Plaintiff, the Federal Trade Commission ("FTC"), for its Complaint alleges:

I. The FTC brings this action under Section 13(b) of the Federal Trade Commission Act

("FTC Act"), 15 U.S.C. § 53(b), to obtain permanent injunctive relief, rescission or reformation

of contracts, restitution, the refund of monies paid, disgorgement of ill-gotten monies, and other

equitable relief for Defendants' acts or practices in violation of Section 5(a) of the FTC Act, 15

U.S.C. § 45(a), in connection with the advertising, marketing, distribution, offering for sale, and

sale of fuel-saving products or devices.

JURISDICTION AND VENUE

2. This Court has subject matter jurisdiction pursuant to 28 U.S.C. §§ 1331, 1337(a), and

1345, and 15 U.S.C. §§ 45(a) and 53(b).

3. Venue is proper in this district under 28 U.S.C. § 139l(b) and (c), and 15 U.S.C. § 53(b).

PLAINTIFF

4. The FTC is an independent agency of the United States Government created by statute.

15 U.S.C. §§ 41-58. The FTC enforces Section 5(a) of the FTC Act, 15 U.S.C. § 45(a), which

prohibits unfair or deceptive acts or practices in or affecting commerce.

5. The FTC is authorized to initiate federal district court proceedings, by its own attorneys,

to enjoin violations of the FTC Act and to secure such equitable relief as may be appropriate in

each case, including rescission or reformation of contracts, restitution, the refund of monies paid,

DEFENDANTS

6. Defendant Green Foot Global, L.L.C., also doing business as Green Foot Global,

Greenfoot Global, GFG, GFG Commercial, GFG Industrial, www.GreenFootGlobal.com, GFG

Fuel Tech, LLC, and GWO Network ("GFG"), is a Nevada limited liability company with its

principal place of business at 2360 Corporate Circle, Suite 400, Henderson, Nevada 89074-7722.

GFG transacts or has transacted business in this district and throughout the United States. At all

times material to this Complaint, acting alone or in concert with others, GFG has advertised,

marketed, distributed, or sold fuel-saving products or devices to consumers throughout the

United States.

7. Defendant William C. Hyman, also known as Bill Hyman ("Bill Hyman"), is an owner

and officer ofGFG. At all times material to this Complaint, acting alone or in concert with

others, Bill Hyman has formulated, directed, controlled, had the authority to control, or

participated in the acts and practices of GFG, including the acts and practices set forth in this

Complaint. Defendant Bill Hyman, in connection with the matters alleged herein, transacts or

has transacted business in this district and throughout the United States.

8. Defendant Mary Ann P. Hyman, also known as Mary Ann Proulx Hyman, Mary A.

Hyman, Mary P. Hyman, Mary Ann Proulx, MaryAnn Denise L. Proulx, Mary Ann Prouleaux,

Mary P. Proulx Hyman, Mary Ann A. Hyman, and Mary Hyman ("Mary Ann Hyman"), is an

owner and officer of GFG. At all times material to this Complaint, acting alone or in concert

with others, Mary Ann Hyman has formulated, directed, controlled, had the authority to control,

or participated in the acts and practices of GFG, including the acts and practices set forth in this

Complaint. Defendant Mary Ann Hyman, in connection with the matters alleged herein,

9. Defendant Ralph M. Flynn, Jr., also known as Ralph Flynn ("Ralph Flynn"), was an

owner or officer of GFG from 20 I 0 until 2012. At times material to this Complaint, acting alone

or in concert with others, Ralph Flynn has formulated, directed, controlled, had the authority to

control, or participated in the acts and practices of GFG, including the acts and practices set forth

in this Complaint. Defendant Ralph Flynn, in connection with the matters alleged herein,

transacts or has transacted business in this district and throughout the United States.

10. Defendant Martinez Van Turner, also known as Martinez V. Turner, Marty Turnberg, and

Marty Turner ("Marty Turner"), was an employee ofGFG from 2010 until2012. At times

material to this Complaint, acting alone or in concert with others, Marty Turner has formulated,

directed, controlled, had the authority to control, or participated in the acts and practices ofGFG,

including the acts and practices set forth in this Complaint. Defendant Marty Turner, in

connection with the matters alleged herein, transacts or has transacted business in this district

and throughout the United States.

II. Defendant Patrick Hintze, also known as Pat Hintze ("Pat Hintze"), was an employee of

GFG from 2010 until2012. At times material to this Complaint, acting alone or in concert with

others, Pat Hintze has formulated, directed, controlled, had the authority to control, or

participated in the acts and practices of GFG, including the acts and practices set forth in this

Complaint. Defendant Pat Hintze, in connection with the matters alleged herein, transacts or has

transacted business in this district and throughout the United States.

COMMERCE

12. At all times material to this Complaint, Defendants have maintained a substantial course of

trade in or affecting commerce, as "commerce" is defined in Section 4 of the FTC Act, 15 U.S.C. § 44.

13. Since at least 2010, Defendants have manufactured, advertised, promoted, marketed,

distributed, offered for sale, or sold EnviroTabs to consumers nationwide, claiming that it is the

"World's 1" Multi-Vitamin for Your Engine!"

14. Defendants sell EnviroTabs directly to consumers via the Internet, including through the

website: www.greenfootglobal.com. Defendants also sell EnviroTabs to consumers via multi

level marketing, a system whereby Defendants' "distributors" or salespeople are compensated

not only for sales they personally generate, but also for the sales of the distributors or salespeople

that they recruit.

15. Defendants promote EnviroTabs as an environmentally-friendly, eco-friendly, or "green"

fuel additive that provides general environmental benefits such as increasing fuel economy and

reducing emissions.

16. Defendants hold EnviroTabs out as a product, available in tablet form, that primarily

consists of organometallic compounds, including ferrocene.

17. As co-founder and CEO ofGFG, Bill Hyman actively participates in Defendants'

deceptive scheme. For example, Bill Hyman is the voice behind many online and telephonic

presentations for EnviroTabs, asserting his first-hand knowledge ofEnviroTabs' alleged benefits.

Bill Hyman was directly involved in the installation of a "fuel saver calculator," which purports

to show how much fuel consumers will save by using EnviroTabs, on a GFG website. Bill

Hyman also reviews and approves language contained in advertisements and marketing materials

for EnviroTabs, and he has drafted documents relating to how EnviroTabs works and why

consumers should use the product.

18. As co-founder and CEO ofGFG, Mary Ann Hyman actively participates in Defendants'

promotional documents. Mary Ann Hyman also reviews and approves the claims printed on the

EnviroTabs product packaging and on GFG's websites, including documents relating to the

major "benefits" ofEnviroTabs.

19. As former co-CEO ofGFG, Ralph Flynn was responsible, from 2010 until2012, for all

aspects ofGFG strategy, products, fmancial performance, daily operations, field organization

and development. He also was responsible for drafting marketing and recruitment materials

containing misrepresentations as to the efficacy ofEnviroTabs.

20. As GFG's former Director of Customer & Distributor Services, Marty Turner was

responsible, from 2010 until2012, for drafting and distributing marketing materials containing

misrepresentations as to the benefits ofEnviroTabs. Responsible for overseeing GFG's

customer service department, Marty Turner also received inquiries and complaints about the

efficacy of EnviroTabs and responded to those inquiries and complaints, sometimes using

fictitious names such as "Mary Tanner."

21. While employed by GFG, Pat Hintze drafted the instruction manual that explains to

consumers how to use EnviroTabs. Pat Hintze also drafted marketing materials containing

misrepresentations as to the efficacy ofEnviroTabs, including a document titled "Proof

EnviroTabs Reduces Emissions." Additionally, Pat Hintze participated in GFG's efforts to

obtain substantiation for EnviroTabs.

22. To induce consumers to purchase EnviroTabs, Defendants have created, prepared,

disseminated, or caused to be disseminated advertisements and other marketing materials in

English and Spanish, including, but not limited to, the attached Exhibits 1-5. These materials

contain, among other things, the following statements and depictions:

A. "You'll see improved fuel mileage with every tank" (Ex. l, p. 7.)

B. "INCREASE FUEL ECONOMY More Miles per Gallon!" (Ex. 1, p. 11.)

C. "I 0% Increase in fuel mileage" (Ex. I, p. I 8.)

D. "10% [increase in fuel mileage] is very conservative, customers have reported savings of

over 30%" (Ex. 5, p. 10.)

E. "That's an additional2 MPG! = 40 extra miles per tank!" (Ex. I, p. 18.)

F. "INCREASE FUEL MILEAGE Save$$$" (Ex. I, p. 22.)

G. "EnviroTabs improves the burn rate in the combustion chamber providing a significant

improvement in the fuel economy." (Ex. I, p. 22.)

H. "As maintenance costs and emissions decrease, expect engine life, fuel economy,

performance, and horse power to increase." (Ex. I, p. 32.)

I. "You have nothing to lose and only horsepower and fuel efficiency to gain."

(Ex. I, p. 18.)

J. "Greatly reducing your vehicles [sic] harmful tailpipe emissions by up to 75%"

(Ex. I, p. 6.)

K. "Real Results Putting a Tablet in Your Tank Can ... Reduce Emissions Hydro Carbons

(Parts Per Million) BEFORE: 60ppm AFTER 14ppm 76.5% REDUCTION IT CLEANS!!"

(Ex. 1, p. 10.)

L. " ... EnviroTabs helps reduce emissions, which include carbon monoxide, nitrogen oxide,

and other volatile organic compounds." (Ex. I, p. 19.)

M. "Many EnviroTabs customers have found that after not passing their initial emission test

they were able to after using EnviroTabs in just two tanks of fuel." (Ex. 1, p. 21.)

breathe for you your children and your grandchildren. This alone makes the use ofEnviroTabs

FUEL EFFICIENCY AND EMISSIONS REDUCTION ESTABLISHMENT CLAIMS

0. "Double blind, statistical testing proved your mileage will increase from 7% to 14% and

customers have reported as much as 19% or more." (Ex. 3, p. 4.)

P. "Independent Emissions Testing Facilities have found you can dramatically reduce

emissions with the use of EnviroTabs. Testing has shown 40-91% reduction." (Ex. I, p. 22.)

Q. "EnviroTabs has been proven safe and effective through millions of miles of use."

(Ex. I, p. 17.)

R. "Patented and [] tested for over 40 years with intensive road testing & commercial use."

(Ex. 4, p. 14.)

S. "Organometallic Technology Proven by 20 Million+ Operating Hours" (Ex. 3, p. 1.)

T. " ... based on over 30 years of research on combustion catalysts and burn rate modifiers

in both the aerospace industry and the fuel additive industry." (Ex. I, p. 17.)

VIOLATIONS OF THE FTC ACT

23. Section 5(a) of the FTC Act, 15 U.S.C. § 45(a), prohibits "unfair or deceptive acts or

practices in or affecting commerce."

24. Misrepresentations or deceptive omissions of material fact constitute deceptive acts or

practices prohibited by Section 5(a) of the FTC Act.

COUNT I- FALSE OR UNSUBSTANTIATED FUEL EFFICIENCY AND EMISSIONS REDUCTION CLAIMS

25. Through the means described in Paragraphs 13-22, Defendants have represented, directly

or indirectly, expressly or by implication, that EnviroTabs, when added to any type of fuel, will

26. The representations set forth in Paragraph 25 are false or misleading or were not

substantiated at the time the representations were made.

27. Therefore, the making of the representations set forth in Paragraph 25 of this Complaint

constitutes a deceptive act or practice, in or affecting commerce, in violation of Section 5(a) of

the FTC Act, 15 U.S.C. § 45(a).

COUNT II- FALSE FUEL EFFICIENCY AND EMISSIONS REDUCTION ESTABLISHMENT CLAIMS

28. Through the means described in Paragraphs 13-22, Defendants have represented, directly

or indirectly, expressly or by implication, that scientific testing proves that EnviroTabs increases

fuel mileage and reduces emissions.

29. The representations set forth in Paragraph 28 are false.

30. Therefore, the making of the representations in Paragraph 28 of this Complaint

constitutes a deceptive act or practice, in or affecting commerce, in violation of Section 5( a) of

the FTC Act, 15 U.S.C. § 45(a).

CONSUMER INJURY

34. Consumers have suffered and will continue to suffer substantial injury as a result of

Defendants' violations of the FTC Act. In addition, Defendants have been unjustly enriched as a

result of their unlawful acts or practices. Absent injunctive relief by this Court, Defendants are

likely to continue to injure consumers, reap unjust enrichment, and harm the public interest.

THE COURT'S POWER TO GRANT RELIEF

35. Section 13(b) of the FTC Act, 15 U.S.C. § 53(b), empowers this Court to grant injunctive

and such other relief as the Court may deem appropriate to halt and redress violations of any

provision of law enforced by the FTC. The Court, in the exercise of its equitable jurisdiction,

refund of monies paid, and the disgorgement of ill-gotten monies, to prevent and remedy any

violation of any provision oflaw enforced by the FTC.

PRAYER FOR RELIEF

36. Wherefore, Plaintiff FTC, pursuant to Section 13(b) of the FTC Act, 15 U.S.C. § 53(b),

and the Court's own equitable powers, requests that the Court:

A. Enter a permanent injunction to prevent future violations of the FTC Act by Defendants;

B. Award such relief as the Court fmds necessary to redress injury to consumers resulting

from Defendants' violations of the FTC Act, including, but not limited to, rescission or

reformation of contracts, restitution, the refund of monies paid, and the disgorgement of ill

gotten monies; and

C. Award Plaintiff the costs of bringing this action, as well as such other and additional

relief as the Court may determine to be just and proper.

Rules for Maximum Performance

• Before using EnviroTabs®, you must establish an accurate baseline. Follow the detailed instructions

on the Mileage Tracking Form to determine your baseline. Do this for the first two tanks. Do not

guess.

• Do not rely on your vehicle's computer to calculate mileage. The computer in your vehicle measures

tire rotation, not fuel consumption, and may not give accurate mpg/kpl results.

• Know exactly how many gallons/liters your tank holds. Check your Owner's Manual or contact the

manufacturer to obtain the actual tank size.

• EnviroTabs® will be blocked from entering the fuel tank if your vehicle has an anti-siphoning device.

Check your manual or with your dealer to find out if your vehicle has such a device. If so, crush the

tabs before you put them in the fuel flute or dissolve EnviroTabs® in a small container of fuel before

adding it to the tank.

• EnviroTabs® eliminates the need for high octane fuel. You will notice your engine runs better

without the use of high octane fuel when using EnviroTabs®.

• Always add EnviroTabs® to the fuel tank or fuel container before adding your fuel. This ensures the

tab will get past the check valve that most cars have in the filler tube.

• After your baseline is established, prepare your engine for maximum results. Double dose the first

tank only. If you have a large tank, double dose for the first tank, or 120 gallons/4541iters,

whichever comes first. Double dosing does not mean double the tabs. For example, if you have a 10

gallons/38 liter tank you would treat 20 gallons/76liters. After the first tank there is no need to

double dose.

• For proper dosing instructions refer to the Mileage Chart. Dose accordingly and record your results

on the Mileage Tracking Form.

• Remember upon future fill-ups to treat only the untreated fuel. For example, if you have a 20-

gallon/76 liter tank and you are filling at a half-tank, you treat 10 gallons/381iters only.

*"Chemistry for Chemists" Chemistry IS a scientific discipline with very wide applications ranging from biological-medical to the technological field. In most cases it is therefore easy to indicate potential practical application of discoveries which have motivated a Nobel Prize in chemistry. This year the prize has been awarded for work, practical applications of which are not very obvious, it is a prize in "chemistry for chemists". A very essential part of a scientific discipline is its structure and its concepts. Fischer and Wilkinson widened the basic concepts of chemistry by their work and therefore also changed the structure of chemistry.

*It is necessar-y to look back in the history of chemistry to be able to appreciate • their contributions. The birth of organometallic chemistry can be traced to the 18th century, but the first organometalfic compound proper was prepared 1849 by Frankfand in Great Britain. This discovery had a great impact on the chemical thinking of the time, mainly because it was the first chemical compound between a metal atom Zn and an organic radical methyl CH3. In the chemica/language of our time it was the first compound which contamed chemical bonds between a metal atom and carbon atoms (see fiaure 1 ). Organometallic compounds of this type have since been prepared andslud1ed in considerable detail. Some of them are well known, or rather ill-known, because of the environmental hazards they have caused, such as organa-mercury and organa-lead compounds. They have, however, also been very useful m preparative chemistry and two Nobel Prizes have been awarded for such applications: 1912 to Griqnard and 1963 to Ziealer and Natta. A very remarkable discovery was that the coenzyme vitamin 812 conlamed direct cobalt-carbon bonds (Nobel Prize to Crowfoot Hodgkin 1964).

Tallinn University of Technology Testing Results The use of Combustion Catalyst in Diesel Trucks

When using the diesel fuels and the catalyst, air pollution decreased correspondingly to EU norm 6 normative act 715/2007-2015. Pursuant to normative act 71512007-2015 the following concentrations in exhaust gas are allowed: carbon oxide (CO) - 0.5 g/km and nitric oxides (NOx) - 0.08 g/km. These indicators in the tested trucks were as follows: Mercedes-Benz Reg. No. 048 MKB, the concentration of carbon oxide (CO) 0.35 g/km and the concentration of nitric oxides (NOxJ 0.078 glkm, MercedesBenz Reg. No. 062 ARU, the concentration of carbon oxide (CO) 0.44 g/km and the concentration of

· nitric oxides (NOx) 0.06 glkm, Mercedes-Benz Reg. No. 302 APZ, the concentration of carbon oxide (CO) 0.49 glkm, the concentration of nitric oxides (NOx) 0.03 glkm.

Thus, all the Mercedes-Benz trucks conform to the Euro 6 norms.

Therefore, on the basis of laboratorial and operational test results we can conclude that the use of the catalyst improves engine performance by increasing engine power output, reducing fuel consumption, diminishing forge scale and carbon formation, prolonging engine lifetime and reducing the concentration of harmful components in exhaust gas and thus protecting the environment and the trucks conform to the requirements of Euro 6 normative act 715/2007-2015.
