began my career in mortgage lending and then in sales for an internaonal sporng goods company. I’ve been married to my husband, Kevin, for 36 years. We have 3 children, ages 28, 30 & 32, two on the west coast and one on the east coast. I’ve been a REALTOR® since 1993, and I have worked at Kinlin Grover Real Estate in Brewster for the past 13 years. I love to travel, and 11 years ago I received my designaon as a Cerfied Internaonal Property Specialist (CIPS) aſter compleng course work in Rome. I met one of my future business partners there, and today we are working together on a real estate development project in Panama. Q: You keep trying to beer yourself not only for personal reasons but for work as well. Can you elaborate? A: Yes, I always try to challenge myself in different aspects of my life. In 2008 I fulfilled a long-held dream when I enrolled in a French immersion program at The Instut de Francais in Villefranche-sur-mer, France. I am currently working on a degree at the Harvard Extension School in Cambridge. It is always a thrill to be on campus and to have access to the world-class libraries and museums at Harvard. I currently serve on the MAR Board of Directors, and I am a Trustee of the MAR Charitable Foundaon. I also sit on the Mediaon and Government Affairs Commiees. I volunteer with WGBH, the French Library in Boston and the New England Center for Homeless Veterans in Boston. Q: When and how did you decide to start becoming more involved with CCIAOR? A: The simple answer is I got involved because someone asked me. And I’m so glad I did! I felt it was my me to give back to the Associaon and to our community. 2015 recapA special ‘thank you’ to Aleta Azarian for her commitment and guidance in her role as 2015 CCIAOR President. Aleta

passed the gavel to 2016 President, Laura Usher, at our Annual Installation of Officers at Willowbend Country Club as we welcomed our new Board and celebrated another great year with our members and colleagues.

Our skilled and knowledgeable staff spearheaded two major compliance initiatives, meeting core standards from NAR and Real Estate Transaction Standard (RESO) certification, which sets standards from MLS data across the country. They do a tremendous amount of work to keep both

the Association and the MLS functioning on a daily basis.

We set our new strategic plan in late 2014, executing and fulfilling much of it in 2015. We exceeded our expectations in some areas and made positive strides in others. You’ve seen the fruits of its labor with a new website, streamlined digital communications and more relevant and interesting classes and workshops. Our Member Services & Conference Center was in use more this year than ever before. We had a full house at many of the Professional Development sessions – and a resounding 11 RESPA/ TILA-Truth in Lending Classes! We also added FastStats as a member service that was based on identifying the needs of our members through the planning process.

It was inspiring to see our members represent the Association at the yearly REALTOR® Day on Beacon Hill. The Summer Soiree in June was received so well by our members, we plan to make it an annual event. Visibility and engagement within the local community were at the forefront, especially in our continued commitment with our non-profit partnerships. We stayed ahead of the curve with many local issues, i.e., the National Grid Moratorium, the Smarter Cape Summit and continued

to have fun and raise awareness with the public during live, on-air appearances on the local real estate talk show.

In 2015, we also planned for the CCIMLS future. We already started to implement the tools of the MLS in a more streamlined manner with more resources available on the MLS homepage. This was a major initiative in our CCIMLS Business Plan. We’re going to evaluate the future of the industry, where it’s going and the technology behind MLS systems in 2016 as well, so stay tuned as we keep you updated.

As always, I continue to enjoy getting out of the office to meet our members, listen to concerns, share ideas and provide solutions. I’m willing to come to your office or other location to meet with you one-on-one or with your entire office – just reach out and ask!

Q.Myclientownsarentalpropertyandinsiststhathehasno responsibilityforremovalofsnowexceptforclearingthe sidewalksasrequiredbyamunicipalordinance. Ishecorrect?

A. No. The usual rule is that it is the responsibility of the homeowner or landlord to keep means of egress free of snow and ice. The State Sanitary Code provides that, “the owner shall maintain all means of egress at all times in a safe, operable condition and shall keep all exterior stairways, fire escapes, egress balconies and bridges free of snow and ice.”

If the residence has its own means of egress, meaning that it is not shared with other occupants, the landlord and tenant can agree to allocate the responsibility of maintaining such egress free of snow and ice to the tenant. Therefore, in situations where there is a single or multi-family home and the occupant has its own exclusive means of egress, be sure to review the lease to determine who is responsible for keeping exclusive means of egress clear of snow.

Q:Asapropertyowner,doIhavealegalobligationtoremovesnowandicefrommyproperty?

A. Yes. All Massachusetts property owners have a duty to use “reasonable care” for the protection of visitors, and are legally responsible for the removal of snow and ice from their property. In terms of liability, homeowners should be aware of the 2010 SJC ruling of Papadopoulos v. Target Corp. That case expanded the duty of property owners to remove snow and ice from their property and definitively held that Massachusetts property owners have a duty to use “reasonable care” for the protection of visitors, and are legally responsible for the removal of snow and ice from their property.

The Court did not define “reasonable care,” and the duty of the property owner will depend on the specific situation. It is recommended that every property owner should take are to do the following: (1) review insurance policies to be sure that there is adequate coverage; (2) determine whether contractors or others hired to remove snow and ice have insurance; and (3) be vigilant when there is newly fallen snow, melting or freezing. If complete clearing is not possible, warning signs may be appropriate. Clients that have specific questions regarding their duty to clear snow should consult their attorney.

Q:AreallthepiecesinplacetogetwheretheBoardwantstogoandforyoutoassisttheAssociation?A: The pieces are absolutely in place. We have a strong, cohesive Board that makes decisions, creates policy, etc. I feel like I started my journey here at the Associati on at an exciti ng ti me with our new CEO and employees who are poised to handle whatever is needed. There are so many new initi ati ves and exciti ng things happening in our industry, and I am genuinely thrilled to be President during this ti me.

Q:What’syourroleasPresidentandwhat’sonyouragendafor2016?A: Commitment, leadership, educati on & involvement! One of the most important roles in leadership is to identi fy and nurture future leaders for our Associati on. They need to understand the role they can play to bring their experiences and experti se to the table. Just as someone did for me. One initi ati ve set forth by NAR this year is the nati onwide partnership with the Boys & Girls Club. We’ve already met with our local representati ves and plan to get our members involved in this venture. We will keep you appraised of this and other projects throughout the year.

I am an experienced REALTOR® and have been a business owner, practi ti oner and manager for almost 40 years. Like many of you, I have also been involved with numerous committ ees in the real estate industry on the local, state and nati onal level. Being elected as the 2015 President of CCIAOR, however was an honor that I will cherish always. I have

learned so much, worked with incredible people within our Associati on and beyond, and will always have the disti ncti on of serving our

membership under the leadership of our new CEO, Ryan Castle.

We identi fi ed and accomplished many of our goals and objecti ves we set out to complete in 2015 – most notably updati ng the Bylaws and MLS Rules and Regulati ons and creati ng new Citati on/Ombudsman and MLS Citati on policies.

I am looking forward to serving on the Executi ve Committ ee and as the RPAC Chair this year – and I encourage others who may be interested to also get involved in 2016! CommunityOutreachCommitment to our community helps us build relati onships, increases visibility in our region and bett ers where we live and work.

Our involvement in 2015 included: A $1500 donati on to HomelessNotHopeless,Inc., a non-profi t organizati on that provides transiti onal shelter, educati on and advocacy for the needs of the homeless community in the Hyannis area. Also, a $2000 gift was made to the SouthYarmouthPaperPantry drive that serves seniors and low-income families to help purchase paper products. Both contributi ons were made possible via MAR Charitable Foundati on grants.

Our partnership with CapeCodHealthcare conti nues to provide a convenient Blood Drive locati on 2-3x/year for our neighbors and members while endorsing their mission, “Every pint donati on stays on the Cape to serve our community to save the lives of friends, family and neighbors.” Thanks to our members and the general public, the HousingAssistanceCorporation(HAC) was the recipient of 11 baskets fi lled with household items for recipients transiti oning from shelter to permanent housing. We plan to work more closely with them throughout the year. CCIAOR also received a NAR Placemaking micro-grant and teamed with the TownofYarmouth to donate a much-needed message board to their new dog park. Both projects were initi ated by the YPN Planning Committ ee.

Paint A True PictureThe dream of owning a home on Cape Cod or the Islands can be brought to reality when a member of CCIMLS presents the opportunity to show a listi ng that has been placed into the CCIMLS database to their fellow member colleagues. The informati on presented should be as accurate and as complete as possible in order to paint a true picture of the piece of paradise for sale.

It has been brought to the att enti on of the CCIMLS offi ce that several listi ngs within the MLS may have inaccurate informati on, including Miles to Beach, Lot Size, Assessment, and even some addresses. This could be misleading to potenti al buyers. Remember that part of being a REALTOR® is showing the public that you are an experienced professional who abides by the strictest standards for the real estate profession. With all the tools available, there is no reason why this informati on should not be accurate.

CCIAOR conti nues its ongoing eff ort to increase professionalism in the marketplace for our members, streamline the ethics hearing process and protect the interests of the public.

CCIAOR’s Professional Standards and Grievance Committ ee is charged with upholding the highest principles of the Associati on and ensuring that members adhere to the REALTOR® Code of Ethics.

Over the years, members have sought ways to avoid ti me-consuming ethics complaint fi lings and hearings. In response, CCIAOR has introduced a new Ethics Citati on Program.

For respondents, electi ng to pay a citati on avoids an uncomfortable and oft en ti me-consuming hearing process. Respecti ng the right for due process, a Respondent may instead elect to request a hearing. The Ethics Citati on Program is as confi denti al as the hearing process.

For complainants, there may be less ti me involved, yet justi ce will be served, thereby protecti ng the industry from unethical behavior.
