BE IT EN A C TED :—

Canon X X X II. be amended as follows :—1. In Section 2 delete all the words from “ with ”

in line 9 to “ Assessor ” in line 12, and insert the fol­lowing: : ‘ ‘ and shall be assisted by two Clerical Assessors who shall, if possible, be of the Cathedral Chapter, and two Lay Assessors, of whom one shall be the Chancellor of the Diocese, if there be one, or his deputy, approved by the Bishop.”

2. In the last paragraph add the following words after “ Assessor ” in the last line; “ or if there be no Chancellor, then such other person, learned in the law, as the Bishop may appoint.”

3. Insert the following new Section 3 :—“ The Courts constituted under "this Canon shall follow mutatis mutandis the procedure laid down in Canon X X X “ Of Judicia Proceedings.’ ”

4. Wherever in this Canon the word “ Chapter ” occurs, it shall be taken to mean, in a Diocese where there is no Chapter, a body constituted ad hoc, and consisting of the Archdeacon and at least three Priests in charge of Parishes within the Archdeaconry to which the Priest, whose case is being considered, belongs.

BE IT ENACTED T H A T;—Sub-sections 3 and 5 of Section 3 of Canon

X X X V II. “ of Trusts ” be amended as follows:—

That a new paragraph be added to Sub-section 3 to read

(a) In the case of Parochial property vested in the Diocesan Trustees such property may, if so desired by the Parochial authorities, be retrans­ferred to the Rector, or Priest-in-Charge, and Churchwardens, and their successors in Office, as Trustees for the time being of such rela­tive Parish, or District, for the purpose of raising funds for Parochial development on the security of such property, provided however, that before such retransfer, and mortgage of any property, can be affected the special leave of the Diocesan Trustees shall be obtained and the prior sanction of the Parishioners of the relative Parish in Vestry duly assembled for that purpose; and provided further that such right to mortgage shall be subject to the limitations imposed in Sub-section 4 hereof.

(b) That all words from “ provided ” in line 5 of Sub-section 5 to “ property ” at the end of the said Sub-section be deleted.

BE IT ENACTED THAT :—

7. Procedure on the Vacancy of any Sue.i. On the death of any Diocesan Bishop, the

Dean, or, in his absence, the Senior Priest in the Diocese (that is the Priest next after the Dean in dignity) shall notify the Vacancy in writing to the Metropolitan who shall thereupon issue a Mandate to the Clergy and Laity of the Vacant See, enjoining them to proceed to the election of a godly man to be their Bishop, in accord- ance with the Canons. The Mandate shall be addressed to the Dean, or, in his absence, the Senior Priest at that time in the Diocese.

2. In the event of the resignation, translation, com­pulsory retirement, or deprivation of a Bishop, or the refusal of the person elected to a Bishopric to accept

J9the office, or the non-confirmation of an election (except in such cases as are hereinafter provided for in Section III.) or the disallowance of a delegation by the Bishops of the Province, the Metropolitan shall at once notify the same to the Diocese and issue his Mandate for the election as provided in the foregoing Section.

3. Within eight days after the receipt of the said Mandate the Dean, or the Priest who shall have received the same, shall summon the Clergy of the Diocese and Representatives of the Laity to meet in an Assembly to be called “ The Elective Assembly ” on such day and at such time and place within the Diocese as he shall see fit, by a notice which he shall direct to be published in the several Churches and Chapels of the Diocese, during Divine Service, on the first Sunday after the receipt thereof, provided that the day shall not be less than two, or more than three calendar months from the date of his issuing his Sugnnons, and that the place be the Cathedral Church, unless there be grave reasons to the contrary.

II. Constitution of the Elective Assembly.1. The election of the Bishop of any Diocese in

this Province shall be by the Clergy of the Diocese (if the number of Priests in such Diocese be not less than six) with the assent thereto of the Representatives of the Laity.

When the number of Priests in any Diocese is less than six, the Bishop shall be elected by the Bishops of the Province.

2. The Members of the Elective Assembly shall be:—

(a) The Clergy of the Diocese in Priests’ Orders,voting severally, and the Diaconate voting corporately, through one of their number, chosen by the Diaconate, provided that if there be fewer than three Deacons in such Diocese, the Diaconate shall have no Vote.

(b) Representatives of the Laity of the Diocese, qualified and elected, as follows :—

(i) If there be not less than three or more than twelve male Communicants of twenty-

one years of age and upwards in any Parish, Chapelry, or College, such Parish, Chapelry or College shall be entitled to one represen­tative.

If there be more than twelve and less than fifty such Communicants, two representa­tives. If there be fifty or more Communi­cants, such Parish, Chapelry, or College shall be entitled to three representatives.

Every such representative shall be a male Communicant of the Church of the Province of the full age of twenty-one years, not under Church censure, and duly elected by the majority of Lay Parishioners, being Communicants of the Parish, Chapelry,- or College he represents.

Any Parish, Chapelry, or College may, if it so desires, elect not only the number of re­presentatives to which it is entitled, but also alternative representatives who shall repre­sent such Parish, Chapelry, or College in case the primary representatives are unable to attend.

It is convenient that on the day of Election of Lay Representatives in each Parish, Chapelry, or College, there be a celebration of the Holy Communion.

III. Procedure of the Elective Assembly.1. On the day and at the time and place appointed

for the Election, after Celebration of Holy Communion, the Dean, or, in his absence, the Senior Priest then present, shall proceed to constitute the Assembly, in which, when so constituted, he shall preside, and shall be advised and assisted by the Registrar of the Diocese or his deputy.

2. In proceeding to constitute the Elective Assembly, the President shall require:—

(a) I he Archdeacon, Chancellor, and Registrar, or their deputies to scrutinise the qualifications of all who claim to vote in the Assembly, and if any informality be found, or objection alleged

against: any, the matter shall be reserved for the consideration of the Assembly when duly constituted.

(b) Ihe necessary evidence of qualification for a Cleric shall be the Bishop’s Licence, the same being at that time in due force.

(c) For a Lay Representative, a certificate of due election in the following form :—

We hereby certify that A.B. has been duly elected as provided for in Canon IV. 2b of the Provincial Canons (entitled of the election, etc., of a Bishop) to represent the Parish, Chapelry, or College, of in the Assembly convened by the Mandate of the Most Reverend the Metropolitan, bearing date for the election of a Bishop of this Diocese

(d) A Deacon shall present a certificate of Electionsigned by the Archdeacon.

3- When the Scrutiny is ended, the names (a) of all shall be inscribed on the Roll of Electors, which shall be signed by the Archdeacon, Chancellor, and Registrar, or any two of them or their deputies and delivered to the President, who shall then declare the Assembly Constituted, and shall read the Mandate.

(b) 1 wo Secretaries shall then be elected : one by the Clergy, and one by the Laity.

(c) The Assembly shall then take into considerationany informalities and any objections against any member, and determine the same according to the Canon.

(d) The Secretaries shall then call the Roll and mark those present who have the right to vote, and this shall be done at every meeting of the Assembly.

(e) L nless one half of the Clergy, and one half ofthe Lay Representatives duly cited and elected, be present at any meeting of the Assembly!

there shall be no election, nor formal delibera­tion for the purpose of election at that meeting.

(f) If the requisite number of Clergy and Laitv be not present so that final action can be taken within seven days of the day appointed for the opening of the Assembly, the President shall return to the Metropolitan a notice of failure to elect.

4. If the requisite number (both Clergy and Laitv) be present, the Election Assembly may either (a) elect a Bishop in which case it may also at the same time nominate by fresh election, or by successively fresh elections, one or more persons, in order that if the person first elected shall refuse to accept office, or his election be not confirmed, the first on the alternative list shall then be regarded as the elected person, and if he also refuse, or his election be not confirmed, the next on the list shall be substituted, until the election of one is confirmed, or the list is exhausted.

The Bishop may be elected or chosen from this church or from any church in Communion with the Church of this Province.

or (b) Delegate (subject however to the approval of a majority of the Bishops of the Province), to the Metropolitan and other person or persons being Clerks in Holy Orders, resident in the Province, with the Proviso that they shall con­sider the desire of the majority of the Elective Assembly (if expressed by a resolution formally conveyed to them) that a Bishop shall be chosen from the Church of England, in which case the Archbishop shall take counsel regarding the Vacant See with the Archbishop of Canter­bury.

(c) If the Assembly decide to proceed to electnominations shall then be received which must be duly proposed and seconded, by the Priests then present and deliberation shall then follow according to the Standing Rules of the Provin­cial Synod.

(d) Each of the Clergy present shall vote, byrecording his vote on a voting paper, and delivering the same signed with his name to

the Secretaries. Voting papers shall be in the following form :

(e) When the votes have been taken, the Secre­taries in conjunction with two scrutineers (one Cleric and one Lay Representative) appointed by the Assembly, shall count the votes, and shall report the result to the Assembly through the President.

When a majority of two-thirds of the votes is recorded for any person, that person shall be deemed to be elected by the Clergy; and the name shall be sent down to the Laity for their acceptance or rejection.

The voting of the Lay Representatives shall be governed by the same rule as the voting of the Clergy.

Voting papers shall be in the following form :—

(f) If the requisite majority of two-thirds be notrecorded for any name, a second vote shall be taken in the same manner after further delibera­tion : and if the second vote be indecisive, the Assembly shall then determine whether to proceed to a new nomination or to delegation, and act accordingly.

(g) When a majority of two-thirds of the votes ofthe Laity is recorded in assent to any election, the election is complete: and the person so chosen shall be the Bishop-elect: if their assent be not so given the proceedings shall begin De novo.

(h) When the assembly has elected a Bishop, it shall then determine whether or not to proceed to the further nominations and elections per­mitted by Par. 4 (a), and such further nomina­tions and elections shall be governed by the previous provisions of this Section.

5. (a) If no nominations be placed before the Assembly, it shall without discussion proceed to delega­tion.

(b) The same rule of procedure shall be followed alike in the case of direct election or of election of any person or persons to whom the Assembly determines to delegate its powers.

6. If any member of the Assembly decline to re­cord his vote he shall be deemed to assent, to the full extent of his powers, to the nomination before the Assembly : or if there be more than one, to that nomina­tion which shall reegive the greatest number of votes : and his voting shall be recorded accordingly.

7. If an Election or Delegation be made, the Declaration of such Act shall be signed in duplicate in presence and in behalf of the meeting, by the President, witnessed by one Clerical and one Lay Member of the Assembly. One of these Declarations shall be trans­mitted without delay to the Metropolitan and the other kept in the Registry of the Diocese.

8. If no Election or Delegation be made, a return to that effect shall be made to the Metropolitan by the President; and in such case, or if, in the case of delega­tion, the Delegates shall not have nominated to the Metropolitan some person willing to fill the vacant Bishopric within six months from the date on which the Assembly was held, it shall devolve upon the Metropoli­tan and the Bishops of the Province to choose a Bishop for the Vacant See, and the Metropolitan shall call upon them to do so with all convenient speed, lest the Diocese suffer from being long deprived of the prayers and watchful care of the Bishop.

9. The Elective Assembly shall appoint, or give power to appoint, a Proctor who shall pray the Bishops to confirm the Election and also appear in their behalf

10. When the Declaration of Election or Delega­tion or the return of the failure to elect or delegate, is signed and the Proctor is appointed, or power to appoint given, the functions of the Assembly shall be

Missionary Bishops shall be chosen by the Bishops of the Province : provided that, if the number of Priests in such Missionary Diocese be not less than six, no Bishop shall be elected by the Bishops of the Province until the Clergy of the Diocese shall have had opportunity to communicate their wishes to the Metro­politan and through him, to the Bishops of the Province.

Gravamen.W HEREAS it is desirable that provision should

be made for uniformity of Procedure, in the various Dioceses in the Election of Bishops:

Reformandum.Now be it enacted that Canon IV. be amended as

hereinafter set forth.

(a) Delete Section 8 and substitute therefor new' paragraph :

The Dean or in his absence the Senior Priest then present shall be presiding officer of the Elective Assembly and shall be advised and assisted by the Chancellor of the Diocese, if there be one, and the Registrar thereof or their deputies.

New paragraph g. On the day and at the time and place appointed for the election, as soon as con­veniently may be after the celebration of Holy Com­munion, the presiding officer and the Diocesan Secretary shall proceed to scrutinize the qualifications of the members of the assembly, and if any informality shall

(b) Should the name of any member present be proposed, he shall withdraw from the Assembly during both the discussion and voting on his name.

16. Lay Representatives shall have equal rights of discussion with Clerical members.

17. When all the nominations have been made and discussed the Clerical members shall record their votes,

and if anv name receive the requisite majority that name shall forthwith be submitted to the votes of the Laity.

18. If only one name be proposed, each of the Clergy shall proceed to record his vote by word of mouth, and by writing “ aye ” or “ no,” and signing his name and handing the same on to the Secretaries who shall report the result to the meeting through the President. If not less than two-thirds "of the Clergy whose names are recorded as present vote ” aye ” the name shall then be presented to the Laitv for their acceptance or rejection.

*9* _ If more names than one have been proposed, the Clerical members shall then record their votes by word of mouth and in writing as follows : Each member shall rise in order and declare “ I, A .B., do hereby record my vote for C .D ,” and shall write the name of the person for whom he votes, sign the paper and place the voting paper in the ballot box. Any member desiring to-vote in the negative on all the names pro- posed shall decare “ I, A.B., do vote for none of the names proposed,” and shall write the words “ None of the names proposed ” upon his voting paper, sign his name and place the voting paper in the ballot box." The Secretaries shall then report the result of the voting to the meeting through the President, and if anv candidate shall have received not less than two-thirds of the votes of the Clergy, he shall be deemed elected by the Clero-y, and his nam.c shall be presented to the Laity for their acceptance or rejection.

20. After the first taking of the vote, if no person las received two-thirds of the votes, successive votes shall be taken in like manner; or the Assembly may return, if it see fit, to the question of delegation dis­cussion being allowed as before.

. " j ■ The name of the person receiving the required majority of the votes of the Clergy present shall be presented to the Laity for their acceptance or rejec­tion. If he be accepted by the votes of more than half of the Laity present and voting, the election is complete; if they do not so accept him, the process shall begin dc novo.

22. In recording votes for the election of the Bishop, the President shall have his own vote, but not a casting vote.

Reformandum.Any Bishop of this Province may, upon the repre-

_______________________ sentation of the other Bishops of this Province, be ____asked, or if necessary be required, to resign his See, if it be unanimously agreed among them that he is no longer able to discharge adequately the duties of his Office, such representation to be forwarded in writing to the Metropolitan; provided that the Bishop so pre- sented shall have opportunity of shewing cause against the presenters, and also that no action be taken bv the Metropolitan until he is satisfied that due provision has been made for the maintenance of the Bishop required to resign his See.

(3) hat a Syllabus of Religious Instruction be drawn up for use in Government Schools, which shall concentrate upon the teaching and person of Our Lord as set forth in the New Testament, with special emphasis upon Christian ethics and the Christian theory and practice of Prayer rather than upon the theology and ethics of the Jewish Faith as set forth in the Old Testament.

(4) That the teaching of this subject should onlybe given by those Teachers who were-willing A r t and, so far as possible, had been trained to do so. IukuC

(5) That with a view to providing such training, in all Normal Colleges facilities should be given to all Students for taking a course of training in the subject based upon the Syllabus in use in the Schools, and those Students who have satisfied the Examiners in this subject should have their certificates endorsed to that effect.

If the Billreceives assent to the Third Reading it will requireconfirmation by Resolution of the next Provincial Synod • \ s in order to become operative.
