NOTICE: INVITING TENDER
Sub: Tender enquiry for Preventive Maintenance of machines in STM (as per scope of work- Annexure-I) Sir, Your sealed offer in two-bid system is invited for works contract on labour basis for Preventive Maintenance of various machines of STM (as per scope of work- Annexure-I). The offer has to be submitted in two bids: Part 1 : Techno-commercial bid, part : 2 : Price bid. Annexure –A duly filled in by the contractor is to be submitted with tecnno-commercial bid. Annexure-B will be submitted in Price-bid in a separate envelop. The two part bids must be kept in separate envelopes and put together in a single envelope. Techno-commercial bid will be opened on the date of opening. This will be evaluated for qualifying tenders for price-bid opening. Price-bid of only Techno-commercially qualified offers will be opened with due intimation to the participants.
Your two part offer in sealed envelope, super-scribing your name, tender reference and due date of opening has to reach to the Tender Room (Green Box), ADM Building Ground Floor. Latest by 11.00 am on 16-02-2018. The offer shall be opened at 02.00 pm on same day in -Tender Room, ADM Building Ground Floor. TENDERING PROCEDURE
Tenders may be dropped on or before the due date & Time in the Works Tender Box (Tender Room ADM Building, Ground Floor of BHEL, Bhopal – 462021
The bids shall be submitted in two parts.
1. Techno-commercial bid (Part – 1). II). Price Bid (Part – 2).
1.1 Techno-commercial Bid (Part – 1 ) : The first envelope shall contain the Techno-commercial Bid as per the enclosed technical bid pro-forma with relevant documents like copies of ESI, PF code, Labour license, PAN No., EMD, Documents for fulfilling qualifying criteria along with all relevant papers. The envelope shall be super scribed “Techno-commercial bid Enq. No. … (Name of work)”…………………………….
1.2 The Second envelope shall contain only the price bid to be quoted in Schedule of Rates (Annexure ‘B’) any other information in the price bid other than quoted price shall not be considered and the quotation is likely to be rejected. Price bid document shall be signed by the tenderer at the bottom of the page. The envelope shall be sealed and super scribed “Price Bid ----------- (name of work)”.
1.3 Both the above two envelopes shall be kept in another sealed cover. The cover shall be super-scribed with “Quotation for -------- (name of work)” and shall be addressed to Sr. Engineer (FTX) and drop to Tender Room ADM Building, Ground Floor of BHEL, Bhopal – 462021 to reach on or before 16-02-2018 by 11.00 hrs. on due date and it should also contain Tenderer address, Tender No.& due date.
1.4 The tenders will be opened in BHEL Bhopal on tender due date at 14.00 hrs in presence of those tenderers who choose to be present. BHEL will be not responsible for any postal delay.
Note: - Only part –1 i.e. Techno-commercial offer shall be opened on the due date of tender opening.
1.5 Date of opening of price bids will be intimated after techno-commercial suitability.
1.6 The technical bid consists of technical schedule requiring documentary proof. In case the party has not satisfied all the conditions along with documentary proof, the tender will be rejected.
1.7 Tenders received mixed with both technical & Price bid documents without individual envelop will be rejected. The Techno-commercial Bid as Part – 1 will be opened at 02:00 PM on due date. Price – Bid will be opened later after evaluation of Techno-commercial Bid.
1.8 Contractor has to furnish and accepts the above Technical, Commercial and General Terms & Conditions. If nothing is written about it will be presumed that you have agreed to all the conditions therein.
1.9 Cost of the Tender documents Rs. 200/- (Rupees Two Hundred only) payable in the form of Electronic Fund Transfer in favour of BHEL Bhopal and is not refundable. Receipt to be attached with the Techno – Commercial offer. GST shall be extra.
2. TERMS OF PAYMENT: Shall be as under: –
Payment shall be made against submission of running bills on every Month on actual man hour Basis of Skilled, Semiskilled & Unskilled Worker.
3. TDS will be deducted from running bill as applicable. Contractor has to pay minimum wage as declared by HR CLC Department. Contractor has to compulsory give Bonus to their works as per BHEL guidelines.
Contractor has to compulsory give safety shoe, uniform & Helmets to their works. GST will be Paid Extra as applicable.

4. DEPLOYMENT OF MANPOWER :

Note : 1. Deployment of manpower on Sunday & Holidays will be as per BHEL requirement.
2. Above mentioned man hours are tentative it may increased or decrease depending up on BHEL requirements.
5. PENALTY CLAUSE :-
Penalty shall be deducted only if shortage in actual man hour is more than 10% of the required man hour for each quarter. Actual man hour (skilled semiskilled & unskilled) will be calculated for every three month (including overtime hours given to workers). The deduction for each category shall be Rs. 35 per hour. Above mentioned deduction can be calculated after every 3 months (each quarter) of the contract period deducted from the next contractor bill. Calculation for the last quarter shall be done in the last bill.
i.The maximum cumulative penalty shall be limited to 10% of the Work order value. 6. INSPECTION:
In view of the criticality of the job the bidders are advised to inspect the machines to study the requirement of work in details before bidding. The bidder can inspect the machines with prior intimation on any working day from 9:00 hrs. to 16:00 hrs. before the last date for submission of tenders.
7. EARNEST MONEY DEPOSIT & SECURITY DEPOSIT Earnest Money Deposit and Security Deposit will be as per the tender documents.
7.1 Earnest Money Deposit (EMD):
7.1.1 The earnest money deposit shall be Rs. 21,465/- or one time EMD of Rs. 5,00,000/-.
7.1.2 Modes of deposit The EMD may be accepted only in the following forms: (i) Electronic Fund Transfer credited in BHEL account (before tender opening) 7.1.3 Forfeiture of EMD EMD by the Tenderer will be forfeited as per NIT conditions, if: i) After opening the tender and within the offer validity period, the tenderer revokes his tender or makes any modification in his tender which is not acceptable to BHEL. ii) The Contractor fails to deposit the required Security deposit or commence the work within the period as per LOI/ Contract. EMD by the tenderer shall be withheld in case any action on the tenderer is envisaged under the provisions of extant “Guidelines on Suspension of business dealings with suppliers/ contractors” and forfeited/ released based on the action as determined under these guidelines. 7.1.4 EMD given by all unsuccessful tenderers shall be refunded normally within fifteen days of award of work. In case of expiry of offer validity period or any other circumstances, EMD can be released with the approval of Head of Contracting dept., not below the rank of AGM. 7.1.5 EMD shall not carry any interest. 7.1.6 EMD of successful tenderer will be retained as part of Security Deposit. 7.2 Security Deposit Security Deposit means the security provided by the Contractor towards fulfilment of any obligations in terms of the provisions of the contract.

7.2.1 The total amount of Security Deposit will be 5% of the contract value. EMD of the successful Tenderer shall be converted and adjusted towards the required amount of Security Deposit. 7.2.2 Modes of deposit: The balance amount to make up the required Security Deposit of 5% of the contract value may be accepted in the following forms: i) Electronic Fund Transfer in favour of BHEL iii) Bank Guarantee from Scheduled Banks/ Public Financial Institutions as defined in the Companies Act. The Bank Guarantee format should have the approval of BHEL iv) Fixed Deposit Receipt issued by Scheduled Banks/ Public Financial Institutions as defined in the Companies Act (FDR should be in the name of the Contractor, a/c BHEL) v) Securities available from Indian Post offices such as National Savings Certificates, Kisan Vikas Patras etc. (held in the name of Contractor furnishing the security and duly endorsed/ hypothecated/ pledged, as applicable, in favour of BHEL) (Note: BHEL will not be liable or responsible in any manner for the collection of interest or renewal of the documents or in any other matter connected therewith) 7.2.3 Collection of Security: At least 50% of the required Security Deposit, including the EMD, should be collected before start of the work. Balance of the Security Deposit can be collected by deducting 10% of the gross amount progressively from each of the running bills of the Contractor till the total amount of the required Security Deposit is collected. If the value of work done at any time exceeds the contract value, the amount of Security Deposit shall be correspondingly enhanced and the additional Security Deposit shall be immediately deposited by the Contractor or recovered from payment/s due to the Contractor. The recoveries made from running bills (cash deduction towards balance SD amount) can be released against submission of equivalent Bank Guarantee in acceptable form, but only once, before completion of work, with the approval of the authority competent to award the work. (Note: In case of (a) small value contracts not exceeding ` 20 lakhs or (b) SAS jobs, work can be started before the required Security Deposit is collected. However, payment can be released only after collection/ recovery of initial 50% Security Deposit).
7.2.4 Security Deposit shall be released to the Contractor upon fulfilment of contractual obligations as per terms of the contract. 7.2.5 The Security Deposit shall not carry any interest.
8. TENDER SUBMISSION AND OPENING: Tender submission location: Tender Box (For Works), Tender Room, Ground Floor, Administrative Building, Bharat Heavy Electricals Limited, Piplani PO Bhopal – 462 022. Tender Submission time/date: Before 11:00 hrs on 16.02.2018. Tenders received after 11:00 hrs. will be treated as LATE TENDER. Tender opening time/date: 14.00 hrs on 16.02.2018 in Tender Room. The tender envelope must carry the following information on the top of the envelope:

9. In the event of acceptance of tender, and if the contractor fails to commence work within Prescribed period, BHEL shall, without prejudice to any other right or remedy, be at liberty to forfeit the said earnest money.
10. Accepting authority reserves the right to reject any or all quotations without assigning any reason thereof.
11. For General terms and conditions for inviting reconditioning tenders and award of contract ref. Annexure-III.
12. Quotations must be valid for at least 90 days.

13. RULES AND REGULATIONS OF THE CENTRAL/STATE GOVERNMENT: In the event of award of any contract to Central/State government, it will have to observe and perform all the laws/enactment for the time being in force. For an example the information about wage bills amount and deduction of contributory provident fund of all of your employees every month have to be submitted. Permanent P.F. Account No., ESI Reg. No., Labour License No. etc. allotted by the concerned authority should
also be mentioned in your quotation. This is necessary as per the latest directives from Regional Provident
Fund Commissioner M.P. Government. Documents regarding your registration with Sales Tax and Excise
authorities may also be forwarded along with income tax clearance.
14. All the documents being sent herewith should be returned back to us duly signed on each paper along with
your offer. The general terms and conditions being attached herewith shall also form an integral part of
contract Agreement for individual machines in case the work order for any is awarded to you.
15. Bids lower than the minimum statutory amount, i.e. minimum wage, PF, ESI, etc., as may be
declared by unit HR deptt., shall be rejected.
16. BHEL reserves all rights for the short closure or extension of works contract as per BHEL requirement.

Annexure -I
Scope of Work
In STM division we have 6 heavy machines, 22 medium and 56 small machines, Preventive
Maintenance of heavy machines will be done Four times in a year and Preventive Maintenance
of medium and Small machines will be done Twice in a year. Number of M/Cs may vary on
account of transfer/condemnation/reconditioning/new procurement.
Activities to be carried out during PM are as below :-
1.1 Mechanical:-
1. Cleaning and visual inspection.
2. Check jib strips at full range.
3. Check all the transverse, slide and table ways.
4. Check column guides, wedges etc.
5. Cleaning of air filters, oil filters, and water strainers etc.
6. Checking of couplings, coupling bolts of power transmission.
7. Checking of proper functioning of hydraulic systems.
8. Check the working of refrigeration /cooling system.
9. Check the back lash of moving parts
10. Check the axial play.
11 Check the lubrication of the gear box, apron, saddles, pumps, slides, guides etc.
12. Greasing of lead screws and bearings of the motors.
13. Refilling and replacing of hydraulic and lubricating oil.
14 check the proper working of lubrication system.
1.2 Electrical:-
1. Check the motor insulation by meter .
2. Check the earthing wire.
3. Check main switches, fuses and limit switches.
4. Check control gears, starters, brushes etc
5. Clean contactors,relays etc
6. Clean resistors, transformers etc
7. Check rectifiers
8 Check the safety interlocks
This is a generalized PM check list. However , machine specific check list and other instructions
will be given by the Engineer In-charge at the time of execution.

ANNEXURE III
GENERAL TERMS AND CONDITIONS
1. In the event of acceptance of tender, and if the contractor fails to commence the work
within stipulated time frame ,BHEL shall be at liberty to forfeit the said earnest money.
2. Accepting authority reserves the right to reject any or all the quotations without assigning
any reason thereof.
3. The successful contractor has to execute an agreement on non-judicial M.P. Government
non-judicial stamp paper of Rs. 100/- denomination.
4. General
a) All the safety precautions will be taken care of by the contractor.
b) BHEL shall not be responsible for any accident/injury to the persons employed by the contractor for working in the BHEL, Bhopal premises.
c) The contractor has to ensure payment of minimum wages to their workers. The
contractor will ensure that they release payment to their workers/supervisors as per
norms published by our HR Contract labour cell. The contractor shall be responsible for
providing uniform, shoes and helmets to their workers and remit contributions of PF and ESI on timely and regular basis which will be subject to checking by our HR
Contract Labour Cell.
d) The contractor shall observe /perform all the laws/enactment rules and regulations of
the central and state govt. which are in force from time to time. The workers will have to
be paid bonus as per prevailing rules and also ensure payment of leaves as applicable.
e) In case of contractor abandoning the work and running away, BHEL reserves all rights
to get the unfinished work completed at the risk & cost of contractors.
5. Jurisdiction, if any, shall be at Bhopal only.
6. Attendance record of contract workers - “The contractor should maintain an Attendance
Register against each work order in respect of the contract labourers
deployed by him in that department. The contractor shall record the daily
attendance of the workers. The register shall bear the daily signature of contract
workers & contractor. The register shall at all the times of work, be available at the place of work/deptt. Attendance register shall be maintained in the format of Form
No XVI as per CL (R&A) Central rules 1971 and available on CLC web page. If during
any inspection, the attendance register is not found at the place of work, the
contract is liable to be short closed/ terminated. “
7. Wage record of contract workers - “The contractor should maintain a Wage Register against
each work order in respect of the contract labourers deployed by him in that department. Wage
Register shall be maintained in the format of Form No. XVII/XVIII as per CLC (R&A) Central Rules
1971 and available on CLC web page. The Wage Register shall be based on the Attendance Register as
mentioned above. The Contractor shall issue Wage Slip to each contract worker, every month
on the last day of the wage month. Wage slip shall be as per the CLC format available at CLC Web page. The Contractor shall pay wages not later than 7th of the succeeding month.
The Wage Register shall bear the PF and ESI nos. of the workers.”
8. Compliance of PF/ ESI deductions - “The Contractor shall file the electronic return of PF/ ESI and
submit proof of payment of both the employer’s and employees’ contributions every month. (PF has to be remitted by 15th and ESI by 21st of the
succeeding month.) Contractor shall submit the Challan along with copy of a self-
certified list of contract workers (bearing their names and PF/ESI no. and
deductions made) for whom the contribution has been submitted by him for the
said period. Such list shall be displayed in the notice board of the department.”
9. ESI card based Labour Entry -“Only those workers shall be allowed entry
into Factory premises who have valid ESI card.”

10. Uniform, shoes & helmet for contract workers- “In the first month of the execution of
work order the contractor shall provide uniform, shoes & helmet to
his workers and provide an undertaking on this regard to the department and the
first bill shall be processed only on the production of the undertaking. In case of
non-compliance beyond second month the contractor shall be issued notice of termination of contract.”
11. Supervision of Contractor labour- “The contractor should provide for at least one
identified supervisor. All issues regarding discipline at the works like
work allocation, early exit, snacks distribution etc. are to be supervisor’s personal
responsibility.
12. Contract labour accidents while at work:-“In case of medical emergencies faced
by contract worker at work, medical facilities in the interest of the well-being of
the worker shall be provided by BHEL. The decision of the doctors attending the
emergency shall be final and binding. The cost incurred shall be deducted from the bills of the contractor. The Contractor shall complete the ESI formalities and
BHEL shall submit claim of reimbursement of medical expenses to ESI. The
amount reimbursed by ESI shall be paid back to the contractor.”
13. Police Verification :
Contractor must have to submit Police Verification of their Contract workers within 15 days i.e. from start of work to the respective contracting departments /executives /HoDs.
14. First and Final Bill to be cleared only after submission of Form VI A & VI B:
“Contractor shall within 5 days of commencement /completion of Work Order
submit Form VI A to RLC office. Contractor shall submit a copy of Form VI A bearing the receipt seal of RLC office to HR department. The first and final bill
shall be processed only on clearance regarding submission of Form VI A and VI B
by contractor. New Work order no. shall be allotted only after the contractor
concerned furnishes copy of Form VI A regarding the closure of the earlier
contracts (if any)”.

INSTRUCTIONS TO CONTRACTORS
STATUTORY COMPLIANCES TO BE ENSURED BY WORK ORDER ISSUING AUTHORITY UNDER WORKS CONTRACT
BHEL shall have the privities of the contract with the contractor only and will give instructions to the contractor or his authorized representative. BHEL will have nothing to
do or be concerned with the employment of employees working for the contractor. The
relationship between BHEL and the Contractor will be that of independent entities and
nothing herein contained will amount to joint venture, partnership or an employer-
employee relationship.
The contractor shall maintain regular contact with the designated employee(s) of BHEL
and will interact on matters relating to the work awarded under this contract.
Contractor will ensure that the job is executed through his employees on his rolls and
under no circumstances the contractor will deploy any casual employee to carry out the job nor shall sub-contract the job without prior written permission.
Contractor shall observe Provisions of the Factories Act in respect of working hours, holidays, rest intervals, leave and overtime to his employee. No work shall be done on
second/third shift, overtime, Sundays or on other declared holidays without written
permission.
Contractor shall obtain Police Verification of all his workers.
Contractor shall submit following Certificate for each contract separately.
“ It is certified that PF challans of the amount -------------------- pertains to my workers
whose names are appearing in the wage sheet of the month ------------------- and these workers are engaged in --------------------------- (type of work) against work Work order no.
------------------------ in --------------- (name of department).

PAYMENT OF WAGES
Contractor shall be responsible for making payment of wages through Bank / Cheque
before expiry of 7 days from the last day of wage period and to ensure disbursement of
wages in the presence of the authorized representative of contract operating division &
representative of HR who shall record under his signature at the end of entries in the
Register of wages in the following form
“Certified that the amount shown in column no. ………. has been paid to the workers
concerned in my presence on date ………….. at time…………..”.
In case contractor fails to make payment of wages to his employees or remittance of contribution to the concerned authorities, the security deposit /other dues under the
contract can be utilized by BHEL to discharge the liability of the contractor.
SAFETY AND DISCIPLINARY ACTION
Contractor shall ensure that his employee do not indulge in any unsafe or hazardous
practices. They use safety equipment such as safety belts, safety shoes, goggles, helmet and

masks where use of such equipment is required in day-to-day operations. All such safety gadgets will be provided by the contractor failing which the contract operating division will
provide safety equipment to such employee of the contractor at the cost of the contractor to
be recovered from his bills. Contractor shall fully indemnify BHEL against any claim for
damages for injury to person or property resulting from such accidents.
Contractor to ensure that employee deployed in the premises is physically and mentally fit and do not have any criminal record.
Contractor will be responsible for good conduct of his employees. In case of misconduct,
contractor shall take prompt disciplinary action as per "Model Standing Orders" on the advice of Contracting officer.
The contractor has to provide a distinct uniform different from BHEL employees. The
Uniform should have logo of the Contractors firm / company. The uniform shall be kept in
neat, tidy and wearable condition. Wherever necessary, the Cap shall be integral part of the
uniform
Contract awarded is liable for termination for any contravention of statutory provisions or
any other reasons without assigning any explanation or notice to the contractor.

RECORDS & INFORMATION TO BE FURNISHED BY CONTRACTOR
Contractor shall maintain neatly, completely and legibly registers, records, reports and returns for inspection by various authorities at short notice.
Contractor shall submit the details of work awarded to him by other departments indicating work order No., nature of work and maximum number of workers employed etc.
Contractor shall provide information as required in respect of all his employees employed by him to enable the contract operating division to monitor compliance of P.F./ESI and also to
enable him to furnish information to Ministry and Labour deptt. as may be required.
Contractor shall provide full particulars of each employee employed by him before start of the work and from time to time. He will also endorse a copy of returns furnished by him to
the Labour Department under the Contract Labour (Regulation and Abolition) Act 1970.
COMPLIANCE OF STATUTORY PROVISIONS

3. Annual leave with wages including National Holiday & Festival holiday.
4. Leave record register.
5. Shall engage only adult workers who have attained the age of 18.
6. Work to be done on second/third shift, overtime, Sundays or on other declared holidays with written permission.
7. Obtain insurance cover for his employees/equipments, tools etc. & third party insurance coverage at his own cost.
8. Remit Provident fund contributions in prescribed 3A & 6A forms
9. ESI contributions in Form 6.
10. Submit challans of PF & ESI contributions every month.
11. Provide Personal protective equipments for his employees.
12. Distribute wage slip each month to his employees.
13. Ensure payment as per Minimum Wages Act, 1948 & additional wages as declared by BHEL, Bhopal from time to time, in the presence of concerned dept representative/ through bank account
14. Submit employee and employer contribution as per Shram Kalyan Nidhi Adhiniyam 1982.
3.0 PAYMENT OF WAGES ACT
1. Those engaging 100 or more workman, should submit or copy of standing orders.
2. Shall comply with the provisions of Factories Act.
