What must be protected in a PRI?

Those research results that don´t have previous protection lose

the opportunity to be used and exploited commercially:

- Pharmaceutical sector

- Global market in new advanced sector

- Technologies for the creation of a new technology-based

company (spin-off)

Also those results for which there is a contractual obligation by

previous research agreements between CSIC and companies.

Then the patent system is a right way to protect the research

results in a public research organization

The first general idea is that a patent is a document

which contains information about an invention.

A patent is also considered a legal right, it works like

a monopoly .

In the end, more importantly, the patent is a

crowbar for creating relations with third parties,

specifically collaborative projects between

research groups and companies stablished as

research agreements associated to its license.

Continous and active evaluation and commercialization process of every patent is executed by de CU until its licensing to a company, the creation of a spin-off or

the abandoning decission of international extension is taken.


Knowledge Transfer

- Does a patent hinder the research? No, the information

and data included in a patent are free for use in scientific

research. The patents are public documents, without

restrictions.

- Can the research result be published if we want to

protect it? Yes, but the patent application filing must be

carried out in a patent office previously to its publication or

public access.

- How a patent is granted? After a formal evaluation process

and an assessment of parameters of patentability. The

evaluation process can take years, is very expensive and the

outcome is uncertain.

- Then, one of the main goals of our IPR Unit is to

increase the value of a patent application and reduce

the risk of its rejection:

- conducting an analysis of the patentability of the

invention prior to application in each disclosure invention

received,

- dismissing those inventions which do not meet the

parameters of patentability, and

- writing the strongest and most complete patent memory

possible.

Fundamentos de creación de Empresas de Base Tecnológicas (EBTs) en el CSIC

- Investigador emprendedor

- Servicios de la UPR-EBTs


Knowledge Transfer

- Los trabajadores del CSIC pueden tener participaciones de una empresa

- Deben comunicar dicha situación de forma inmediata al CSIC

a través de la VATC mediante declaración escrita.

- No pueden tener más del 10% de las acciones o capital social de la empresa, ni directa ni indirectamente.

- Los investigadores del CSIC tienen dedicación en exclusiva, es decir, intelectualmente sus resultados, tiempos y

especialmente sus ideas pertenecen al CSIC.

- Los investigadores no pueden ocupar cargos de la empresa ni cobrar un salario de la misma.

- Deben evitarse conflicto de intereses, por una parte, entre las obligaciones del investigador del CSIC y los

derechos del CSIC y, por otra parte, los intereses de la EBT.

- Las relaciones de los investigadores del CSIC con las empresas en las que forman parte deben regularse

contractualmente a través de la VATC.

- No se permiten empresas “instrumentales” para generar financiaciones para el propio grupo.

- No se aceptan empresas de “prestación servicios” ya

que descapitalizan las propias competencias del CSIC.

- Las EBTs deben ser nuevas empresas para el desarrollo y comercialización de productos, entendiendo como tales

resultados de investigación concretos generados en el CSIC , protegibles o no, es decir, patentes, “secreto industrial”, software,

etc.

- La relación del CSIC y la EBT se lleva a cabo mediante contratos, especialmente mediante un contrato de licencia al

menos.

- Se pueden acompañar las licencias con contratos de investigación.

- Además, se pueden cerrar contratos de colaboración para

compartir infraestructuras y recursos del CSIC con presupuesto y con el acuerdo previo de la dirección del instituto.

- El término “spin-off del CSIC” no es término legal o institucional.

- Sólo se permite el uso de dicho término cuando existe

entre el CSIC y la EBT una licencia de un resultado del CSIC.

- Toma de participaciones del CSIC en la empresa es un proceso complejo. Rompe la barrera del 10% y el hecho

de no poder ser un asalariado de la empresa.

- Trasladar transparencia y trazabilidad de todas las acciones de los propios investigadores emprendedores a la Institución.

- Traslado de las ideas de los emprendedores a terceras partes que puedan ayudar:

- Inversores, - asesores públicos y privados de planes de empresa

- Gestión de la propiedad industrial o intelectual de los

inventores que pueda ser de interés de la EBT: evaluación de las patentes, responsables de las decisiones que se trasladan al comité de patentes.

- Preparación, negociación y firma de los contratos que se precisen.

What can no be protected as a patent?

Scientific idea, image representations, bussiness models, aesthetic creations, computer programs



What can be protected a patent? Inventions in any technical field provided that -they are not against public order, quirurgic treatments, animal races, -patentability requirements

Examples: New product: material, alloy, machine; New activity: method of fabrication, method of doing, aplication of an existing product to a new field

What can I think is patentable? An entity, a product Example: Copper alloy having improved stress relaxation resistance

Claim 1. A copper alloy having improved stress relaxation resistance, said copper alloy consisting essentially of: from 1.8 to 3.0 weight percent iron; from 0.01 to 1.0 weight percent zinc; from 0.001 to 0.25 weight percent phosphorous; from greater than 0.11 to 0.35 weight percent of free magnesium; less than 0.2 weight percent titanium less than 0.1 weight percent tin; and the balance copper and unavoidable impurities whereby said copper alloy is substantially free of magnesium phosphide inclusions and has an electrical conductivity of greater than or equal to 60% IACS

There are three basic requirements for patentabilityof an invention: (i) the invention must be "susceptible of industrial application"; (ii) the invention must be "new"; (iii) the invention must involve an "inventive step".

Granted patent: long way Requirements include clarity, concisness, sufficient of disclosure, legal issues, format, procedure, and so on

Novelty An invention is "considered to be new if it does not form part of the state of the art". The "state of the art" is defined as "everything made available to the public by means of a written or oral description, by use, or in any other way, before the date of filing of the patent application".

Industrial Application An invention shall be considered as susceptible of industrial application if it can be made or used in any kind of industry, including agriculture.

It has to be considered in a broad view: Do it have a practical use? Example of exception: Discovers are not patentable

Inventive Step An invention shall be considered as involving an inventive step if, having regard to the state of the art, it is not obvious to a person skilled in the art. Person skilled in the art: knows everything (it is possible to combine different documents), he is not inventive and he has to have a reason to find an alternative/the solution to a problem

TIP: negative results make the invention strong, keep them and include it in the proposal
