Note from the Guam Environmental Protection Agency.

The enabling legislation of Chapter 46, Title 10, GuamCode Annotated, in particular the Water ResourcesConservation Act, established the general requirementsthat must be met by well drillers, contractors, andoperators. However, implementation of the Act requiredspecific regulations and detailed requirements such as thetype of information required in license applications as wellas the form to be used in preparing such an application.These regulations were promulgated by GEPA under theauthority of Title 10, Guam Code Annotated, Chapter 45.

This document presents a completely rewrittenversion of the existing Rules for the Protection,Development and Conservation of Water Resources in theIsland Territory of Guam under Title 16 Subchapter C ofthe Administrative Rules and Regulations of theGovernment of Guam. These new regulations addresslicensing, permit applications for drilling and operating awell and also present specific standards for construction,inspection, and water quality. Data reporting requirementsare also addressed, it should be noted that fees forapplications, license and permits have been included in theRegulations.

§7101. Authority. Section 45106 of Chapter 45, Title 10,of the Guam Code Annotated authorizes and directs theGuam Environmental Protection Agency to promulgaterules and regulations necessary to implement theprovisions of the Water Resources Conservation Act.

§7102. Purpose. The purpose of these regulations is toprotect the beneficial use of the Territory's undergroundand surface water resources in the interest of the people ofGuam and for the public welfare by prescribing rules andprocedures governing the development and operation ofwater supply wells and surface water supply wells.

§7103. Definitions. (a) Abandoned Well means a wellwhose use has been permanently terminated and no futureuse is anticipated.

(b) Administrator means the Administrator of theGuam Environmental Protection Agency or his dulyauthorized representative.

(c) Agency means the Guam Environmental ProtectionAgency (GEPA).

(d) Agricultural Wells means water wells used tosupply water for irrigation or other agricultural purposes,including so called stock wells, and not used to supplywater for human consumption.

(e) Alteration, Rehabilitation or extension meansdeepening, reperforating, the installation of packers orseal, or other material changes in the construction designof the well.

(f) Aquifer means a saturated permeable geologic unitthat can transmit significant quantities of water underordinary hydraulic gradient, or is permeable enough toyield economic quantities of water to wells.

(g) Aquifer Yield means the maximum rate ofwithdrawal that can be sustained by the complete by anaquifer without causing an unacceptable decline inhydraulic head in the aquifer.

(h) ASTM refers to the latest standards of theAmerican Society of Testing and Materials, 1916 RaceStreet, Philadelphia, Pennsylvania 19102.

(i) AWWA Standards refers to the latest edition ofapplicable standards as approved and published by theAmerican Water Works Association, 6666 W. QuincyAvenue, Denver, Colorado 80235.

(j) Basin Yield means the maximum rate of withdrawalthat can be sustained by the complete hydrogeologicsystem in a ground water basin without causingunacceptable decline in the hydraulic head in the system orcausing unacceptable changes to any other component ofthe hydrologic cycle in the basin.

(k) Board means the Board of Directors of the GuamEnvironmental Protection Agency (GEPA).

(1) Beneficial Use of Water shall include the use of waterreasonably required for domestic, agricultural, commercial,industrial, recreational and other purposes on both publicand private lands. The use of water for domestic purposesshall have the preference over any other uses of water.

(m) Commercial Irrigation Wells means wells used tosupply irrigation water for landscaping, including golfcourses.

(n) Community Water System means a system for theprovision of piped water for human consumption whichserves a minimum of 15 service connections used by year-round residents or regularly serves a minimum o£ 25 year-round residents.

(o) Confined Aquifer means an aquifer that is confinedbetween to aquitards and occurs at depth.

(p) Construction means all acts necessary to the actualconstruction of a well as defined in this Section, butexcluding the installation of surface appurtenances such aspumps and pumping equipment.

(q) Contamination means the presence of any foreignsubstance (organic, inorganic, radiological or biological) inwater which tends to degrade its quality so as to constitutea hazard or impair the usefulness of the water.

(r) Destroyed Well means a well whose use has beenpermanently suspended and has been filled in accordancewith the provisions of these regulations.

(s) Destroyed as used in these regulations shall meanthe proper sealing or filling of abandoned well, includingtest hole to restore, as far as feasible the geohydrologic

conditions that existed before the well was drilled andconstructed.

(t) Driven well means a well which is constructed bydriving a pointed screen, referred to as drive point, into theground. Casing and lengths of pipe are attached to thedriving point as it is being driven into the ground.

(u) Elevation means the distance measured verticallyfrom Mean Sea Level (MSL) to the point being stipulated.

(v) Fill means placing of fill materials in the well boreof an abandoned well for the effective and permanentprevention of the vertical movement of water within thewell bore, including vertical movement of water within theannular space surrounding well casing.

(w) Groundwater means any water, except capillarymoisture, beneath the land surface in the zone ofsaturation.

(x) Inactive Well means a well whose use has beentemporarily suspended and may be reactivated at a futuredate.

(y) Individual Domestic Well means a well used tosupply water for human consumption or for the domesticneeds of an individual residence or commercialestablishment such as an apartment house, cafe, gasstation, etc., which are not served by a community wastersystem as defined in this section.

(z) Industrial Wells means water wells used to supplyindustry on an individual basis and not used to supplywater for human consumption.

(aa) License means a well driller license issued by theAgency permitting a person to do business in well drillingwithin the Territory of Guam.

(bb) Mining means pumping that exceeds a safe orsustainable yield within a particular zone or sub-basin.

(cc) Monitoring Well means wells used for the purposeof observing subsurface hydrologic conditions andcollecting hydrologic or water quality data and not for use

in extracting water from an aquifer for beneficial use.

(dd) NSF means the National Sanitation Foundationand refers to the listings developed by the Foundation,P.O. Box 1468, Ann Arbor, Michigan 48106.

(ee) Permit means a well drilling permit or welloperating permit issued by the Agency.

(ff) Person means any individual, firm, partnership,association, or corporation, both public and private,including agencies of the Government of Guam and of theUnited States of America.

(gg) Plug means placing of sealing materials in thewell bore of an abandoned well to eliminate physicalhazard, prevent ground water contamination, conserveyield and maintain hydrostatic head of aquifers andprevent intermingling of desirable and undesirable waters,or the placing of a plug or bridge, lead wool, steel shavingsor large stones (not more than 1/3 of the diameter of thehole) inside the bore of an abandoned well to permit theplacement of appropriate sealing materials where sealingwith ordinary materials by the usual methods isimpractical to perform.

(hh) Public Water Supply Well means a well used tosupply potable water for a community water system asdefined in this Section.

(ii) Recharge or Injection Well means well constructedfor the purpose of introducing water or substances into theground as a means of replenishing groundwater basins orrepelling intrusion of sea water or disposing of asubstance.

(jj) Repair means any action which involves thephysical alteration or replacement of any part of a well, butdoes not include the alteration or replacement of anyportion of a well which is above the ground surface.

(kk) Test Boring means a hole drilled for geologic orhydrologic exploration and not intended for use as waterproduction well or monitoring well.

(11) Transition Zone means the portion of the

groundwater aquifer where the concentration of chloridein the water varies spatially between 250 mg/l and 19,000mg/l.

(mm) Transition Zone Centerline means the level in avertical column of water extending through thegroundwater lens where the salinity equals 9,500 mg/l.

(nn) Unconfined Aquifer or Water-Table Aquifer meansan aquifer in which the water table forms the upperboundary. It occurs near the ground surface.

(oo) Water shall be construed to include ponds,springs, wells and streams and all other bodies orunderground wells, natural or artificial, inland or coastal,fresh or salt, public or private.

(pp) Water Production Well means well that yield asufficient amount of potable water and can be used tosupply water for the community water system.

(qq) Well means any hole that is driven, drilled, dug,or bored at any angle, either cased or uncased, by anymethod into the ground, for the purpose of obtainingwater or knowledge of water bearing or soil formations, orfor the disposal of surface water drainage. This definitionshall include well used for the purpose or (1) dewateringembankments during construction, or (2) stabilizinghillsides or earth embankments.

(rr) Well Driller means any person engaged in thebusiness of well drilling.

(ss) Well Drilling means the act of constructing a wellas defined in this Section.

(tt) Wellhead Protection Area shall mean the surface andsubsurface area within a minimum of 1,000 feet radius of awater well or wellfield, supplying a public water systemthrough which contaminants are reasonably likely to movetowards and reach such water well or wellfield.

(uu) Well Seal means an approved device installedinside the casing or covering the top of the casing toprevent contamination from entering the well.

(vv) Well Pit means a common method of providingconvenient access to the top of the well and theunderground lateral pipe from the well casing connectingto the distribution system.

(ww) Yield means the maximum pumping rate thatcan be supplied by a well without lowering the water levelin the well below the pump intake.

§7104. Well Drillers License. (a) Any person who isengaged or intends to engage in the drilling of wells isrequired to apply for a driller's license. Such licenses arerequired not only of those who make a regular business ofwell drilling, but all who may construct wells for their ownpurposes or for others, as an incident to any line ofbusiness activity. The application shall be submitted to theAdministrator on forms supplied by the Agency and shallinclude the following information.

(1) Name and business mailing address of theapplicant;

(2) Statement as to whether it is an originalapplication or renewal application;

(3) If the applicant is not an individual naturalperson, the type of organization or association, orprivate or public legal entity or the agency theapplicant is;

(4) Contractor license number;

(5) Statements and documents for the billing:

(A) Bonding and financial capability;

(B) Insurance for comprehensive and generalliability coverage;

(C) Qualifications and experience; and

(6) Signature of the applicant or authorizedrepresentative thereof indicating under penalty ofperjury that the information provided in theapplication is true and accurate to the best of his/herknowledge.

(b) A fee of two hundred dollars ($200.00), payable tothe Treasurer of Guam, shall accompany each initialapplication or a well driller's license. A renewal fee of twohundred ($200.00) for another two years or three hundreddollars ($300.00) for triennial renewal shall accompanyeach renewal application.

(c) The initial license shall be valid for a period of twoyears from the date of issuance and may be renewed foranother two years and triennial thereafter.

(d) A well driller's license shall not be required forperson who performs labor or services at the direction andunder the direct on-site supervision of licensed well driller.

(e) An application for a well driller's license shall beaccepted if applicant proves to the satisfaction of theAdministrator that:

(1) He or it has at least a minimum experience offive (5) years continuous work in well drilling andconstruction under the direct supervision of a licenseddriller.

(2) He or it can obtain performance and paymentbonds for work of this magnitude or otherwisedemonstrate financial capability; and

(3) He or it shall be able to post insurance forcomprehensive and general liability coverage inaccordance with legal requirements.

(f) Performance and payment bonds, andComprehensive and general liability insurance does notapply to Federal and Government of Guam Departmentsand Agencies, but shall apply to all their respectivecontractors.

(g) The Administrator shall deny an application for awell driller's license if the information submitteddemonstrates that the applicant does not satisfy therequirements pertinent to the license.

(h) Well driller's license is not a permit to drill wellsand that an application must also be made for a welldrilling permit in accordance with §7105 prior to drilling

any well.

§7105. Well Drilling Permits. (a) No well may bedrilled unless the Owner of the land on which the well is tobe drilled shall, before the commencement of drilling, haveobtained a permit therefor and filed a preliminary report tothe Administrator. A well drilling permit application shallbe completed on a form provided by the Agency andsubmitted to the Administrator for each new well, repair,or alteration, rehabilitation or extension of an existing well.The application shall include the following:

(l) Name and address of the owner of the well andowner of the land on which the well is to be located. Ifthe Owner of the land and the owner of the well to bedrilled are not the same, a notarized statement fromthe owner of the land granting permission for theconstruction of the well must be submitted with theapplication.

(2) A map or drawing with a scale of 1” = 50showing the following data.

(A) Location of well with respect to knownreferences such as property lines, streetintersections or survey monuments, includingcoordinates of the well. to the nearest foot, basedon the Government of Guam TriangulationNetwork (GGTN)

(B) Topography with contour intervals notgreater than two (2) covering a land areaextending not less than 1000 feet in all directionsfrom the well.

(C) Property lines of property upon which thewell is to be drilled.

(D) Location and identification of a benchmark. where the completed well can be tied.Elevation of the bench mark shall be establishedby a Registered Land Surveyor in the Territory ofGuam.

(E) Location of existing or abandoned wellswithin a radius of 1000 feet.

(F) Sewer lines and wastewater disposal,ponding basins, septic tanks & leached fields,sewage treatment plants or sewage wet wells,solid waste disposal sites, livestock and animalpens, cesspools, privies, animal feedlots, andabandoned and improperly sealed wells.

(G) Other natural features such as springs,rivers or sinkholes.

(3) A statement as to the purpose for which thewater is to be used; estimated pumping rate: estimatedhours of operation; and the estimated volume of waterto be pumped on an annual basis.

(4) Details of the proposed construction,including:

(A) The type of pump to be installed; therated capacity (flow at a specific total dynamichead) of the pump or a pump performance curve.

(B) Hydraulic calculations supporting thesizing of the well and pump.

(C) Proposed depth of the well.

(D) A sketch showing well features, includingsizing and details of casing or lining, depth ofwell, type of screen or casing perforationsproposed, water level measurement provisions,grouting of annular space, vent, water sample tap,air release valve assemblies, pressure gauge,discharge piping and fittings, production watermeter provided with totalizer, etc.

(E) Size and capacity of water productionmeter. Meter should be capable of readingpumping rates in gallons per minute up to a flowof 150 percent of the pump capacity and beprovided with a totalizer registering total volumeof water pumped in gallons.

Accuracy shall be within two (2) percent ofthe range of the meter.

(F) Elevation of the top of the well casinoabove mean sea level MSL) and a statementregarding the potential of flooding.

(G) A detailed description of the proceduresto be utilized in the well drilling operation andwell construction including but not limited towater to be used in the drilling operation, distancefrom pollution sources, disinfection information,sealing information, material setting, slush pit,etc.

(H) Sampling taps as specified in §7119.

(I) Adequate access and clearance for welldrilling equipment.

(b) A fee of two hundred fifty dollars ($250.00) perwell (production well, monitoring well, observation well,test boring), payable to the Treasurer of Guam, shallaccompany each application for the drilling or excavationof a new well production, monitoring, irrigation,industrial, and observation well and electrical ground well,test boring, repair or alteration - rehabilitation or extensionof an existing well or new well.

(c) Application for a well drilling permit shall be madeat least fifteen (15) dabs before drilling operations begin.No drilling shall commence without issuance of a permitby the Administrator and a building permit issued by theDepartment of Public Works.

(d) The proposed site for well drilling shall beinspected in the field by the Administrator or hisauthorized representative prior to issuance of a welldrilling permit

(e) Before a permit is granted, the Owner of the wellshall submit to the Administrator a performance bond foreach well or exploratory hole or test boring hole to beconstructed with proposed depth geological andhydrological conditions meeting the followingrequirements:

(l) The amount of bond shall be set by theAdministrator but in no case shall be greater than ten

(2) The amount of performance bond as set by theAdministrator shall include the estimated cost ofsealing the in accordance with these regulationsshould it be necessary to abandon the well for anyreason prior to its completion. In the event theperformance bond is forfeited, the Owner of the wellwill not be eligible for future permits within a periodof two years.

(3) The bond shall be effective for a periodcovering the duration of the well drilling permit oruntil issuance of a well operating permit, whicheveroccurs first.

(4) The payee of the bond shall be theGovernment of Guam and shall be payable if theapplicant fails to complete the well or test holes inaccordance with the provisions of the well drillingpermit.

(f) The maximum capacity of the well(s) shall notexceed the pumping rates as identified in the NorthernLens Study as prepared by the Guam EnvironmentalProtection Agency, for the groundwater management onein which it is located, taken together with the designpumping rates of all existing wells in that one.

(g) The Owner of the well or his authorizedrepresentative shall notify the Administrator 48 hours inadvance of initiating any drilling work and when thedrilling work is completed, including the installation of thewell casing, any equipment or appurtenances in the well.

(h) The Administrator shall deny, or imposeappropriate standards or conditions in a permit to drill anew well or to alter, repair, rehabilitate, or extend anexisting well so that the proposed work shall not adverselyaffect the groundwater resources by:

(1) Excessive lowering of the ambientgroundwater table, or

(2) causing or bringing about excessive malt waterintrusion, excessive mineralization or other

degradation of water quality, or

(3) Significant interference with the operations ofexisting established water sources, or

(4) Introducing contaminants into thegroundwater.

(i) No drilling permit application shall be accepted forreview and approval by the Administrator, unless theowner/driller has obtained clearance approval from thePublic Utility Agency of Guam (PUAG) in accordance withthe following water utilization priorities:

(1) First priority shall be for use or resale by thePUAG for any purpose, or for household use, for bonafide farms, plant nurseries, aquaculture, ranches, otherbona fide agricultural uses, for golf courses of lessthan 4,000 square meters or for ornamental lawns andgardens of less than 4,000 square meters.

(2) Second priority shall be for any other use bythe government of Guam for public recreation and forother public purposes only and not for purposesenumerated in subsections (3) and (4) below.

(3) Third priority shall be for industrial use.

(4) Fourth priority shall be for irrigation of golfcourses of 4,000 square meters or larger, or forirrigation of lawns or ornamental gardens of 4,000square meters or larger.

(5) Fifth priority shall be for any other purpose.

Any use of higher priority shall have preferenceover any use of lower priority regardless of which usewas first in time.

As between water uses of equal priority, first intime shall have a temporary priority to the extent ofsuch prior use for so long am the water is actuallybeneficially used on a regular or seasonal basis, but ifnot used such temporary water right shall be deemedabandoned pursuant to the common law.

All water rights and water rights to use watershall be determined according to the above-mentionedpriorities pursuant to Public Law 20-6.

(j) The owner/driller shall prepare a preliminaryreport signed by a hydrologist in the form of anEnvironmental Impact Assessment (EIA) [see Appendix DForms] for the proposed well project and to be submittedtogether with the drilling permit application for reviewand approval by the Administrator.

(k) The well drilling permit shall indicate themaximum pumping rate, as established by theAdministrator.

(l) The Administrator shall require that the well drillerkeep an accurate record of the well drilling operations andwell drilling log for each individual well, including ageological description of the representative sample of thematerials encountered together with the elevations of thetop and bottom of each change -in geologicalcharacteristics or at a minimum of five foot intervalswhichever provides greater detail. The log shall alsoinclude a record of water levels encountered and anychanges thereof; construction details, casing grout, gravelpack, etc.; other information such as owner, driller, andequipment used. The well drilling operations and driller'slog shall be maintained on forms provided by the Agency(See Appendix J & J-1). The Drilling Operation's Record, inaddition to supplying the information specifically requiredin the drilling operation forms, shall include informationconcerning all -shut down or standby periods with reasonthereof. The Driller's Log, in addition to supplying thatinformation require in the driller's log form, shall include areport on the amount of the hole filled by any cave-inmaterials and the driller's opinion of the level from whichthe caving occurred. It shall also include the following:

(1) The reference point for all depth measurement(in feet above MSL)

(2) The depths at which water is encountered (infeet above MSL and depth below top of casing).

(3) Static water level at the start of each day work.

(4) Depth at which hole diameter changes.

(5) Identification of the kind and quantity (whenapproved for use) of drilling fluid additives employedand the depths at which they are added.

(6) Measured final depth of borehole andcompleted well.

(7) Description of pumps and pumpingprocedures including rates and settings.

(8) Description of all cleaning agents andadditives used including quantities and times of use.

(9) Any and all other information relating todrilling the well that will contribute to a complete andaccurate log.

(m) A complete physical and chemical analysis of thewater produced from a new well shall be made after 36hours continuous pumping at the design withdrawal rateas required in §7106 of these regulations. If the analysisreveals that the water from the well fails to meet themaximum contaminant levels as prescribed by the GuamPrimary and Secondary Safe Drinking Water Regulationsincluding turbidity, color, and threshold odor limitations,or shows excessive hydrogen sulfide, carbon dioxide orother constituents or minerals which make the waterundesirable or unsuited for domestic use, appropriatetreatment shall be provided.

(n) If a well blow-off line is provided, it shall slopedownward and terminate at a point which will not besubject to submergence by flood waters

(o) All completed well unit shall be protected byintruder resistant fences, the gates of which are to beprovided with locks, or enclosed in locked, ventilated wellhouses to exclude possible contamination or damage to thefacilities by trespassers.

(p) An all weather access road shall be provided toeach well site.

(q) The well site shall be fine graded so that the site is

free from depressions, reverse grades or areas too roughfor proper ground maintenance so as to assure that surfacewater will rain away from the well. In all cases,arrangements shall be made to carry off floor drainage.Suitable drain pipes located at the outer edge of theconcrete floor shall be provided to carry off this water andprevent its ponding or collecting around the well head.This waste water shall be disposed of in such a manner tothat it will not cause any nuisance from mosquito breedingor stagnation. Drains shall not be directly connected tostorm or sanitary sewers.

(r) Within thirty (30) days after completion of theconstruction of each well, the driller shall submit to theAdministrator a complete, legible, and true copy of thedrilling operation records and the well driller's a log ofeach well, representative samples of rock materialspenetrated during drilling and the results of any pumpingtests conducted, inclusive of the drawdown of water leveland estimated radius of influence based upon measuredtransitivity. A map showing the location of the test site,pumped well and piezometers, and including recharge andimpervious boundaries, if any. A lithological cross-sectionof the pumping test site, based on data obtained from thebore holes, and also showing the elevations and depth ofthe screens, tables with results of the field measurements,including measurements of well discharge and waterlevels in the various piezometers, hydrographs, illustratingthe corrections applied to the data observed, if applicable,time-drawdown curves and distance-drawdown curves,considerations leading to the selection of the method ofanalysis applied, the calculations in an abbreviated form,including the values of the aquifer characteristics obtainedand a discussion as to their accuracy, recommendations forfurther investigations, if applicable, and a summary of themain results obtained.

(s) An accurately completed report of yield anddrawdown resulting from any pumping tests conducted bythe well driller shall be submitted to the Administrator onforms provided by the Agency (See Appendix L, L-1, & L-2) upon completion of the required pumping test.

The Administrator shall require the applicant/drillerto furnish one or more water samples for subsequentanalysis by the Agency laboratory to verify the correctness

of the test results submitted by the applicant/driller.

Pumping tests conducted by the driller for each wellshall include: (1) A step-drawdown test with increasingdischarge rates; (2) a long-term, continuous, constant rate,time-drawdown; (3) time-recovery tests.

For conducting these tests, the bottom of the soundingtube shall be strapped or lowered adjacent to the bottom ofthe well screen. Sounding tube shall be one and one-half(1-1/2) inches diameter, schedule 80 PVC pipe. Eachsection shall be twenty (20) feet length, except the lower-most section shall be ten (10) feet in length, PVC slottedscreen, having slot opening of 0.030 inches. Threaded capshall be provided at the top of the sounding tube.

If any well(s) are located less than 1.000 feet awayfrom the new well, the driller shall measure the waterlevels of those well(s) during the long-term andsubsequent recovery tests at the same time intervals as thewell is being pumped.

(1) For step-drawdown tests, the pump shall beinitially operated at the rate of 50 gpm. The pumpingrate will then be increased by 50 gpm increments atone hour intervals until the well has been tested atdesign capacity or maximum pumping rate,whichever is lower. The test duration shall not exceed12 hours unless otherwise specified by theAdministrator. During the test, the driller shall recordthe time, water level in the pumped well and allobservation wells, and discharge at 15-minutesintervals. When the test is completed and the pumpstopped, the driller shall measure water level recoveryin the well and observation wells as directed undersub-section (3) below until the water level has fullyrecovered to the original static water level.

(2) The long-term, continuous, constant-rate, time-drawdown tests shall commence after the water levelin the pumped well has recovered from the step-drawdown test. The rate of pumping shall be equal to100 percent design capacity or as determined by theAdministrator. The driller shall insure that thepumping rate selected remains within the allowablevariance of plus or minus 10 percent throughout the

test. The test duration is anticipated to be less than 24hours, but the driller shall run the test for a period oftime as directed by the Administrator.

The water levels shall be measured by the drillerin the well being pumped, all observation wells, andsprings or ponds hydraulically connected to theaquifer at the following time intervals or as directedby the Administrator.

0 to 5 minutes - once every 0 seconds

5 to 10 minutes - once every minute

10 to 30 minutes - once every two minutes

30 to 90 minutes - once every ten minutes

90 to completion - once every hour

During the long-term tests, changes in waterquality, particularly chloride concentrations, areextremely important. The driller shall take watersamples at the following intervals or as directed by theAdministrator, for analysis of chloride content.

One sample after two minutes of pumping

Once every hour for the first 10 hours

Once every two hours for the remainder of thetest.

(3) As soon as the pump is turned off at thecompletion of the time-drawdown test, the timerecovery test shall begin. The driller shall take waterlevel measurements in the well being pumped and allobservation wells, and springs or ponds at thefollowing time intervals or as directed by theAdministrator.

0 to 5 minutes - once every 30 seconds

5 to 20 minutes - every minute (or until fullrecovery to original static water level)

(4) If there is any interruption in conducting thistest, the driller shall re-do the test after the water levelhas fully recovered.

(5) The driller shall plot all test data on semi-loggraph paper with drawdown (recovery) indicated onthe arithmetic axis and time (in minutes) on thelogarithmic axis.

(6) The driller shall not consider the yield at thebeginning of the test if the water level is dropping. Forestimating the actual flow of water, the yield shall bemeasured after the water level in the well hasstabilized. The estimated yield shall be determined bythe average output when drawdown has ceased andwhen the water table has been stable for at least fourcontinuous hours. The time intervals required for thewater level to return to its original level shall begin tobe recorded immediately after pumping has ceased.

§7106. Well Operating Permits. (a) No well shall beplaced into operation until a well operating permit hasbeen obtained by the owner. (Permits for injection wellsare covered in §7111).

(b) An application to operate each new well shall bemade within ninety (90) days after the drilling operationsare completed and shall be submitted to the Administratoron forms provided by the Agency, signed by the owner,and shall include the following:

(I) Name and address of the owner of the well.

(2) Name and address of the person who will beresponsible for operation of the well, if different thanthe owner.

(3) A plan of the well showing:

(A) Control valves, miscellaneous fittings andappurtenances, and discharge pipes leading fromthe well;

(B) Flow metering device for recording

output of the well, including size, flow range, andmanufacturer;

(C) Diagram of the well along its axisincluding the following:

(1) Ground surface and bottom of wellelevation;

(2) Casing diameter and depth (lengthfrom ground surface);

(3) Limits of grouting of annular space;

(4) Elevation of top and bottom of wellscreen;

(5) Limits of gravel pack;

(6) Pump setting, and

(7) Water level measurement devices orother piping extending down the well (insideor outside the casing);

(8) Sampling tap (for sampling after 36hours of continuous pumping at the designwithdrawal rates and thereafter samplingactivities.

(D) Chlorination and fluoridation equipment,if provided;

(E) Elevation and location of a permanentbenchmark to which the altitude of a measuringpoint on the completed well can be determined;

(F) Elevation of the top of the well casingabove mean sea level;

(G) Sampling taps as specified in §7119.

(4) Well construction specifications including:

(D) Casing details specifying diameter, depth(length from surface), type, size, wall thickness,weight and material, and installation procedure;

(E) Screen or perforation details specifyingtype, slot size, length, diameter, material andmethod of installation;

(F) Cement grouting, specifying method usedin grouting, gravel packing, specifying size, totaldepth, annular thickness and cubic yards ofgravel placed, and emplacement procedure;

(G) Well development, specifying the methodused in development;

(H) Flow measurement and testing,specifying pump capacity, design characteristics,static water level, specific capacity at test andmethod used for flow measurement and testing;

(L) Log of well, specifying the formationspenetrated and the stratum thickness includingdescription and samples, whenever possible, ofthe materials penetrated shall be in accordancewith the requirement of §7124 of theseregulations.

(5) A statement as to the purpose for which thewater is to be used, the estimated pumping rate,estimated hours of operation, and the estimatedvolume of water to be produced on the annual basis.

(c) The owner/driller of the well shall arrange with anapproved laboratory, certified to conduct chemical andbacteriological analyses. The owner/driller shall submit alltest results to the Administrator for review and approval.Results of the analyses must be approved by theAdministrator before an operating permit is issued. Therequired water analyses shall be performed for all publicwater supply and individual domestic wells in accordancewith the requirements shown in Appendix I, “WaterAnalysis Reporting Form.”

(d) Except for monitoring wells, fee in accordance withthe following schedule is required for each operatingpermit. The fee includes the costs of the inspections, waterquality test result evaluations and tabulation of data.

(1) A fee of two hundred fifty dollars ($250.00)shall accompany the initial or renewal application.This fee is payable every five years.

(2) In addition to the initial or renewal fee of twohundred fifty dollars ($250.00), annual operating feeshall be assessed base upon the maximum pumpingrate authorized, as stipulated in the operating permit.The annual operating fee shall be as follows:

or his authorized representative.

(f) An application for a well operating permit shall beapproved if all the necessary conditions and requirementsspecified above have been fully met to the satisfaction ofthe Administrator. It shall be valid for a period of five (5)years.

(g) The Administrator shall deny an application for awell operating permit if the well was not constructed, ormodified or repaired or extended in accordance with theapproved application plan or other limiting conditions ofthe well drilling permit.

(h) The well operating permit shall indicate themaximum rate the well may be pumped as established bythe Administrator.

(i) As a condition of the well operating permit, theowner shall:

(1) File an annual well operating report no laterthan January 15 of each year which shall include:

(A) Total volume of water pumped by month,for the preceding year;

(B) A description and details of anyalteration, rehabilitation or extension made to thewell or well appurtenances during the precedingyear;

(C) An itemization, including dates, allmaintenance performed during the precedingyear including repairs or replacement of wellequipment (pump, motor, etc.), chemicaltreatment of the screen, resetting of the pump, etc.Only below ground repairs or replacement ofunderground equipment must be reported to theAdministrator.

(2) Submit the total monthly volume of waterwithdrawn within the first ten (10) days of thefollowing month.

(3) Submit a quarterly report on the analytical

analysis results of the water (irrigation and monitoringwells).

(4) Have paid the annual operating fees and thefive-year renewable application fee, if due.

(j) For wells in existence and operation at the timethese regulations are approved and adopted, a welloperating permit application shall be filed with theAdministrator no later than 60 days after the effective dateof these rules, unless a current permit is in effect.

(k) The Administrator may revoke, modify or suspendan operating permit for a well which producescontaminated water until the causes of the contaminationare removed, or if the well is not being operated incompliance with the provisions of the well operatingpermit, or if operation of the well has contributed to thesalinity profile of the aquifer.

(1) Government agencies or other appropriateengineering or research organizations shall be required tofile an operating permit application in conformance withthe provisions of this section for any monitoring wells usedin the investigation or management of groundwater basins.All monitoring wells shall be sealed with concrete pads aswell as be fitted with locking cap on top of the casing or anapproved surface plate and bear the label “MonitoringWell” and the name of the agency or organization. Anannual monitoring well report and water quality analysisresults shall be submitted to the Administrator no laterthan January 15 of each year on forms provided by theAgency (See Appendix H and Appendix I).

(1) No fee shall be assessed for operating amonitoring well.

(m) Adequate access and clearance for well drillingequipment within the confines of the property shall beprovided by the owner/driller.

(n) The Administrator reserves the right to increase ordecrease the monitoring frequency and to includecontaminants in addition to the contaminants listed inAppendix I as well as for requirement for additionalmonitoring well that may be warranted based on the

analysis of submitted data.

§7107. Action on Application. (a) The Administratormay require the applicant to furnish additionalinformation, plans or specifications before acting on anapplication for license or permit.

(b) The Administrator shall review and act on anypermit application and licenses within fifteen (15) days ofreceipt of the completed application. Should additionalinformation, plans, or specifications be requested, thefifteen (15) days limitation will begin on the latest date ofreceipt of the requested data.

(c) The Administrator shall notify the applicant inwriting of his approval, disapproval or denial, orconditional approval of the application, and he shallinform the applicant of sufficient facts and reasons uponwhich a disapproval or conditional approval was basedand afford the applicant an opportunity to appeal the finalactions before the Board in accordance with §7129 of theseregulations.

§7108. Revoking of Licenses and Permits. (a) A welldrilling permit shall expire, if the construction, repair,alteration, rehabilitation or extension is not completedwithin one (1) year of the date of issuance, unless theapplicant secures an extension of the expiration date.

(b) The Administrator shall revoke a well drillingpermit if the construction, repair, alteration, orrehabilitation is not in compliance with the approvedapplication, plans, or limiting conditions of the permit.

(c) The Administrator may revoke a well driver'slicense, a well drilling permit or a well operating permitfor violation of the regulations or conditions pertainingthereto.

(d) The Administrator shall revoke a well driller'slicense, a well drilling permit or a well operating permitfor willful misrepresentation, or falsification of facts for thepurpose of obtaining such license or permit.

(e) The Administrator shall revoke or otherwisemodify a well operating permit upon his findings that a

well is not being maintained or operated in accordancewith these regulations, or that continuance of such permitcould adversely affect the groundwater resource. TheAdministrator shall suspend a well operating permit if thedrinking water being produced from such well iscontaminated.

(f) If the Administrator proposes to suspend or revokea license or permit, he shall inform the licensee orpermittee of sufficient facts and reasons upon which theproposed suspension or revocation is based and afford thepermittee an opportunity for a hearing before theAdministrator, prior to making a final decision.

(g) No application for a new well driller's licensepursuant to these regulations may be made within one (1)year after revocation of any such license.

§7109. Transfer and Renewal of Licenses or Permits.(a) A well driller's license, well drilling permit or welloperating permit issued pursuant to these regulations shallnot, under an; circumstances, be transferred from onelocation to another, or from one person to another, withoutthe approval of the Administrator.

(b) Renewal applications for well driller's license, welldrilling permits, or well operating permits shall be treatedin the same manner as the initial license or permitapplication.

(c) The Administrator, upon his discretion mayexempt an applicant for renewal of a license or permitfrom particular initial permit or license requirements ifsuch initial requirements have already been fully met bythe applicant to the Administrator's satisfaction.

(d) Renewal applications for well driller's license, welldrilling permits, or well operating permits shall be madewithin thirty (30) days before expiration of such license orpermit.

(e) For renewing expired driller's license, the drillershall pay all the required license fees in addition to the twohundred dollars ($200) penalty fee for not renewing thelicense on time

§7110. Posting of Permits, Falsifying or alteringPermits or Licenses. (a) Upon granting an approval for awell drill permit, the Administrator shall issue to theapplicant a certificate, referred to as a well drilling permit,which shall be posted in a conspicuous place specified forwhich the permit is issued.

(b) No person shall deface, alter, forge, counterfeit, orfalsify a drilling permit, well operating permit or welldriller's license.

§7111. Injection Wells. (a) The construction ofinjection wells and their operation shall be accordance withthe regulations establish by the Guam EnvironmentalProtection Agency entitled “Underground InjectionControl (UIC) Regulations”, a copy of which can beobtained from the GEPA office.

§7112. Well Location. (a) The minimum horizontaldistance from a public water well to potential sources ofbacterial contamination** shall conform to the followingminimum distances:

Unknown 1000 feet only after comprehensive geologicalsurvey of the site and its surroundings hasestablished, to the satisfaction of theAdministrator that favorable formation exist.

Poor Safe distance can only be established followingboth

(Consolidated) the comprehensive geologica l andcomprehensive sanitary surveys. These surveyalso permit determining the direction in which awell may be located with respect to sources ofcontamination. In no case should the acceptabledistance be less than 1 000 feet whichever isgreater.

** Horizontal distances for other possible sources ofcontamination will be established on a case-by-case basis.

(b) Whenever there a reasonable basis to expect theadverse conditions exist, the Administrator shall require

greater distance between a well and source ofcontamination than that given above.

(c) Whenever possible, wells shall be located upgradient (upstream) from any surface or groundwater flowof specific sources of contamination.

(d) For public water supply or individual domesticwell located down gradient (downstream) from acontamination or pollutant source, the Administrator shallrequire greater distances between the well and source ofcontamination that given in item (a) of this section.

(e) If contaminant/pollutant source is an injection wellor drainage well, distances from the well to thecontaminants or pollutants shall be at the discretion of theAdministrator.

(f) The top of the casino shall terminate above anyknown conditions of flooding by drainage or runoff fromthe surrounding land, but in no case shall be less than 13inches above the concrete pad.

(g) All wells shall be located on terrain not subject toponding or flooding. Furthermore, the slope of the groundsurface in the vicinity of the well(s) shall be away from thewell. In level areas, full compacted earth shall be placedaround the well so as to elevate the platform, pad or apron.

(h) The minimum separation between a well or wellsand possible sources of contamination shall be a functionof the drawdown and radius of influence of the well orwell. It shall be the responsibil ity of the design engineer topresent data showing the radius of influence anddrawdown together with the sanitary survey of the areainfluenced by the well. Such survey shall extend one-milebeyond the radius of influence of the well. In casesinvolving multiple wells, the interference among wellsshall be determined. It shall be the design engineer'sresponsibility to show that the tow thirty (70) feet of theaquifer is not tapped by the well(s)

(i) Wells shall be so located that there will be nodanger of pollution from flooding or from unsanitarysurroundings, such as cesspools, privies, sewage treatmentplant, or sewage wet well, sewage pumping stations, septic

tanks & leached fields, livestocks and animal pens, solidwaste disposal sites, or abandoned and improperly sealedwell(s), etc.

(A) No well shall be selected which is within 1,000feet of a sewage or sewage wet well, sewage pumpingstation or drainage ditch which contains industrialwaste discharges or the wastes from sewage treatmentsystems;

(B) No water wells shall be located within 1,000feet of animal feedlots, solid waste disposal sites orland irrigated by sewage plant effluent;

(C) Livestocks in pastures shall not be allowedwithin 1,000 feet of water supply wells;

(D) Abandoned water wells in the area of aproposed well(s) shall be plugged and sealed properlyto prevent possible contamination of fresh waterstrata. The procedures and methods to be followed inplugging and sealing shall be in accordance with§7128 of these regulations.

§7113. Sealing the Annular Space. (a) Generalrequirements. The space between the well casino and thewall of the drilled hole (the annular space) shall beeffectively sealed to protect against contamination orpollution by surface and/or shallow, subsurface waters.The minimum vertical distance of the annular space to besealed from the ground surface shall be 100 feet or thedepth to the static groundwater level whichever is less.The required distance may be increased if necessary toprotect the aquifer.

(b) Conductor (or Surface) Casing. For public watersupply wells, if used, the minimum thickness of steelconductor casing shall be one fourth (1/4) inch for singlecasing. Steel used for conductor casing shall, as aminimum, conform to the specifications described in §7116of this regulation.

(c) Sealing materials. The sealing material shallconform to the American Water Works Associationstandards (AWWA A100-84) including its latest revisionthereof and shall consist of neat cement grout, pozmix-

cement grout, portland cement-concrete grout and sand-cement grout.

(1) Net-cement grout shall consist of a mixture ofa API Spec. 10, Class G cement or Class B similar toASTM C150 Type II) and water in the ratio of 0.67cubic feet (5.0 gallons) of water per 94 lb sack ofcement weighing approximately 118 lb/cu ft. Amaximum of 6 percent, by weight, bentonite and 2percent, by weight, calcium chloride may be added.

(2) Pozmix-Cement grout shall consist of mixtureof 50 percent, by volume, Pozzolan (74 cubic feet) and50 percent, by volume, API Spec. 10, Class G cementwith 0.77 cu ft of water per 84 lb of mixture. To thismixture may be added a maximum of 2 percent, byweight, bentonite and a maximum of 2 percent, byweight, calcium chloride, at the discretion of thedriller.

(3) Portland cement-concrete grout shall contain5.3 sacks of portland cement (ASTM C150 Type II) percubic yard (0.76 cubic meter) of concrete and amaximum 7.0 gallons of water per 94 lb (42.6 kg) ofsack of cement. The maximum slump shall be 4 inches.The aggregate shall consist of 47-percent sand and 53-percent coarse aggregate, conforming to ASTM C33.The maximum size aggregate should be 0.75 inches.Concrete seal shall not be place in an annulus of lessthan 3 inches.

(4) Sand-cement grout shall consist of a mixture ofportland cement (ASTM C150 Type II), sand, andwater in the proportion of not more than 2 parts, byweight, of sand to 1 part of cement with not more than6 gallons of water per 94 lb (42.6 kg) sack of cement.

(d) Thickness of Seal. The thickness of the seal shallbe at least two (2) inches, and not less than three (3) timesthe size of the largest coarse aggregate used in the sealingmaterial. To accommodate adequate seal thickness theborehole must be nominally at least four (4) inches largerin diameter than the nominal casing diameter.

(e) Placement of Seal. The sealing material shall beapplied in one continuous operation starting from the

bottom of the interval to the sealed to the top. Temporarycasing may be used but must be removed duringplacement of seal. Gravity installation of sealant withoutthe aid of a tremie, or grout pipe shall not be used unlessthe interval to be sealed is dry and in no case where theinterval is over 30 feet in depth.

§7114. Surface Construction Features. (a) Openings.Openings designed to provide access into well casinos formaking measurements, adding, gravel, etc., shall beprotected against entrance of surface waters or foreignmatters by installation of water tight caps or plugs,concrete pad, sampling tap, etc.

Air vents and casing vents: Access opening designedto permit the entrance or discharge of air (air or casingvents) shall terminate above the ground and the knownflood lines and shall be protected against the entrance offoreign material by installation of down-turned andscreened “U” bends. All other opening shall be sealed.

(1) Where the pump is installed directly over thecasing, all holes in the base of the pump which openinto the well shall be sealed by a method acceptable tothe Administrator. An annular watertight seal shall beplaced between the pump head and the pump base, ora watertight seal shall be placed between the pumpbase and the rim of the casing, or a sanitary seal or“well cap" shall be installed to close the annularopening between the casing and the pump columnpipe.

(2) Where the pump is offset from the well orwhere a submersible pump is used. the openingbetween well casing and any pipes or cables whichenter the well shall be closed by a watertight sanitaryseal or “well cap".

(3) All pump discharge piping, not located withinthe well itself, shall be located above ground.

(4) If the concrete base or slab (sometimes called apump block or pump pedestal) is to be constructedaround the top of the casino. it shall be free fromcracks, honeycombing, or other defects likely todetract from its watertightness.

(5) In all cases, a concrete pad extending at least 3feet from the well casing in all directions, with aminimum thickness of 6 inches, and sloped to drainaway at not less than 0.25 inches per foot shall beprovided around the wellhead.

(6) Well heads and pump bases shall be sealed bythe use of gasket, sealing compounds, and properlyvented to prevent the possibility of contamination ofthe well water. A well casing vent shall be providedwith the opening covered with 16-mesh or finecorrosion resistant screen, faced downward andlocated and elevated so as to prevent the drawing ofcontaminants into the well.

(b) Well pits and pitless adaptors. Because of theirsusceptibility to contamination and pollution the use ofwell pits or pitless adaptors shall not be permitted.

(c) Enclosure of Well and Appurtenances. For publicwater supply wells, the well and pump shall be enclosedwith a six-foot high chain link fence or other approvedsecurity enclosure, and provided with a lock to excludeaccess by unauthorized persons.

(d) Well Identification. The Administrator shalldesignate the numbers and series of wells. Water operatorsshall be responsible to see to it that every well shall beidentified by means of a sign designating the number andseries of the well, e.g., A-3, and shall be posted on theoutside of the well enclosure. The sign shall have aminimum size of 9 inches by 12 inches with a yellowbackground and black letters and numbers with a six inchminimum height.

(e) Pump Blowoff. When there is any blowoff or drainline from the pump discharge, it shall be so located thatthere is no hazard to the safety of the water supply byreasons of flooding, back siphonage, or lack of pressure.The blowoff or drain line shall not be connected to anysewer and must discharge to the atmosphere.

(f) Air Vents. Casing vents to minimize possibility ofcontamination by creation of partial vacuum duringpumping and air vent to release sir trapped in pumpcolumn when pump is not running.

(g) Backflow Preventer. All pump discharges notdischarging to the atmosphere shall be equipped with acheck valve or similar device to prevent backflow and/orbacksiphonage into the well when the pump shuts down.The check valve shall be installed between the pump headand the connection to the distribution system. Sample tapshould be installed after this check valve.

§7115. Well Casing. (a) Whenever there is areasonable basis to expect that any well subject to theseregulations could result in wastage or contamination ofwater resources, which could be prevented through anyone of the following construction techniques, theAdministrator shall require the well to be cased, recased,lined, re-lined, grouted, or abandoned.

(b) For all new and/or modified wells wherein casingis required, the casino and joints shall be of a qualityconforming to the American Water Works Associationspecifications AWWA A100-84 including its latestrevisions thereof or be constructed with any othermaterials approved by the Administrator (See §7113).

(c) In all new and/or modified wells wherein casing isrequired the annular space shall be grouted in a mannerapproved by the Administrator for a minimum depth setunder §7113 of this regulation.

(d) Joints in the steel casing may be either of thewelded or screwed type with external sleeves. Weldedjoints are to be made by a competent welder. Externalsleeve threaded joints shall be screwed to refusal beforebeing lowered into the ground. The threads of the pipecasing and the sleeves shall be cleaned of any rust, dirt, orgrease and given a coating of approved metal preservative.After the joint has been made up, all exposed surface of thejoints, sleeves and uncovered threads are to be given afinal coating of the same preservative.

(e) The lower end of the casino shall be set at suchdepth and by such method chosen by the contractor andapproved by the Administrator as will minimize thepossibility of leakage and insure that any loose materialwill not enter or travel into the well.

(f) Should a pump not be installed immediately after

well drilling and placement of the casing, the top of thecasing should be closed with a metal cap screwed or tack-welded into place or covered with sanitary well sealmeeting the requirements of §7113. (Sealing AnnularSpaces) of this regulation.

(g) All casing shall be placed with sufficient care toavoid damage to casing sections and joints. Where thecasing will be enclosed in ground pack and gravel pack),the casing shall be hung in tension while gravel and groutmaterial are being installed. In no case shall the casing orscreen be landed on the bottom of the boring.

(h) Galvanize sheet metal pipe downspout or woodshall not be used as casing.

(i) Minimum inside diameters for well casino shall bebased on the capacity of the well as indicated below:

(i) The minimum wall thickness of steel well casingshall be 5/16 inch and the minimum thickness of theconductor casing, i.e. surface casing, if used, shall be 1/4inch.

(k) The top of the casino shall terminate above anyknown conditions of flooding by drainage or runoff fromthe surrounding lands, but in no less than 18 inches abovethe concrete pad.

§7116. Sealing-Off Strata. (a) In areas of SouthernGuam where a well penetrates more than one aquifer andany of the aquifers contain water of a quality such that, ifallowed to mix in sufficient quantity will result in asignificant deterioration of the quality of water produced,the strata producing the undesirable quality water shall besealed off to prevent entrance of the water into the well orits migration to other aquifer(s). The producing strata shallbe sealed off by placing impervious material opposite thestrata and opposite the confining formations for asufficient vertical distance (but no less than 10 feet) in

either direction, or, in the case of "bottom“ waters in theupward direction. Sufficient sealing material shall beapplied to fill the annular space between the casing and thewall of the drilled hole in the interval to be sealed, and tofill the voids which might absorb the sealing material. Thesealing material shall be placed from the bottom to the topof the interval to be sealed.

(b) Sealing material shall consist of the neat-cementgrout, poz-mix-cement grout, portland-cement-concretegrout, or sand-cement grout (See §7113 for a description ofthe various materials required).

§7117. Disinfection and Other SanitaryRequirements. (a) All newly constructed wells or existingwells subjected to any repair work shall be disinfectedbefore being placed in service. A chlorine solution ofapproximately 100 mg/l of available chlorine in the wellwater is normally adequate. The solution shall beintroduced into the well in such a manner that all surfacesabove the static level will be completely flushed with thesolution. The well contents should then be agitated touniformly distribute the chlorine throughout the well. Thechlorine solution shall remain in the well for not less than24 hours. The chlorine residual should be monitored toinsure adequate concentration. Before providing water forconsumptive use, the well shall be flushed until all tracesof chlorine have been removed. After flushing the residualchlorine from the well, a water sample shall be collectedfor bacterial analysis. If the coliform bacteria test is positive(i.e., one or more counts per 100 ml), the well shall bedisinfected again as prescribed above. Water samples shallthen be placed into operation until the well has beenadequately disinfected as demonstrated by testing.

(b) Gravel. Gravel used in gravel-packed wells shallcome from clean sources and should be thoroughlywashed and disinfected by hypochlorite treatment beforebeing placed in the well. Gravel purchased from a suppliershould be washed free of silt, and other foreign materialsprior to delivery to the well site. Crushed rock shall not beused.

(c) Drilling Fluid. Only fresh water shall be used indrilling fluids whether employed alone or in combinationwith drilling additives. Only high grade clays or

commercial chemicals, approved by the Administrator,shall be used in the make-up of any drilling fluid. Drillingfluid with a mixture of water and unprocessed mud, clay,or other material will not be permitted. Drilling fluid shallnot impart any toxic substances to the water or promotebacterial contamination. Drilling fluid ejected from thewell during drilling operation must be contained on-site ordisposed off as directed by the Administrator.

(d) The premises, materials, tools and drillingequipment shall be maintained so as to minimizecontamination of the underground water during thedrilling operation.

(e) Disinfection of Non-flowing Wells.

(1) Method A. Where practical, the standard-concentration chlorine solution used to disinfect thewell should be prepared in the surface in containershaving a volume equal to at least twice the volume ofwater contained in the well. This prepared solutionshould then be rapidly discharged into the well, carebeing taken to flush the walls above the water level.

(2) Method B. Instead of preparing the standard-concentration chlorine Solution in containers, a stockchlorine solution of 15,000 mg/l could be added to acontinuous flow of water into the well to provide thestandard-chlorine concentration. Either of the abovemethods will carry the chlorinated water into thevoids of the water-bearing formation and shouldprovide effective treatment if the chlorinated water isapplied rapidly enough to reach all formationspenetrated by the well or is introduced at differentlevels in it.

(3) Method C. If methods A and B are notpractical, stock solution may be added to the well,preferably at different levels, to provide the standardconcentration in the, water contained in the well. Thewell should then be agitated with a bit, bailer, or testpump to spread the chlorine solution throughout thewater.

(4) Method D. Instead of using liquid chlorinesolutions, a perforated pipe container capped at both

ends, containing hypochlorite tablets may be movedup and down in the wall by means of a weightedcable. Sufficient compound should be applied toprovide the standard concentration.

(f) Disinfection of equipment and material used inwell.

(1) If the well is disinfected prior to the insertionof the test pump all exterior parts of the test pumpscoming in contact with the water must be cleaned,wetted, and dusted with a powdered chlorinecompound. If possible, at the start of the operation ofthe pump, the pump discharge be so regulated thatsome of the chlorinated water maybe returned to thewell.

(g) Chlorine Solution. A stock solution of chlorinemay be prepared by dissolving fresh chlorinated lime,hypochlorite tablets, or other chlorine compounds in waterin the proportion of 4 oz (113.4 g) of available chlorine to 1gal. (3.79 L) of water. This gives a chlorine concentration of30,000 mg/l or 3.0 percent, by weight. To obtain an appliedstandard concentration of 100 mg/1, 1 gallon (3.79 L) ofstock solution is used to treat 300 gallons (1136 L) of water.

Table 1 shows the number of ounces of chlorinecompounds of a given available chlorine content (generallymarked on the outside of the can or package) required forthe effective disinfection of the well can be computed bythe use of Table I together with Table 2, showing thecontents in gallons per foot of wells of various diameters.Volume of water for various size wells is shown in Table 3.

§7118. Well Development. (a) Developing,redeveloping, or conditioning of a well shall be done withcare and by methods which will not cause damage to thewell or its casing or cause adverse sub-surface conditionsthat may destroy barriers to the vertical movement ofwater between aquifers.

(1) Every well shall be developed to remove thenative silts and clays, drilling mud or finer fraction ofthe gravel pact.

(2) Development should continue until thespecific capacity is obtained from the completed well.

(3) Where chemical conditioning is required, thespecifications shall include provisions for the method,equipment, chemicals, tasting for residual chemicals,and disposal of waste and inhibiters.

(4) Where blasting procedures may be used, the

specifications shall include the provision for blastingand cleaning. Special attention shall be given to assurethat the grouting and casing are not damaged by theblasting. No mercury containing explosives shall bepermitted.

(b) Observation wells shall be constructed inaccordance with the requirements or permanent wells. Ifthe observation wells will not be used in service it shall beconsidered as abandoned wells and shall be subject to therequirements of §7128 Well Operating Permit if it willremain in service.

§7119. Water Quality Sampling Provisions. (a) Exceptwhere there is free discharge from the pump (that is,except where there is no direct connection to the waterdelivery system), a sample tap shall be provided on thedischarge line downstream (system side) of the check valveand upstream of any disinfection or other treatmentequipment so that representative of the water in the wellmay be drawn for laboratory analysis by an approvedcertified laboratory.

(b) For wells provided with chlorination or otherchemical feed systems, a second sample tap shall beprovided on the discharge line after the point at whichchlorination or other chemicals are introduced and beforeconnection to main water line.

(c) Water quality (physical, biochemical, and chemicalcomposition) shall be determined by analysis of watersamples collected from the well.

(d) Sampling Procedures - The procedures outlined inthe latest edition of Manual of Methods for chemicalanalysis of water and wastes, U.S. EPA shall be followed.

(1) Field tests: water temperature, pH, dissolvedgases shall be determined on samples collected andanalyzed in the field.

(2) Water samples shall be taken at the end of thepumping test for chemical analyses. Testing must bedone by an approved certified laboratory.

§7120. Large Diameter Shallow Wells. (a) The use of

bored or dug wells, or wells less than fifty (50) feet deep toprovide cubic water supply shall be avoided unless there isnot other feasible means for obtaining water. When usedfor this purpose, these wells shall be located at least onethousand (1,000) feet away from any undergroundinjection well facility, and stricter monitoring requirementsmay be instituted.

§7121. Driven Wells. (a) Driven wells shall not bepermitted.

§7122. Repair Rehabilitation, and Deepening ofWells, Temporary Cover. (a) Repair or Rehabilitation orDeepening of Wells. The Administrator shall be notifiedat least forty-eight (48) hours before the owner removespumps or other devices installed in the well bore for thepurpose of making repairs to the well. If water quantitydecreases over time, the well may need to be rehabilitatedrather than deepened. When such devices are removed, theAdministrator shall be allowed access to the cleared wellfor inspection and measurements. In emergencies, theAdministrator shall be notified as soon as practicable afterthe devices are removed. After completion of therehabilitation, repair or deepening of the well, the wellmust be disinfected in accordance with the requirements ofSection §7115 of this regulation and must be completedwith the sampling analysis prior to putting the well back inoperation.

§7123. Existing Wells. (a) Every owner or user of anyexisting well within the Territory of Guam shall, uponrequest of the Administrator, disclose the location of suchwell and all other facts or information within hisknowledge or possession relating to such well. He shallinclude a statement of the manner in which the well isbeing used or operated, and the method and means ofcontrol thereof. The owner, upon request, shall provide theAdministrator, or his authorized representative, access tothe well for inspection purposes.

(b) The owners of existing wells shall be required toalter or augment existing facilities or appurtenances toobtain data, which is satisfactory to the Administrator andto the best interest of the general public.

(c) The owners of all active wells in operation shall be

required to obtain a well operating permit. The owners ofall wells to be altered, rehabilitated or repair or extendedshall first obtain a well drilling permit.

(d) The Administrator shall allow continued operationof an existing well if such operation would not cause anadverse effect to the groundwater resources and that theexisting well must be supplying water of acceptablequality as well. Wells ordered for discontinuance ofoperation shall be brought into compliance according tothe provision of these regulations within a reasonable timeas determined by the Administrator, or the well shall beconsidered abandoned.

(e) For all existing wells without a sounding tube, theowner shall provide, install and maintain at his ownexpense a sounding tube for determination of water leveldata. The owner shall complete the installation of therequired sounding tube for each well by December 31,1991.

§7124. Utilization and Metering of Well Water. (a)The Administrator may limit the amount of water drawnfrom any well covered under these regulations duringemergency conditions or drought, or if there is areasonable basis to expect that otherwise operation of thewell will:

(1) Excessively lower the ambient groundwatertable, or

(2) Cause or bring above excessive salt waterintrusion, excessive mineralization or otherdegradation of water quality which may render adomestic water source unfit for such purposes, or

(3) Interfere with the operations of existingestablished water sources.

(b) For all wells constructed after March 9, 1967 fromwhich water is to be drawn, the owner shall provide theinstallation of a water meter, as set forth in §7105(a)(4)(e)of these regulations, and shall maintain such device at hisown expense. At no time shall a well be operated without awater meter for more than a consecutive five (5) dayperiod.

(c) Prior to the replacement of pumps at a well for itsoperation with a rated capacity different than the ratedcapacity of the existing pump, an application for new welloperating permit shall be filed with the Administrator.Issuance of the permit shall be subject to the approval ofthe Administrator, based on the criteria set forth in §7105of these regulations. The Administrator's decision shall bemade within fifteen (15) days after filing for the welloperation permit.

(d) For all new wells from which water is to be drawn,that does not have the required utilities, the owner shallprovide, install and maintain the following at his ownexpense:

(1) A sounding tube to determine water level in amanner satisfactory to the Administrator;

(2) Adequate access and clearance £or welldrilling equipment;

(3) Sample tap for obtaining water samples;

(4) Water meter capable of registering pumpagerates in gallons. The meter shall have an indicator anda totalizer and be of sufficient size to accommodateflows up to 150 percent of the well design capacity.Accuracy shall be within two percent over the range ofthe water meter; and

(5) Pressure gauge on the discharge piping,reading in pounds per square inch.

§7125. Test Borings. (a) The owner/driller shall notifythe Administrator in writing and submit an application forwell drilling prior to any test boring work.

(b) Test borings shall be subject to the well drillingpermit requirements under §7115 of these regulations,except that a group of test borings less than 20 feet or 10feet in depth located on a single property may beconsidered under one permit and a group of ten (10) orportion thereof shall be considered as one (l) well for welldrilling fees. All test borings of 20 feet or more in depthshall be permitted individually.

(c) Test borings conducted in aquifer areas orgroundwater recharge areas, unless developed into a waterproducing or drainage well (underground injection controlwell) or monitoring well, must be properly destroyed inaccordance with pertinent sections of §7128 of theseregulations.

(d) Test borings which encounter groundwater at anydepth shall be afforded the maximum protection possibleagainst entrance of contaminants throughout the drillingprocess and must be destroyed immediately uponcompletion of the geologic study for which they weremade. In no case shall they remain open overnight.

(e) The owner/driller shall submit to GEPA a boringlog and a copy of soil analysis report within ten (10) daysof completion of the borings.

§7126. Access to Wells and Inspection of Wells. (a)Any duly authorized officer, employee, or representativeof the Agency may enter and inspect any propertypremises or place where a water well is being operated,constructed, or abandoned, for the purpose of ascertainingthe state of compliance with these regulations

(b) No person shall refuse entry or access to anyauthorized representative of the Agency who requestsentry for purposes of inspection, and who presentsappropriate credentials; nor shall any person obstruct,hamper or interfere with any such inspection. If requested,the owner or operator of the premises shall receive a reportsetting forth all facts found which relate to compliancestatus.

(c) If upon the basis of such inspections the Agencyfinds that applicable laws, rules and regulation have notbeen complied with, the Administrator or his authorizedrepresentative conducting the inspection shall issue aviolation for the purpose of compliance with theseregulations. The owner shall have thirty (30) days to bringthe well into compliance or the owner shall terminate theuse of the well until the violations have been corrected. Ifthe Administrator determines that continued operation ofthe well could cause an acute danger or health hazard tothe people of Guam, the Administrator may terminate theuse of the well.

(d) The owner of any well covered under theseregulations shall be responsible for providing adequatesafeguards at the well at his own expense so that anyperson permitted to be on such property where such wellis located shall be exposed to any danger, hazard ornuisance.

§7127. Discontinued Use of Wells. (a) The well owneror his authorized representative for which a well drilling awell operating permit has been issued shall submit awritten statement to the Administrator when a welldrilling operation has been discontinued and/or welloperation terminated for more than thirty (30) days. Thestatement shall indicate the nature and reason for theaction, the date of termination, the period of time that thewell drilling is to be discontinued or the well it to be out ofoperation, and shall be submitted within thirty (30) days ofthe action. The well shall then be declared either an “in-active well" or an “abandoned well", and the drilling oroperation permit shall be revoked by the Administrator.

(b) A well shall be considered “abandoned" if the wellis not being used in compliance with or maintained undera valid operating permit or the well has not been used for aperiod of twelve (12) consecutive months unless the ownershows evidence of his intention for the continued use andproper maintenance of the well in such a way that:

(1) The well has no defects which will facilitatethe impairment of quality of water in the well or in thewater-bearing formations penetrated;

(2) The well is covered with an appropriate lockedcap or approved surface plate;

(3) The well is marked so that it can be clearlyseen; and

(4) The area surrounding the well is kept clear ofbrush or debris.

(c) If the pump has been removed for repair orreplacement, the well shall not be considered“abandoned", provided that evidence of repair can beshown. During the repair period, the well shall beadequately covered to prevent injury to people and to

prevent the entrance of undesirable water or foreignmatter into the well.

(d) Monitoring wells used in the investigation ormanagement of groundwater basins by governmentalagencies or other appropriate engineering or researchorganizations are not considered "abandoned" so long asthey are maintained for this purpose. When these wells areno longer used for this purpose or for supplying water,they shall be considered as “abandoned wells".

(e) The Administrator, at his option or discretion, mayconvert the use of Government of Guam owned wells thathave been designated as "abandoned" to a new use as amonitoring well. In this event, the well shall be properlymaintained at the expense of the Agency according to theprovisions specified in the §7127(d) of this Section.

(f) All wells declared as being “abandoned wells" shallbe properly destroyed in accordance with §7128.

§7128. Requires for Destruction of Abandoned Wells.(a) All “abandoned" wells, including test holes, shall bedestroyed by their owner in such a way that they will notproduce water or act as a channel for the interchange ofwaters, when such interchange will result in a water-bearing formations penetrated, or present a hazard to thesafety and well being of people and animals.

(b) Before the hole is filled, the well shall beinvestigated by a licensed well driller to determine itscondition, details of construction, and whether there areobstructions that will interfere with the process of fillingand sealing.

(1) If there are any obstructions, they shall beremoved if possible, by cleaning out the hole or byredrilling.

(2) Where necessary, the insure that sealingmaterial fills not only the well casing but also anyannular space or nearby voids, the casing should beremoved (if possible), perforated, or otherwisepunctured, prior to placing the sea ling material.

(c) The following are requirements for filling and

sealing when certain conditions have been found to exist asestablished through inspection by the Administrator.

(1) When the well is wholly situated inunconsolidated material in an unconfinedgroundwater zone. If the groundwater is within fifty(50) feet of the surface, the upper twenty (20) feet shallbe sealed with impervious material and the remainderof the well shall be filled with clay, sand, or othersuitable inorganic material.

(2) Well penetrating several aquifers orformations. In all cases the upper twenty (20) feet ofthe well shall be sealed with impervious material.

In areas where the interchange of water betweenaquifers will result in a deterioration of the quality ofwater in one or more aquifers, or will result in a loss ofartisan pressure, the well shall be filled and sealed soas to prevent such interchange, and or otherformations where impervious sealing material is notrequired. Impervious material must be placedopposite confining formations for a sufficient verticaldistance (but no less than 10 feet) in either direction, orin the case of “bottom water", in the upward direction.

(3) Well penetrating crevice or fractured rock. Ifcreviced or fractured rock formations are encounteredjust below the surface, the portions of the wellopposite this formation shall be sealed with neatcement, cement grout, poz-mix cement grout, orconcrete, alternate may be used to fill the well. Finegrained material or fractured rock formations.

(4) Well in noncreviced, consolidated formation.The upper twenty (20) feet of a well in a noncreviced,consolidated formation shall be filled with imperviousmaterial. The remainder of the well may be filled withclay or other suitable inorganic material.

(5) Well penetrating specific aquifers, localconditions. Under certain local conditions, theAdministrator may require the specific aquifers orformations be sealed off during destruction of thewell.

(d) The following requirements shall be observed inplacing fill or sealing material in wells to be destroyed:

(1) The well shall be filled with the appropriatematerial (as described in this Section) from the bottomof the well up.

(2) Where neat cement grout, portland cementgrout, poz-mix cement grout or sand-concrete grout isused, it shall be placed in one continuous operation.

(3) Sealing material shall be placed in the intervalor intervals to be sealed by methods that prevent freefall, dilution, and/or separation of aggregates fromcementing materials.

(4) Where the head (pressure) producing flow isgreat, special care and special methods must be usedto restrict the flow while placing the sealing material.In such cases, the casing must be perforated oppositethe area to be sealed and the sealing material forcedout under pressure into the surrounding formation.

(5) When pressure is applied to force sealingmaterial into the annular space, the pressure shall bemaintained for a length of time sufficient for thecementing mixture to set.

(6) To assure that the well is filled and that therehas been no jamming or “bridging“ of the material,verification shall be made that the volume of materialplaced in the well installation at least equals thevolume of the empty hole.

(e) Materials. Requirements for sealing and fillmaterials are as follows:

(1) Impervious Sealing Materials. Sealingmaterials shall have such a low permeability that thevolume or water passing through them is of smallconsequence.

Suitable materials include neat cement grout,portland cement grout, poz-mix-cement grout, andsand-cement grout, and native soils and naturalmaterial that have a co-efficient of permeability of lessthan one hundred (100) feet per year, used drillingmuds are not acceptable.

(2) Fill Material. Many materials are suitable foruse as a filler in destroying wells. These include clay,

silt, sand, gravel, crushed stone, native soils, mixturesof aforementioned types, and those described in§7128(e)(1). Material containing organic matter shallnot be used.

(f) Additional Requirements for Abandonment ofWells in Urban Areas. In areas developed for multiplehabitation, to make further use of the well site, thefollowing additional requirements must be met:

(1) A hole shall be excavated around the wellcasing to a depth of a six (6) feet below the groundsurface and the well casing removed to within six (6)inches of the bottom of the excavation.

(2) The sealing material used for the upperportion of the well shall be allowed to spill over intothe excavation to form a cap at least one (1) foot thick.

(3) After the well has been properly filled,including the sufficient time for sealing material in theexcavation to set, the excavation shall be filled withnative soil.

(g) Temporary Cover. During periods when no workis being done on the well, such as overnight or whilewaiting for sealing material to set, the well andsurrounding excavation, if any, shall be covered. The covershall be sufficiently strong and securely anchored toprevent the introduction of foreign material into the wellad to protect the public from a potentially hazardoussituation.

(h) The Administrator shall set a compliance schedulefor the sealing of abandoned wells and shall notify, inwriting, the owner of the wells to be destroyed. Theadministrator reserves the right to require the owner toreplug any well where it can be determined that theprevious plugging was not effective due to failure ofcement seal or other causes.

(i) Inspection of destroyed wells after Sealing orFilling. The owner shall notify the Administrator forty-eight (48) hours in advance of his intent to commencework. All destroyed wells shall be inspected during andafter sealing or filling operation, by the Administrator or

his authorized representative to insure that properprocedures have been carried out.

§7129. Surface Water Requirements. (a) SurfaceWater Development.

(1) No surface source development shall beaccepted for review and approval by theAdministrator, unless the owner/purveyor hasobtained clearance approval from the Public UtilityAgency of Guam (PUAG) in accordance with thefollowing water utilization priorities:

(A) First priority shall be for use or resale bythe PUAG for any purpose, or for household use,for bona fide farms, plant nurseries, aquaculture,ranches, other bona fide agricultural uses, for golfcourses of less than 4,000 square meters or forornamental lawns and gardens of less than 4,000square meters.

(B) Second priority shall be for any other useby the government of Guam for public recreationand for other public purposes only and not forpurposes enumerated in subsections (C) and (D)below.

(C) Third priority shall be for irrigation use.

(D) Fourth priority shall be for irrigation ofgolf courses of 4,000 square meters or larger, orfor irrigation of lawns or ornamental gardens of4,000 square meters or larger.

(E) Fifth priority shall be for any otherpurpose.

(2) An elevation shall be made of the proposedsurface water impoundment or flowing supply in thearea of diversion and its tributary streams todetermine the degree of pollution from all sourceswithin the watershed.

(A) Where surface water sources which aresubject to continuous contamination by municipaland industrial wastes and/or treated effluent are

contemplated for development for public watersupply systems, the adverse effects of saidcontamination on the quality of raw waterreaching the purification plant shall bedetermined by sanitary surveys and laboratoryprocedures and findings submitted to the Agencywith planning materials. These findings will thenbe used to determine whether or not the proposedraw water intake is adequately separated from allcontamination sources.

(B) The disposal of liquid or solid wastesfrom any source in the watershed must be inconformity with the requirements of applicableGuam Environmental Protection AgencyRegulations and/or United States EnvironmentalProtection Agency Rules and Regulations

(C) Shore installations, marinas, boats and allhabitations on the watershed shall providesatisfactory sewage disposal facilities. Septic tanksand soil absorption fields, sanitary sewer, sewermanholes or other approved toilet facilities shallnot be located in the area within 1,000 feethorizontal distance from the lake water surface atthe uncontrolled spillway elevation at the lake or1,000 feet horizontally from the 50 year floodelevation whichever elevation is lower.

(D) Disposal wastes from boats or any otherwatercraft shall be in accordance with therequirements of the Guam Water PollutionControl Act, the Guam Water Quality Standardsand all applicable federal rules and regulations.

(3) Intakes shall be so located and constructed asto permit a wide variation in depths from which theraw water is taken, as well as to permit withdrawal ofwater when reservoir levels are very low.

and areas not subject to receiving immediaterunoff from flood prone areas, wetlands andswamps.

(B) Water intake works shall be providedwith screens or grates to minimize the amount ofdebris entering the plant and must be constructedso that water can be obtained from various waterlevels.

(C) No public boat launching ramps, marinasdocks, and floating fishing piers, shall be locatedwithin 1,000 feet from the raw water intake.

(4) The water treatment plan and all pumpingunits shall be located in well-drained areas not subjectto flooding and away from seepage areas or where theunderground water table is near the surface.

(A) Water treatment plants shall not belocated within 1,000 feet of a sewage treatmentplant. Any sanitary sewer within 1,000 feet of anyof the underground treatment plant units shall beconstructed of cast iron pipe with watertightjoints. A minimum of spacing of 1,000 feet mustbe maintained within any septic tank open-jointor perforated drainfield line and anyunderground treatment unit.

(B) Plant site selection shall also take intoconsideration the need for disposition of all plantwastes in accordance with rules both local andfederal.

(C) The water treatment plant and allappurtenances thereto shall be enclosed by anintruder resistant fence, the gates of which can bekept locked.

(D) An all-weather road shall be provided tothe treatment plant.

(E) Flow measuring devices shall be providedto measure both the raw water supplied to theplant and the treated water supplied from theplant, to provide for the accumulation of water

(b) Springs and Other Water Sources.

(1) Water obtained from springs, infiltrationgalleries, wells in fissured areas and/or any othersource subject to surface or near surface contaminationof recent origin shall be evaluated fro the provision oftreatment facilities, in addition to chlorination.

(2) The extent of water treatment required will bedetermined on the basis of geological data, nearbysources of contamination and, if appropriate, on thebasis of quantitative bacteriological and chemicalanalysis.

(c) Water Treatment.

(1) Surface Water.

(A) All water secured from surface sourcesshall be given complete treatment at a plant whichprovide facilities for pre-treatment disinfection,taste and odor control, continuous coagulation,sedimentation, filtration, covered clear wellstorage and terminal disinfection of water withchlorine and suitable chlorine compounds.

(B) The treatment capacity of a water plantbased on current acceptable design standardsshall always be in excess of the maximumexpected draft of any day of the year.

(C) No cross connection or interconnectionshall be permitted to exist in a filtration plantbetween a conduit carrying filtered or postchlorinated water and another conduit carryingraw water or water in any prior stage oftreatment. No conduit or basin containing rawwater or any water in a prior stage of treatmentshall be located directly above or permitted tohave a single common partition wall with anotherconduit or basin containing finished water. Therule is not strictly applicable, however, topartitions open to view and readily accessible forinspection and repair.

(D) All drainage conduits shall be constructed

so as to be thoroughly tight against leakage. Theyshall discharge and be located in such a mannerthat no currents of water can, under anycircumstances, be carried from a drain outlet tothe plant intake or to any other water intakelocated in the vicinity of the plant.

(E) Reservoi rs for p re t rea tment(sedimentation) and/or selective quality controlshall be provided where complete treatmentfacilities may not continue to operate satisfactorilyat times of maximum turbidities anticipated fromthe source of supply to be developed. Recreationat such reservoirs should be prohibited.

(F) Treatment plants shall be provided withefficient devices for measuring and applyingchemicals to the water under treatment.

(1) At least one chemical feeders shall beprovided as a standby or reserve unit.

(2) An accurate flow meter shall beprovided for determining rate of treatmentand total amount of water treated. Allchemical feed equipment shall be capable ofready adjustment to variations in the flow ofwater being treated.

(3) Dry chemical feeders shall beprovided with dissolving tanks whenapplicable.

(4) Chemical feeders shall be providedwith dissolving tanks when applicable.

(5) Chemical solutions transported fromfeeder to application point should beaccomplished through open channels. Ifenclosed feed lines must be used, they shallbe designed and installed so as to preventclogging and facilitate cleaning.

(f) Coagulants shall be applied to thewater in the mixing basis or chambers so as topermit their thorough mixing with the water.

(G) Provision of chemical application pointsbeyond the mixing basins or chamber shall beprovided for taste and odor control, stabilizationand disinfection for quality controls.

(H) Chemicals shall be sorted in a separate,dry room above ground and above floor level andprotected against flooding or wetting from floorsand wells.

(1) Storage facilities at the plant shall beadequate to store at least one month's supplyof chemicals used.

(2) Chemical storage facilities shall be solocated with reference to chemical feeders tofacilitate handling of bulk chemicals fromstorage to feed machines shall be such as tofacilitate good housekeeping.

(I) Flash mixing and flocculation equipment,capable of adequate flexibility of adjustment toprovide optimum flocculation under varying rawwater characteristics and rates of raw watertreatment, shall be provided.

(1) An ideal combination of flash mixingand flocculation will provide 1 to 2 minutesof violent agitation, followed by about 30minutes to 1 hour of slow mixing toaccomplish desired flocculation.

(2) Where special types of equipment forrapid mechanical mixing, softening ors e d i m e n t a t i o n a r e p r o p o s e d , t h emanufacturer sha l l guarantee theperformance of said equipment.

(3) Sufficient facilities for coagulationand sedimentation must be provided toclarify the water so that settled turbidity is ata level so as to produce a treated water at orbelow 1.0 turbidity until (TU) after filtration.

(i) Settled water turbidity of 10 TU orless are generally required to produce

treated water turbidity of less than orequal to 1.0 TU after filtration.

(ii) All turbidity measurements mustbe made in accordance with therequirements of the current GuamP r i m a r y S a fe Dr inkin g W a t e rRegulations (GPSDWR).

(J) In order to insure continuous operation,basins for flocculation and straight-flowsedimentation of coagulated waters shall be atleast two in number. They shall be designed forseries or parallel operation and shall provide atotal detention period of at least 6 hours each.

(1) Facilities for sludge removal shall beprovided by mechanical means or by theprovision of hopper bottomed basins withvalves capable of complete draining of theunits.

(2) Basins shall be designed as to preventshort circuiting of flow or the destruction ofthe floc. Coagulated water or water fromflocculators shall be transported tosedimentation basis in such a manner as toprevent destruction of floc.

(3) The length of rectangular settlingbasins shall preferably be at least twice theirwidth. Long effluent weirs will aid theefficiency of clarification. The depth ofsedimentation basis shall be such as tomaintain proper velocity of permissible depthbeing slightly removal. Flow line elevationsshall not vary more than a few inches aboveor below the normal level.

(4) Sedimentation basins shall beprovided with facilities for draining the basinin a period not in excess of 6 hours. In theevent that the plant site topography is suchthat gravity draining cannot be realized, apermanently installed electronic poweredpump station shall be provided to dewater

the basin.

(5) Where it is proposed to use apatented, tipflow or other type sedimentationbasin or clarification facilities with less thanthe previously specified detention time, thefacility may be conditionally accepted wherethe manufacturer or supplier provides a 2year performance bond that the water goingto the filters will turbidity of less than 10turbidity units. In no case shall the minimumsettling or clarification detention time be lessthan 2 hours. Facilities to monitor and recordthe turbidity of the raw and the settled watermust be provided. Engineering datasubmitted with the engineering report for theproposed settling basin should verity that thebasin is of proven design to treat the qualityof the raw water available to the treatmentplant.

(K) Filters shall be gravity or pressure type.

(1) The design of rapid and pressure typesand filters shall be based on a filtration rateof no more than 2 gallons per square foot perminute. Mixed-media and/or coal-sandfilters, of the slow and gravity type only, maybe conditionally accepted with filtration ratesof more than 2 gallons per square foot perminute when facilities to monitor and recordturbidities of raw, settled, and finished waterare provided.

(2) The depth of filter sand, anthracite orother filtering materials shall be between 24inches and 30 inches, and this filteringmaterial shall be free from clay, dirty, organicmatter and other impurities. Its effective sizeshall range from 0.35 to 0.45 mm for finesand, 0.45 to 0.55 mm for medium sand and0.55 to 0.65 mm for coarse sand, and itsuniformity coefficient shall not exceed 1.7.The grain size prescribed by the latestAWWA Standards.

(3) Under the filtering material, at least12 inches of gravel shall be placed varying insize from 1/16 inch to 2-1/2 inches. Thegravel is to be arranged in 3 to 5 layers suchthat each layer contains material about twicethe size of the material above it.

(4) The rate of flow of wash water shallnot be less than 20 inches vertical rise perminute and usually not more than 30 inchesvertical rise per minute, which shall expandthe filtering bed 30 to 50 percent. The freeboard in inches shall exceed the wash rate ininches of vertical rise per minute.

(i) The water backwashing of filtersshall be of the same quality as thatproduced by the plant and may besupplied by elevated wash water tanksor by pumps provided for backwashingof filters only, which take suction fromclear wells. For installations having atreatment capacity no greater than150,000 gallons per day, however, wasterfor backwashing may be secured directlyfrom the distribution system with propercontrols.

(ii) Rate of backwashing of filtersshall be regulated by rate-of-flowcontrollers.

(5) If surface filter wash systems areprovided, atmospheric vacuum breakers shallbe installed in the system lines and above theoverflow level of the filters such that all waterpasses through them.

(6) Each filter unit shall be equipped withrate-of-flow controllers and loss-of-headgauges for proper operation of filtrationprocess.

(7) Filter-to waste connection, if included,shall be provided with an air gap connectionto waste.

(8) Filters shall be so located thatcommon walls will not exist between themand aerators, mixing and sedimentationbasins or clear wells. This rule is not strictlyapplicable, however, to partitions open toview and readily accessible for inspection andrepair.

(L) Pipe galleries with ample working room,good lighting, and good drainage provided bysloping floors, gutters and slumps shall beincorporated in the plant design, along withadequate ventilation to prevent condensation andto provide humidity control.

(M) The identification of influent, effluent,waste and backwash lines can be accomplished byuse of various colors of paint. In order to maintainuniformity, the following color code is suggestedfor pipe galleries:

Blue Treated WaterGreen Clarified WaterTan Raw WaterBrown Waste WaterOrange Pumps, valve bodies and

metal pump basesBright Red Chlorine gas piping, flexible

couplings on pumps and othermachinery, and all exposed rotatingparts.

(N) For surface water treatment plants, anadequately equipped laboratory must be availableon-site where daily bacteriological and chemicaltests can be made on water supplied by all plantsserving 25,000 persons or more. For plants servingless than 25,000 population, on-site facilities formaking bacteriological tests may be omitted andthe required bacteriological samples submitted toa certified laboratory. All surface water treatmentplants shall be provided with equipment formaking at least the following determinations: pH,chlorine residual, alkalinity, turbidity, thresholdodor and other tests deemed necessary to monitorspecific water quality problems or to evaluate

specific water treatment processes.

(2) Disinfection.

(A) All waters obtained from surface sourcesmust be chlorinated prior to distribution at adosage sufficient to produce an adequate chlorineresidual in the water leaving the plant.

(B) All water stored in treated waterreservoirs for pumping directly to the distributionsystem must contain an adequate chlorineresidual. Chlorination facilities must be providedfor all such locations where an adequate chlorineresidual is not maintained from prior treatment.

(C) Disinfection equipment shall be selectedand installed so that continuous and effectivedisinfection can be secured under all conditions ascovered in treatment requirements for surfacewater.

(1) Disinfection equipment shall have acapacity at least 50 percent greater than thehighest expected dosage to be applied at anytime. It shall be capable of satisfactoryoperation under every prevailing oranticipated hydraulic condition.

(2) Automatic proportioning of thedisinfectant dosage to the rate of flow of thewater treated shall be provided at the largeplants and at all plants were the rate of flowvaries more than 50 percent above or belowthe average flow. Manual control shall bepermissible only where the rate of flow isrelatively constant or an attendant is alwaysat hand to effect promptly the necessaryadjustments in dosage.

(3) All disinfecting equipment at surfacewater treatment plants shall include at leastone standby unit for insuring uninterruptedoperation.

(4) Facilities shall be provided for

determining the amount of disinfectant useddaily, as well as the amount of disinfectantremaining to be used.

(5) When used, solutions of calciumhypochlorite shall be prepared in a separatemixing tank, then diluted and allowed tosettle so that only a clear supernatant liquid isprovided in the solution suction tank for thehypochlorinator.

(6) Provision shall be made for bothpretreatment disinfection and postchlorination in all surface water plants and atsuch additional points in the treatmentprocess as in order to provide for qualitycontrol treatment procedures.

(7) Disinfectants other than chlorine maybe used only at points in the treatmentprocess prior to post chlorination, and onlywith written permission from theAdministrator for community-type systems.

(8) Disinfectants other chlorine proposedfor use in non-community type systems willbe considered on a case-by-case basis.

(D) A suitable gas mask or self-containedtype breathing apparatus and also a small bottleof fresh ammonia solution, or approved equal, fortesting for chlorine leakage shall be provided andaccessibly located outside the chlorinator roomwhen chlorine gas is used.

(E) Housing for gas chlorination equipment acylinders for chlorine shall be separate buildingsor separate rooms with impervious walls orpartitions separating all mechanical and electricalequipment from the chlorine facilities, and shallbe located above ground level as a safety measure.This equipment and cylinders may be installed onthe outside of buildings when protected fromadverse weather conditions and vandals.

(F) Adequate floor level ventilation shall be

provided for all enclosures in which chlorine isbeing fed or stored.

(G) Safety measures for the use of alternatedisinfectants shall be as prescribed by the Agency.

(4) Special treatment processes. The adjustment offluoride ion content, special treatment for iron andmanganese reduction, special methods for taste andodor control, demineralization and other proposalscovering other than usual treatment will be consideredas special projects.

(5) Sanitary facilities for water works installations.Toilet and hand washing facilities provided inaccordance with established standards or good publichealth engineering practices shall be available at allinstallations requiring frequent visits by operatingpersonnel.

(6) Permits for waste discharge. For dischargingwastes from water treatment the purveyor/ownershall obtain the applicable permits from the GEPA andUSEPA. Region IX.

§7130. Wellhead Protection for Public Water SupplyWell. (a) The intent and purpose of this section is tosafeguard the public health, safety and welfare byproviding established standards

(b) Wellhead Protection Area shall mean the surface andsubsurface area surrounding a water well or wellfieldsupplying a public water system through whichcontaminants are reasonably likely to move toward andreach such water well or wellfield, or a minimum of 1,000feet radius of any potable water supply well.

(c) Maps if the Groundwater Management ProtectionZone:

(1) The Administrator shall maintain map(s) ofthe Groundwater Management Protection Zone(GWMPZ) as are necessary for the purpose ofgroundwater management. The GWMPZ map(s) maybe amended from time to time by the Administrator ashe deemed necessary.

(2) Any changes, additions or deletions to saidmap(s) shall be approved by the GEPA Board ofDirectors.

(d) Septic tanks and leached fields, sanitary sewer,storm water disposal, liquid waste storage disposal ortreatment in violations of this chapter within the GWMPZ:

(1) Notwithstanding any provisions of this rule,no department or agency of the Government of Guamshall approve, grant or issue any building permitclearances, certificate of use and occupancy for anyland use served or to be served by a septic tank withleached field, sanitary sewer, storm water disposalmethod, and which is within the GWMPZ area orwithin the 1,000 feet radius of any public utilitypotable water supply well, until the owner obtain theprior written approval of the Administrator.

(2) Furthermore, notwithstanding any provisionof this regulations, no person shall construct, utilize,operate, occupy or cause, allow or let, permit or sufferor to be constructed, utilized, operated or occupiedany land use served or to be served by septic tank andleached field, sanitary sewer, storm water disposalmethod, or liquid waste storage, disposal or treatmentmethod, and which is within the GWMPZ and withinany 1,000 feet radius of any public utility potablewater supply well, until the person has obtained the

prior written approval of the Administrator. TheAdministrator shall issue his written approval only ifhe finds that all septic tanks and leached fields, stormwater disposal method and liquid waste storagedisposal or treatment methods will be installed uponthe property as far away as is reasonably possiblefrom all potable water supply well, and;

(i) That the property served or to be servedby septic tanks is residential and uses a publicwater supply.

(ii) Residential land uses: No gravity sanitarysewer shall have an exfiltration rate greater thanfifty (50) gallons per inch pipe diameter per mileper day. Sewer lateral lines located in the publicright-of-way shall be a minimum of six (6) inchesor as required by the Public Utility Agency ofGuam latest Standards.

(iii) Sanitary Force Mains: All sanitary sewerforce mains installed within the GWMPZ orwithin the 1,000 feet radius of any public watersupply well, shall be constructed of either ductileiron or PVC pressure sewer pipe. No such ductileor PVC pipe sanitary sewer force main shallexfiltrate at a rate greater than that allowableleakage rate specified in the latest AmericanWater Works Association Standard C600 at apressure of one hundred C100) pounds per squareinch.

(iv) All gravity sanitary sewers with invertelevations above the average surrounding watertable and all sanitary sewer force mains shall betested to ensure compliance with theaforementioned exfiltration rate standard.

(v) A registered professional engineer shallprovide written certification of the exfiltration ratefor all manhole/gravity sewer systems installed,in equivalent gallons per inch pipe diameter permile per day (twenty four (24) hours), and theexfiltration rate for all sanitary sewer force mainswith pipe diameters of eight (8) inches or moreshall be visually inspected by television every five

(5) years by the responsible utility or propertyowner to ensure both structural a and pipe jointintegrity. Existing manholes shall be visuallyinspected for both structural and incoming pipeconnection integrity every five (5) years. Certifiedtest and inspection results and repair logs shall besubmitted to the Administrator within thirty (30)days after completion of the particular test,inspection, or repair.

(2) Storm Water Disposal Methods: Storm waterdisposal methods utilized or to be utilized will belimited as set forth in the most current UndergroundInjection control (UIC) Regulations for the Territory ofGuam.

(3) Liquid waste storage, disposal or treatmentmethods other than septic tanks utilized for thedisposal, discharge, storage or treatment of domesticsewage:

Liquid waste storage, disposal or treatmentmethods (other than septic tanks utilized for thedisposal, discharge, storage or treatment of domesticsewage, sanitary sewer lift stations, and publicsanitary sewers), shall be prohibited within theGWMPZ or within a minimum of 1,000 feet radius ofany potable water supply well.

(4) Notwithstanding the foregoing, no personshall issue his written approval unless theAdministrator has determined that the land use willcomply with all provisions of this chapter and that thefollowing water pollution prevention and abatementmeasures and practices shall be provided:

(i) Monitoring and detection of waterpollution caused by toxic chemicals andhazardous materials, and

(ii) Secondary containment of water pollutioncaused by toxic chemicals and hazardousmaterials, and

(iii) Inventory control and record keeping oftoxic chemicals and hazardous materials, and

(iv) Storm water management of waterpollution caused by toxic chemicals andhazardous materials, and

(v) Protection and security of facilitiesutilized for the generation, storage, usagehandling, disposal or disposal or discharge oftoxic chemicals and hazardous materials.

(e) Prohibition of toxic chemicals and hazardousmaterials within wellfield protection areas:

(1) Notwithstanding any provision of thisregulation, no approval, grant issuance of anybuilding permit, certificate of use and occupancy andbusiness license (except for changes in ownership),zoning action (unusual use, use variance) for any non-residential land use, other than a bona fideagricultural land use, or a public water supplyfacilities use, a public sewer facilities use, or a publicwater supply facilities use, within the GWMPZ orwithin the 1,000 feet radius of any public utilitypotable water supply well, without obtaining priorwritten approval from the Administrator. TheAdministrator shall issue his written approval only ifthe Administrator determines that the non-residentialland use is in compliance with all applicableprovisions of these regulations.

(2) Pursuant to the foregoing, the Administratorshall issue his written approval only if theAdministrator determines that all potential sources ofpollution will be installed upon the property as faraway as is reasonably possible from all potable watersupply wells, toxic chemicals and hazardous materialswill not be used, generated, handled, disposed of,discharged or stored on that portion of the propertywithin the GWMPZ and within the 1,000 feet radius ofany public utility potable water supply well.

(3) Notwithstanding the foregoing, the use,handling or storage of factory prepackaged productsintended primarily for domestic use or consumptiondetermined by the Administrator to be toxic chemicalsand hazardous materials shall not be prohibitedprovided, however, that the requirements of

applicable subsections of these regulations or otherapplicable local and federal regulations are fulfilled.

(A) The use, handling or storage of factorypre-packaged products intended primarily fordomestic use or consumption determined by theAdministrator to be toxic chemicals andhazardous materials shall not be prohibited,provided, however, that:

(i) The use, or storage of said factory pre-packaged products occurs only within abuilding, and

(ii) The non-residential land use is anoffice building use (or equivalent land use) orbusiness use (or equivalent land use) engagedexclusively in retail sales of factory pre-packaged products intended primarily fordomestic use or consumption, and

(iii) The non-residential land use isserved or to be served by public water andpublic sanitary sewers, and

(B) If the Administrator determines:

(i) That the application for a buildingpermit, certificate of use and occupancy(except for changes in ownership), businesslicense is for replacement, modification orlimited expansion of an existing facility,provided in no case shall such replacement,modification or limited expansion, cause,permit, let, suffer or allow the use,generation, handling, disposal, discharge orstorage of toxic chemicals and hazardousmaterials on the property to be increasedbeyond that existing on the property to beincreased beyond that existing on theproperty at the time of such application.

(ii) That the proposed replacement,modification or limited expansion will resultin a substantial reduction in the existing riskof pollution from the toxic chemicals and

hazardous materials to the closest publicutility potable water supply well.

(iii) In determining whether these will bea substantial reduction of the existing risk ofpollution as aforesaid, the following factorsshall be considered and evaluated by theAdministrator prior to rendering his decision.

(1) Whether the proposedreplacement, modification or limitedexpansion of the facility will provideadequated and increased monitoring anddetection of pollution which may be orwhich has been caused by the toxicchemicals and hazardous materials onthe property;

(2) Whether the proposedreplacement, modification or limitedexpansion will provide adequate andincrease inventory control and recordkeeping of toxic chemicals andhazardous materials on the property;

(3) Whether the proposedreplacement, modification or limitedexpansion will provide adequate andincreased storm water management ofpollution which may be or which hasbeen caused by the toxic chemicals andhazardous materials on the property;

(4) Whether the proposedreplacement, modification or limitedexpansion will provide adequate andincreased protection and security of thefacilities utilized for the generation,storage, usage, handling, disposal, ordischarge of toxic chemicals andhazardous materials on the property.

(iii) That there will be a substantialreduction of the existing risk of pollutionfrom the toxic chemicals and hazardousmaterials to the closest public utility potable

water supply well, only if, all the aforesaidfactors have been determined by theAdministrator to have been complied with.

(f) Applicability of Zone of Influence within thewellhead protection areas:

(1) The following procedures shall be utilizedwhen making a determination on the applicability ofthe zone of influence under these regulations;

(A) Property wholly within wellheadprotection areas have restrictions shall begoverned by the restrictions from a minimum of1,000 feet radius from any potable waterproduction well.

(B) Property within two or more wellheadprotection areas have restrictions, shall begoverned by the total sewage loading for theproperty. Total sewage loading shall be derivedby adding the sewage loading with each wellheadprotection area, and dividing the resultantamount by the gross acreage for the property;

(C) Property within both restricted andunrestricted wellhead protection area shall begoverned in accordance with these subsections,except that the portion of the property outside ofthe restricted wellhead protection area shall beexcluded from averaging a the applicablerestrictions as aforesaid. However, all septic tanksand, leached fields, storm water disposal methodsand liquid waste a storage disposal and treatmentmethods shall be installed upon the property asfar away as is reasonably possible from all potablewater supply wells.

(g) Excavation.

(1) Notwithstanding any provisions of thisregulation, no approval, grant, or issuance of anypermit, of any kind whatsoever, certificate ofcompletion, or any excavation within theGroundwater Management Protection Zone(GWMPZ) or within the 1,000 feet radius of any public

utility potable water supply well, until the applicantfor such permit or action has obtained the priorwritten approval of the Administrator.

(2) Furthermore, notwithstanding any provisionof this regulation, no person shall cause, allow, let,permit or suffer any excavation within theGroundwater Management Protection Zone(GWMPZ) or within the 19000 radius of any publicutility potable water supply well until the person hasobtained the prior written approval of theAdministrator.

(3) The Administrator shall issue his writtenapproval only if the Administrator determines that theexcavation will comply with the following:

(i) The property upon which the excavationhas occurred or will occur and that portion of theproperty which has not been excavated or will notbe excavated shall be provided with protectionand security measures to prohibit the handling,disposal of, discharge or storage of toxicchemicals and hazardous property which has notbeen excavated or will not be excavated Saidprotection and security shall be subject to theapproval of the Administrator.

(ii) The excavation will not be located withinthe 1,000 feet radius of any public utility potablewater supply well and the excavation will notexceed a depth of forty (40) feet below the existinggrade.

(h) Pipelines for toxic chemicals and hazardousmaterials:

(1) No approval, grant or issuance of any permitof any kind whatsoever for the installation,modification, or expansion of that portion of anypipeline used or to be used for the transmission orstorage of any toxic chemicals and hazardousmaterials and which portion is within the GWMPZ orwithin the 1,000 feet radius of any public utilitypotable water supply well.

(i) Land uses within the GWMPZ:

(1) No approval, grant or issuance of any buildingpermit, certificate of use and occupancy (except forchanges in ownership) or zoning action (unusual use,use variance, new use, similar use), for any land usewithin the GWMPZ, without obtaining the priorwritten approval of the Administrator.

(2) Furthermore, notwithstanding any provisionof this regulation, no person shall construct, utilize,operate, occupy or cause, allow, let, permit or suffer tobe constructed, utilized, operated or occupied anyland use within the GWMPZ without obtaining theprior written approval of the Administrator.

(3) The Administrator shall issue his writtenapproval only if:

(i) The Administrator determines that theproperty is within the GWMPZ and the existingland use(s) for the property or the land use(s)requested for the property is one or more of theland uses set forth in the most recent GuamZoning Regulations and the land use(s) will havean adverse environmental impact upon thegroundwater quality in the GWMPZ.

(ii) The Administrator determines that theland use is not listed in the most recent GuamZoning Regulations, the land use(s) is not set forthas a permitted use, special exception, unusual useof conditional use by the zoning regulations, theland use(s) is not land use(s) found in the zoningregulations and the land use(s) will not have anadverse environmental impact on groundwaterquality in the GWMPZ.

(iii) Notwithstanding the foregoing, theAdministrator shall not determine that the landuse is comparable to land use(s) set forth in thezoning regulations if the land use is permitted inone or more of the zoning classifications and thatthe land is not permitted in one or more of thezoning classifications which are less restrictivethan the most recent zoning classifications.

(iv) In determining whether the land use iscomparable to one or more land use(s) set forth inthe most current Guam Zoning Regulations, theAdministrator shall consider the following factors:

(A) The materials used, handled andstored, and the products and wastesproduced;

(B) The activities, processes and methodswhich are employed and utilized;

(C) The machinery and other facilitiesutilized and maintenance requirements ofsaid machinery and facilities;

(D) Uses commonly attendant to orassociated with the primary use.

§7131. Penalties and Appeals. (a) Any person whoviolates any of the provisions of these regulations shall bepenalized pursuant to §7031 of the Water ResourcesConservation Act as amended, 22 GCA Chapter 46.

(b) Any order or decision of the Administratorpursuant to these regulations, shall become final unless ahearing is requested before the Board. The Board shallhave the order or decision of the Administrator soappealed. Such appeal shall be made pursuant to theprovisions of the Administrative Adjudication Law, 5 GCAChapter 9.

(c) Any order or decision of the Board pursuant tothese regulations shall be subject to an appeal therefrom tothe Island Court of Guam. Such appeal shall be madepursuant to the provision of the AdministrativeAdjudication Law, 5 GCA Chapter 9.

§7132. Severability. (a) If any rule, section sentence,clause, or phrase of these regulations or its application tonay person or circumstance or property is held to beunconstitutional or invalid, the remaining portions of theseregulations or the application of these regulations to otherpersons or the circumstances or property shall not beaffected.

The deep monitoring well must penetrate into the 100percent Seawater Salinity (19,000 ppm) at the bottom of theTransition Zone - It must be located midway between theshoreline and the site of the proposed production well.
