Overview

Charter Schools were authorized by Del. C., Title 14, Chapter 5, originally passed in 1995. Charter Schools were created to improve student learning; encourage the use of different and innovative or proven school environments and teaching and learning methods; provide parents and students with improved measures of school performance and greater opportunities in choosing public schools within and outside their school districts; and to provide for a well-educated community. Financial Reform Resources

Overview

Financial Reform Resources provides the department with expertise and services in the areas of state funds, federal funds, appropriated and non-appropriated special funds fiscal operations.This group also provides support services to the department in day-to-day operations. State and Local Funds A charter school is a public school and is not allowed to charge tuition except in accordance with 14 Del.C.c.6. A charter school shall not collect fees not permitted to be assessed by school districts. A charter school is eligible to receive both State funds and funds from the local school districts in which its students reside. Requirements and Procedures State and local fund calculations are funding mechanisms that are primarily determined by:

Student enrollment

Local cost per student rates

Staff certification, experience and education level

Transportation contracts and eligible students

Legislatively mandated funding streams

The September 30 Unit Count is:

- A statewide student count that is conducted each year by the Department of Education. District and charter allocations are based on a ratio of students. The ratios are considered as

equivalent to a funding “unit” as referenced in 14 Del. C. § 1703.

- Local funds are calculated using Needs Based Funding divisors. Local Funds calculations per student category by school district can be located at the following site:

- Click on the Revenue Estimates link under Finance and the rates are detailed on that page under Resources for operating Charter Schools.

- Local fund billings to the districts are displayed on the web after July 1 for preliminary billing of 35% and after September 30 unit count for final billing.

Preliminary: 75% at the beginning of each fiscal year (50% for new schools and schools on formal

review) state funds are forwarded in July and reflect May 1 student enrollment.

Final: The remaining balance of state funds is typically forwarded by December; amounts are recalculated and adjusted to reflect the September 30 unit count.

Financial Planning & Budgeting Process This is the process of the financial planning and budgeting for expectation of new charter applicants and schools that will open this year.

Training of Charter School Board and Citizen Budget Oversight Committee Members All Charter School board members and Citizen Budget Oversight Committee members must be trained by a sponsored Department of Education training session. Sessions will be advertised through the school leaders and then shared with board and committee members. Within these training materials are sample budgets and other pertinent documents that business managers in a charter school should be maintaining to responsibly manage the funds of a charter school.

Transportation

Overview

A Delaware charter school has a choice of providing transportation to its own students or asking the school district where the charter school is located to provide transportation. If the charter school provides transportation for its students, it may contract out the service. In any event, the school’s transportation activities must meet state requirements.

School Facilities

Overview As an independent school, each charter school must arrange for and finance its own school facilities. School facilities for charter schools are approved by the local jurisdiction through the issuance of a Certificate of Occupancy. Charter school facilities shall be designed and/or constructed to meet the function and occupancy load placed on the facility. School facilities should also be designed and/or constructed to further enhance the educational process of the students who will occupy it. Overview

The goal of the Technology Resources and Data Development workgroup is to collect, organize, and facilitate access to accurate and current data in order to provide schools, districts, DOE program managers, and other information consumers easy access to the information they need to make informed educational decisions. Delaware School Choice Program

Overview The Delaware School Choice Program began in the 1996-1997 School Year. The law addressing School Choice is found in 14 Del. C. c. 4. There are no statewide regulations addressing the School Choice Program. (See Delaware Code online at http://delcode.delaware.gov/title14/c004/index.shtml). Nonpublic School Information

Overview The Delaware Code requires all nonpublic schools to register with the Department of Education (DOE). This includes both private schools and homeschools. Enrollment information is collected as of September 30 of the current school year and attendance information is collected at the end of the school year. Once you have registered with the DOE, a school code is issued; the school information is put on our database. Enrollment and Attendance is recorded online. Adult and Prison Education Resources

Overview The workgroup provides academic instruction to adults (16 years of age and older) who are out of school. Students who attend want to increase their skills in order to obtain a job or job promotion; access vocational training; enter college; support their children in school; and/or become more active in their communities. Through Adult Education, students can upgrade their Reading, Math, and Writing skills; increase their English language proficiency; prepare for the GED®; or complete their credits to obtain a State of Delaware high school diploma. Technical assistance is given to programs that develop basic skills and provide instruction to allow adults to earn a high school diploma.

Private Business and Trade Schools

Overview Private business and trade schools are educational institutions privately owned and operated for profit or nonprofit by an owner, partnership, or corporation offering business or trade and industrial courses usually associated with business training schools, trade schools or specialized skill training schools. Applications for an initial certificate of approval to conduct a private business and trade school, and for annual renewal of such certificates, shall be made on forms approved by the Department of Education. Teacher and Administrator Quality

Overview

The group focuses its work on the development and implementation of policies for licensure and certification, induction programs, educator evaluation and assessment, curriculum & professional development, federal requirements, and initiatives to support Delaware's ongoing education reform initiatives.

Delaware Center for Educational Technology (DCET)

Overview The Delaware Center for Educational Technology is intended to create a modern educational technology infrastructure in Delaware's public schools for the purpose of enabling students through the use of information technology, to meet the academic standards set by the State Board of Education and to develop the skills needed by a world-class work force. Delaware Interscholastic Athletic Association (DIAA)

Overview The Delaware Interscholastic Athletic Association (DIAA) is responsible for administering interscholastic athletics at the high school and middle school levels for 89 member schools. DIAA sponsors and manages state championship tournaments for 11 girls and 12 boys; sports for the benefit of all student-athletes statewide. Management of these events is accomplished through the work of 23 committees representing more than 230 volunteers. DIAA also recognizes 17 sports officials’ organizations representing over 1,200 certified officials. In addition to the Secretary of Education, a Governor-appointed 18 member Board of Directors provides administrative oversight to DIAA. Our mission is to promote the educational value of interscholastic athletics and assure interscholastic athletics remains compatible with the educational mission of our member schools. Overview

In the State of Delaware, any person under the age of eighteen seeking a driver’s license must complete an approved driver education program. Federal and State Programs

Overview The purpose of Federal and State Consolidated Programs is to build each school's capacity for continuous advancement toward the goal of all students meeting or exceeding challenging Delaware State Standards. Overview

Career and Technical Education

Overview The Career and Technical Education workgroup is responsible for the oversight of Career and Technical Education Programs. The work group administers both federal (Perkins IV) and state programs relating to Career and Technical Education. Career and Technical programs are administered under the following content areas: Skilled and Technical Sciences, Health Sciences, Technology, Agriscience, Family and Consumer Science and Business and Marketing. The work group also works with the training of Delaware's 1,700 registered apprentices, and oversight of instruction to upgrade the skills of incumbent trades persons. The Career and Technical Education work group also administers federal funds for postsecondary vocational education programs. The group is also highly involved in the creation of Programs of Study that works to develop K-14 career guidance systems and career pathways that aid the transition from school to work. Archives

Overview

The Delaware Public Archives is one of the oldest public archives programs in the country.

The mission of the Delaware Public Archives is three-fold:

To identify, collect, and preserve public records of enduring historical and evidential value;

To ensure access to public records for present and future generations of Delawareans; and

To advise and educate in the creation, management, use, and preservation of public records

The Archives holds more than 95,000 cubic feet of government records and historical documents.

Records Management/Records Retention

A charter school has a responsibility to protect and preserve certain documents, files and records that are generated by the school on a regular basis through normal operations. For example, there are student records and employee personnel records. Each of these has a legal retention period. The school must become familiar with what must be retained and for how long. The Delaware Public Archives (see “Agency Contacts”) is established as a division within the Department of State and charged with administering, implementing and enforcing all provisions of the Delaware Public Records Law. The Archives is the official repository for the archival records of the State of Delaware and all political subdivisions. The Archives is responsible for: 1) establishing guidelines for the management and preservation of all public records; and 2) establishing and administering an archives and records management program for the retention, preservation and disposal of public records. Overview The Auditor of Accounts, an elected office, serves as the State of Delaware's fiscal watchdog. As the independent auditor, the Office of Auditor of Accounts (AOA) is charged with responsibility for the State's annual financial and federal single audits. AOA also helps to assure accountability of taxpayer dollars by conducting various audits and investigations.

Auditing Charter Schools

The charter school is responsible for contracting audits of all financial transactions for their school out to an independent certified public accounting (CPA) firm. The school must have their financial statements audited each year. The draft audit should be completed by September 30 and the final audit should be completed by October 1 of each year. Copies of the audits should be submitted to the Department of Education, the Department of Finance, the Office of Management and Budget and the Office of the Auditor of Accounts.

Division of Accounting

Overview

The mission of the division is to provide statewide expert financial and technical accounting services for the State of Delaware, delivering central support to state organizations as well as consistent and reliable financial information to the public. The division is responsible for preparing and issuing the State's Comprehensive Annual Financial Report (CAFR) in full compliance with Governmental Accounting Standards Board Statement 34 and 35, which more closely aligns governmental financial statements with the ones found in private industry. Each fiscal year since 1995, the State has received the Certificate of Achievement for Excellence in Financial Reporting from the Government Finance Officers Association. Services

Overview

The Department of Technology and Information (DTI) is the state's central IT organization, chartered to (1) deliver core services to other state organizations and (2) exercise governance over the technology direction and investments of the state. DTI is primarily an internal service organization, with only a few of its services directly touching the citizens or customers of the state. DTI provides enterprise services that enable other organizations to effectively fulfill their missions.
