Case studies

David’s story

David, a 57 year old self employed builder, took out cover on his credit facility in November 2007. In May 2010 he suffered a cardiac arrest and tragically passed away.

Whilst David’s family was coping with their loss, a benefit of over $3,000 was paid to David’s credit facility, covering his outstanding balance at the time of his death. It was one thing his family didn’t have to worry about at that difficult time.

Megan’s story

Megan, a case worker, took out cover on her credit facility in June. The following year, she discovered a lump in her left breast and was diagnosed with breast cancer. Megan was forced to stop working to undergo chemotherapy treatment.

Megan’s doctor is hopeful that she will recover and return to work sometime within the next year. Although Megan was receiving sick leave payments she was pleased that she had cover. Since her diagnosis, she received a monthly benefit of $71 to help her cover her credit facility repayments, allowing her to focus on her recovery.

These stories are based on actual claims paid by MetLife. Names and photos have been changed to protect the privacy of claimants.

11

Am I eligible to apply for cover?

You can apply for CardGuard cover if you:

• have a new or existing credit facility;• are aged between 18 and 59 years;• are an Australian citizen or permanent resident of Australia;

and• have received this PDS.

How much am I covered for?

With CardGuard you don’t need to select a level of cover – you will be covered every month for your outstanding balance on your monthly statement, up to $50,000.

When will my cover commence?

Your cover will commence as soon as your application for CardGuard is accepted. You will receive a welcome letter and policy document, confirming that your cover is in place and specifying your commencement date. Your contract of insurance consists of your welcome letter, together with your policy document.

When will my cover end?

Your cover ends on the earliest of the following events:

• you reach the age of 65;• the cancellation of your credit facility;• your insurance is cancelled due to non-payment of premium;• you cancel your policy; • your death; or• the maximum cumulative benefits for the policy have been

paid to you or your estate.

Your policy will continue until the earliest of one of the above events occurs. Your life insurance benefits provide continuous cover until the policy ends and we will automatically renew the general insurance benefit components of your policy annually.

We will inform you at least 30 days before each policy anniversary of any changes to the premium rates or the policy terms. If you do not wish to accept the changes to the policy terms or premium rates, you may cancel the policy at any time.

If there are any changes we will send you a notice, explaining any changes to the policy terms (including the premium rate), at least 30 days before the policy anniversary.

How can I cancel my policy?

You may cancel your policy at any time by calling 1300 135 538 or by writing to:

13

CardGuard costs just 59c per $100 of your outstanding balance on your monthly statement. This premium will be automatically charged to your credit facility and listed on your monthly statement.

How is my premium calculated?

Your monthly premium payable may be different each month, depending on the outstanding balance on your monthly statement.

In any month that you have no outstanding balance on your monthly statement, there will be no premium charged.

For example:

David has a credit limit of $20,000. David has chosen CardGuard to protect his credit facility repayments.

In the first month, David’s outstanding balance on his statement date is $2,800. The premium for that month is calculated as $2,800/100 x $0.59 = $16.52.

In the second month, the outstanding balance on his monthly statement is $0. The premium for that month is $0.

What happens if my premium is not paid?

Your premium must be paid when due, throughout the life of your policy. We may cancel your policy if you do not pay your premium when it is due and if 30 days have passed after you receive notification that your credit facility is in default under the terms and conditions of your credit facility and you do not rectify this situation within the 30 day notice period.

Can my premium change?

We may amend your premium rate at any time and as a result, your premium may increase or decrease. However, your premium can only change if we change the rates for all CardGuard policies like yours. You will not be singled out for an increase. If we amend the premium rate we will provide you with at least 30 days written notice.

What does CardGuard cost?

• the reduced price is available due to one of the following: - the items offered during a ‘limited quantity, ‘going out

Information about Consumer Credit Insurance (CCI)

CardGuard is a CCI product. Before taking out a CCI policy, you should read this PDS carefully to find out:

• what the policy will cover you for; and• when the policy will pay out the outstanding balance or

make payments towards the outstanding balance of your credit facility and when it will not.

Cover is provided under the policy in respect of certain events which are described under the section “What are the significant benefits?” on page 7 and the extent of the loss is measurable by reference to your liability under your credit facility.

We may pay up to 20% commission to the distributor. The premiums you pay take into account this commission so it is not an additional charge to you.

Parts of this PDS and the policy differ from the standard cover noted in the Insurance Contracts Act 1984 and may contain unusual terms.

You are not obliged to take out this type of insurance and you are able to arrange CCI through another insurer. You are required to be truthful in your dealings with us.

If you change your mind and wish to cancel your policy during that time, you will be entitled to a full refund of premiums paid up to that time provided a claim has not been made.

Are there any risks in purchasing CardGuard insurance?

Some of the risks associated with purchasing CardGuard insurance include:

• the type of cover provided may not suit your needs;

• there are limits placed on the benefits; and

• a benefit may not be paid because of one of the limitations listed in the section ‘When will a benefit not be paid?’ on page 14.

It is important for you to ensure this policy meets your needs both now and in the future.

Will I have to pay tax on my CardGuard benefits?

Generally, lump sum payments to individuals, under the Price Protection Benefit or as a result of death are not assessable for income tax purposes. Payments made due to Injury, Illness or Unemployment may be taxable. Premiums are generally not tax deductible.

GST only applies to the Price Protection and Unemployment Benefit components of the insurance premium. This charge is included in the premium rate quoted. If tax laws are altered, we reserve the right to increase premiums or charges to reflect any new or increased taxes.

We collect, use and retain personal information in accordance with the Australian Privacy Principles and the Privacy Act 1988 (Cth). Our detailed privacy policies are available on our respective websites at www.metlife.com.au and www.acegroup.com/au

We collect your personal information (which may include sensitive information such as health information) when you are applying for, or changing an insurance policy with us or when we are processing a claim in order to help us properly administrate your insurance application, policy or claim. We will generally collect an individual’s personal information only from that person except when it is unreasonable or impracticable for us to do so. Sometimes we collect personal information from a third party (which may include a person or entity with whom we have a distribution partnership or other business relationship), or from a publicly available source, but only if the individual has consented to such collection or would reasonably expect us to collect their personal information in this way. The primary purpose for our collection and use of your personal information is to enable us to provide insurance services to you. Sometimes, we may use your personal information for our marketing campaigns, in relation to new products, services or information that may be of interest to you.

We may also disclose your personal information to third parties, including service providers engaged by us to carry out certain business activities on our behalf (such as assessors and call centres in Australia), other companies within our groups of companies, other insurers, our reinsurers, medical and health practitioners, government agencies and regulators (where we are required to by law), law enforcement bodies and agents and/or representatives of persons covered under our Policies. Some of these third parties may be located outside Australia. Lists of countries in which recipients of your information are likely to be located are available in the privacy policies available on our respective websites.

In all instances where personal information may be disclosed to third parties who may be located overseas, in addition to any local data privacy laws to which those entities are subject, have measures in place to ensure that those parties hold and use such information in accordance with the consent provided by the individual and in accordance with our obligations under the Privacy Act. In dealing with us, you agree to us using and disclosing your personal information as set out in this section and in our respective Privacy Policies. This consent remains valid unless you alter or revoke it by giving written notice to our respective Privacy Officers. However, should you choose to withdraw your consent it is important for you to understand that this may mean we may not be able to provide you with this insurance or to respond to any claim.

Register of alternative forms of remuneration

We maintain a register of alternative forms of remuneration paid to intermediaries as required by the Financial Services Council, of which we are a member. The purpose of this register is to provide an outline of the alternative types of remuneration paid and received. You can obtain a copy by calling us on 1300 555 625.

Financial Claims Scheme and Compensation Arrangements

ACE is an insurance company authorised under the Insurance Act 1973 (Insurance Act) to carry on general insurance business in Australia by the Australian Prudential Regulation Authority (APRA) and are subject to the prudential requirements of the Insurance Act. The Insurance Act contains prudential standards and practices designed to ensure that, under all reasonable circumstances, financial promises made by ACE are met within a stable, efficient and competitive financial system.

Because of this:

• The protection provided under the Financial Claims Scheme legislation applies in relation to ACE and the Policy. If ACE were to fail and were unable to meet its obligations under the Policy, a person entitled to claim under insurance cover under the Policy may be entitled to payment under the Financial Claims Scheme (access to the Scheme is subject to eligibility criteria). Information about the Financial Claims Scheme can be obtained from the APRA website at www.apra.gov.au and the APRA hotline on 1300 558 849; and

• ACE is exempted by the Corporations Act 2001 from the requirement to meet the compensation arrangements Australian financial services licensees must have in place to compensate retail clients for loss or damage suffered because of breaches by the licensee or its representatives of Chapter 7 of that Act. ACE has compensation arrangements in place that are in accordance with the Insurance Act.
