Preface We are very pleased to publish the tenth edition of Casino City’s North American Gaming Almanac. The data in the almanac is currently available in print and in various electronic formats on a companion CD.

Casino City’s North American Gaming Almanac provides market, financial, legal, and regulatory information about land-based and online gambling in the United States and Canada. From a synopsis of each jurisdiction's gaming activity to the details of the participating properties, it furnishes a complete overview of gaming in North America.

This new edition provides information in two major areas not included in previous editions of the almanac. This edition covers the nearly 300 properties in the United States whose sole gaming-related activity is offtrack betting. More than 200 gaming-related associations and organizations providing services within North America are also now catalogued in the almanac. The almanac has several main areas of focus within each jurisdiction. The areas include:

A textual overview of gaming activities in the jurisdiction. Four years of calendar year net gaming revenue by gaming activity. The four calendar

years of data are presented in U.S. dollars for all jurisdictions. Revenue for Canadian jurisdictions is also shown in Canadian dollars. The data is also presented in inflation-adjusted terms as December 2013 dollars. See the appendix for details of the calculations required to produce the revenue data presented in this book.

Five-year revenue bar charts for each gaming activity in each jurisdiction. An inflation-adjusted chart is included for each jurisdiction as well.

Four years of revenue, revenue change since prior year, inflation-adjusted revenue, and inflation-adjusted revenue change since prior year for each gaming activity.

Summary tables with distribution and total numbers for types of gaming facilities, gaming devices (including slots and video lottery terminals), and gaming tables (including poker) within the jurisdiction. Other summarized statistics include casino square footage, convention square footage, number of rooms, restaurants, entertainment venues, parking spaces, and number of employees.

Descriptions of major market segments including casino and card room gaming, lotteries, race and sports wagering, tribal gaming, charitable gaming, and online gaming. Historical and current regulatory environments, an overview of pending legislation, and major trends are included.

Up to 15 years of raw revenue data as reported by the responsible gaming regulatory agencies within the jurisdiction. In some jurisdictions, the raw data is reported in pari-mutuel handle or gross sales.

More than 1,800 gaming property profiles across the jurisdictions. Details provided for individual properties include physical address, phone and fax numbers, website and e-mail address, property owner, types of table games and gaming machines, restaurant names and cuisines, entertainment venues, attractions, and hours of operation. All of the summarized statistics listed above are also provided for individual properties.

Regulatory body for each gambling activity in the jurisdiction. Details include name, location, and contact information.

Casino City’s North American Gaming Almanac also includes an ownership section that lists over 500 gaming property owners that own North American gaming properties. Along with contact information, the ownership details show the properties owned and ownership share. The almanac also contains ranked lists of North American gaming properties by gaming machines, table games, gaming positions, and hotel rooms. A cross-reference of properties by facility type is also included.

The CD version includes a market analysis spreadsheet tool enabling custom gaming property marketplace analysis by geographic area and by type of gaming facility. More than 220 annual reports of North American gaming businesses are provided on the CD, together with the print version of the current and all past editions of Casino City’s North American Gaming Almanac in PDF format. The CD also includes a MapPoint file displaying every gaming property in the United States and Canada geographically pinpointed on an interactive map, and an Excel workbook with historical gaming revenue data including commercial casino and card room gaming revenue, lottery revenue, and race and sports wagering revenue data back to calendar year 2000 by state and province. The creation of Casino City’s North American Gaming Almanac and Casino City’s North American Gaming Almanac CD and the development of the infrastructure required to support their production was a massive effort involving many disciplines by a team of very dedicated people. We’re proud of the effort put forth by every employee of Casino City Press. Paul Mogilevsky, our Publications Project Manager, has overall product management responsibility and worked closely with the development and content teams to manage the research, analysis, and production work required to publish this edition of Casino City’s North American Gaming Almanac and CD. Paul was a major contributor, gathering financial data, compiling property and game counts, updating gaming jurisdiction summary descriptions, creating maps, and performing quality assurance reviews and final book production. Sylvia Corfman worked closely with Paul, performing quality assurance reviews of financial data. Steve Bloom, Vice President of Engineering, has overall responsibility for the software engineering efforts required to create Casino City’s North American Gaming Almanac and CD including database design, data-entry applications, and data extract procedures, in addition to managing the design and layout of the book and CD. Introduction

Casino City’s North American Gaming Almanac CD provides in-depth coverage of gaming properties and major property owners in North America with analysis and mapping tools that enable you to perform geographic marketplace analyses of gaming market areas.

Detailed information on more than 1,800 North American gaming properties is provided, including comprehensive coverage of casinos and card rooms, racinos, horse tracks, dog tracks, jai-alai frontons, off-track betting locations, and casino cruises.

The gaming market analyzer workbooks allow you to easily perform a geographic analysis of gaming market areas. Specify a gaming property and the distance around the property comprising the marketplace you’d like to examine. Results will show the total number of properties, gaming machines, table games, poker tables, bingo seats, sportsbooks, racebooks, casino square footage, convention square footage, hotel rooms, restaurants, entertainment venues, parking spaces, and employees for that area. Use of the workbook requires Microsoft Excel or compatible spreadsheet software sold separately.

Map files are also included that display the locations of all gaming properties in the United States and Canada geographically on a map. You can zoom in on the maps to see properties located anywhere in North America, click on a property icon to see its details, and print maps showing the location of selected gaming properties. The maps are provided in Microsoft MapPoint format, and require Microsoft MapPoint software sold separately.

More than 220 annual reports are included, covering more than 60 gaming businesses in North America that publish their financial results.

State-by-state and province-by-province annual gaming revenue is included for the years 2000 to 2013 by gaming activity and in total.

Casino City’s North American Gaming Almanac CD also includes the print edition of the almanac as a PDF (Portable Document Format) file. You can view and search the document on your PC using the free Adobe Acrobat Reader.

CD User Interface All of the information available on Casino City’s North American Gaming Almanac CD is accessible through an easy-to-use interface. The interface operates using a standard Web browser and provides direct single-click access to all features from the CD home page. The layout of the CD home page is shown in Figure 1 below. The CD home page features four major functions:

1. Use the gaming market analyzer workbook to calculate geographic gaming market statistics and view property profiles for more than 1,500 gaming properties in North America.

2. Display all North American gaming properties geographically on a map using MapPoint. 3. View and search the print edition of Casino City’s North American Gaming Almanac. 4. View more than 220 annual reports covering more than 60 gaming businesses.

Each of these areas links to pages of more detailed information, and links are also provided to the complete user guide, related products, terms of use, and contact information. On a Windows personal computer, the interface is launched automatically when Casino City’s North American Gaming Almanac CD is inserted into the CD drive. If you want to use the interface on a Macintosh or other non-Windows computer, you must open the index.html file located in the CDInterface folder on the CD.

/MarketAnalyzers Folder containing the current and prior versions of the North American gaming market analyzer. Each market analyzer is an Excel workbook with property profiles for more than 1,800 gaming properties in North America and with facilities to calculate geographic gaming market statistics. The workbooks can only be opened using Microsoft Excel or compatible software purchased separately.

/CommaSeparatedValues Comma-separated values (also known as CSV and ASCII format) versions of the data tables. The names of the files in the folder are of the form DataTableName.txt.

/TabSeparatedValues Tab-separated values versions of the data tables. The names of the files in the folder are of the form DataTableName.txt.

/Excel Excel spreadsheet versions of the data tables in Excel 97-2000 (version 8.0 and 9.0) format. The names of the files in the folder are of the form DataTableName.xls.

Autorun.inf Configuration file that automatically launches the user interface for Casino City’s North American Gaming Almanac CD when it is inserted into the CD drive of a personal computer using Windows.

A gaming market analyzer Excel workbook provided on the CD allows you to calculate geographic gaming market statistics and view property profiles for more than 1,800 gaming properties in the United States and Canada. You begin by selecting the specific types of properties to be considered, such as casinos, racinos, or casino cruises. Then you select the location of properties you’re interested in – all properties in North America, or properties in the United States or Canada, or properties in a state (e.g., Nevada) or a province (e.g., British Columbia). Alternatively, you can select a gaming property such as Foxwoods and include all properties that lie within a specified distance – say 250 miles. The workbook automatically shows you all of the selected gaming properties and calculates the following marketplace statistics:

Using a Gaming Market Analyzer Workbook A gaming market analyzer workbook can be opened by clicking on the link for a specific workbook such as the 2015-2016 Workbook link on the CD home page, by clicking on the CD “Gaming Market Analyzers” navigation item and following the directions on the page that is displayed, or by clicking on the file entry in one of the folders within the /MarketAnalyzers folder on the CD. The workbooks are in Microsoft Excel XSLM format. Microsoft Excel version 2007 or above is required to open and use the market analyzers. In order to use the Excel workbook, Excel must be configured to allow macros and content editing. The workbook is only supported by versions of Excel on the Windows operating system. In Excel 2013, when a workbook is opened containing untrusted macros the user will be presented with a message indicating “Security Warning.” Clicking on “Enable Content” will enable access to the content of this workbook for this session only. Alternatively, the user may select File and then Info. The security warning’s enable content drop-down includes advanced options. The dialog box below will be displayed. Selecting “Trust all documents from this publisher” and clicking the OK button will establish that Excel workbooks from Casino City Press will be trusted. Figure 2: Security Warning Dialog Box

Once you have opened a Gaming Market Analyzer workbook, three spreadsheets are visible: 1. Query Sheet: This is the opening sheet of the workbook and is where you select the

properties you are interested in by property type plus either a location or a property name plus a radius or distance around the property. You may also choose a specific property within the selected marketplace that should be compared to the marketplace as a whole. The columns of information to be included in the property profiles are also specified using this sheet. Once you leave the Query Sheet, you can return to it by clicking the “QuerySheet” tab at the bottom of the workbook window.

2. Summary Sheet: This is the second sheet of the workbook, which can be viewed by clicking the “SummarySheet” tab at the bottom on the workbook window. The Summary Sheet displays market summary data for the gaming properties that match the criteria you specified on the Query Sheet. The summary data shows the number of properties, gaming machines and video lottery terminals, table games, poker tables, bingo seats, sportsbooks, racebooks, casino square footage, convention square footage, hotel rooms, restaurants, entertainment venues, parking spaces, and employees for the market area and any specific property you specified. If you selected a specific property on the Query Sheet, statistics for that property are also displayed plus the property’s percentage share of the gaming marketplace for each statistic.

3. Detail Sheet: This is the third sheet of the workbook, which can be viewed by clicking the “DetailSheet” tab at the bottom of the workbook window. This sheet displays detailed profiles for properties matching the search criteria you selected on the Query Sheet. One property will be listed in each row of the spreadsheet, and the columns of data that appear will match those you selected on the Query Sheet.

Query Sheet The first spreadsheet of the Excel workbook file is the Query Sheet shown in Figure 3.

On the Query Sheet, you can select the gaming properties comprising the marketplace you are interested in by:

1. Property Type: You can check one or more of the following property types: • Casinos (excluding Native American Casinos) • Horse Tracks • Native American Casinos • Dog Track Racinos • Casino Cruises • Horse Track Racinos • Dog Tracks • Jai-Alai Frontons • Off-Track Betting Facilities You can click the “Select All” button to select all property types or the “Clear All” button to clear all property selections and begin again. By default, all property types are selected. As you add or remove property types or make other changes to the properties you have selected,

the description and number of gaming properties you have selected are automatically recalculated and displayed in the message area near the top of the Query Sheet.

2. Country: You can select all of North America or you can select either the United States or

Canada. 3. State/Province: If you select either the United States or Canada, you will be given the option

4. Property plus a Radius: Selecting a geographic area using the country and state/province

criteria outlined above is only one of two ways you can define a gaming marketplace. You can also define a gaming marketplace as the area surrounding a specified gaming property. First you must select a specific property that will serve as the center point for the geographic area in which you are interested. Simply select an individual gaming property from the dropdown box containing all gaming properties that match the property type and other location criteria you have entered. After you make a property selection, a new input box will appear labeled “Radius.” Enter the distance of the radius of a circle surrounding the property you chose to specify the gaming marketplace. The distance may be specified in either miles or kilometers in accordance with your radio button selection. Once you have specified a radius the description and number of gaming properties you have selected are automatically recalculated and displayed in the message area at the beginning of the Query Sheet (see Figure 5).

You may also choose a specific property within the selected marketplace that you would like compared with the marketplace as a whole. Simply select an individual gaming property from the dropdown box containing all gaming properties that match the property type and other location criteria you have entered. When you specify a property, you can choose to define the marketplace as the properties within a circle surrounding the property by specifying a radius as described above, but you can also omit a radius specification to simply compare the selected property with the marketplace defined based on the country and state/province criteria you specified. Once you have selected the types of properties you are interested in and their location, you can select the columns of data you would like to view as part of each property profile on the Detail Sheet. One or more columns may be selected from the list shown below. By default, the Property, City, State, and Country columns are selected. A distance column is also shown if you have selected a property on the Query Sheet. A detailed description of the information presented in each column is given in Appendix B. The Summary Sheet displays market summary data for all properties that meet the criteria you specified in the Query Sheet (see Figure 6). The Summary Sheet always displays the following columns of information: 1. Market Size statistics including counts of the number of properties, gaming machines, table

games, poker tables, bingo seats, sportsbooks, racebooks, casino square footage, convention square footage, hotel rooms, restaurants, entertainment venues, parking spaces, and employees in the market area you specified.

2. The number of “Properties with Non-Zero Values” in the specified market area for each of these statistics. A property is included in the count of properties with a non-zero value for a particular statistic if a value is provided for the property and it is not zero. This value tells you the number of properties included in the market size figure for each statistic.

If you selected a property in the Query Sheet, then the property name and address are shown in the Summary Sheet (see Figure 7). The following two columns of information are also provided in the Summary Sheet: 1. Statistics for the property selected in the Query Sheet are provided in the “Property” column.

This column shows the value of each statistic for the property you selected and allows easy comparison with the corresponding aggregate statistic for the marketplace.

2. The market share of the property selected in the Query Sheet is provided in the “Share” column for each statistic. Market share is calculated by determining the value of a statistic for the selected property as a percentage of the value of the statistic for the marketplace.

The Detail Sheet displays the profiles of each property matching the property type and locations you have selected (see Figure 8). Each property is included in a separate row of the spreadsheet and each column of data displayed matches the selections you made on the Query Sheet. The rows are displayed in ascending order based on the value in the first column. If you have defined a gaming marketplace by selecting a specific property and a radius around the property, then the first column of data that will appear in each property profile will be the “Distance” from the selected property that each property in the spreadsheet is located (see Figure 9). The distance is given in miles if the miles radio button is selected on the Query Sheet and in kilometers if the kilometers radio button is selected.

Hidden Workbook Sheets Each gaming market analyzer workbook contains a number of hidden sheets. The sheet named “Data” contains the raw gaming property data used as input to market analyzer calculations. If you would like to change any of the raw gaming property data used by the market analyzer, you can simply change the values stored in the Data sheet for the property. In order to modify the contents of the Data sheet you must first unhide it by selecting the Excel format menu item, selecting the “Sheet” option within format, and then selecting the “Unhide” option within Sheet. Excel will display a list of the hidden sheets. Select the Data sheet and press the “OK” button and the Data sheet will no longer be hidden. The four other hidden sheets should not be modified or the market analyzer will malfunction. The CountriesAndStates, PropertyTypes, Variables, and Scratch sheets are all used to facilitate the computations performed by the market analyzer.

Gaming Property Maps A gaming property map can be opened by clicking on the link for a specific map such as the 2014-2015 Map link on the CD home page, by clicking on the CD “Gaming Property Maps” navigation item and following the directions on the page that is displayed, or by clicking on the file entry in one of the folders within the /Maps folder on the CD. The maps include all gaming properties in the United States and Canada, and are provided in both Microsoft MapPoint 2013 and Microsoft MapPoint 2006 formats. Microsoft MapPoint is sold separately. Clicking on the label associated with a pushpin in the left portion of the MapPoint window will open a window that will allow you to edit the pushpin properties and view all matching items on the map represented by the pushpin, as shown in Figure 12. Four sections are presented in the popup window with the following labels: 1. General: In this section, you can view summary data for the records represented by the

pushpin on the gaming property map and you can change the name and symbol used to identify the pushpin and its associated records.

2. Matching: In this section, you can view the list of all records represented by the pushpin. The list will display the property name and its latitude and longitude.

3. Hyperlink: In this section, you can modify the hyperlink properties associated with the pushpin on the gaming property map. Hyperlinks are currently set to open a popup window, or “balloon,” displaying a mini-property profile when a pushpin is clicked on the map.

4. Balloon: In this section, you can add new fields or change the fields in the gaming property profile that you would like to view in the property profile balloon for all properties represented by the pushpin. In addition to the fields displayed by default, you can request the following fields: phone number, fax number, toll-ree phone number, number of slots, table games, poker tables, and bingo seats, whether a sportsbook or racebook is present, casino square footage, convention square footage, number of hotel rooms, restaurants, entertainment venues, and employees, as well as website and e-mail address, whether the property is Native American owned, the property type, the location precision, and the identification number assigned to the property.

You can continue zooming in by selecting smaller areas with your mouse. Right-clicking your mouse button will allow you to zoom out again. You can also determine the area surrounding a gaming property that is within a specified driving distance. For example, Figure 16 shows the area within which the Majestic Star Casino can be reached in a drive of 95 minutes or less. Simply right-click on the pushpin for a property and select the “Create Drivetime Zone” option. You will be presented with a drivetime dialog box like the one shown in Figure 15, and you simply select the drive time and press the “OK” button.

Historical Data Casino City’s North American Gaming Almanac CD now contains a Microsoft Excel workbook including state-by-state gaming revenue totals by gaming activity. A separate worksheet is provided for each gaming activity as well as a worksheet containing total gaming revenue by jurisdiction. Charts of annual revenue for the United States and Canada have been provided. Refer to Appendix A in the print edition of Casino City’s North American Gaming Almanac or the almanac PDF on this CD for the methodology used to calculate jurisdictional annual revenue. Agencies and Commissions Descriptions of the agency and commission data tables provided on Casino City’s North American Gaming Almanac CD are provided below in Table 3. Microsoft Word Mail-Merge One common use of Casino City’s North American Gaming Almanac CD is the production of mailing labels or letters for executive contacts. Word mail-merge is designed to perform both of these tasks, and you will find sample Word mail-merge template files on the CD that should help simplify the process for you. Information about the sample mail-merge template files can be found in Appendix E. This section documents how to perform a mail-merge with Microsoft Word 2000. If you want to create mailing labels, template files are provided for Avery 5160 style labels (thirty 1” by 25/8” labels per sheet), Avery 5161 style labels (20 1”-by-4” labels per sheet), and Avery 5162 style labels (14 11/3”-by-4” labels per sheet). Open the template file Avery5160Labels.doc, Avery5161Labels.doc, or Avery5162Labels.doc contained in the Templates folder. Then select Mail Merge on the Tools menu to open the Mail Merge Helper dialog box. Since you have already opened a mailing label template file, you can go directly to step two and click on Get Data and then on Open Data Source. Select the data table file you wish to use to create mailing labels and click OK.

In step three, you merge and format the labels. As part of this step you may select the Query option to choose which contacts to use. The query option allows you to sort or select records according to criteria you specify. For example, you can select properties with a certain minimum number of table games or hotel rooms. If you want to specify more complex criteria, such as selecting contacts with particular departmental responsibilities, you must use a more sophisticated query tool like Microsoft Query, whose usage is explained in the next section. To create a letter, follow a process similar to the one outlined above for mailing labels, but use the file SampleLetterTemplate.doc. After selecting the appropriate data source for your letter, edit the contents of the sample letter so it has the contents you desire before performing the merge. You can easily delete the body of the letter and type or copy and paste new material from other documents. You can use any of the columns in the selected data table to customize your letter. For example, you can insert the first name of the recipient into a sentence in the body of the letter to make it more personal, or you can include specific information about the property, such as the number of gaming machines, in your letter. Word uses the term “field” to refer to data table columns. Use the Insert Merge Field button on the Mail Merge tool bar to insert columns from the data table. Your letter can also include different words or sentences based on the value of columns in the data table. Just press the Insert Word Field button on the Mail Merge tool bar and select the If…Then…Else… option. Sometimes you may want to create letters or mailing labels for a group of executives that you cannot easily specify using the information on the CD and the Query facility provided by Word. In this situation consider using GamingDirectory.com to create a custom data extract to use with Word mail-merge that contains just the executives you require. The GamingDirectory.com data selection facilities are designed to handle certain types of executive selection criteria not easily specified using Word Query options and the information available on the CD. Using Microsoft Query with Microsoft Word Mail-Merge Using Microsoft Query with Word mail-merge enables you to easily construct sophisticated queries to select an appropriate set of North American Gaming Almanac data. Select Mail Merge on the Tools menu to open the Mail Merge Helper screen box, click on Get Data under step two after setting up the main mail-merge document and then click on Open Data Source. The Open Data Source screen will appear. Click on the MS Query button to select data using the Microsoft Query tool. Microsoft Query is an optionally installed component of Microsoft Office, so you will only be able to use it if it has been installed. The first screen presented by Microsoft Query is the Choose Data Source screen. If the North American Gaming Almanac data you are using is in comma-separated values format, you must select “<New Data Source>” and click OK. Data downloaded from GamingDirectory.com is always in comma-separated values format. The Create New Data Source screen will appear if you select <New Data Source>. You must provide a name for the data source, select “Microsoft Text Driver (*.txt, *.csv),” and click Connect. The ODBC Text Setup screen will then be presented. Uncheck “Use Current Directory” and press the Select Directory button to open the Select Directory screen. Select the drive where the directory containing the data is located, select the folder containing the data, and

On the Choose Data Source screen, select the newly created data source name if you have created a new data source for comma-separated values data. Select MS Access Database to use Access database files on the CD or select Excel Files to use Excel spreadsheets on the CD. Click OK once you have chosen a data source. If you indicate a database or spreadsheet data source, a Select Database or Select Spreadsheet screen will appear. Select the drive where the database or spreadsheet is located, select the folder containing the database or spreadsheet, select the specific database file or spreadsheet if required, and click OK. The Query Wizard Choose Columns screen will now be displayed. Select the North American Gaming Almanac table you wish to use, click the “>” button to select all columns in the table, and click Next. The Query Wizard Filter Data screen is displayed. Select a column to be used to filter the data. For example, select the Country column within the AgencyAndCommissionContacts table if you wish to select contacts based on country. Next, select an operator such as “Equals” and enter a value such as “France.” To specify additional criteria for the same column, simply select “or” and specify the criteria, such as “Equals” “Germany.” Thus you can easily request contacts that have either France or Germany responsibilities. To filter based on another column, select it and specify the desired criteria. Once all criteria are specified click Next. The Query Wizard Sort Order screen will appear. Specify any desired sort order and click Next. The Query Wizard Finish screen will be displayed. We recommend checking “View data or edit query in Microsoft Query” before pressing the Finish button if you have specified a query involving multiple columns. Appendix A: Data Table and Detail Sheet Columns The following table summarizes the columns containing data in each of the six data tables provided on Casino City’s North American Gaming Almanac CD as well as the details worksheet of the Market Analyzer. Within each data table the columns are ordered in the same sequence as they are listed in the table below. Columns without a checkmark are still present in a data table, but do not contain any actual data. The data tables are provided in four distinct data formats. Descriptions of the contents of each data table column can be found in Appendix B. The Type column indicates whether the data in a column is of data type text or data type number. If you convert data from one format to another, you should be sure the appropriate data type is specified for each column during the conversion process. The mailing label templates are designed to use Avery 5160, 5161, and 5162 or compatible 8½” by 11” label sheets. Avery5160Labels.doc uses a layout of 30 1”-by-25/8” labels per sheet, Avery5161Labels.doc uses a layout of 20 1”-by-4” labels per sheet, and Avery5162Labels.doc uses a layout of 14 11/3”-by-4” labels per sheet. The 5160 and 5161 templates use eight point Arial type and the 5162 template uses 10 point Arial type, allowing full seven-line addresses to fit on the mailing labels. A sample letter template named SampleLetterTemplate.doc can also be found in the Templates folder on the CD. The sample letter template formats the address heading section of the letter in a fashion similar to that used in the mailing label template. However, the TitleLong field is used rather than the Title field and the StateLong field is used rather than the State field. Also, the Country is always placed on a separate line since the limitation of a maximum of seven address lines necessary for the mailing labels can be relaxed within the heading of a letter. A bookmark named Recipient is also created using the name line of the address so it can easily be used again in the salutation line. If you wish to examine the details of the heading of the letter template, simply select the heading portion of the sample letter from within Word, right-click on your mouse while the mouse pointer is positioned over the selected text, and select the Toggle Field Codes menu item.

If a concurrent usage license has been purchased for the CD-ROM then the licensed organization may network the CD-ROM or install the contents of the CD-ROM on a network server for concurrent use on the number of computers or computer terminals for which a license was purchased. Such usage must be restricted to the personnel of the licensed organization performing work on the organization's behalf.

OWNERSHIP; COPYRIGHT: Title to the CD-ROM and the Documentation, and patents, copyrights and all other property rights applicable thereto, shall at all times remain solely and exclusively with Casino City Press and its licensors, and You shall not take any action inconsistent with such title. The CD-ROM and Documentation are protected by United States, Canadian and other applicable laws, and by international treaty provisions. Any rights not expressly granted herein are reserved to Casino City Press and its licensors.

OTHER RESTRICTIONS: You may not cause or permit the disclosure, copying, renting, licensing, sublicensing, leasing, disseminating or otherwise allow the distribution of the CD-ROM or the Documentation by any means or in any form, without the prior written consent of Casino City Press. If You modify, enhance, supplement, create a derivative work from, adapt, or translate the contents of the CD-ROM, the results You create shall be subject to the same restrictions as the original CD-ROM.

LIMITED WARRANTY: Casino City Press warrants for a period of ninety (90) days following original retail purchase of the Package that the CD-ROM is free from substantial errors or defects that will materially interfere with the operation of the CD-ROM as described in the Documentation. This limited warranty applies to the initial purchaser only. EXCEPT AS STATED ABOVE, CASINO CITY PRESS MAKES NO OTHER WARRANTY OR CONDITION, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, REGARDING THIS CD-ROM. THE IMPLIED WARRANTY THAT THE CD-ROM IS FIT FOR A PARTICULAR PURPOSE AND THE IMPLIED WARRANTY OF MERCHANTABILITY SHALL BOTH BE LIMITED TO THE NINETY (90) DAY DURATION OF THIS LIMITED EXPRESS WARRANTY. implied warranty or condition lasts, so the above limitation may not apply to You. This limited warranty gives You specific legal rights, and You may also have other rights which vary from jurisdiction to jurisdiction.

If You believe You have found any such error or defect in the CD-ROM during the warranty period, (i) if You are in the United States, call Casino City Press at 617-332-2850 between the hours of 9:00 a.m. and 5:00 p.m. Monday through Friday (Eastern Time), holidays excluded, and provide the Product ISBN number; or (ii) if You are outside the United States, send Your original CD-ROM disc to Casino City Press, 95 Wells Avenue, Newton, Massachusetts 02459, United States, together with dated proof of purchase, the Product ISBN number, a brief description of such error or defect and the address to which it is to be returned. If You have a problem resulting from a manufacturing defect in the CD-ROM, the entire liability of Casino City Press and Your exclusive remedy for breach of this limited warranty shall be replacement of the CD-ROM, within a reasonable period of time and without charge, with a corrected version of the CD-ROM. Some jurisdictions do not allow the exclusion or limitation of relief, incidental or consequential damages, so the above limitation or exclusion may not apply to You.

CASINO CITY PRESS SHALL NOT BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES, EVEN IF CASINO CITY PRESS IS ADVISED OF OR AWARE OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE LIABILITY OF CASINO CITY PRESS EXCEED THE PURCHASE PRICE OF THIS PACKAGE. Some jurisdictions do not allow the exclusion or limitation of relief, incidental or consequential damages, or the limitation of liability to specified amounts, so the above limitation or exclusion may not apply to You.

GENERAL: This Agreement constitutes the entire understanding between Casino City Press and You with respect to the subject matter hereof. Any change to this Agreement must be in writing, signed by Casino City Press and You. Terms and conditions as set forth in any purchase order which differ from, conflict with, or are not included in this Agreement, shall not become part of this Agreement unless specifically accepted by Casino City Press in writing. You shall be responsible for and shall pay, and shall reimburse Casino City Press on request if Casino City Press is required to pay, any sales, use, value added (VAT), consumption or other tax (excluding any tax that is based on the net income of Casino City Press), assessment, duty, tariff, or other fee or charge of any kind or nature that is levied or imposed by any governmental authority on the Package.

EXPORT AND IMPORT COMPLIANCE: In the event You export the CD-ROM or the Documentation from the country in which You first received it, You assume the responsibility for compliance with all applicable export and re-export regulations, as the case may be.

GOVERNING LAW; ARBITRATION: This Agreement shall be governed by, and any arbitration hereunder shall apply, the laws of the Commonwealth of Massachusetts, U.S.A., excluding (i) its conflict of laws principles; (ii) the United Nations Convention on Contracts for the International Sale of Goods; (iii) the 1974 Convention on the Limitation Period in the International Sale of Goods; and (iv) the Protocol amending the 1974 Convention, done at Vienna April 11, 1980.

Any dispute, controversy or claim arising out of or relating to this Agreement or to a breach hereof, including its interpretation, performance or termination, shall be finally resolved by arbitration. The arbitration shall be conducted by three (3) arbiters, one to be appointed by Casino City Press, one to be appointed by You and a third being nominated by the two arbitrators so selected, or if they cannot agree on a third arbitrator, by the President of the American Arbitration Association (“AAA”). The arbitration shall be conducted in English and in accordance with the commercial arbitration rules of the AAA. The arbitration, including the rendering of the award, shall take place in Boston, Massachusetts, and shall be the exclusive forum for resolving such dispute, controversy or claim. The decision of the arbitrators shall be binding upon the parties hereto, and the expense of arbitration (including without limitation the award of attorney’s fees to the prevailing party) shall be paid as the arbitrators determine. decision of the arbitrators shall be executory, and judgment thereon may be entered by any court of competent jurisdiction. Notwithstanding anything contained in this Paragraph to the contrary, Casino City Press shall have the right to institute judicial proceedings against You or anyone acting by, through or under You, in order to enforce the rights of Casino City Press hereunder through reformation of contract, specific performance, injunction or similar equitable relief.
