    Introduction

    1. Until a few years ago the traffic management arrangements forcommunity events, that affected the highway, were managed, agreedand, in some cases, provided by the local police. Responsibility forevents that affect the highway has since been passed to CornwallCouncil as Traffic Authority to agree and liaise with the event promoter.This change was brought about by the Traffic Management Act 2004placing a duty on the Council to manage planned events on the highwaycoupled with the police reviewing its role and restricting itself to its coreresponsibilities.

    2. Cornwall Council is required to follow more onerous and restrictiveprocedures than those previously followed by the police, due tolegislative constraints. This has placed demands on resourcesintroducing costs, some of which are significant.

    3. Where possible the Council actively supports and encouragescommunity events but its resources to assist are limited.

    4. In November 2011, the Council Cabinet approved a policy for TrafficManagement at Community and Other Events. At this time it was

    agreed that a charging framework would be introduced followingstakeholder engagement.

    5. This consultation document considers the charging framework.

    Scope

    6. The scope of this document extends to all temporary events occurringon the highway, but excludes road and street works and events onNational Significance such as Remembrance Day parades.

    7. Typically the type of events considered include: Street Parties, both large and small. Community events such as carnivals, parades, etc Sporting Events, including fun runs, triathlons, etc Events of national Significance, e.g. Remembrance Day parades,

    8. Event promoters range from small community groups, which may be afew residents organising a small street party through to largecommercial events such as music festival. The proposed chargingframework applies to the full range of event promoters.

    9.

    Within the charging framework the stages of an event have beenbroken down into 4 key stages, these being;

    Event application pre-advice Assessing Traffic Management Plan applications and making any

    Temporary Traffic Regulation Orders (TTROs)

    The provision and implementation of signage, e.g. Road Closedsigns

    Provision of, and placing of, no-waiting cones

    Definition of Terms used in the Charging Framework

    10.The definitions of the Event Promoter used in the Proposed ChargingFramework are as follows:

    10.1. Promoter categories are defined as; Community Group, includes;

    o A group of residentso Village carnival committeeo Parish Council

    Not for profit organisation / charity, includes;o Town councilso Large festivals such as Golowan, Flora day, etc

    Commercial promoter or entrance charged, includes;o Events promoted by commercial organisations. E.g.

    Boardmasters Festival.

    o Royal Cornwall Show, Stithians show, etc10.2. The chargeable activity is defined as; Pre-event advice;

    o This is pre-application advice the Council may offer prior tothe submission of the Traffic Management Plan.

    Event application and TTROs;o Assessment, amendment and approval of the Traffic

    Management Plan

    o Assessment of applications for, and making TemporaryTraffic Regulation Orders, identified in the TrafficManagement Plan.

    Signage;o The provision of, placing, maintenance and removal of

    warning signs (e.g. road closed signs) and other associatedequipment.

    No waiting cones;o Assessing applications for the temporary restrictions of

    traffic

    o Provision of supporting warning signage and coneso Placing of warning signage and no waiting cones.

    10.3. Type of Event is defined as; Street Parties (basic);

    o A street party held on a small residential street andorganised locally.

    o The event is not advertised, only residents and friends andfamily attend.

    Street Parties (standard);o A street party on a busy street or on a bus route.o The wider community may be invited but the event is not

    publically advertised.

    SMALL - Fetes, Carnivals, Agricultural Shows etc;o Typical event where less than 5,000 people are in

    attendance

    LARGE - Fetes, Carnivals, Agricultural Shows etco Events where there are more than 5,000 people in

    attendance.

    Sporting and other moving events on the highway;o All sporting events held on or impacting the highway

    including cycling and running events.

    o Small Sporting events are those with less than 100participants, large more than 100.

    Remembrance Day Parades and events of national significance(these are exempt from charge and out of the scope of thisconsultation;

    o Events falling into this category are those where Devon &Cornwall Police have agreed with the event promoter to

    provide the traffic management. The Council will make anorder to restrict traffic using the Town Police Clauses Act1847.

    Proposal The proposed framework includes a scale of charge which ranges

    from zero charge to meeting the Councils full costs of providing theservice.

    Promoters of small community events will either have no charge or amodest charge levied.

    Not-for-profit organisations and registered charities are expected tomake a larger contribution to the costs while promoters ofcommercial events will be expected to meet the full cost of theCouncil.

    11.The proposed Charging Framework is shown below;11.1. It is proposed that these charges will be implemented with effect

    from the 01 January 2013.

    Key: # - a 80 charge will apply if a temporary traffic regulation order isrequired, this increases to 160 if the event is large.

    ## - a 360 charge will apply if the event is large and/or requires atemporary traffic regulation order.

    * - Placing of traffic management signage is the responsibility of the eventpromoter who will need to hire, borrow or buy signage if not already owned

    ** - If an order needs making under s14 of the RTRA then a 800 chargewill apply. (e.g. when a traffic regulation order is made on a road away from

    where the event will occur)R full costs incurred will be recovered from the event promoter

    12.1. Pre-event advice12.1.1. Advice on traffic management matters and temporary

    traffic regulation orders will be provided without charge providingthe advice is related to the planned event and completion of

    event application forms. A right to charge is reserved if theadvice required is beyond the norm; e.g. detailed advice on theproduction of a sign schedule and signage layout.

    12.2. Event application and Temporary Traffic Regulation Orders12.2.1. The charging structure for this activity is on a sliding

    scale and the charges identified within the framework are belowcost for most events.

    12.2.2. The charges identified include the making of thetemporary traffic regulation order.

    12.2.3. The Council will no longer be responsible for posting theroad closure notices on site in advance of the road closure orother temporary traffic regulation order. Once the TrafficManagement Plan is approved the Council will draft thedocumentation, including notices. These notices will then bepassed to the event promoter and the promoter will then arrangefor these to be placed on site. Guidance will be issued on bestpractice to ensure legal compliance. If a promoter requires theCouncil to place and remove the notices this will be charged at

    50 per visit.

    12.3. Signage and traffic management equipment12.3.1. Cornwall Council will no longer provide traffic

    management equipment as part of the event application process.It is the event promoters responsibility to source equipment anderect at locations identified in the approved Traffic ManagementPlan.

    12.3.2. The only exception will be if the equipment or signagecosts or other requirements are excessive in light of the eventbudget. The Council may in exceptional circumstances considersupporting the provision of equipment; this will be subjectbudget and Member approval.

    12.3.3. If an event promoter requires traffic managementequipment this may be hired from the Council; contact CormacSolutions Ltd, Tel 01872 323313 or alternatively it may hiredfrom a commercial company.

    12.4. No waiting cones12.4.1. Where temporary waiting restrictions have been

    identified and confirmed in the approved Traffic Management

    Plan then the Council will make a temporary traffic regulationorder.

    12.4.2. All areas identified and agreed for temporary no waitingrestriction will require a temporary traffic regulation order to

    enable enforcement.

    12.4.3. The Council will provide and place and collect the nowaiting cones and signs necessary to identify the restrictions andwarn motorists.

    12.4.4. The Council will charge for this activity as detailed in theProposed Charging Framework

    Training

    13.Since January 2011 the Council has offered training in TrafficManagement for Community Events. Over 370 people have attendedand successfully completed this training.

    14.The training has been proved at no charge to participants while it coststhe Council approximately 60 per person.

    15. It is proposed that as from the 1 January 2013 candidates will becharged at cost for the training. The cost is estimated to be 60 perperson.

    16.The original training offered is valid for 5 years. Refresher training willbe required after this time for those who wish to remain active incommunity event traffic management.

    17. It is proposed that the refresher training will be charged at 25 - 30per head (to be confirmed when the first refreshed events are arrangedin 2014).
