  • SUMMARY

    This enactment amends the Citizenship Act to, among other things, updateeligibility requirements for Canadian citizenship, strengthen security and fraudprovisions and amend provisions governing the processing of applications andthe review of decisions.

    Amendments to the eligibility requirements include

    (a) clarifying the meaning of being resident in Canada;

    (b) modifying the period during which a permanent resident must reside inCanada before they may apply for citizenship;

    (c) expediting access to citizenship for persons who are serving in, or haveserved in, the Canadian Armed Forces;

    (d) requiring that an applicant for citizenship demonstrate, in one ofCanadas official languages, knowledge of Canada and of the responsibilitiesand privileges of citizenship;

    (e) specifying the age as of which an applicant for citizenship mustdemonstrate the knowledge referred to in paragraph (d) and mustdemonstrate an adequate knowledge of one of Canadas official languages;

    (f) requiring that an applicant meet any applicable requirement under theIncome Tax Act to file a return of income;

    (g) conferring citizenship on certain individuals and their descendants whomay not have acquired citizenship under prior legislation;

    (h) extending an exception to the first-generation limit to citizenship bydescent to children born to or adopted abroad by parents who werethemselves born to or adopted abroad by Crown servants; and

    (i) requiring, for a grant of citizenship for an adopted person, that theadoption not have circumvented international adoption law.

    Amendments to the security and fraud provisions include

    (a) expanding the prohibition against granting citizenship to include personswho are charged outside Canada for an offence that, if committed in Canada,would constitute an indictable offence under an Act of Parliament or who areserving a sentence outside Canada for such an offence;

    (b) expanding the prohibition against granting citizenship to include personswho, while they were permanent residents, engaged in certain actionscontrary to the national interest of Canada, and permanently barring thosepersons from acquiring citizenship;

    (c) aligning the grounds related to security and organized criminality onwhich a person may be denied citizenship with those grounds in theImmigration and Refugee Protection Act and extending the period duringwhich a person is barred from acquiring citizenship on that basis;

    (d) expanding the prohibition against granting citizenship to include personswho, in the course of their application, misrepresent material facts andprohibiting new applications by those persons for a specified period;

    Le texte modifie la Loi sur la citoyennet pour notamment y mettre jour lesconditions dadmissibilit en vue dobtenir la citoyennet canadienne, renforcerles dispositions touchant la scurit et la fraude et modifier les dispositionsrgissant lexamen des demandes et la rvision des dcisions.

    Les modifications apportes aux conditions dadmissibilit visent notam-ment :

    a) clarifier le sens de rsidence au Canada;

    b) modifier la priode pendant laquelle un rsident permanent doit habiterau Canada avant de pouvoir prsenter une demande de citoyennet;

    c) offrir un accs acclr la citoyennet aux personnes qui servent ouqui ont servi dans les Forces armes canadiennes;

  • (e) increasing the period during which a person is barred from applying forcitizenship after having been convicted of certain offences;

    (f) increasing the maximum penalties for offences related to citizenship,including fraud and trafficking in documents of citizenship;

    (g) providing for the regulation of citizenship consultants;

    (h) establishing a hybrid model for revoking a persons citizenship in whichthe Minister will decide the majority of cases and the Federal Court willdecide the cases related to inadmissibility based on security grounds, ongrounds of violating human or international rights or on grounds oforganized criminality;

    (i) increasing the period during which a person is barred from applying forcitizenship after their citizenship has been revoked;

    (j) providing for the revocation of citizenship of dual citizens who, whilethey were Canadian citizens, engaged in certain actions contrary to thenational interest of Canada, and permanently barring these individuals fromreacquiring citizenship; and

    (k) authorizing regulations to be made respecting the disclosure ofinformation.

    Amendments to the provisions governing the processing of applications andthe review of decisions include

    (a) requiring that an application must be complete to be accepted forprocessing;

    (b) expanding the grounds and period for the suspension of applications andproviding for the circumstances in which applications may be treated asabandoned;

    (c) limiting the role of citizenship judges in the decision-making process,subject to the Minister periodically exercising his or her power to continuethe period of application of that limitation;

    (d) giving the Minister the power to make regulations concerning themaking and processing of applications;

    (e) providing for the judicial review of any matter under the Act andpermitting, in certain circumstances, further appeals to the Federal Court ofAppeal; and

    (f) transferring to the Minister the discretionary power to grant citizenship inspecial cases.

    Finally, the enactment makes consequential amendments to the FederalCourts Act and the Immigration and Refugee Protection Act.

    Les modifications apportes aux dispositions sur lexamen des demandes etla rvision des dcisions visent notamment :

    a) prvoir que toute demande doit tre complte afin dtre reue aux finsdexamen;

    b) largir les cas o lexamen dune demande peut tre suspendu et modifier la dure de la suspension, ainsi qu prvoir les cas o une demandepeut tre considre comme abandonne;

    c) restreindre le rle des juges de la citoyennet dans le processusdcisionnel sous rserve de lexercice priodique par le ministre de sonpouvoir de prolonger la priode dapplication de la restriction;

    d) accorder au ministre le pouvoir de prendre des rglements concernant laprsentation et lexamen des demandes;

    e) mettre en place un rgime de contrle judiciaire de toute questionrelevant de lapplication de la loi, et permettre, dans certainescirconstances, lappel la Cour dappel fdrale;

    f) transfrer au ministre le pouvoir discrtionnaire dattribuer lacitoyennet dans des cas particuliers.

    Enfin, le texte apporte des modifications corrlatives la Loi sur les Coursfdrales et la Loi sur limmigration et la protection des rfugis.

    Her Majesty, by and with the advice andconsent of the Senate and House of Commonsof Canada, enacts as follows:

    SHORT TITLE

    1. This Act may be cited as the Strengthen-ing Canadian Citizenship Act.

    CITIZENSHIP ACT

    2. (1) The portion of subparagraph3(1)(f)(ii) of the French version of the Citizen-ship Act before clause (A) is replaced by thefollowing:

    (n) the person, on April 1, 1949, was aBritish subject neither born nor naturalized inNewfoundland and Labrador and was ordi-narily resident there, and did not become acitizen on or before that day;

    (o) the person was born outside Canada andNewfoundland and Labrador before January1, 1947 to a parent who is a citizen underparagraph (k) or (m), and the person did notbecome a citizen on that day;

    (p) the person was born outside Canada andNewfoundland and Labrador before April 1,1949 to a parent who is a citizen underparagraph (l) or (n), and the person did notbecome a citizen on or before that day;

    (q) the person was born outside Canada andNewfoundland and Labrador before January1, 1947 to a parent who became a citizen onthat day under the Canadian Citizenship Act,S.C. 1946, c. 15, and the person did notbecome a citizen on that day; or

    (3) Section 3 of the Act is amended byadding the following after subsection (1):

    (1.01) For greater certainty, the reference toCanada in paragraphs (1)(k), (m) and (o) to (r)is a reference to Canada as it existed immedi-ately before the union of Newfoundland andLabrador with Canada.

    (4) Section 3 of the Act is amended byadding the following after subsection (1):

    (1.1) A person who would not become acitizen under paragraph (1)(b), (g) or (h) for thesole reason that, on the coming into force of thissubsection, his or her parent referred to inone of those paragraphs is deceased, is acitizen under paragraph (1)(b), (g) or (h) if thatparent, but for his or her death, would have beena citizen under paragraph (1)(f), (i) or (j).

    (5) Section 3 of the Act is amended by

    adding the following after subsection (1.1):

    (1.2) A person who would not become acitizen under paragraph (1)(b), (g), (h), (o) or (p)for the sole reason that, on the coming into forceof this subsection, his or her parent referredto in one of those paragraphs is deceased, is acitizen under that paragraph if that parent, butfor his or her death, would have been a citizenunder any of paragraphs (1)(k) to (n).

    (1.3) A person who would not become acitizen under paragraph (1)(q) for the solereason that his or her parent died before January1, 1947 and did not become a citizen on that dayunder the Canadian Citizenship Act, S.C. 1946,c. 15, is, nonetheless, a citizen under thatparagraph if his or her parent would have beena citizen if that Act had come into forceimmediately before their death and the datereferred to in the provisions of that Act that setout the requirements to be met to become acitizen had been the day of that coming intoforce rather than January 1, 1947.

    (1.4) A person who would not become acitizen under paragraph (1)(r) for the solereason that his or her parent died before April1, 1949 and did not become a citizen on that dayunder section 44A of the Canadian CitizenshipAct, S.C. 1946, c. 15, as enacted by S.C. 1949,c. 6, is, nonetheless, a citizen under thatparagraph if his or her parent would have beena citizen if that Act had come into forceimmediately before their death and the datereferred to in the provisions of that Act that set

    out the requirements to be met to become acitizen had been the day of that coming intoforce rather than April 1, 1949.

    (6) Section 3 of the Act is amended by

    adding the following after subsection (2):

    (2.1) Paragraphs (1)(k), (m), (o) and (q) donot apply to a person if

    (a) before January 1, 1947, the person madea declaration of alienage, had his or her statusas a British subject revoked or ceased to be aBritish subject as a consequence of therevocation of another persons status as aBritish subject; or

    (b) the person became a citizen by way ofgrant on or after January 1, 1947 andsubsequently

    (i) renounced his or her citizenship underany of the provisions set out in clauses(1)(f)(i)(A) to (F), or

    (ii) had his or her citizenship revoked forfalse representation, fraud or concealmentof material circumstances under any of theprovisions set out in clauses (1)(f)(ii)(A) to(G).

    (2.2) Paragraphs (1)(b), (g) and (h) do notapply to a personwho, but for this subsec-tion, would be a citizen under one of thoseparagraphs for the sole reason that one or bothof his or her parents are persons referred to inany of paragraphs (1)(k), (m), (o) and (q) ifthe person became a citizen by way of grant onor after January 1, 1947 and subsequently

    (a) renounced his or her citizenship underany of the provisions set out in clauses(1)(f)(i)(A) to (F); or

    (b) had his or her citizenship revoked forfalse representation, fraud or concealment ofmaterial circumstances under any of theprovisions set out in clauses (1)(f)(ii)(A) to(G).

    (ii) soit a vu sa citoyennet subsquem-ment rvoque pour cause de faussedclaration, fraude ou dissimulationde faits essentiels au titre de lunedes dispositions vises aux divisions(1)f)(ii)(A) (G).

    (b) the person became a citizen by way ofgrant on or after April 1, 1949 and subse-quently

    (i) renounced his or her citizenship underany of the provisions set out in clauses(1)(f)(i)(A) to (F), or

    (ii) had his or her citizenship revoked forfalse representation, fraud or concealmentof material circumstances under any of theprovisions set out in clauses (1)(f)(ii)(A) to(G).

    (2.4) Paragraphs (1)(b), (g) and (h) do notapply to a personwho, but for this subsec-tion, would be a citizen under one of thoseparagraphs for the sole reason that one or bothof his or her parents are persons referred to inany of paragraphs (1)(l), (n), (p) and (r) if theperson became a citizen by way of grant on orafter April 1, 1949 and subsequently

    (a) renounced his or her citizenship underany of the provisions set out in clauses(1)(f)(i)(A) to (F); or

    (b) had his or her citizenship revoked forfalse representation, fraud or concealment ofmaterial circumstances under any of theprovisions set out in clauses (1)(f)(ii)(A) to(G).

    (7) The portion of subsection 3(3) of the

    Act before paragraph (b) is replaced by thefollowing:

    (3) Paragraphs (1)(b) and (f) to (j) do notapply to a person born outside Canada

    (a) if, at the time of his or her birth, only oneof the persons parents was a citizen and thatparent was a citizen under paragraph (1)(b),

    (11) Section 3 of the Act is amended byadding the following after subsection (4):

    (4.1) Subsection (3) does not apply to aperson who, on the coming into force of thissubsection, was a citizen.     (5.1) A person who is born outside Canadato a parent referred to in paragraph (a) or (b) andwho is either a citizen under prior legislation orthe former Act other than under any provi-sion referred to in subparagraphs (3)(b)(i) to(viii) or was granted citizenship under para-graph 5(2)(a) of this Act, as it read before April17, 2009, or under subsection 5(1), (2) or (4) or

    11(1) of this Act is deemed, as of the cominginto force of this subsection, never to have beena citizen by way of grant:

    (a) a parent one or both of whose parents, atthe time of that parents birth, were employedoutside Canada in or with the CanadianArmed Forces, the federal public administra-tion or the public service of a province,otherwise than as a locally engaged person;or

    (b) a parent one or both of whose adoptiveparents, at the time of that parents adoption,were employed outside Canada in or with theCanadian Armed Forces, the federal publicadministration or the public service of aprovince, otherwise than as a locally engagedperson.

    (5.2) Subsection (5.1) does not apply to aperson born outside Canada after February 14,1977 who, before April 17, 2009, ceased to be acitizen because he or she failed to make anapplication to retain his or her citizenship undersection 8, as it read before April 17, 2009, ormade an application but the application was notapproved.

    (14) Section 3 of the Act is amended by

    adding the following after subsection (6):

    (6.1) A person who was born outside Canadaafter February 14, 1977 and who, before thecoming into force of this subsection, wasgranted citizenship under section 5 is deemednever to have been a citizen by way of grant if

    (a) he or she was born to a parent who wasborn in Canada and who is a citizen underparagraph (1)(f) or (i); or

    (b) he or she was born to a parent who wasborn outside Canada to parents neither ofwhom was a citizen at the time of thatparents birth, and who is a citizen underparagraph (1)(f) or (i).

    (15) Section 3 of the Act is amended by

    adding the following after subsection (6.1):

    (16) Subsection 3(7) of the Act is amended

    by striking out and at the end of para-graph (f), by adding and at the end ofparagraph (g) and by adding the followingafter paragraph (g):

    (h) a person referred to in paragraph (1)(b)who is a citizen under that paragraph for thesole reason that one or both of his or herparents are referred to in paragraph (1)(f) or(i) is deemed to be a citizen under paragraph(1)(b) from the time that he or she was born.

    (17) Subsection 3(7) of the Act is amended

    by striking out and at the end of para-graph (g) and by adding the following afterparagraph (h):

    (i) a person referred to in paragraph (1)(b)who is a citizen under that paragraph for thesole reason that one or both of his or herparents are referred to in any of paragraphs(1)(k) to (n) is deemed to be a citizen underparagraph (1)(b) from the time that he or shewas born;

    (j) a person referred to in paragraph (1)(k) or(m) is deemed to be a citizen under thatparagraph as of January 1, 1947;

    (k) a person referred to in paragraph (1)(o) or(q) is deemed to be a citizen under thatparagraph as of January 1, 1947;

    (l) a person referred to in paragraph (1)(l) or(n) is deemed to be a citizen under thatparagraph as of April 1, 1949; and

    3. (1) Paragraphs 5(1)(c) to (e) of the Act

    are replaced by the following:

    (c) is a permanent resident within the mean-ing of subsection 2(1) of the Immigration andRefugee Protection Act, has, subject to theregulations, no unfulfilled conditions underthat Act relating to his or her status as apermanent resident and has, since becoming apermanent resident,

    (i) been physically present in Canada forat least 1,460 days during the six yearsimmediately before the date of his or herapplication,

    (ii) been physically present in Canada forat least 183 days during each of fourcalendar years that are fully or partiallywithin the six years immediately before thedate of his or her application, and

    service of a province, otherwise than as a locallyengaged person, shall be treated as equivalent toone day of physical presence in Canada for thepurposes of paragraphs (1)(c) and 11(1)(d).

    (1.02) Any day during which an applicant forcitizenship was a permanent resident within themeaning of subsection 2(1) of the Immigrationand Refugee Protection Act and was employedoutside Canada in or with the Canadian ArmedForces, the federal public administration or thepublic service of a province, otherwise than as alocally engaged person, shall be treated asequivalent to one day of physical presence inCanada for the purposes of paragraphs (1)(c)and 11(1)(d).

    (1.03) Any day during which an applicant forcitizenship was the spouse or common-lawpartner, or child, of a permanent residentreferred to in subsection (1.02) and residedwith that permanent resident shall be treated asequivalent to one day of physical presence inCanada for the purposes of paragraphs (1)(c)and 11(1)(d).

    (1.1) For the purposes of paragraphs (1)(c.1)and 11(1)(d.1), the persons intention must becontinuous from the date of his or her applica-tion until they have taken the oath of citizen-ship.

    (3) Section 5 of the Act is amended by

    adding the following before subsection (2):

    (1.2) Paragraph (1)(c) does not apply to apermanent resident within the meaning ofsubsection 2(1) of the Immigration and RefugeeProtection Act who, within the period referredto in that paragraph, completed a number ofyears of service in the Canadian Armed Forcesthat is equal to the length of residence requiredunder that paragraph less one year. However,that paragraph does apply to the permanentresident if he or she was released other thanhonourably from the Canadian Armed Forces.

    (1.3) Paragraph (1)(c) does not apply to aperson who is or was attached or seconded tothe Canadian Armed Forces and who, within theperiod referred to in that paragraph, completed a

    (4) Subsections 5(1.2) and (1.3) of the Act

    are replaced by the following:

    (1.2) Paragraph (1)(c) does not apply to apermanent resident within the meaning ofsubsection 2(1) of the Immigration and RefugeeProtection Act who has, subject to the regula-tions, no unfulfilled conditions under that Actrelating to his or her status as a permanentresident and who

    (a) during the six years immediately beforethe date of his or her application, completedthree years of service in the Canadian ArmedForces; and

    (b) has met any applicable requirement underthe Income Tax Act to file a return of incomein respect of three taxation years that are fullyor partially within the six years immediatelybefore the date of his or her application.

    However, paragraph (1)(c) does apply to thepermanent resident if he or she was releasedother than honourably from the CanadianArmed Forces.

    (1.3) Paragraph (1)(c) does not apply to aperson who is or was attached or seconded tothe Canadian Armed Forces and who, within thesix years immediately before the date of his orher application, completed three years of servicewith the Canadian Armed Forces.

    (5) Subsection 5(2) of the Act is replacedby the following:

    (2) The Minister shall grant citizenship toany person who is a permanent resident withinthe meaning of subsection 2(1) of the Immigra-tion and Refugee Protection Act and is theminor child of a citizen, if

    (a) an application for citizenship is made tothe Minister by a person authorized byregulation to make the application on behalfof the minor child;

    (4) Despite any other provision of this Act,the Minister may, in his or her discretion, grantcitizenship to any person to alleviate cases ofspecial and unusual hardship or to rewardservices of an exceptional value to Canada.

    (8) Paragraph 5(5)(d) of the Act is re-placed by the following:

    (d) has been physically present in Canada forat least 1,095 days during the four yearsimmediately before the date of his or herapplication;

    (5) Subsection (4) does not apply to a personwho was

    (a) adopted by a parent who, at the time ofthe persons adoption, was employed outsideCanada in or with the Canadian ArmedForces, the federal public administration orthe public service of a province, otherwisethan as a locally engaged person;

    (b) adopted by a parent one or both of whoseparents, at the time of that parents birth, wereemployed outside Canada in or with theCanadian Armed Forces, the federal publicadministration or the public service of aprovince, otherwise than as a locally engagedperson; or

    (c) adopted by a parent one or both of whoseadoptive parents, at the time of that parentsadoption, were employed outside Canada inor with the Canadian Armed Forces, the

    (a.1) if the person was adopted beforeJanuary 1, 1947 and, on that day, only oneof the adoptive parents was a citizen and thatparent was a citizen under paragraph 3(1)(o)or (q), or both of the adoptive parents werecitizens under either of those paragraphs;

    (a.2) if the person was adopted before April1, 1949 and, on that day, only one of theadoptive parents was a citizen and that parentwas a citizen under paragraph 3(1)(p) or (r),or both of the adoptive parents were citizensunder either of those paragraphs; or

    (11) Section 5.1 of the Act is amended byadding the following after subsection (5):

    (6) Paragraphs 5.1(4)(a) and (a.1) do notapply to a person who is adopted before April 1,1949 if

    (a) only one adoptive parent was a citizen atthe time of the adoption, in the case ofparagraph (a), or was a citizen on January 1,1947, in the case of paragraph (a.1); and

    (b) the other adoptive parent became acitizen on April 1, 1949 further to the unionof Newfoundland and Labrador with Canada,other than under paragraph 3(1)(p) or (r).

    5. The Act is amended by adding the

    following after section 5.1:

    (11) Larticle 5.1 de la mme loi estmodifi par adjonction, aprs le paragraphe(5), de ce qui suit :

    5.2 A person born outside Canada who wasadopted by a parent referred to in paragraph (a)or (b) and who is either a citizen under priorlegislation or the former Act other than underany provision referred to in any of subpara-graphs 3(3)(b)(i) to (viii) or was grantedcitizenship under paragraph 5(2)(a) of thisAct, as it read before April 17, 2009, or undersubsection 5(1), (2), or (4) or 11(1) of this Act isdeemed, as of the coming into force of thissection, to have been granted citizenship undersection 5.1:

    (a) a parent one or both of whose parents, atthe time of that parents birth, were employedoutside Canada in or with the CanadianArmed Forces, the federal public administra-tion or the public service of a province,otherwise than as a locally engaged person;or

    (b) a parent one or both of whose adoptiveparents, at the time of that parents adoption,were employed outside Canada in or with theCanadian Armed Forces, the federal publicadministration or the public service of aprovince, otherwise than as a locally engagedperson.

    6. Section 7 of the Act is replaced by the

    following:

    7. A person who is a citizen shall not ceaseto be a citizen except in accordance with thisPart or regulations made under paragraph27(1)(j.1).

    7. (1) The portion of subsection 9(1) of theAct before paragraph (a) is replaced by thefollowing:

    9. (1) Subject to subsection (2.1), a citizenmay, on application, renounce his citizenship ifhe

    (2) Section 9 of the Act is amended byadding the following after subsection (2)

    (2.1) No application for renunciation may bemade if the Minister has provided the applicantwith a notice referred to in subsection 10(3) orhas commenced an action under subsection10.1(1) or (2) for a declaration in respect of the

    applicant until the Minister provides the appli-cant with his or her decision under subsection10(5) or a final judgment has been rendered inthat action, as the case may be.

    (2.2) If an application for renunciation ismade and the Minister subsequently providesthe applicant with a notice referred to insubsection 10(3) or commences an action undersubsection 10.1(1) or (2) for a declaration inrespect of the applicant, the processing of thatapplication is suspended until the Ministerprovides the applicant with his or her decisionunder subsection 10(5) or a final judgment hasbeen rendered in that action, as the case may be.

    (3) Subsection 9(3) of the Act is replaced

    by the following:

    (3) If an application under subsection (1) isapproved by the Minister, the Minister shallissue a certificate of renunciation to theapplicant and the applicant ceases to be acitizen after the expiration of the day on whichthe certificate is issued or any later day that thecertificate may specify.

    8. Section 10 of the Act is replaced by thefollowing:

    10. (1) Subject to subsection 10.1(1), theMinister may revoke a persons citizenship orrenunciation of citizenship if the Minister issatisfied on a balance of probabilities that theperson has obtained, retained, renounced orresumed his or her citizenship by false repre-sentation or fraud or by knowingly concealingmaterial circumstances.

    (2) The Minister may revoke a personscitizenship if the person, before or after thecoming into force of this subsection and whilethe person was a citizen,

    (a) was convicted under section 47 of theCriminal Code of treason and sentenced toimprisonment for life or was convicted ofhigh treason under that section;

(1) Sous rserve du paragraphe 10.1(1),le ministre peut rvoquer la citoyennet dunepersonne ou sa rpudiation lorsquil estconvaincu, selon la prpondrance des probabi-lits, que lacquisition, la conservation ou larpudiation de la citoyennet de la personne ousa rintgration dans celle-ci est intervenue parfraude ou au moyen dune fausse dclaration oude la dissimulation intentionnelle de faitsessentiels.

    (2) Le ministre peut rvoquer la citoyennetdune personne si celle-ci, avant ou aprslentre en vigueur du prsent paragraphe, etalors quelle tait un citoyen, selon le cas :

    a) a t condamne au titre de larticle 47 duCode criminel soit lemprisonnement perptuit pour une infraction de trahison soitpour haute trahison;

    (b) was convicted of a terrorism offence asdefined in section 2 of the Criminal Code or an offence outside Canada that, ifcommitted in Canada, would constitute aterrorism offence as defined in that section and sentenced to at least five years ofimprisonment;

    (c) was convicted of an offence under any ofsections 73 to 76 of the National Defence Actand sentenced to imprisonment for lifebecause the person acted traitorously;

    (d) was convicted of an offence undersection 78 of the National Defence Act andsentenced to imprisonment for life;

    (e) was convicted of an offence undersection 130 of the National Defence Act inrespect of an act or omission that is punish-able under section 47 of the Criminal Codeand sentenced to imprisonment for life;

    (f) was convicted under the National DefenceAct of a terrorism offence as defined insubsection 2(1) of that Act and sentenced toat least five years of imprisonment;

    (g) was convicted of an offence described insection 16 or 17 of the Security of Informa-tion Act and sentenced to imprisonment forlife; or

    (h) was convicted of an offence undersection 130 of the National Defence Act inrespect of an act or omission that is punish-able under section 16 or 17 of the Security ofInformation Act and sentenced to imprison-ment for life.

    (3) Before revoking a persons citizenship orrenunciation of citizenship, the Minister shallprovide the person with a written notice thatspecifies

    (a) the persons right to make writtenrepresentations;

    (b) the period within which the person maymake his or her representations and the formand manner in which they must be mad
