Citibank’s “Queensbay Mall Mania” Contest Terms and Conditions

CONTEST PERIODThis Citibank Berhad (“Citibank”) “Queensbay Mall” Contest (“Contest”) shall run from 15th January to 18th May 2008 (both dates inclusive) (“Contest Period”).

ELIGIBILITY

I. Subject to Recital II below,

a) all principal and supplementary Citibank credit cardmembers who are residents of Malaysia; and/or

b) persons who apply for a principal Citibank credit card at Citibank’s roadshow booth located at GF-Central Zone, Queensbay Mall 100, Persiaran Bayan Indah, 11900 Bayan Lepas, Pulau Pinang during the Contest Period;

are eligible to participate in this Contest (“Eligible Persons”).

II. The following persons are NOT eligible to participate in this Contest

a) permanent and/or contract employees of Citibank Berhad (“Citibank”) (including its subsidiaries and related companies) and their immediate family members;

b) representatives and/or agents (including advertising and promotion agents) of Citibank and their immediate family members;

c) holder (s) of Citibank credit card(s) not issued in Malaysia;

d) holder (s) of Citibank credit card(s) who is (are) in default of facilities granted by Citibank at any time during the Contest Period, subject to Citibank’s discretion; and/or

e) holder(s) of Citibank credit card(s) whose accounts have been closed before 18 May 2008.

THE CONTEST

1. During the Contest Period, an Eligible Person will be given one (1) Contest entry form for every minimum spending of Ringgit Malaysia Fifty (RM50) and above in a single receipt with their Citibank credit card at any merchant at Queensbay Mall (“Qualifying Transaction”).

2. During the Contest Period, each successfully approved Citibank principal credit card applications (“Card Application”) will entitle the Eligible Persons to ten (10) Contest entries.

3. For the avoidance of doubt, “successfully approved” means Card Applications submitted at the Citibank roadshow booth in Queensbay Mall which has been approved by Citibank and accordingly, a Citibank credit card has been issued to the Eligible Person. Conditional approvals of card applications, which may be received by an Eligible Person from Citibank, are not deemed to be successfully approved Card Applications.

4. In the event that Contest entry forms are submitted by persons who:

a) are not Eligible Persons; and/or,

b) have committed or are suspected of committing any fraudulent or wrongful acts in relation to the use of their Citibank credit card(s) and/or any transactions made thereof;

Citibank reserves the right to disqualify such persons from participating in the Contest and/or from using or submitting the Contest entry forms.

5. Contest entry forms can be obtained from the following venues in Queensbay Mall:-

a) Citibank roadshow booth located at GF, Central Zone, Queensbay Mall; and

b) Selected merchant partners at Queensbay Mall.

6. Eligible Persons are required to answer two (2) questions on the Contest entry form and submit the completed Contest entry forms together with their original sales draft of the relevant Qualifying Transaction (“Participant”) and/or the corresponding Card Application form, as the case may be, by dropping them into the drop-box provided by Citibank at the Citibank roadshow booth located at GF, Central Zone Queensbay Mall during the Contest Period. Failure to attach the original sales draft with the Contest entry form and/or the corresponding Card Application shall render the Contest entry form to be disqualified.

7. For purposes of the Contest, Contest entry forms earned by Eligible Persons in accordance with Clause 2 and submitted in accordance with Clause 6 above shall only be taken into consideration by Citibank upon the successful approval of the Eligible Person’s Card Application in accordance with Clause 3 above during the Contest Period.

8. Proof of submission of Contest entry forms by Participants does not amount to proof of receipt by Citibank.

9. There is no limit to the number of Contest entry forms that can be submitted by the Participants. However, only the Contest entry form with the correct answers will be considered for purposes of the Contest. The last date for the submission of Contest entry forms is 18th May 2008. Citibank reserves the right to reject any Contest entry forms that are not duly completed and/or is submitted without the original sales draft and/or submitted after 18 May 2008.

10. The Contest consists of two (2) Draws.

a) Draw Draw (1) is from 15th January 2008 – 15th March 2008 (both dates inclusive)

b) Draw Draw (2) is from 16th March 2008 – 18th May 2008 (both dates inclusive).

Upon the end of each Draw of the Contest, the top twenty five (25) Participants for Draw Draw 1 and the top One Hundred and Thirty (131) Participants for Draw Draw 2 who have submitted an all-correct answer Contest entry form with the highest number of Contest entries will win Prizes (as more particularly described in Clause 12 below) based on their ranking. In the event of a draw in the number of Contest entries submitted, the Participant with the highest collective amount spent in respect of the original sales draft submitted will be selected as the winner of the relevant Prize.

11. For the avoidance of doubt, Participants who qualify for Draw Draw 1 are equally qualified for Draw Draw 2 of the Contest.

PRIzES

12. The Round Prizes and the Grand Prize for the Contest (collectively known as “Prizes”) are as follows:-

Round 1

a) First Prize: Philips 37” LCD TV (Five (5) winners)

b) Second Prize: Philips Home Theater System (Twenty (20) winners) (collectively known as “Draw Prizes”)

Round 2

a) First Prize : Philips Micro Hifi System (Thirty (30) winners)

b) Second Prize : Philips Mini Vac Cleaner (One hundred (100) winners) (collectively known as “Draw Prizes”)

c) Grand Prize : Volkswagen – Cross Polo (One (1) winner)

13. Prize Winners will be officially notified by telephone and in writing within three (3) to six (6) weeks from the end of each Draw of the Contest.

14. The following terms and conditions apply to the Prizes:

a) the Draw Prizes will be delivered to the Draw Prize Winners via courier to the Draw Prize Winners’ latest mailing addresses recorded with Citibank within eight (8) weeks from the notification of their winnings;

b) the Prizes are provided on an “As Is” basis;

c) the Prizes are subject to availability from the supplier. In the event that the supplier is unable to supply the same model of the Prizes to Citibank, Citibank reserves the right at its absolute discretion to substitute the Prizes with another product and/or vehicle of similar retail value at any time without prior notice;

d) the Prizes do not include any accessories or items that are shown in the leaflet or website, as they are for illustrative purposes only;

e) Each Prize Winner is only entitled to receive a maximum of two (2) Draw Prizes throughout the Contest Period;

f) Prizes are not transferable, nor exchangeable for cash, credit or kind whether in part or in

full;

g) Prize Winners are not allowed to exchange their Prize(s) for any other Prize(s) offered in this Contest;

h) Prizes won by a supplementary Citibank Card member, if any, will be delivered to the principal Citibank credit cardmember;

i) to the fullest extent permitted by law, there are no, and Citibank expressly excludes and disclaims any representations, warranties, or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability of fitness for a particular purpose in respect of the Prizes;

j) the title in the Prizes and any risk of loss or damage to the Prizes passes to the Prize Winners upon physical delivery of the Prizes to the Prize Winners. Citibank shall not be liable for or obliged to recognize or replace any defective, lost, damaged or stolen Prizes during delivery or otherwise.

15. The following additional terms and conditions shall apply to the Grand Prize:

a) all road tax, registration fees, cost in respect of the application for a number plate, installation expenses, insurance as well as any other personal expenses, fees, payment and/or cost incurred in relation to the Grand Prize shall be borne solely by the Grand Prize Winner;

b) Citibank retains the sole discretion to select the colour of the Grand Prize;

c) For the avoidance of doubt, the display car at the Queensbay Mall shall be the Grand Prize for purposes of the Contest;

d) The Grand Prize will be handed over to the Grand Prize winner at a date and location to be stipulated by Citibank.

16. In the event that a Prize is won by a person who:

a) is not eligible to be a Participant in the Contest; and/or

b) has committed or is suspected of committing any fraudulent or wrongful acts in relation to use of their Citibank Credit card and/or any transaction made thereof;

Citibank reserves the right to disqualify such person(s) from participating in the Contest and/ or from winning a Prize.

INSTANT GIFTS

17. In conjunction with the Contest, an instant gift will be given out to principal Citibank credit cardmembers who spend a minimum of RM200 and above in a single receipt (“Eligible Cardmembers”). The instant gifts are only applicable on the weekends throughout the Contest Period. Eligible Cardmembers are required to produce the original sales receipt to redeem the instant gift at the Citibank roadshow booth in Queensbay Mall.

18. Only the first One Hundred (100) Eligible Cardmembers would be entitled to the instant gift daily. Each Eligible Cardmember is only entitled to one (1) instant gift daily while stocks last.

19. Citibank reserves all rights to determine the type of instant gifts that would be given out to the Eligible Cardmembers in conjunction with the Contest.

ON THE SPOT REDEMPTION

20. In conjunction with the Contest, Eligible Persons would be entitled to make on the spot redemption (“redemption”) for 17 types of Philips products in the promotional Citibank Rewards program with discounted points at Citibank’s roadshow booth in Queensbay Mall. Fast track option is equally available to Eligible Persons.

21. The redemption is only made available on weekends throughout the Contest Period. It is strictly applicable only for Rewards redemption made at Queensbay Mall. It is not applicable for Rewards redemption made via Citibank website, CitiPhone, fax or mail.

22. In the event that a product is redeemed by a person who:

a) is not eligible to be an Eligible Person in the Contest; and/or

b) has committed or is suspected of committing any fraudulent or wrongful acts in relation to use of their Citibank Credit card and/or any transaction made thereof;

Citibank reserves the right to disqualify such person(s) from participating in the redemption and/ or from redeeming the product.

MISCELLANEOUS

23. By participating in this Contest, the Participants hereby expressly agree to be bound by these Terms and Conditions, the decisions of Citibank and/or the Contest judges, and the Participants hereby give their consent to and authorise Citibank to disclose their particulars to the third party service providers engaged by Citibank for purposes of the Contest. Citibank warrants that the disclosure of such particulars to any third party service providers shall be limited to the Participant’s name, address and telephone number and shall be used only in relation to and for purposes of the Contest.

24. Prize Winners hereby give their consent to and authorize Citibank to use their names and any photographs taken or other information approved by the Prize Winners for current and future advertising and promotion purposes relating to the Contest. Prize Winners may be requested to attend a prize presentation ceremony, of which the date and venue will be notified by Citibank, or to be featured in any publicity material relating to the Contest.

25. To the fullest extent permitted by law, Citibank expressly excludes and disclaims any representations, warranties or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability of fitness for a particular purpose in respect of the Prizes.

26. In the event of any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the English and Bahasa Malaysia version of these Terms and Conditions, the English version of these Terms and Conditions will prevail only in respect of such inconsistency (ies), conflict (s), ambiguity (ies) or discrepancy (ies).

27. In no event will Citibank or any of its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Citibank may engage for purposes of the Contest), be liable for any loss or damages (including without limitation any income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Contest and/or Prizes, even if Citibank has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.

28. Citibank reserves the right to cancel, terminate or suspend the Contest with or without any prior notice. For the avoidance of doubt, the cancellation, termination or suspension of the Contest by Citibank shall not entitle the Participants to any claim or compensation against Citibank for any loss or damage suffered or incurred by the Participants as a direct or indirect result of such act of cancellation, termination or suspension.

29. Citibank shall not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failure or any event beyond the reasonable control of Citibank.

30. Citibank’s decision on all matters relating to the Contest, including the decision of the Contest judges in determining the Prize Winner shall be final and binding and no further correspondence or attempt to dispute such decision would be entertained.

31. Citibank reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions from time to time without prior notice. These Terms and Conditions may be modified, added, deleted or varied by Citibank by way of posting on the Website, or in any other manner deemed suitable by Citibank. The Participants agree to access the Website at regular time intervals to view these Terms and Conditions and to ensure that they are kept up-to-date with any changes or variations to these Terms and Conditions. The Participants agree that their continued participation in the Contest shall constitute their acceptance of these Terms and Conditions (as modified and varied from time to time).

32. Subject to Clause 31, these Terms and Conditions shall prevail over any provisions or representations contained in any other promotional materials advertising the Contest.
