Medische informatie Medical information

Alle paarden zijn in de week vooraf-gaande aan de veiling klinisch gekeurd.Alle paarden niet ouder dan 5 jaar (veu-lens uitgezonderd), alle sportpaarden en

fokmerries zonder PROK-certificaat, zijn röntgenologisch gekeurd.

Oudere fokmerries in het bezit van een PROK-certificaat, zijn alleen klinisch

gekeurd en onderzocht op dracht.

Beoordeling van de röntgenfoto’s en de klinische keuring, alsmede de toelichting daarop, zal op eigen verantwoording uit-

gevoerd worden door veilingarts dhr. Drs. Leendert-Jan Hofland van Dierenartsen-

praktijk Bodegraven B.V. of zijn plaatsver-vanger. Röntgenfoto’s, keuringsrapporten

en PROK-certificaten kunnen op de kijkdagen en op de veilingdag worden be-keken. Op die dagen is Drs. Leendert-Jan Hofland of zijn plaatsvervanger aanwezig voor het beoordelen van de röntgenfoto’s

en het geven van toelichtingen.

Buiten die dagen is het is geïnteresseerden, echter op eigen kosten, toegestaan voor de veiling rechtstreeks contact op te ne-

men met DAP Bodegraven B.V. voor het inwinnen van medische informatie over

de te veilen paarden. De röntgenfoto’s zijn online beschikbaar voor beoordeling door uw eigen dierenarts. Stuur een e-mail naar [email protected] onder vermelding van

het catalogusnummer waar het om gaat. U krijgt dan een link waarmee u de röntgen-

foto’s van dat betreffende catalogusnum-mer online kunt beoordelen.

All horses have been clinically examined the week prior to the auction. All horses younger than 5 (except foals), all horses of-fered as sporthorse and mares that have no PROK certificate, are examined radiograp-hically.

Older mares in possession of a PROK certificate are only clinically tested and examined for pregnancy.

The evaluation of the radiographs and clinical examination, and notes thereto, will be carried out on own account by the auction veterinarian Drs. Leendert-Jan Hofland of Dierenartsenpraktijk Bode-graven B.V. or his deputy. The X-rays, test reports and PROK- certificates can be viewed on the trial days and the day of the auction. On these days, Drs. Leendert-Jan Hofland or his deputy will be present for assessing the radiographs and giving explanations.

Outside these days interested parties can, at their own expenses, contact DAP Bo-degraven BV directly prior to the auction for veterinary information on the horses to be auctioned. The radiographs are online available for evaluation by your own vete-rinarian on request. If you sent an email to [email protected] with the catalogue-number of the horse you are interested in, we will provide you with a link by which you can view the x-rays online.

Betaling PaymentNa de veiling meldt u zich met uw koopcontract op het secretariaat van de Maalwater Elite Auction. Er

zijn verschillende manieren van betalen.

ContantU betaald contant. U ontvang uiteraard een beta-

lingsbewijs. Betalen kan ook via internet. U maakt het geld dan op het secretariaat met spoed over naar

de rekening van Stoeterij Het Maalwater B.V.

Eenmalige machtiging U vult een formulier in en ondertekent voor

eenmalige machtiging van de verkoper Stoeterij Het Maalwater B.V.. Het bedrag is dan binnen 7 dagen

na de veiling van uw bankrekening afgeschreven.

Bankgarantie U kunt bij uw bank een bewijs aanvragen dat

getuigt van uw ‘financiële gegoedheid’. Met deze bankgarantie krijgt u van ons toestemming giraal te betalen. Het bedrag dient dan binnen 7 dagen na de veiling op de rekening van Stoeterij Het Maalwater

B.V. te staan.

Vooruit betaling Afhankelijk van het bedrag dat u eventueel bereid bent uit te geven tijdens de veiling, betaalt u voor-afgaand aan de veiling op de derdenrekening van de notaris een bedrag dat in redelijke verhouding

staat (te beoordelen door verkoper) tot het mogelijk uit te geven bedrag. U machtigt de notaris tot het doen van betalingen aan Stoeterij Het Maalwater B.V. voor de paarden die u tijdens de veiling hebt

aangeschaft. Als u geen paard heeft gekocht krijgt u het bedrag na afloop van de veiling door de notaris

teruggestort.

Referenties U kunt goede zakelijke referenties opgeven

waarvan er tenminste één bereid is voor u garant te staan.U dient van tevoren bij het secretariaat van de

Maalwater Elite Auction te melden wie er voor u garant staat. Naar oordeel van de organisatie van de Maalwater Elite Auction zult u al dan toestemming krijgen om giraal te betalen. Indien u toestemming

krijgt dient het bedrag binnen 7 dagen na de veiling op de rekening van de verkoper Stoeterij Het Maal-

water B.V. te staan.

Voor “Buying By Telephone “gelden er aanvullende voorwaarden.

Partial payment in advanceDepending on the price that you are eventually prepared to pay at the auction, you can transfer a sum to the escrow account of the Notary in advance of the auction; the sum should be a reasonable amount (as judged by the organization of the Maalwater Elite Auction) in the light of the possible final sum. You authorize the notary to use this advance payment to make payments on your behalf for the horses you have purchased. In case you don’t buy a horse, the sum will be returned to your account after the auction.

Sound business referencesYou may provide sound business references where there is at least one that is willing to stand as your guarantor. You should notify the secretariat of the Maalwater Elite Auction , in advance, of whom your guarantor is. If the organization of the Maalwater Elite Auction is satisfied, you will then receive per-mission to pay by giro transfer, in which case the sum should be paid to the account of the seller, Stoeterij Het Maalwater B.V. within 7 days after the auction

Aflevering / Verblijf Delivery / Stabling

Direct na afslag worden alle verantwoor-delijkheden als mede alle risicofactoren overgedragen aan de betreffende koper. De paarden, welke verblijven op de ac-

commodatie van Manege Beukers, dienen na betaling door de koper en na over-

dracht aan de koper binnen 24 uur van de accommodatie te worden verwijderd.

De kosten, de verantwoordelijkheid en de risico’s van transport komen voor risico

van de koper.

Wij begrijpen dat niet elke koper aan de voorwaarde van verwijdering binnen 24

uur kan voldoen. In overleg met en na ver-kregen schriftelijke toestemming van ver-koper bestaat er de mogelijkheid een door u aangeschaft paard over te brengen naar

de accomodatie van Stoeterij Het Maalwa-ter, waar uw aanschaf een beperkte, vooraf

overeen te komen, periode kan verblijven in afwachting van het transport naar de

definitieve bestemming.De kosten en de risico’s van het transport

naar en het verblijf op de accomodatie van Stoeterij Het Maalwater B.V. zijn geheel

voor rekening van de koper.

We understand that not every buyer can meet with the condition of removal within 24 hours. With prior written consent of the seller, there is the possibility to stable new purchases at Stoeterij Het Maal-water B.V., for a short while, pending the transport of your horse to the final destination. All such arrangements must be made in advance, and the costs and risks of transport to and stabling at Stoeterij Het Maalwater B.V. are the sole responsibility of the buyer.

Kaja-Maria is a full sister of the stallion Chacon and did an outstanding maretesting. She jumped on 1.30m-level and is classified third level-dressage. She already produced two 1.30m-jumpers and a third level-dressagehorse, two of them did an excellent maretest themselves. Contender is reknown for champions like Montender and Checkmate.

Kaja-Maria excelleerde in de mer-rietest met een recordscore, zo kreeg

ze voor de springonderdelen driemaal een 9 en werden ook haar bewegin-gen hoog gewaardeerd. Vervolgens

presteerde ze in zowel het Z1-dressuur als het Z-springen. Ze leverde al twee

1.30m-springpaarden en van Métall het Z2-dressuurpaard Thia-Maria, die

ook uitzonderlijk hoog scoorde in de EPTM met gemiddeld een 8,7 voor de

dressuuronderdelen. Dochter Umea-Maria (v.Carthago) behaalde gemiddeld een 8,8 voor de springonderdelen in de

EPTM. Zelf is Kaja-Maria een volle zus van de Holsteiner Verbandhengst

Chacon. Als vader staat de topvererver Contender te boek, die springcracks

als Montender en Checkmate leverde. Uit deze directe moederlijn komt de

stempelhengst Landgraf I.

Sire Zhivago is very successful in the Small Tour and he passes on his qualities to his offspring. Dam Thia-Maria M earned excellent marks in the maretesting and is classified third level-dressage (Z2). Granddam Kaja-Maria is a full sister of the stallion Chacon and did an outstanding maretesting and performed on third level-dressage as well.

Vader Zhivago won afgelopen zomer brons op het NK in de Lichte Tour en

krijgt ook als fokhengst steeds meer voet aan de grond dankzij vele talent-

volle nakomelingen. Moeder Thia-Maria M presteerde in het Z2-dressuur

en slaagde op jonge leeftijd met zeer goede cijfers voor de EPTM. Ook

grootmoeder Kaja-Maria excelleerde in de merrietest met een recordscore, zo kreeg ze voor de springonderdelen

driemaal een 9 en werden ook haar be-wegingen hooggewaardeerd. Vervolgens

presteerde ze in zowel het Z1-dressuur als het Z-springen. Zelf is Kaja-Maria

een volle zus van de Holsteiner Ver-bandshengst Chacon. Deze moederlijn

gaat in rechtstreekse lijn terug op Eva (v.Ladykiller xx), een volle zus van de

invloedrijke topvererver Landgraf I.

Bretton Woods won bronze on the WC in Verden and is now trained by Matthias-Alexander Rath. Dam Zhara Maria M is sired by the Grand Prix-stallion OO Seven. Granddam Thia Maria M is classified third level-dressage and earned high marks in the maretesting as well. This damline produced stallions like the foundation sire Landgraf I.

De genetisch interessante Bretton Woods won brons op het WK voor

jonge dressuurpaarden en de spraak-makende hengst wordt nu in Duitsland opgeleid voor het hogere werk. Hasara-Maria M is gefokt uit de merrie Zhara

Maria M, die met 79 punten een goede IBOP-proef aflegde met onder meer een

8,5 voor de draf. Grootmoeder Thia-Maria presteerde zelf op Z2-niveau en

heeft op jonge leeftijd al veel indruk ge-maakt in de EPTM. Ook grootmoeder Kaja-Maria M kende een succesvolle ei-gen carrière, ze behaalde een recordsco-re in de EPTM en presteerde vervolgens

in het Z1-dressuur en Z-springen. Ze leverde verder al twee 1.30m-paarden.

Deze stam gaat terug op de merrie Eva (v.Ladykiller xx), een volle zus van de

stempelhengst Landgraf I.

Veilingkosten

15. Voor de koper bedragen de veilingkosten 6% van de afgeslagen hoofdsom exclusief B.T.W.

Omzetbelasting

16. Stoeterij Het Maalwater is ondernemer voor de omzet-belasting inzake het veilen van de paarden. De door hen ingebrachte paarden worden verkocht exclusief BTW. Voor paarden tot en met 4 jaar en voor paarden die bestemd zijn voor het fokken, bedraagt de BTW 6%. Voor alle andere paarden bedraagt de BTW 21%.

17. Kopers worden geacht als particulier aan deze veiling deel te nemen, tenzij door hen duidelijk op de koop-overeenkomst wordt kenbaar gemaakt dat aan de vei-ling is deelgenomen als ondernemer en/of landbouwer in de zin van de Wet op de Omzetbelasting.

Gezondheid paarden

18. De paarden zijn voor het grootste gedeelte PROK-waardig en/of hebben een PROK-certificaat en zijn in de week voorafgaande aan de veiling klinisch gekeurd. Alle paarden niet ouder dan 5 jaren , alle paarden die als sportpaard worden aangeboden en fokmerries die geen PROK-certificaat hebben, zijn tevens röntgeno-logisch gekeurd. Oudere fokmerries in het bezit van een PROK-certificaat , zijn alleen klinisch gekeurd en onderzocht op dracht. De beoordeling van de röntgen-foto’s en van de klinische keuring, alsmede de toelich-ting daarop, zal op eigen verantwoording uitgevoerd worden door de veilingarts de heer Drs. Leendert-Jan Hofland van Dierenartsenpraktijk Bodegraven B.V. of zijn plaatsvervanger. De röntgenfoto’s, keuringsrappor-ten en PROK-certificaten kunnen op de kijkdagen en op de veilingdag worden bekeken. Op die dagen is Drs. Leendert-Jan Hofland of zijn plaatsvervanger aanwezig voor het beoordelen van de röntgenfoto’s en het geven van toelichtingen. Buiten die dagen is het geïnteresseer-den, echter op eigen kosten, toegestaan voor de veiling rechtstreeks contact op te nemen met DAP Bodegraven B.V. voor het inwinnen van medische informatie over de te veilen paarden.

Uitsluiting aansprakelijkheid

19. De verkoper sluit, voor zover rechtens toegestaan, elke aansprakelijkheid uit ten opzichte van de kopers en der-den.

20. De verkoper is niet aansprakelijk wanneer een in de vei-lingcatalogus vermeld paard uiteindelijk niet ter veiling wordt aangeboden.

21. De verkoper heeft gepoogd de veilingcatalogus en de website zo nauwkeurig mogelijk samen te stellen. De informatie over de afstamming is erop gericht een zo goed mogelijk beeld te geven van de kwaliteit van de paarden, echter zonder de pretentie volledig te kunnen zijn. De verkoper is niet verantwoordelijk voor de ac-curaatheid van de informatie in de veilingcatalogus of de website of op een andere wijze verstrekt.

Algemeen

1. De veiling zal plaatsvinden onder toezicht van een notaris. Deze veilingvoorwaarden zijn van toepassing op alle overeenkomsten gesloten op de Maalwater Elite Auction tussen verkoper en koper met betrekking tot de via de verkoper op de veiling aangeboden paarden, alsmede alle overeenkomsten die daaruit voortvloeien.

2. Op deze veilingvoorwaarden, alsmede de in artikel 1 vermelde overeenkomsten is uitsluitend Nederlands recht van toepassing met uitsluiting van het Weens Koopverdrag (CISG).

3. De veilingvoorwaarden zullen in elk geval voor aan-vang van de veiling door de verkoper worden bekend-gemaakt aan de veilingbezoekers. Daartoe zijn deze veilingvoorwaarden opgenomen in de veilingcatalogus en zijn gepubliceerd op de veilingsite . Bieders worden geacht bekend te zijn met het bestaan van en de inhoud van de veilingvoorwaarden.

4. Aan de in de artikelen 5 tot en met 9 van deze veiling-voorwaarden met hoofdletters aangegeven begrippen komt in deze veilingvoorwaarden de daaronder ver-melde betekenis toe.

Begrippen

5. KOPER: natuurlijk persoon of rechtspersoon die als koper optreedt bij een overeenkomst van koop en ver-koop van een paard tijdens de veiling.

6. VERKOPER: natuurlijk persoon of rechtspersoon die als verkoper optreedt bij een overeenkomst van koop en verkoop van een paard.

7. PAARD: de merries,hengsten, veulens en ruinen die in de veilingcatalogus zijn vermeld.

8. VEILING: Handelsstal- en Fokkerij Het Maalwater B.V. als enige participant, hierna te noemen Stoeterij Het Maalwater.

9. VEILINGMEESTER:de door participant aangewezen veilingmeester die de veiling leidt.

Koopovereenkomst

10. De koopovereenkomst komt rechtstreeks tot stand tus-sen verkoper en koper , onder de verplichting voor de koper de in deze veilingvoorwaarden bepaalde koop-som, veilingkosten en BTW aan Stoeterij Het Maal-water te voldoen.

Wijze van veiling

11. De veiling vindt plaats door de door participant aange-wezen veilingmeester de heer H. Sinnige of zijn plaats-vervanger

12. De paarden worden bij opbod verkocht. De aanbieding van de paarden vindt op de door Stoeterij Het Maalwa-ter aangegeven volgorde plaats.

13. Iedere bieder wordt geacht voor zichzelf te bieden en is aan zijn bod gebonden totdat een hoger bod wordt geaccepteerd.

14. Indien de veilingmeester zich heeft vergist, heeft hij het recht zijn vergissing te herstellen.

Kosten en renteverlies ontstaan door het innen van de cheque, zijn voor rekening van koper. Bij betaling in buitenlandse valuta, is de koopsom in Euro’s maatgevend. Het bedrag wat op de bankreke-ning van de verkoper wordt bijgeschreven, moet cor-responderen met de koopsom in Euro’s.

Het is mogelijk om vooraf een betalingsregeling te tref-fen met de notaris door middel van het storten van een bedrag op de rekening derdengelden van de notaris.

23. Indien koper op de veiling aan al zijn financiële ver-plichtingen heeft voldaan, zal levering plaatsvinden.

24. Tot het moment van de feitelijke levering aan de koper blijft een paard voor rekening en risico van de koper.

25. Indien koper niet tijdig aan zijn afnameverplichtingen voldoet, dan verbeurt hij ten opzichte van de verkoper een direct opeisbare boete van € 1.000,-- (zegge: dui-zend euro) , vermeerderd met een boete van € 100,-- (zegge: honderd euro) voor elke dag dat deze nalatig-heid voortduurt.

26. Het vervoer van de veilingplaats naar de koper is geheel voor rekening en verantwoording van de koper.

27. Het registratiebewijs, paspoort en eventuele andere bescheiden blijven in het bezit van verkoper totdat de koper aan al zijn financiële verplichtingen ten genoe-gen van de verkoper heeft voldaan, alsmede zolang het paard niet is afgeleverd.

Betaling en aflevering veulens jonger dan 4,5 maanden en merries die een veulen hebben jonger dan 4,5 maanden

28. Na toewijzing van een veulen jonger dan 4,5 maand of een merrie die een veulen zoogt jonger dan 4,5 maand dient Koper 10 % van de de koopsom te voldoen als aanbetaling.

29. Koper van het veulen en koper van de merrie die het veulen zoogt stemmen ermee in dat levering van het veulen respectievelijk de merrie wordt uitgesteld tot het tijdstip dat het veulen kan worden afgespeend, norma-liter als het veulen 4,5 maanden oud is.

30. Verkoper neemt de verplichting op zich om, indien en voor zolang, een veulen jonger dan 4,5 maanden is, deze bij de merrie te laten, zonder dat koper van de merrie of het veulen hiervoor een vergoeding is ver-schuldigd.

31. Zolang de betreffende merrie of veulen bij verkoper verblijft, zijn alle kosten en risico’s voor rekening van

verkoper.32. Aflevering van de betreffende merrie of veulen vindt

plaats in Oude Niedorp op de accommodatie van ver-koper, na ontvangst van de resterende koopsom.

33. Koper heeft het recht de betreffende merrie of veulen op de accommodatie verkoper klinische te laten keuren op basis kosten ongelijk, mits koper en verkoper vooraf overeenstemming bereiken over de keuze van de keu-ringsarts.

34. Indien de betreffende merrie of veulen door de keu-ringsarts klinisch wordt afgekeurd, betaald koper de aanbetaling van 10 % van de koopsom terug.

Niet voldoen aan de overeenkomst

35. Verkoper staat ervoor in dat het door hem verkochte paard niet lijdt aan één van de stalgebreken luchtzui-gen, systematisch weven en kribbebijten en wel gedu-rende een periode van twee maal 24 uur na feitelijke aflevering van de merrie door verkoper aan koper.

36. Indien door een door het Veterinair Kwaliteits Orgaan gecertificeerde keuringsdierenarts één van de in artikel 28 genoemde stalgebreken wordt geconstateerd en hij daaromtrent een schriftelijke verklaring heeft afgelegd, inhoudende dat dit stalgebrek naar zijn deskundig oordeel bestond vóór de datum van feitelijke levering, heeft de koper het recht ontbinding van de overeen-komst te vorderen. Een schriftelijk ( bij aangetekende brief ) verzoek daartoe dient verkoper binnen 3 weken na feitelijke aflevering te bereiken, bij gebreke waarvan het recht vervalt om op deze grond ontbinding van de koopovereenkomst te vorderen.

Geschillen

37. Alle geschillen, welke tussen verkoper en koper ont-staan naar aanleiding van de op de Maalwater Elite Auction gesloten overeenkomsten met betrekking tot de geveilde paarden, danwel nadere overeenkomsten, die daarvan het gevolg mochten zijn, zullen worden beslecht door arbitrage ( zonder hoger beroep) over-eenkomstig het arbitragereglement van het KWPN ( Koninklijke Vereniging Warmbloed Paardenstamboek Nederland). Een fotokopie van het arbitragereglement is op aanvraag verkrijgbaar op het secretariaat van het KWPN.

38. Arbitrage vindt plaats overeenkomstig eerder genoemd reglement, waarbij arbiters als één van de eerste ver-plichtingen op zich nemen een termijn te bepalen waar-binnen, onvoorziene omstandigheden daargelaten, door hen uitspraak zal worden gedaan. Steeds echter zullen arbiters hun vonnis zo spoedig mogelijk geven. Hun last duurt voort totdat een eindvonnis is gegeven.

39. Tenminste één der scheidslieden zal erkend paar-dendierenarts zijn, afgestudeerd aan de Universiteit Utrecht, terwijl tenminste één der scheidslieden met de gebruiken van een paardenveiling bekend dient te zijn.

Auction Costs

15. The purchaser has to pay 6 % of the purchase price ex-cluding VAT, as auction costs.

VAT

16. Concerning VAT Stoeterij Het Maalwater is an en-trepreneur auctioning the horses. The horses are sold exclusive VAT. For horses younger than 5 years old and for horses intended for breeding, the VAT is 6%. For all other horses the VAT is 21%.

17. Purchasers are expected to take part in this auction as private individuals, unless they clearly state on the contract of sale that they took part in this auction as entrepreneur and/or farmer, concerning VAT.

Health of the horses

18. The horses are have been clinically examined in the week prior to the auction. All horses not older than 5 years ( except the foals born 2013) , all horses offered as a sport horse and mares that have no PROK certificate, are also examined radiographically. Older mares in possession of a PROK certificate are only clinically te-sted and examined for pregnancy. The evaluation of the radiographs and clinical examination, and notes the-reto, will be carried out on own account by the auction veterinarian Drs. Leendert-Jan Hofland of Dierenart-senpraktijk Bodegraven BV or his deputy. The X-rays, test reports and PROK- certificates can be viewed on the trial days and the day of the auction. On these days, Drs. Leendert-Jan Hofland or his deputy will be present for assessing the radiographs and giving explanations. Outside these days interested parties can, at their own expenses, contact DAP Bodegraven BV directly prior to the auction for veterinary information on the horses to be auctioned.

Exclusion from liability

19. The seller assumes no liability with respect to purcha-sers and third parties to the extent permitted by law.

20. The seller cannot be held responsible when a horse mentioned in the auction catalogue or website is not offered at the actual auction.

21. The seller has tried to compose the catalogue and web-site with the utmost care. The information on the pedi-gree has the aim to give an expression of the quality of the horse without having the pretence to be complete. The seller is not responsible for the accuracy of the in-formation in the auction catalogue or the website or provided in some other way.

General

1. The auction will take place under the supervision of a notary.

These terms and conditions apply to all agreements closed at the Maalwater Elite Auction between seller and purchaser with relation to all horses offered at the auction by the seller, as well as all agreements that re-sult from the auction

2. Exclusively Dutch law applies to these terms and condi-tions as well as the under art. 1 mentioned agreements, with exclusion of the Vienna Convention (CISG).

3. The terms and conditions will be announced to the auction public by the seller before the start of the auc-tion. Therefore the terms and conditions are included in the auction catalogue and the auction website.

4. The definitions mentioned in article 5 to 9 of these terms and conditions and written with a capital letter, have the meaning following the definition in the terms and conditions.

Definitions

5. PURCHASER: a natural person or a legal entity who acts as the buyer during the contract of purchase and sale of a horse during the auction.

6. SELLER: a natural or a legal entity who acts as the sel-ler during the contract of purchase and sale of a horse during the auction.

7. HORSE: the mares, foals, fillies, colts and geldings who are mentioned in the auction catalogue and the auction website.

8. AUCTION: Handelsstal- en Fokkerij Het Maalwater B.V. as the sole participant, hereinafter referred to as Stoeterij Het Maalwater

9. AUCTIONEER: the auctioneer, appointed by the par-ticipant, who leads the auction.

Contract of Sale

10. The contract of sale is directly brought about between the seller and the purchaser, under the obligation for the purchaser to pay the purchase price, auction costs and VAT and to Stoeterij Het Maalwater as specified in the terms and conditions of this auction.

Auction procedure

11. The auction is led by the auctioneer appointed by the participant Mr. H. Sinnige or his substitute

12. The horses will be sold to the highest bidder. The of-fering of the horses for auction follows the order deter-mined by Stoeterij Het Maalwater.

13. Each bidder is supposed to bid for his own account and is bound to his bid until a higher bid is accepted.

14. In case the auctioneer makes a mistake, he has the right to correct his mistake.

Payment , Delivery of horses older than 4,5 months.

22. The amount due will be calculated as follows: Knock-down price + 6% of the knock-down price as auction costs ------------------------------------------------------ Net price + V.A.T. ( 6 or 21 %) ------------------------------------------------------ = AMOUNT DUE =============================

Payment has to be effected in the auction office imme-diately after acceptance of the bid or by bank confirmed cheque. It is possible to settle a payment arrangement beforehand with the notary by making a deposit pay-ment to the notary.

Costs and interest occured through cashing-in have to be paid by the buyer. In case of payment in foreign currency, the amount credited with the organizer’s ac-count is decisive. This amount has to correspond to the amount due in Euro

23. In case the purchaser has fulfilled his financial obligati-ons delivery will take place.

24. Up to the moment of actual delivery to the purchaser the horse remains at the account and risk of the seller.

25. In case the purchaser cannot meet the acceptance, the negligent party owes a penalty of €€ 1,000 ( one thousand euro ) to be paid directly to the seller. This penalty will be incremented with € 100 ( one hundred euro) for every day that the negligence continues.

26. The transport of the horses from the auction premises to the purchaser is completely for account of and the responsibility of the purchaser.

27. The registration certificate, passport and other docu-ments remain in the seller’s possession until the purcha-ser fulfilled his financial obligations upon the seller, in addition until the horse is actually delivered.

Payment , Delivery of foals younger than 4.5 months and mares suckling a foal younger than 4.5 months

28. On purchasing a foal younger than 4.5 months or a mare suckling a foal younger than 4.5 months, the buy-er pays 10% of the amount due to be held as a deposit.

29. Buyer of such a foal or mare agrees that delivery of the foal or the mare is deferred until the time that the foal can be weaned, usually once the foal has reached the age of 4.5 months.

30. Foals under the age of 4.5 months will be stabled free of charge by the seller until they are of weaning age.

31. As long as the mare or foal is staying with the Seller all costs and risks are undertaken by the seller.

32. Delivery of the mare or foal takes place in Old Niedorp on the property of the seller, after receipt of the remai-ning 90 % amount due.

33. Buyer has the right to have his purchase clinical exa-mined on the properties of seller before delivery. Buyer and seller have to reach prior agreement on the choice of the medical examiner. If the medical examiner ap-proves the mare or foal the costs of the examination are the buyer’s responsibility.

34. If the mare or foal is clinically rejected by the medical examiner, the seller will refund the 10% deposit to the buyer and seller will pay the costs of the clinical exa-mination.

Failing to Meet the Contract of Sale

35. The seller vows for the fact that the horse sold by him does not suffer one of the stable vices such as wind-sucking, systematically weaving and crib biting for a period of two times 24 hours after the actual delivery of the horse by the seller to the purchaser.

36. In case a certified veterinarian (VKO) detects one of the stable vices as specified in article 28 and has provi-ded a written declaration on this matter in which it is stated that in his competent judgment the stable vice was already present before the moment of the actual delivery, the purchaser is entitled to demand that the contract of sale is cancelled. A written request that ad-dresses this issue should be mailed to the seller within a three-week period after the moment of actual delivery by means of a registered letter. If purchaser is in default, this will result in the expiry of his rights to claim the cancelling of the contract of sale.

Failure on behalf of the Purchaser

37. In case the purchaser fails to meet his accepted obliga-tion, the seller is entitled, in his choice and decision, to either claim the obligation or to regard the contract of sale as dissolved without further notice or judicial intervention, whilst in all cases maintaining all rights and claims to full compensation.

Differences

38. All differences originating from agreements between seller and purchaser made at the Maalwater Elite Auc-tion concerning horses auctioned by the seller, as well as any further resulting agreements, will be settled by ar-bitration ( without the possibility of appeal) in concor-dance with the arbitration regulations of the “KWPN“. A photocopy of the arbitration regulations can be ac-quired by sending a request to the KWPN secretariat.

39. Arbitration takes place according to the arbitration regu-lations mentioned before, where one of the first obliga-tions of the arbitrators will be to determine the term in which the proceedings will be carried out and wherein, excluding accidental conditions, the arbitrators will pass their judgment. The arbitrators will always return their verdict as soon as possible. Their burden will continue up to the moment a final judgment is given.

40. At least one of the arbitrators will be a veterinary sur-geon with a degree obtained at the Utrecht University, while at least one of the arbitrators must be familiar with the practices of the horses auction.

41. This clause has been translated from the original Dutch wording. In case of differences between the wording of this clause and the original Dutch wording, the provi-sions of the latter shall prevail.
