TENNESEE COURT SYSTEM• 1. Trial Courts – jurisdictions in Tennessee are divided

• Appellate judges are appointed and then subject to a retention vote. This is called the “Tennessee Plan.”

Basic Judicial Requirements
Jurisdiction: is the power of a court to hear a dispute and render a verdict that is legally binding on the parties to the dispute.

What is Minimum Contacts
Defendant must have minimum contacts:
Examples:
1. Committing a tort (injury/civil wrong) within the state – car accident
2. Advertising/selling/putting a product into the stream of commerce in that state

Jurisdiction Over Businesses
Does the company do business or advertise within the state?
Does company deliver its products into the stream of commerce with the expectation that they will be purchased by consumers in the forum State.

•When a business purposefully avails it self of the privilege of conducti ng activities in a State, it is not unreason able to subject it to a lawsuit there.

Jurisdiction over Property

Why - Diversity Jurisdiction
• The US Constitution gives federal courts the power to hear diversity cases. The framers of the Constitution were concerned that when a case is filed in one state, and it involves parties from that state and another state, the state court might be biased toward the party from that state

Appeals
• If you do not believe judge or jury made right decision, you can appeal it.
• Appeals court JUST reviews – not a new trial

Whether to sue:
• Assuming you do win your lawsuit, you need to ask yourself whether or not you will be able to collect any form of judgment.
• Keep in mind that it will do you little to no good to win a lawsuit against someone that cannot pay the judgment or does not have insurance.

• Courts only have the power to tell you that you are legally entitled to a monetary judgment; they cannot help you collect it
