Constitutional crunchhits job quotas

Amid the hullabaloo over job quota for Scheduled Castes in theprivate sector, the biggest irony of Dalit politics lies hidden in thefiles of the Uttar Pradesh Secretariat. It was the Mayawati-led

State Government which examined, and subsequently rejected the proposalfor reservation in private jobs. In the process, it probably became the firstState Government to officially explore the idea and reject it. That Mayawati,a Dalit icon, should preside over such a decision, is significant.

The proposal was mooted by Mayawati when she came to power in2002 with the help of the BJP. Possibly enthused by the Bhopal declara-tion on Dalits, she announced reservation for Dalits and tribals in liquorshops, auctioned by State and PDS outlets allotted by the government. Itwas accompanied by Mayawati calling for Dalit quota in private sector.

Sources said the announcement in mid-2002 was followed by a pro-posal initiated by the Chief Minister’s office. But the subject hit a road-block when it reached the Legal Department.

Principal Secretary, Law, A B Shukla, struck down the idea. Sources saidthat Shukla reportedly noted on the file that it was not “legally possible” todictate to private sector to reserve jobs on caste or other considerations.

One of the arguments was that the constitutional provisions did notgive liberty to interfere in trade and business established on private capitaland based on money and work.

The NGO CultureA reader has spelt out something that must have nagged manya Gangtokians mind every time he/ she saw the cow carryingwhat appears to be a tumour, foraging for food in dustbins inthe upper reaches of the capital. The reader hopes that theanimal husbandry department, some NGO or concerned indi-viduals reach some treatment for the abandoned cow. Now,someone might. What would have been ideal is that the news-paper, instead of reporting on an abandoned animal, sufferingan untreated medical condition, had instead got the chance toreport on how an abandoned, suffering animal was rescued.That did not happen. But this is not just about the cow up atBaluakhani. It is another proof of the absence of a Civil Societyin the State. Abandoned and suffering animals, piles of gar-bage dumped in unnotified areas, defacement of public prop-erty... these are all manifestations of a society that does notcare enough. It is easy to expect efficient NGOs working in thesocial field, but NGOs, by their very definition are Non Govern-mental Organisations. Their patronage does not come fromthe State [the funds might], it comes from the people and whenthe people would rather not care, there will not be NGOs thattake initiative. At best, they will take directions, but there is nopressure on them to improvise. There are several NGOs allover the world doing exemplary work among the underprivi-leged. It is difficult to pinpoint any that stand out in Sikkim. Thisis perhaps because there is no pressure on them to seek outareas that need non-governmental efforts. There are someNGOs that are doing good work, but they are mostly attachedto some national project or the other. What Sikkim could use issome community initiative which identifies areas of thrust be-yond the purview of imported projects which are rarely flexibleenough to accommodate local situations. For that to happen,the society as a whole will have to become more “concerned.”Well-meaning individuals might lead an NGO well, but for theNGO culture to really become effective, the entire society needto get involved. Become more “concerned”.

I would like to bring attention through your paper about a cow in a verysorry state. Her stomach is hanging on one side and seems to be grow-

ing worse every day. Whenever I come to Gangtok, I see it roaming aroundand eating from the garbage bins, which may be the reason for the pro-truding stomach of hers. GANGTOK, 30 June: The StatePollution Control Board, in re-sponse to NOW’s report on Ambi-ent Air Monitoring System pub-lished on 29 June informs that theAmbient Air Monitoring Machinesare regularly generating data, whichis then being fed to the Central Pol-lution Control Board, Delhi.

CPCB, however, has not ac-corded any approval as yet to use orrelease the data. Scientists are report-edly coming from Delhi to inspectand verify the operation and instal-

lation of the Air Monitoring System.The machines will have to be ap-proved for their working conditionbefore the data can be disseminated.

This verification, inform sources,is neccessitated because several Statesin the northeast have been feedingSPCB data without having even in-stalled the air monitoring machines.To verify the dependability of theSikkim data, expert will be visitingGangtok on August 15, it is learnt.

A proposal to install such ma-chines at Namchi has also beenapproved and the machines havebeen ordered.

The Alpine CricketClub and Rustic CC, which hadmade to the finals of the tourneywhich saw the participation of 16local teams were declared the jointwinners on 28 June when shortageof time and grounds made it impos-sible to hold the finals. The organ-isers inform that the tournament washeld to “encourage the young gen-eration” and have promised to holdit again next year. It has also thankedthe Sikkim Cricket Associationwhich supported the tournament.

According to sources, the ac-ceptance of independent candidatesby the GNLF would act against theparty norms as it cannot be deniedthat votes were divided because ofthe independent candidates, a fac-tor which maybe taken as the causefor the loss of the GNLF candidatesin the relevant wards.

Col D K Pradhan convener ofthe PDF said: “The independentcandidates who have won do notcount in the victory list of theGNLF; moreover if one is to abideby the party rules then they are notto be accepted”.

Though the GNLF managed toform the municipal body with vic-tory of their 16 candidates out of the23 wards, an important factor wasrecorded in this year’s polls. Out ofthe percentage turnout which voted(61.65%), only 35% voted in favourof the GNLF. Hence the remaining65% were in favour of the variousindependent candidates or in simpleterms the opposition.

Analysts say, this is the sign ofa dim future for the ruling party,taking into consideration the resultsin the other two sub-divisions ofDarjeeling and Kurseong.

“If the number of Independentcandidates were a little less, then theresults certainly would have been inour favour. But no-doubt this is asign of the masses demanding achange” said Col Pradhan.

GANGTOK, 30 June: ManitaThapa, Chairperson, STDC, alongwith Executive Director PK Dong,D.E. Prakash Chettri, Under Sec-retary [CSS], Raju Dong, inspectedvarious areas including Apica Gar-den, Pakyong, Kartok Monastery,Jhandi Dara, Krishan Tar to assessthe possibility of initiating tourismrelated activities in these areas.

In the first instance, it was foundvery essential to develop a parkingplace along side the road at ApicaGarden, for which the Tourism De-partment will initiate a proposal. Itwas also found that the swimmingpool there was in a bad shape. Thevisiting team agreed that proper in-frastructure needs to be put in placeand also decided to construct a newswimming pool for the girls and chil-dren at the adjacent vacant land. Bet-ter lighting at the park and waterfountains were also discussed to en-hance the appeal of the toruist spot.

At Pakyong, a Welcome Gatebefore the entrance of CommunityCentre will now be included in theproposal alongwith the suggestionto construct a View Point above Ba-zaar School Dara.

On the prospect of developingan artificial lake at Bojay Tar, it wasfound necessary to study the scopeof developing such a lake by wayof rain water harvesting. A proposalin this respect has already been sub-mitted by the Forest Departmentand the same may have to be pur-sued, the team agreed.

Jhandi Dara, at an altitude ofmore than 6000 ft., offers a bird’seye view of various places of

Sikkim and West Bengal. Alreadypopular with trekkers and nature-lovers as the trail follows virginnatural reserves covered with rarevarieties of trees and medicinalplants, the visiting team saw “greatscope” for tourism developmenthere, specially if it was linked withBudang Gari, which has an im-mense historical importance.

The team agreed to promote trek-king activities here by developing ba-sic necessary infrastructure at requiredlocations along the route coupled withproper publicity of its significance.

Karthok Monastery, one of theoldest monasteries in Sikkim, hasalso been proposed for improve-ment. The team felt it necessary togive “top priority” to the construc-tion of a public galley at the mon-astery ground so that the KagyatDance held there could be pro-moted among the devout.

Christian Tar which is situated atDikling has a very picturesque natu-ral landscape with hills at the back-ground and has a great potential ofdeveloping into a village eco resort.The official felt that the area couldbe developed into a resort by involv-ing private entrepreneurs. For this

will have a positive impact.”But the trial could contribute to the

upheaval in Iraq by polarizing Saddam’ssupporters and detractors, said WalidMohammed al-Shibibi, a Baghdad at-torney and editor of a legal journal.

cussing reinstating Iraq’s death pen-alty, which was suspended by Ameri-can occupation chief L. Paul Bremer.

A team of 20 foreign lawyersappointed by Saddam’s wifeSajidah might not be permitted torepresent him, al-Shibibi said.

The only foreign lawyers per-mitted to defend Iraqis without spe-cial permission are Palestinians andSyrians, he said. Others must seekapproval from the Iraqi Bar Asso-ciation, he said.

The proceedings will rely on amix of Iraqi criminal law, interna-tional regulations such as the Ge-neva Conventions and experiencesof bodies such as the Rwanda warcrimes tribunal. As much as 30 tonsof documents and other evidencemust be culled.

In an April interview with Na-tional Public Radio, Chalabi saidthe evidence includes a 1983 docu-ment describing procedures to befollowed in killing 5,000 membersof the Kurdish Barzani tribe. Hesaid there is also a tape recordingof what sounds like Saddam order-ing those killings.

LITERACY NOW OR NEVERTOTAL LITERACY CAMPAIGN/ POST LITERACY PROJECT/

CONTINUING EDUCATION IN EAST DISTRICTLunched in February 2004, the total literacy campaign was intended toimpart functional literacy to the illiterate adults in the age group of 15-35 yrs within a stipulated time of 18 months. The programme sought toachieve this objective through a center-based programme and throughmass volunteer based approach.

The door to door survey of identifying the clientless was completedand the TLC centers have already started functioning on war footing. Atotal of 21,000 illiterates are identified and for this 400 TLC centers areopened with equal number of volunteer teacher’s (VTs) entrusted withthis magnanimous job to make them literates and aware of the causes oftheir deprivation and more towards the amelioration of their conditionthrough organization and participation in the process of development.

The First phase of training i.e. (KRPs) Key Resource Person wasorganized by the MHRD, New Delhi at conference Hall of Human De-velopment Department, Gangtok in March 2004.

The next phase of training of the VTs which will be held very shortly.In the East District the TLC centers are being run mostly by the teach-ers & unemployed youths voluntarily. People are also taking interest tocome in the centers to learn. The learners are provided with free textbook/ exercise book/ pencil/eraser/ slate/ chalk & the center are pro-vided with free black board/chalk and duster.

After the first phase of the TLC is completed the Second phase i.e.PLP(Post Literacy Project) will follow immediately & lastly the (CE)Continuing Education. Since, we have already entered into a new era,where we cannot shut our eyes to the burning problem of eradicationof illiteracy & say ‘Literacy can Wait’ ‘Literacy conginately cannot wait’.This cannot be brought about by any single individual institute as manyas by the Govt.

Literacy definitely cannot wait. This work have to be collective ef-forts of those believe in the need for relevance of literacy or those whoview literacy as a tool or weapon for social change. At the afternoon meeting, theCM also asked for the allotment ofMBBS and BDS seats under Centralpool for Sikkim. He urged the UnionMinister for the restoration of fullallotment of 20 seats each for MBBSand BDS for Sikkimese students.

The Chief Minister also put ina request for a grant for a capacitybuilding project on food safety andquality control of drugs. The CMhas placed a request a grant for Rs.1.47 crores to be sanctioned by theUnion Ministry for this project.

Another proposal placed by theCM concerned the up-gradation andstrengthening of emergency facili-ties at the sub-hospital of Singtamnear NH 31A for its trauma-centre

amounting to Rs. 1.5 crores.He also urged the Union Min-

ister to establish a de-addiction cen-tre for Mangan Hospital in northSikkim. The State government hasalready established such centres inthe other three districts of Sikkim.

Also forwarded was a demandfor establishment of an Oncology unitfor Cancer patients here at SikkimManipal Institute for Medical Sci-ences. The Union Minister after go-ing through the demands assured thathis ministry would take positive stepstowards the welfare of Sikkim.

Today, the Chief Minister alsomet PR Khyndea, Union Minister forTribal Welfare and DONER for thesecond time during his present visitto Delhi and reiterated the demandsalready placed with his Ministry.

LOS ANGELES: A woman charged with stalk-ing Catherine Zeta-Jones has never even killeda goldfish, and has written the actress a letterof apology saying she was infatuated withMichael Douglas, her lawyer said on Tuesday.

Dawnette Knight was arrested in BeverlyHills, California, last month and charged withstalking, making numerous calls and writingthreatening letters to the Oscar-winning star of“Chicago,” who is married to Douglas.

Knight is in custody pending trial but herlawyer Richard Herman told reporters she had
