1 Chapter 1 Organisation, Functions and Duties [Section 4(1)(b)(i)] As prescribed under section 4(1)(b) of the Right to Information Act., the KSHRC notify the following for information of the general public:- Name of the Organisation, Address and details of the Commission Karnataka State Human Rights Commission 2nd, 3 rd & 4 th floor, 5 th Phase, Multi Storied Building, Bangaluru – 560001. The Karnataka State Human Rights Commission is a statutory organization established as per Section 21 of the Protection of Human Rights Act, 1993. The State Commission consists of a Chairperson and two Members, who shall be appointed by the Governor, after obtaining recommendation of the Committee Constituted as per Section 22(1) of the Protection of Human Rights Act. The Commission has came into existence on 25-07-2007. The details of the Hon’ble Chairperson and Hon’ble Members of the Commission are as follows. 1. Chapter 1

Organisation, Functions and Duties

[Section 4(1)(b)(i)]

As prescribed under section 4(1)(b) of the Right to Information Act., the KSHRC

notify the following for information of the general public:-

The Karnataka State Human Rights Commission is a statutory

organization established as per Section 21 of the Protection of

Human Rights Act, 1993. The State Commission consists of a

Chairperson and two Members, who shall be appointed by the

Governor, after obtaining recommendation of the Committee

Constituted as per Section 22(1) of the Protection of Human Rights

Act. The Commission has came into existence on 25-07-2007.

Functions

As per P.H.R. Act, the Commission shall perform the following

functions, namely:-

(a) inquire, suo-motu or on a petition presented to it by a victim or

any person on his behalf (or on a direction or order of any court),

into complaint of:-

(i) violation of human rights or abetment thereof; or

(ii) negligence in the prevention of such violation by a public

servant;

(b) intervene in any proceeding involving any allegation of violation

of human rights pending before a court with the approval of such

Court;

(c) visit, notwithstanding anything contained in any other law of the

time being in force, any jail or other institution under the control

of the State Government, where persons are detained or lodged

for purposes of treatment, reformation or protection, for the study

of the living conditions of the inmates thereof and make

recommendations thereon to the Government;

(d) review the safeguards provided by or under the Constitution or

any law for the protection of human rights and recommend

measures for their effective implementation;

(e) review the factors, including acts of terrorism, that inhibit the

enjoyment of human rights and recommend appropriate remedial

measures;

(f) study treaties and other international instruments on human rights

and make recommendations for their effective implementation;

(g) undertake and promote research in the field of human rights;

(h) spread human rights literacy among various sections of society

and promote awareness of the safeguards available for the

protection of these rights through publications, the media,

seminars and other available means;

(i) encourage the efforts of non-governmental organizations and

institutions working in the field of human rights;

(j) Such other functions as it may consider necessary for the

promotion of human rights.

Chapter 2

Powers and Duties of Officers and Employees

Under Secretary renders assistance to Chief Executive

Officer in respect of ‘Administration and Accounts’

section and also the Drawing & Disbursing Officer of the

Commission.

The Personal Secretary assists the Chairperson and

coordinates between the Chairperson and Members of

the Commission.

Public,

Relation Officer

Publication Relation Officer functions as a link between

the Commission, general public, visitors & various

Government & non-govt. organisations and guides the

public / complainants regarding the procedure to file

their grievances / complaints before the Commission. On

the instructions of the Hon’ble Chairperson and

Members, he also arranges the press meet and issues

press reports.

examined and put up before the Under Secretary.

INVESTIGATION WING

1 Inspector General of

Police

Head of the Investigation team at the Commission,

investigates and submits reports on the human rights

violation cases as directed by the Commission. As per

the directions of the Commission in important human

rights violation cases, undertakes surprise visits to

hospitals, hostels, old age homes and apartments of

general public and city police station on the complaints

of unlawful/illegal detentions, registration of false cases

and cases of torture and lock-up deaths.

Assisting IGP in investigation, meeting complainant in

person based on complaint collection and recording of

statements of complainant / witness, collection and

verification of required documents, video & photos of

the cases. Visiting the police stations, hospitals, jails

and other hostels and other Govt. institutions, for

enquiry where violation of human rights cases are

reported based on the complaints filed in the

Commission. Supervision of the investigation team in

the Commission.

Secretary:

The Secretary of the Commission is of the rank of Secretary to Government or its

equivalent and is the Chief Executive Officer of the Commission and exercises such powers

and discharges such functions as may be delegated to him by the Commission with the

assistance of officer and staff under him.

Registrar:

The Registrar is the head of the Law wing of the Commission who discharge duties as per

the Karnataka State Human Rights Commission (Procedure) Regulation 2007 and will be

responsible for placing the complaints of human rights violations received from the affected

persons before the respective Benches.

Additional Registrar:

The Additional Registrar also discharges duties as per the Karnataka State Human Rights

Commission (Procedure) Regulation 2007 and will be responsible for placing the

complaints of human rights violations received from the affected persons before the

respective Benches.

Inspector General of Police:

The Inspector General of Police is the head of the Investigation wing and as per the

instructions of the Commission the investigation is carried out by him with the assistance of

officer / staff working under him.
