The GOVERNMENT OF THE REPUBLIC OF TllE PHILIPPINES throughthe Department Of Public Works and Highways (DPWH) representedherein by DANIEL A. JARAVATA, OIC-District Engineer, duly authorizedfor this purpose, with main office address at Kin, 48, Canocotan, Tagum City,hereinafter referred to as the "PROCURING ENTI-TY";

City Hall Drive, Brgy.2-A, Davao City represented herein by CATEVIL S. PLARISAN,Proprietress, duly authorized for this purpose, hereinafter referred to as the"CONTRACTOR;"

WITNESSETH:

WHEREAS, the PROCURING ENTITY is desirous that the CONTRACTOR execute theWorks under 18LC0182: Cohstructioh of 2 STY 6 CL School Building at LittlePanay NHS, Panabo City, Davao del Norte, hereinafter called "the Works," andthe PROCURING ENTITY has accepted the Calculated Bid of the CONTRACTORfor the execution and completion of the Works at the calculated unit bid prices shownin the attached Bill of Quantities, or a total Contract price of Fifteen Million FourHundred Fifty-Tv`ro Thousand, Four Hundred Sixty-Five Pesos and 02/looCentavos only (Php 15,452,465.02).

NOW, THEREFORE, for and consideration of the foregoing premises, the partieshereto agree as follows:

1. In this CONTRACT AGREEMENT, words and expressions shall have thesame meanings as are respectively assigned to them in the Conditions ofContract hereinafter referred to.

2. The following documents shall be attached, deemed to form, and be read andconstrued as part of this CONTRACT AGREEMENT, and shall be interpretedin the following order of priority:

3. In consideration of the payments to be made by the PROCURING ENTITY tothe CONTRACTOR as hereinafter mentioned, the CONTRACTOR herebycovenants with the PROCURING ENTITY to execute and complete the Worksand remedy any defects therein in conformity with the provisions of thisCONTRACT AGREEMENT in all respects.

4. In consideration of the execution and completion of the Works by theCONTRACTOR, the PROCURING ENTITY hereby covenants to pay theCONTRACTOR the unit prices in the CONTRACTOR's Calculated Bid, as appliedto the actual quantities accomplished as certified by the PROCURING ENTITYunder the provisions of this CONTRACT AGREEMENT, at the times and inthe manner prescribed by this CONTRACT AGREEMENT.

5. The CONTRACTOR warrants that he has not given nor promised to give anymoney or gift to any employees of the ENTITY (or any Philippine GovernmentInstrumentally) to secure the contract.

6. The CONTRACTOR shall pay taxes in full and on time and that failure to do sowill entitle the Government to suspend payment for the services delivered bythe contracting party.

7. The CONTRACTOR shall likewise regularly present within the duration of thecontract, tax clearance from BIR as well as a copy of its income and businesstax returns duly stamped and received by the BIR and duly validated with tax

payments made thereon.

8. The CONTRACTOR shall comply with a valid instruction of the ENTITY and

proceed expeditiously and without delay, however, a slippage of more than 30days from the original schedule due to the fault of the former would result anon-payment, cancellation of contract, blacklisting of the erring contractor andthe entry of new contractor who will finish the project.
