purchase.

● It is the vote of the Board of Officers that shall decide upon large expenditures for the organization. A majority vote of those present shall pass a motion. Large expenditures are defined to be any transactions that surpass 15% of ASUC Programs and Events moneys allocated in a given year.

● Officers shall prepare their successors for office at a transition meeting held after elections.

● Officers shall arrange a weekly meeting with their respective interns in order to acquaint them with their duties and check on their weekly progress.

● The Board of Officers shall be present at all General and Business Meetings and they may only have 2 unexcused absences from all scheduled meetings. Should an Officer be at fault in this matter he/she shall be approached by the Co-Chairs in an attempt to rectify the situation. Upon a third fault, the matter shall be brought up for discussion before the Board of Officers and the Officer may be subject to impeachment.

ARTICLE IIIChair Duties and Guidelines

● Two Co-Chairs are recommended to be the official spokespersons of the organization

● Shall be responsible for communicating with the Board of Officers in order to compile an agenda so that both the general and business meetings are conducted in an orderly manner.

● Shall facilitate CHE General and Business Meetings.● Shall take on the responsibility of overseeing the administrative functions of

the organization.● Shall be responsible for planning and contacting speakers for General

Meetings.● Shall oversee CHE events and assure their successful realization.● Shall create a calendar of events every semester and subsequently make it

available to the general membership by means of CHE “Meeting tomorrow and CHE Events” email.

● Shall organize, update and maintain a list of professional contacts obtained during the year for successors.

● Shall submit an End-of-the-year Report to the incoming Co-Chairs. The report shall include the highlights of the year as well as recommendations for the upcoming year.

ARTICLE IV

Fundraising Officer Duties and Guidelines

● Two Fundraising Chairs are recommended to perform the duties related to this position.

● Shall be responsible for organizing fundraising events, including but not limited to CHE’s signature Taco Sales.

● Shall promote fundraisers within CHE by providing fundraising options, as well as accepting other ideas.

● Shall encourage participation of members and may assign duties/work shifts to CHE members who sign up for an event in order to insure an organized and successful fundraising event.

● Shall be responsible for requesting donations for all CHE events, including but not limited to DDLM, MIH, ¡AJUA! and CHE Fair.

ARTICLE VHistorian Officer Duties and Guidelines

● One Historian Officer is recommended to perform the duties related to this position.

● Shall document events through media and shall ensure that CHE media promotes solely CHE events and opportunities as well as professional opportunities for its members.

● Shall create a scrapbook of all CHE events for the Fall and Spring semester, which shall be presented at each End-of-the-Semester banquet.

● Shall maintain and update alumni contacts.● Shall coordinate CHE End-of-the-Semester banquets.● Shall act as the primary coordinator for CHE interns. Hence, he/she shall be

responsible for creating a timeline for the health presentations, which shall be proposed by the first business meeting of the semester and shall thereafter facilitate 4 interns meetings in the semester.

● Shall Coordinate Annual Day in College event alongside the Secretary. ● Shall create an alumni newsletter, to be distributed every semester.

ARTICLE VINetworking Officer Duties and Guidelines

● Two Networking Officers is recommended to perform the duties related to this position.

● Shall update and maintain contact information for the other CHE chapters in California as well as update other CHE chapters once per semester about Berkeley CHE events.

● Shall facilitate networking with other UCB organizations (both student and professional).

● Coordinate events with other organizations (e.g. socials, meetings, conferences).

● Shall serve alongside Public Relations as the lead coordinators of the Minorities in Health Conference in the Spring Semester.

ARTICLE VIIPublicity Officer Duties and Guidelines

● Two Publicity Chairs Officer are recommended to perform the duties related to this position.

● Shall publicize all CHE events.● Shall design publicity materials for CHE events (e.g. flyers, brochures). ● Shall be responsible for acquiring a design for T-shirts, sweatshirts and stoles.

Shall thereby be responsible for ordering T-shirts in the Fall, and sweatshirts and stoles in the Spring.

● Shall coordinate tabling with members and Board Officers.● Shall be in charge of the upkeep and mounting of the CHE Sproul Board and

shall update its displayed information every semester. ● Shall forward weekly reminder emails to CHE members. Email reminders

include but are not limited to “Meeting tomorrow and CHE Events” email sent out Tuesdays and weekly “CHE Newsletter[s]”. They shall also ensure that CHE correspondence promotes solely CHE events and opportunities as well as professional opportunities for its members.

● One Public Relations Officer is recommended to perform the duties related to this position.

● Shall facilitate the interaction between CHE and the broader communities (e.g. RAZA, the city of Berkeley, and the Berkeley campus).

● Must participate actively in RAZA caucus by communicating health concerns of the RAZA community, and by participating in relevant RAZA community events.

● Shall synthesize any relevant information for CHE member from the RAZA Caucus, and shall subsequently make it available to the Publicity Officers.

● Shall serve, alongside Networking, as the lead coordinators for the Minorities in Health Conference.

● Shall serve as the coordinator for community service events, including but not limited to ¡AJUA! and Semana Binancional de Salud.

● Shall coordinate with Fundraising Officer regarding any relevant donations for Community Service events.

ARTICLE IXSecretary Officer Duties and Guidelines

● One Secretary is recommended to perform the duties related to this position. ● Shall be the contact person in CHE general brochures and shall promptly reply

to CHE inquiries directed to him/her. ● Shall manage and update CHE official listservs throughout the semester.

Listservs include ○ General Membership listserv - [email protected]○ Paid Members’ listserv - [email protected]○ Interns’ listserv - [email protected]○ Unit Takers’ listserv - [email protected]○ Board of Officers listserv - ucbcheofficers@lists berkeley.edu

● Shall produce and maintain an accurate and up-to-date CHE Membership Directory every semester, which shall be made available to the Treasurer for dues record purposes. 

● Attend all meetings and produce a sign-in sheet that reflects members’ weekly attendance for all General Meetings and main CHE events. The attendance records shall be part of the Directory.

● Arrange for a replacement if unable to attend meetings.● Compose the official minutes of all club meetings and keep them on file.

○ It shall not be necessary to read the minutes of CHE unless specifically requested by any Officer or member of CHE.

○ Business meeting minutes shall be sent to the interns’ and Board Officers’ listserv no later than one day after the meeting. General meeting minutes shall be included on the Tuesday email of the following week.

● Shall be the CHE Units Coordinator and shall maintain contact with the CHE faculty advisor. See Article XIV.

● Shall regularly notify Unit Takers of their progress throughout the semester. ● Shall Coordinate Annual Day in College event alongside the Historian

● One Senior Advisor is recommended to perform the duties related to this position.

● Shall be responsible for updating, maintaining and coordinating the test bank.

● Shall serve as the main contact between CHE and the Latino Medical Student Association (LMSA) and the UCB School of Public Health Graduate Students in charge of the PH Mentorship.

● Shall coordinate advising sessions once per semester and socials with LMSA

● Shall keep a list of CHE members and their LMSA and/or PH Mentor.● Shall be responsible for coordinating study hours including dates, times and location

● Shall be responsible for matching classes for study buddies.● Shall be responsible for creating a course-list of recommended classes.● Shall keep track of midterm and final exam dates of all CHE members.

ARTICLE XITreasurer Officer Duties and Guidelines

● Two Treasurers are recommended to perform the duties related to this position.

● Shall prepare and submit budgets for approval by the Board of Officers whenever needed and shall allocate a budget to meet the financial necessities of each Board Officer.

● Shall collect member dues and provide a comprehensive report of financial standing at the last Business Meeting of every semester.

● Shall maintain accurate record of all club financial transactions thereby reconciling deposits and expenditures.

● Shall collect receipts, process reimbursements through callink , submit paperwork to the ASUC no later than two weeks from the time receipts were received and shall notify payees when reimbursements are ready to be picked up.

● Shall maintain a maximum balance of $200 in the cashbox; any amount that exceeds that sum shall be deposited into the ASUC Misc. Account no later than one week after they were earned.

● Shall prepare and submit ASUC midyear report and Spring Budgeting report in February and March respectively.

● Shall apply for grants to fund events. (e.g. Fifth Account, Student Opportunity Fund).

● Shall deposit leftover cashbox funds to ASUC Misc. account at the end of the academic year.

● Shall coordinate the location(s) where Interns’ Health presentation shall be delivered every semester.

ARTICLE XIIBoard of Officers Elections and Guidelines

At the end of each Spring semester, Co-Chairs shall make the application to CHE’s Board of Officers available to the general membership. In order to assure a smooth transition between Boards, Co-Chairs shall be elected by March and the rest of the Board shall be elected by the second week of April. The application process shall

consist of a written application, as well as an interview. Only members who have paid semester dues shall be eligible to apply. The current Board Officers present at the interviews shall then select the new Board to the best of their abilities by a majority vote. In the case of a tie, the co-chairs shall be allowed two votes. The following are guidelines that shall be taken into consideration during the application process.

• Potential to contribute to CHE• Previous experience or involvement in CHE activities• Enthusiasm about being a CHE Officer• Ideas to improve CHE• Attendance of at least 1 business meeting in an Academic Year.

The announcement of next year's CHE Officers shall be made at the End-of-the-Year CHE Banquet.

Current CHE Officers applying to be part of next year's Board can be considered to repeat their current position only if no new applicant has applied to the same position. Current CHE Officers shall not be part of the interview or selection process for the position they applied for.

ARTICLE XIII

Interns

The CHE internship program is designed for CHE members to further deepen their involvement with the organization. The internship allows students to brief themselves on how CHE is run, hence giving them a better understanding of Officers’ duties and expectations. Similarly, the internship promotes the development of leadership skills including organizational skills, time management and public speaking skills. Ultimately, this program aims at fostering CHE’s strong working and supportive community among interns, Officers and members.

10 Intern Positions Available

○ One Co-Chair Intern ○ One Fundraising Intern○ One Historian Intern ○ One Networking Intern ○ Two Publicity Interns ○ One Public Relations Intern○ One Secretary Intern○ One Senior Advisor Intern○ One Treasurer Intern

Requirements and Duties

● Must take CHE for at least 1 unit and thereby comply with the CHE Units Contract. If unable to take CHE for units, Interns shall still be required to submit units’ paperwork that attest the completion of 45 hours of CHE work.

● Must pay dues. ● Must attend all General and Business meetings, unless there is a conflict,

which must be approved by the Co-Chairs. Should you be unable to attend a meeting, you must inform the Intern Officer and the Secretary no later than one day in advance.

● Intern positions are one-semester positions; it is advised but not mandatory that interested students apply again for any position they have not yet held.

● Must attend a mandatory monthly Intern meeting facilitated by the Interns’ Coordinator, (Historian). These meetings allow interns to provide feedback, check on their status, assign duties and provide a space for interaction amongst interns.

● Every semester, Interns shall collaborate to plan and run a General Meeting.● Shall work with one another in order to design/enhance, plan and execute

Health Presentations, which shall be then delivered to the community. ● Interns shall be active in most of CHE activities and complete their unit

requirements● Interns shall help Officers with their events and be given duties throughout the

semester.● Interns shall be in charge of organizing the committees for the CHE Health

Fair. ● Co-Chair and Senior Advisor Interns who want to apply must have interned at

least 1 semester of intern experience, or at least have been an active CHE member.

Interns’ Positions Description

Co-chair○ Shall update General Meetings’ and events feedback spreadsheet

throughout the semester.Fundraising

○ Shall be in charge of one major fundraiser in the semester. ○ Shall update the Google doc spreadsheet for volunteers’ sign-up for every

Taco sale.○ Shall provide feedback to officer and will seek to improve fundraisers’

efficiency by means of suggesting new procedures. ○ Shall help seek donations for various CHE programs.

Historian○ Shall create invitations to end-of-the year banquets ○ Shall contribute to managing media at events including but not limited to

scrapbooking○ Shall assist the Historian officer in the organization of the semester

banquet. ○ Shall be responsible for the CHE camera, and take electronic documentation

of CHE events. Networking

○ Organize 1 social/semester○ Aid in MIH planning

Publicity○ Shall be in charge of updating the information on CHE’s Sproul Board every

semester. ○ Shall be in charge of reminding members of their time slots for tabling and

flyering. ○ Shall assist in making event posters

Public Relations○ Shall attend RAZA Caucus meeting (held bimonthly).○ Shall be in charge of running one ¡AJUA! Event every semester, he/she shall

thereby be responsible for designing or improving a Health Brochure while abiding by the Public Relations Officer guidelines.

○ Shall attend MIH planning meetings in the Fall semester, or Spring semester during DDLM year.

Secretary○ Shall be in charge of producing sign-in sheets that reflect weekly attendance

for all members for each of the General meetings and coordinate with Secretary for subsequently updating the CHE Directory.

○ Shall be in charge of producing minutes for general and business meetings. ○ Shall assist with weekly attendance records for general meetings.

Senior Advisor

Treasurer○ Shall assist in collecting member dues○ Shall assist in reimbursement process○ Shall aid in grant process for CHE events through semester

ARTICLE XIV

CHE Units

The CHE Units Program shall allow members to take CHE for units as a means of deepening their involvement with the organization while completing one or two academic units. The Secretary shall be responsible for delivering the below information to Unit Takers by means of a contract, which shall be signed and submitted to the Secretary. All Unit-Takers, including Board Officers shall turn in CHE Units Event Forms in order for hours to be credited.

CHE Units Description and Requirements

● Unit Takers shall contribute 45 hours towards CHE activities for one unit and 90 hours for two (2) units. Attendance to General Meetings is mandatory but they do not count towards hours credits.

● Unit Takers shall pay dues.● Unit Takers shall be responsible for submitting CHE Units Events Forms

signed by any Officer to the Secretary no later than deadline specified by Secretary. CHE events include but are not limited to CHE Socials, CHE Business Meetings, CHE Community Events, and CHE Conferences. General meetings shall be excluded from the definition of CHE Events for Units Hours purposes.

● Unit Takers shall write a short reflective analysis paper and submit it to faculty advisor by the deadline established by the Secretary.

● Unit Takers shall attend all weekly general meetings. Two excused absences

and one unexcused absence shall be allowed. To be “excused” the Secretary must be notified prior to the CHE meeting.

ARTICLE XVDissolution

● In the event of dissolution of the CHE organization, all unspent ASUC funds shall remain the property of ASUC. All privately unspent ASUC funds shall be donated to non-profit organizations benefiting the Chicano/Latino community. Such non-profit organizations shall be chosen through a majority vote by the Board of Officers.

ARTICLE XVIAmendments

● These bylaws may be amended, repealed, or altered in whole or in part by a majority vote of members at any duly organized meeting of the membership. All amendments to the constitution shall be adopted only after a majority vote of all members present. Additional articles and amendments may be included if they are in consonance with the University of California and ASUC regulations and policies. These must be filed with the student affairs office within one week of adoption.

● We shall not haze according to California State law, we shall not restrict upon race, color, national origin, sex, sexual orientation, age or handicap.

Amendments made in the Spring of 2011 by Juan Cabrera: Addition of Internship Program, Removal of DULCE Representative Section from Article III, Removal of Article X (Head of Committees). Approved on

August, 27, 2011 at CHE Board’s Annual Summer Retreat.

Amendments made in Spring of 2012 by Miguel Linares: Editing of Internship Program, Editing of Article II, Editing of Article XII, Editing of Article XIII, Addition of Day in College, Transfer of all donation responsibilities to Fundraising, Historian in charge of Banquet.

Approved on April 2, 2012 at CHE’s 9th Board Meeting.

Amendments made in Fall of 2013 by Claudia Pacheco Editing Preamble by omitting “Chicano/Latino” to describe members. Editing Article I by removing Breast Cancer Walk, Relay for Life, Soup Kitchen, & Kindercaminata as signature events.
