THE REGIONAL MUNICIPALITY OF NIAGARA
BY—LAW NO. 59-2012
A BY-LAW TO PROVIDE FOR THE ADOPTION OF AMENDMENT 1-2012 TO THE OFFICIAL PLAN
FOR THE NIAGARA PLANNING AREA TO IMPLEMENT THE NIAGARA ECONOMIC GATEWAY ZONE AND CENTRE
WHEREAS it is deemed expedient to further amend the Official Plan heretofore adopted by Regional Council for the Niagara Planning Area,
THEREFORE the Council of the Regional Municipality of Niagara enacts as follows:
1. That the text and maps attached hereto and so designated are hereby approved as Amendment 1-2012 to the Official Plan for the Niagara Planning Area.
2. That the Regional Clerk is hereby authorized and directed to give notice of Council’s adoption in accordance with Section 17(23) of the Planning Act.
3. That this By-law shall come into force and take effect on the day upon which it is passed.

PART “A” – THE PREAMBLE
TITLE AND COMPONENTS: This document, when approved in accordance with Section 17 of the Planning Act, 1990, shall be known as Amendment 1-2012 to the Official Plan of the Niagara Planning Area. Part “A” – The Preamble, contains background information and does not constitute part of this Amendment. Part “B” – The Amendment, consisting of map and text changes, constitutes Amendment 1-2012 to the Official Plan of the Niagara Planning Area. Part “C” – The Appendices, does not constitute part of the Amendment. These Appendices contain information related to public involvement and agency comments associated with the Amendment. PURPOSE OF THE AMENDMENT: a) The purpose of this Amendment is to implement the recommendations of the Niagara Gateway
Employment Lands Study and the Growth Plan for the Greater Golden Horseshoe (“Places to Grow”).
b) The Amendment has been prepared to conform to the applicable policies of the Provincial Policy Statement, the Provincial Growth Plan for the Greater Golden Horseshoe and the Greenbelt Plan. Specifically, this Amendment is intended to support policy 184.108.40.206 of the Growth Plan.
LOCATION OF THE AMENDMENT: This amendment applies to the entire Niagara Planning Area. BACKGROUND: On May 28th, 2009 the Regional Municipality of Niagara (the Region) adopted Amendment 2-2009 which contained policies intended to implement the Region’s growth management strategy, Niagara 2031. Amendment 2-2009 also included a number of policies which were intended to bring the Regional Policy Plan into conformity with the Provincial Growth Plan, Places to Grow. Of particular relevance was the inclusion of a number of policies which advance the Growth Plan’s Economic Gateway Zone and Centre designations. Amendment 2-2009’s Economic Gateway policies provide a framework for advancing a variety of local and Regional initiatives related to the Gateway Zone and Centre. Since the adoption of Amendment 2-2009, the Region has undertaken two projects which are intended to support the development of the Economic Gateway Zone and Centre, which are:
a) Niagara Gateway Employment Lands Study (June
b) Niagara Gateway Zone and Centre Community
Improvement Plan (August 2011).
The Niagara Gateway Employment Lands Study is the principal technical support document for this Amendment. A separate undertaking is being prepared to address the

Community Improvement Plan. In addition to the above, the Region is nearing the completion of its Master Servicing Study, which provides a ten-year program for Regional infrastructure investment across Niagara. The Binational Economic and Tourism Alliance recently completed a Border Study which addresses issues surrounding cross-border trade and traffic. Lastly, a number of the local municipalities are in the process of updating their Official Plans. The above projects, studies and plans taken together provide direction for the planning and development of Niagara Economic Gateway Zone and Centre. BASIS FOR THE AMENDMENT: 1. This Amendment provides strategic direction for the development of employment lands within
the Gateway Economic Zone and Centre. The amendment establishes a strategic land use focus for each employment area and an implementation strategy to support development of the lands.
2. The changes in this Amendment are consistent with and implement the Growth Plan for the
Greater Golden Horseshoe (Places to Grow (2006)), the Provincial Policy Statement (2005) and Niagara’s Growth Management Strategy (Niagara 2031) – Amendment 2-2009 to the Official Plan for the Niagara Planning Area. The changes proposed are also in conformity with the Niagara Escarpment Plan (2011) (NEP).
3. The Amendment will create a new sub-section for the Economic Gateway Zone and Centre
within the Regional Policy Plan (RPP). The Amendment will also include new policies in order to support economic development in the Gateway in the Regional Policy Plan.
4. The text of the Amendment is divided into sections, which constitute the Amendment:
a) Part I: Addition of Section 4.D – Gateway Economic Zone and Centre b) Part II: Addition of Section 4.E – Rural Employment Lands c) Part III: Revised Wording for Policy 12.72 d) Part IV: Addition of new definitions
5. The Amendment was the subject of a Public Meeting held under the Planning Act on April 25,
2012. Public and agency comments were addressed as part of the preparation of this Amendment.
6. Based on the Region’s review of the Growth Plan for the Greater Golden Horseshoe, the Provincial Policy Statement, Amendment 2-2009 to the Official Plan for the Niagara Planning Area, public consultation, and agency consultation, Regional staff is of the opinion that the Amendment is consistent with and conforms to Provincial and Regional policies and plans and, therefore, represents good planning.
7. The notes in the sidebar of this Amendment do not constitute a part of the Amendment. The
notes in the sidebar are provided for explanatory purposes only.

Section 12, Implementation of the Official Plan for the Niagara Planning Area, shall apply where applicable.
A BRIEF NOTE ON TERMINOLOGY The document makes reference to the Economic Gateway Zone, the Economic Gateway Centre and the Niagara Economic Gateway. The Niagara Economic Gateway encompasses both the Economic Gateway Zone and Centre. The Economic Gateway Zone and Centre stems from language used in the Provincial Growth Plan and refers to two distinct areas in south Niagara. The Zone refers to certain lands in Fort Erie and Niagara Falls and the Centre refers to certain lands in Thorold, Welland and Port Colborne.

PART “B” – THE AMENDMENT
Amendment 1-2012 To the Official Plan for the
Niagara Planning Area Map Changes: Schedules 1 and 2 of Amendment 1-2012 are added to the Official Plan for the Niagara Planning Area as “Gateway Economic Zone and Centre”. The Urban Area Boundaries Map of the Regional Policy Plan is amended by lifting the “Deferred Urban Area” designation as shown on Schedule “3” and changing the land use designation to “Rural Employment Special Gateway Policy Area”. Appendix I is added to the Regional Policy Plan for information and does not form part of this Plan. Appendix I can be modified without amendment to the Plan. Text Changes: The Official Plan for the Niagara Planning Area is amended by adding the following sections:
Part I Section 4.D: Economic Gateway Zone and Centre Introduction
The Niagara Economic Gateway comprises: a) The Gateway Economic Zone which includes all Settlement Areas within Niagara Falls and
b) The Gateway Economic Centre which includes all Settlement Areas within Thorold, Welland
and Port Colborne;
c) Existing port infrastructure, particularly in the Cities of Port Colborne, Welland and
d) The five border crossings to the US including the Queenston-Lewiston Bridge, the Whirlpool
Bridge, the Rainbow Bridge, the Peace Bridge and the rail crossing between Fort Erie and
