History of this Rule The regulations in the 1996 toward gradually increasing the resources

required to respond to a worst-case discharge, and to support development of a national system of response preparedness.

Under these regulations, the Coast Guard periodically reviews existing oil removal equipment requirements to determine if increases in mechanical recovery systems and additional requirements for new response technologies are practicable.

The Coast Guard increased mechanical recovery Caps in 2000 via Federal Register notice (65 FR 710).

This current rulemaking was scheduled to be published in 2003.

ISB has been removed from the rule because the limited use window did not justify the cost

Objective

To increase pollution response preparedness before oil spills occur, thus mitigating the possible environmental harm from such spills.

These regulations apply to approximately 795 tank vessel plan holders and cover about 7,000 vessels and 2,798 facilities.

Overview of Requirements

This rulemaking will require Vessel and Facility Owner/Operators to contract for:

Dispersants and related delivery equipment in pre-authorized areas

Aerial tracking and trained observation personnel.

Compliance date Feb 22, 2011
